Acting Leisure Services Manager Pat Prevenas recommends City Council approval of
revisions to the Port of Dubuque usage policies effective May 3, 2010, to only allow
private rentals at the Alliant Energy Amphitheater that desire beer, wine or liquor to do
so with a licensed beer /liquor permit holder with catering privileges. In addition, the
renting party must provide the Leisure Services Department the name of the licensed
holder to be verified with the City Clerk's office 60 days prior to the rental date.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The purpose of this memorandum is to request City Council approval of revisions to the
Port of Dubuque usage policies.
The Port of Dubuque facilities including the Alliant Energy Amphitheater, American
Trust River's Edge Plaza and Mississippi Riverwalk are reserved by the Leisure
Services Department and maintained by the Public Works Department. Both public and
private uses of the Amphitheater and River's Edge Plaza are allowed and public usage
of the Riverwalk is permitted.
In December 2009 the usage policies were revised and approved by city council to
allow private reservations to be made up to twenty -three months in advance and the
reservations were treated similar to a park pavilion rental. Since that time staff has
realized that a private rental of the Amphitheater, which allows for beer and alcohol to
be distributed to invited guests, could result in the private party obtaining its own beer or
liquor license, dram shop insurance and liability insurance. The December revisions
also allowed private rentals of the Amphitheater without using the Special Event Permit
process via the City Clerk's office.
The following committee met to discuss the potential problems of a private
Amphitheater rental obtaining its own beer or liquor permit, dram shop and liability
insurance:

The main concern with this type of private rental is what department monitors that all the
necessary permits and insurance requirements are in place prior to the rental date.
The committee recommends the polices be revised to only allow private rentals at the
Amphitheater that desire beer, wine or liquor to do so with a licensed beer /liquor permit
holder with catering privileges. In addition the renting party must provide the Leisure
Services Department the name of the licensed holder to be verified with the City Clerk's
office sixty days prior to the rental date. It is also recommended that any future
revisions to these policies only require city manager approval.
ACTION REQUESTED
It is requested that the City Council approve these revisions to the Port of Dubuque
usage policies effective May 3, 2010.

events. Reservations will be held for one hour after scheduled rental.

10:00 p.m., Sunday through Thursday and 7:00 a.m. to 11:00 p.m. Friday, Saturday and
holidays.
• RESERVATION HOURS for Amphitheater are 7:00 a.m. to 10:00 p.m., Sunday
through Thursday and 7:00 a.m. to 2:00 a.m. Friday, Saturday and holidays. Music must stop

• RENTAL FEE for River's Edge Plaza: Pavilion is $75.00 for maximum four -hour period;
available for public or private events.* The pavilion may be rented by only one user group per

• RENTAL FEE for Riverwalk and Amphitheater: $200.00 per day. Riverwalk is available for
public events only, one user group per day; Amphitheater is available for public or private
events; one user group per day.
• PAYMENT must be received at the time the reservation is made.
• REFUNDS are given only with approval of the Public Works Director.
• ELECTRICITY is available.
• SPECIAL EVENT PERMIT is required for all public events at River's Edge Plaza, and
Riverwalk and Amphitheater; they are issued through the City Clerk's office in City Hall.
