Van Milligen, City Manager SUBJECT: Fountain of Youth STEP UP Contract DATE: August 31, 2020 In September 2019, CDBG Microenterprise funds were approved for use to assist low- income individuals create a business. The Economic Development Department began partnering with Fountain of Youth to administer such a program with its participants who had met certain milestones in achieving their personal development goals. This program has come to be known as the STEP-UP program — Success Through Entrepreneurship & Unified Partnerships. The program provides a stipend up to $3,500 for training and startup costs for the creation of a business. The stipends are provided from CDBG microenterprise funds. In order to formalize the relationship between Fountain of Youth and the City, and to set forth some of the procedures of the program, Economic Development Director Jill Connors recommends City Council approval of an agreement with the Fountain of Youth Program. No additional funds are required at this time to fulfill the City's requirements under the agreement, as CDBG funds have already been allocated for the program. Connors, Economic Development Director SUBJECT: Fountain of Youth — STEP UP contract DATE: August 27, 2020 INTRODUCTION This memorandum provides information on an agreement drafted to formalize the work being performed by Fountain of Youth of the STEP UP program. BACKGROUND In September 2019, CDBG Microenterprise funds were approved for use to assist low- income individuals create a business. Our office began partnering with Fountain of Youth to administer such a program with its participants who had met certain milestones in achieving their personal development goals. This program has come to be known as the STEP UP program — Success Through Entrepreneurship & Unified Partnerships. DISCUSSION Fountain of Youth has worked to administer this program with several individuals. One individual has completed the program and started a small business. Another has completed initial instruction on business creation and has not yet begun to incur further business creation expenses. A third individual completed the initial instruction courses and decided not to proceed with creating a business at this time. Several other individuals have recently expressed interest in the program, as well. The program provides a stipend up to $3,500 for training and startup costs for the creation of a business. The stipends are provided from CDBG microenterprise funds. In order to formalize the relationship between Fountain of Youth and the City, and to set forth some of the procedures of the program, the attached agreement has been drafted. No additional funds are required at this time to fulfill the City's requirements under the agreement, as CDBG funds have already been allocated for the program. RECOMMENDATION/ ACTION STEP I respectfully request your signature on the attached agreement in order to formalize the City's relationship with Fountain of Youth for the administration of the STEP UP program. 2 AGREEMENT BETWEEN THE CITY OF DUBUQUE, IOWA AND THE FOUNTAIN OF YOUTH PROGRAM THIS AGREEMENT, dated for reference purposes the ,firl day of ge. 2020, by and between the City of Dubuque, Iowa (City) and The Fountain of outh Program, an Iowa non-profit corporation (Agency). Whereas, the City Council of the City of Dubuque has previously identified as a goal "Robust Local Economy: Diverse Businesses and Jobs with Economic Prosperity;" and Whereas, on September 18, 2019, the City of Dubuque Community Development Advisory Commission approved a program, as amended on December 18, 2019, using Community Development Block Grant microenterprise funds for business creation by low- income individuals, known as the STEP-UP Program (STEP-UP); and Whereas, City staff have determined it is necessary to partner with an organization for the administration of STEP-UP; and Whereas, Agency serves low-income individuals with their personal development and financial goals; and Whereas, City staff have identified Agency as an appropriate organization to facilitate the administration of STEP-UP. NOW THEREFORE, the parties hereto agree as follows: SECTION 1 SCOPE OF SERVICE fa v! v6a11Y1VLr• 1.1 Agency shall make its Partners in Change program and services available to City of Dubuque residents interested in STEP-UP (the Candidates). 1.2 Agency shall work with Candidates for at least 6 months, providing 1-on-1 support, mentoring, and advocacy to help Candidates learn new personal development skills and tailor goals to align with the creation of a business. 1.3 After the 6-month participation in the Partners in Change program, City shall disburse CDBG microenterprise funds (the Fund) to Agency upon receipt of an invoice in an amount not to exceed $3,500 per Candidate. 1.4 Agency shall administer the Fund by paying invoices for eligible expenses of a Candidate's business creation. 082520ba1 1.5 Agency shall keep records of all Candidate applications and eligible expenses paid from the Fund. 1.6 Agency shall provide all records of receipt of and payment from the Funds and deliver to City once the Fund has been fully expended, or and/or upon written request from City. 1.7 Agency shall return to City the unused balance of the Fund by each Candidate on or before June 30, 2021. SECTION 2. CITY RESPONSIBILITIES. City designates the Economic Development Director to act as its representative with respect to the services to be performed under this Agreement, and such person shall have authority to transmit instructions, receive information, interpret and define City's policies and provide decisions in a timely manner pertinent to the services covered by this Agreement until Agency has been advised in writing by City that such authority has been revoked. SECTION 3. TIME OF PERFORMANCE. This Agreement shall take effect upon execution by both parties (the Effective Date). The term of this Agreement shall be from the Effective Date through June 30, 2021. SECTION 4. AUDIT AND EVALUATION. Inasmuch as the funds to be provided to Agency by City are public funds, Agency agrees that it will maintain books of account in accordance with Generally Accepted Accounting Standards together with necessary documentation to support all expenditures. The records of Agency, including payroll accounts and other records of disbursements and receipts, and other records relating to the performance of the activities herein specified, shall be made available for inspection by City or any Certified Public Accountant acting on its behalf, in order to ascertain performance of Agency under this Agreement. Agency agrees to retain such records for not Tess than three (3) years. SECTION 5. REPORTING AND MONITORING. 5.1 Agency shall render to the Economic Development Director a quarterly report detailing its activities related to the use of City funds provided to Agency. Such report shall include a performance report on the program(s) supported by City funds and a financial report on the use of City funds, which shall be rendered no later than the fifteenth (15th) day of the 4th, 7th, 10th, 13th month from the effective date of Agreement. A written annual equity report shall be submitted within sixty (60) days of Agreement end. The performance report shall include services relevant to the objective, output, and outcome that furthers identified City Council goals. 5.2 If Agency has an annual audit performed, Agency shall provide City a copy of the annual audit report within ninety (90) days of Agency's fiscal year-end. SECTION 6. DISCRIMINATION. 2 6.1 In carrying the services under this Agreement, Agency shall not discriminate against any employee or applicant for employment because of race, creed, color, sex, age, national origin, religion, sexual orientation, gender identity, or disability. Agency shall take affirmative action to ensure that applicants for employment are employed and that employees are treated during employment without regard to race, creed, color, sex, age, national origin, religion, sexual orientation, gender identity, or disability. Such action shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. Agency assures that all qualified applicants will receive consideration for employment without regard to race, creed, color, sex, age, national origin, religion, sexual orientation, gender identity, or disability. 6.2 Agency agrees and will undertake whatever affirmative measures are necessary so that no person shall be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activities funded in whole or in part with any of the funds made available to Agency under the terms of this Agreement because of race, color, creed, religion, sex, national origin, age, sexual orientation, gender identity or disability. SECTION 7. TERMINATION OF AGREEMENT. 7.1 If, through any cause, Agency shall fail to fulfill in a timely and proper manner its obligations under this Agreement, or if the Agency shall violate any of the covenants, agreements or stipulations of this Agreement, City shall thereupon have the right to terminate this Agreement by giving written notice to Agency of such and specifying the effective date thereof not Tess than thirty days before the effective date of such termination. If Agency shall fail to cure its default to the satisfaction of City in City's sole discretion within such thirty -day period, this Agreement shall be deemed terminated at the end of such thirty day without further of ------ thirty -day period action either party. 7.2 Upon termination of this Agreement, Agency shall return to City all unexpended funds and/or any funds utilized for purposes other than stated in the Agreement. SECTION 8. ASSIGNABILITY. Agency shall not assign any interest in this Agreement without the prior written approval from City. SECTION 9. INSURANCE. At the time of execution of this Agreement by Agency, Agency shall provide the City copies of Agency's insurance certificates showing general liability, automobile liability, and workers compensation insurance coverage to the satisfaction of City for the term of this Agreement. 3 CITY OF DUBUQUE, IOWA By Attest: Kev* S.
