3 23 20 City Council Proceedings Official_Special1 CITY OF DUBUQUE, IOWA CITY COUNCIL PROCEEDINGS SPECIAL SESSION OFFICIAL The Dubuque City Council met in special session at 6:00 p.m. on March 23, 2020 in the second-floor Council Chambers of the Historic Federal Building, 350 W. 6 th Street. Due to the COVID-10 pandemic, this meeting was also conducted virtually. Present via teleconference: Mayor Buol; Council Members Cavanagh, Jones, Resnick, Roussell, Shaw, Sprank; City Manager Van Milligen (joined at 6:06 p.m.), City Attorney Brumwell Mayor Buol read the call and stated this is a special session of the City Council called for the purpose of conducting such business that may properly come before the City Council and for reviewing certain Fiscal Year 2021 departmental budget. PRESENTATION(S) 1. Mayor Roy D. Buol's Updated COVID-19 Emergency Declaration Proclamation: Mayor Roy D. Buol's Emergency COVID-19 Declaration Proclamation Updated March 17, 2020. Mayor Buol provided an updated statement based on his news release from earlier in the day recommending residents stay home for at least 14 days in an effort to slow the spread of the corona virus (COVID-19). 2. COVID-19 Update: City staff will provide an update on COVID-19 pandemic situation and response activities. Public Health Specialist Mary Rose Corrigan provided updated information on the corona virus related to the City of Dubuque and Iowa generally. Ms. Corrigan demonstrated an interactive map from the Iowa Department of Public Health (IDHP) that provides updates, resources and guidelines intended inform citizens and slow the spread. Other topics included when residents should seek testing or not; the availa- bility of personal protective equipment for health care professionals; and what information to expect to provided healthcare professionals when being screened for testing. Ms. Cor- rigan responded to questions from the City Council. ITEMS SET FOR PUBLIC HEARING 1. Walter Development, LLC / Duluth Holdings, Inc. - Amended & Restated Develop- ment Agreement – April 6, 2020. This item was removed from the agenda at the request of staff and the developer. PUBLIC HEARINGS 1. Public Housing Authority Five -Year Plan: Proof of publication on notice of public hearing to consider approval of the proposed Public Housing Authority 5 -Year Plan (2020- 2 2024), and the City Manager recommending approval. Restated motion by Shaw to re- ceive and file the documents and adopt Resolution Option A (with Source of Income pro- vision) Approving the Public Housing Authority 5-Year Plan (2020-2024); Authorizing the Mayor to execute said Plan and all necessary certifications; designating the Housing & Community Development Director as the Authorized Chief Executive Officer for the Plan; and directing said Plan be submitted to the U.S. Department of Housing and Urban De- velopment. Motion failed for lack of a second. Via telephone, City Manager Van Milligen and Housing and Community Development Director Alexis Steger responded to questions from the City Council regarding the need for additional data collection and tracking as well as the State Legislature’s likely efforts to pre-empt cities from passing a source of income ordinance. Motion by Jones to receive and file the documents and adopt Resolution No. 94 -20 (without Source of Income provision) Approving the Public Housing Authority 5-Year Plan (2020-2024); Authorizing the Mayor to execute said Plan and all necessary certifications; designating the Housing & Community Development Director as the Authorized Chief Ex- ecutive Officer for the Plan; and directing said Plan be submitted to the U.S. Department of Housing and Urban Development. Seconded by Resnick. Motion carried 6-1 with Shaw voting nay. RESOLUTION NO. 94-20 APPROVING THE PUBLIC HOUSING AUTHORITY 5-YEAR PLAN (2020-2024); AU- THORIZING THE MAYOR TO EXECUTE SAID PLAN AND ALL NECESSARY CERTI- FICATIONS; DESIGNATING THE HOUSING & COMMUNITY DEVELOPMENT DIREC- TOR AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE PLAN; AND DI- RECTING SAID PLAN BE SUBMITTED TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT Whereas, the City of Dubuque has prepared a proposed Public Housing Authority 5- Year Plan (2020-2024), including an Analysis of Impediments to Fair Housing; and Whereas, the City of Dubuque must adopt a Public Housing Authority 5 -Year Plan for submission to the U.S. Department of Housing and Urban Development on or before April 15th, 2020; and Whereas, through a series of public meetings and hearing, finalized a Public Housing Authority 5-Year Plan (2020-2024) addressing both rental assistance housing and non - housing needs in the community; and Whereas, copies of the draft FY 2020-2024 Plan have been available for public com- ment 30 days prior to City Council action; and Whereas, the Housing Commission has held a public hearing on the PHA 5 -year Plan on February 25, 2020 and received no comment on the plan; and Whereas, the Housing Commission has reviewed the Public Housing Authority (PHA) 5-Year Plan, its consistency with the goals in the City of Dubuque Consolidated Plan and the Analysis of Impediments to Fair Housing, and recommends adoption of the plan with additional language that includes a goal to adopt a source of income ordinance; and Whereas, the City Council has held a public hearing on the PHA 5-year Plan on March 23, 2020. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: 3 Section 1. The City of Dubuque Public Housing Authority 5-Year Plan (2020-2024) is hereby approved and adopted without the Housing Commission recommended goal of passing a source of income ordinance. Section 2. The City Council authorizes the Mayor to sign the document on behalf of the City of Dubuque, Iowa; directs the Mayor to provide all the necessary certifications required by the U.S. Department of Housing and Urban Development; designates the Housing & Community Development Director as the authorized Chief Executive Officer for said Plan; and further directs the Housing & Community Development Director to sub- mit said Consolidated Plan to the U.S. Department of Housing and Urban Development . Building Services Department FY21 Budget Presentation: Cori Burbach, Acting Building Services Manager There was no public input received through the City Clerk and Budget live email ac- counts nor from the City’s FacebookLive account being monitored by staff throughout all of the budget reviews. The presenters responded to questions from the City Council following their respective presentations. Following the Police Department presentation, Council Member Shaw requested Council consensus for reconsideration of the department’s request for an additional School Resource Officer. A majority of the Council did not concur. Following the Fire Department presentation, Council Member Shaw requested Council consensus for reconsideration of the department’s request for an additional firefighter po- sition. A majority of the Council did not concur. Following the Building Services Department presentation, Council Member Shaw re- quested Council consensus for reconsideration of the department’s request for an addi- tional custodian position. A majority of the Council did not concur. ACTION ITEMS 1. Fiscal Year 2020 Community Development Block Grant (CDBG) Annual Action Plan Amendment 1: City Manager recommending adoption of Amendment 1 to the Community Development Block Grant Annual Action Plan. Motion by Cavanagh to receive and file the documents and adopt Resolution No. 95-20 Adopting Amendment 1 to the Fiscal Year 4 2020 (Program Year 2019) Community Development Block Grant (CDBG) Annual Action Plan. Seconded by Jones. Motion carried 7-0. RESOLUTION NO. 95-20 ADOPTING AMENDMENT 1 TO THE FISCAL YEAR 2020 (PROGRAM YEAR 2019) COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) ANNUAL ACTION PLAN Whereas, the City of Dubuque prepared an Annual Action Plan for Fiscal Year 2020; and Whereas, the City now desires to amend said Annual Plan by reallocating funds be- tween existing activities and providing funds for new activities; and Whereas, said amendment is a substantial amendment as provided in the City’s Citi- zen Participation Plan and therefore must be approved by resolution of the City after a public hearing by the Community Development Advisory Commission; and Whereas, the City made available for public comment said Annual Action Plan on Feb- ruary 19, 2020 at a public meeting of the Community Development Advisory Commission; and Whereas, the Community Development Advisory Commission reviewed said amend- ment during a public hearing on March 18, 2020 and voted to approve said amendment and recommend approval by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The Community Development Block Grant Fiscal Year 2020 (Program Year 2019) Annual Action Plan Amendment 1, attached hereto as Exhibit A is hereby ap- proved. Section 2. The Community Development Block Grant Fiscal Year 2020 (Program Year 2019) Annual Action Plan, as Amended, shall be included in the Five-Year Consolidated Plan for the use of Community Development Block Grant Funds for Fiscal Year 2016 - 2020. Rescheduling the March 25 Departmental Budget Reviews and the March 26, 2020 Public Hearing for the Fiscal Year 2021 Recommended Budget : City Manager recom- mending rescheduling of the Fiscal Year 2021 departmental budget reviews of March 25, 2020 to April 16, 2020; and the March 26, 2020 public hearing adopting the Fiscal Year 2021 Recommended Budget to April 23, 2020. Motion by Jones to receive and filed the documents and adopt Resolution No. 96-20 Re-setting the date for the public hearing on the Fiscal Year 2021 Budget as amended for the City of Dubuque; and Resolution No. 97-20 Re-setting the date for the public hearing on the Five-Year Capital Improvement Program for Fiscal Years 2021 through 2024 for the City of Dubuque . Seconded by Cavanagh. Motion carried 7-0. RESOLUTION NO. 96-20 RE-SETTING THE DATE FOR THE PUBLIC HEARING ON THE FISCAL YEAR 2021 BUDGET AS AMENDED FOR THE CITY OF DUBUQUE 5 Whereas, Iowa Code Section 384.16 provides that the City Council shall set a time and place for a public hearing on the Fiscal Year 2021 budget before the final budget certifi- cation date and shall publish notice before the hearing as provided in Iowa Code Section 362.3; and Whereas, Resolution No. 77-20 adopted by the City Council on March 2, 2020 set the date for the public hearing as March 26, 2020; and Whereas, the State of Iowa has extended the date for certifying municipal budgets to April 30, 2020 as a result of the COVID-19 pandemic. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. Resolution No. 77-20 is hereby rescinded. Section 2, The City Council shall conduct a public hearing on the proposed Fiscal Year 2021 budget as amended for the City of Dubuque in the City Council Chambers at the Historic Federal Building, 350 West 6th Street, Dubuque, Iowa, on Thursday, April 23, 2020, beginning at 6:30 p.m. Section 3. The City Clerk be and is hereby authorized and directed to publish notice of the public hearing, according to law, together with the required budget information. Firnstahl, City Clerk RESOLUTION NO. 97-20 RE-SETTING THE DATE FOR THE PUBLIC HEARING ON THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM FOR FISCAL YEARS 2021 THROUGH 2025 FOR THE CITY OF DUBUQUE Whereas, a proposed Five-Year Capital Improvement Program for the City of Dubuque for Fiscal Years 2021 through 2025 has been prepared and submitted to the City Council; and Whereas, the capital projects for the first year of the program are includ ed in the Fiscal Year 2021 budget for the City of Dubuque; and Whereas, it is deemed to be in the best interest of the City of Dubuque to conduct a public hearing and adopt the five-year Capital Improvement Program simultaneously with the public hearing and adoption of the Fiscal Year 2021 budget for the City of Dubuque; and Whereas, Resolution No. 78-20 adopted by the City Council on March 2, 2020 set the date for the public hearing as March 26, 2020; and Whereas, the State of Iowa has extended the date fo r certifying municipal budgets to April 30, 2020 as a result of the COVID-19 pandemic. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. Resolution No. 78-20 is hereby rescinded. Section 2. The City Council shall conduct a public hearing on the five-year Capital Improvement Program for Fiscal Years 2021 through 2025 in the City Council Chambers at the Historic Federal Building, 350 West 6th Street, Dubuque, Iowa, on Thursday, April 23, 2020, beginning at 6:30 p.m. 6 Section 3. Request for Work Session on COVID-19 Update: City Manager recommending that the City Council schedule a work session for Wednesday, March 25, 2020, beginning at 6:30 p.m. in the Council Chambers to provide an upda te on Coronavirus, City services, City operations and community impact. Motion by Cavanagh to receive and file the doc- uments and set the work session as recommended. Seconded by Jones. No conflicts where expressed. The City Clerk confirmed that the work session would take place virtu- ally as with this evening’s meeting. Motion carried 7-0.
