Van Milligen, City Manager SUBJECT: Dubuque County Limited Winter Maintenance Agreement DATE: September 21, 2020 Public Works Director John Klostermann recommends City Council approval of the Limited Winter Maintenance Agreement with Dubuque County to improve winter maintenance service levels on country roads which provide access to the John Deere Dubuque Plant. In order to meet these needs, the Public Works Department will provide winter maintenance service between the hours of 7:00 pm and 4:00 am on several county roads which provide access to the John Deere Dubuque plant. Van Milligen, City Manager FROM: John Klostermann, Public Works Director SUBJECT: Dubuque County Limited Winter Maintenance Agreement DATE: September 21, 2020 INTRODUCTION The purposes of this memorandum are to provide information and recommend City Council approval of the attached limited winter maintenance agreement with Dubuque County. BACKGROUND The Dubuque County Supervisors wish to improve winter maintenance service levels on county roads which provide access to the John Deere Dubuque plant. Due to limited county resources during the over night hours the City was contacted to provide this service. DISCUSSION The Dubuque County Supervisors wish to improve winter maintenance service levels on several County roads serving the John Deere Dubuque plant. They are John Deere Road South — HWY 3 to Rose Spur, John Deere Road West— John Deere Road South to HWY 3, and Peru Road — Riverside to John Deere Road. In order to meet these needs the Public Works Department and the Dubuque County Secondary Roads Department developed a winter roadway agreement in which the Public Works Department would provide winter maintenance service on sections of county roads listed between the hours of 7:00 pm and 4:00 am during winter events and City plows are dispatched. In consideration, the County will pay $11,000 annually for this service. ACTION STEP I am requesting that you approve the attached winter maintenance agreement with Dubuque County and request approval from the City Council. CC: Crenna Brumwell, City Attorney Arielle Swift, Assistant Public Works Director WINTER ROADWAY MAINTENANCE AGREEMENT BETWEEN DUBUQUE COUNTY, IOWA AND THE CITY OF DUBUQUE, IOWA This Agreement, dated for reference purposes the6d ay of( 4r-2020, is made and entered into by and between Dubuque County, Iowa (County) and the City of Dubuque, Iowa (City), to define the duties and responsibilities of County and City for winter maintenance on roadways of County roads. SECTION 1. City agrees to perform winter maintenance operations on the following roadways between the hours of 7:00 p.m. and 4:00 a.m. only, Sunday through Saturday during winter events when City plows are dispatched: a) John Deere Road South — Hwy 3 to Rose Spur; b) John Deere Road West — John Deere Road South to Hwy 3; and, c) Peru Road — Riverside Drive to John Deere Road. SECTION 2. Winter maintenance shall be defined as the clearance of snow and ice from the roadway and the placement of salt or other deicers as needed upon the roadway. SECTION 3. Nothing in this Agreement shall be construed to transfer any liability from one jurisdiction to the other, except as herein specified. SECTION 4. This Agreement shall take effect upon approval by both parties and shall continue until terminated as provided herein. SECTION 5. This Agreement may be terminated at any time by either party upon thirty (3n1 days written notice delivered to the other party. SECTION 6. The Dubuque County Engineer and the City of Dubuque Public Works Director shall administer this Agreement. In doing so, the Dubuque County Engineer shall consult with the County Board of Supervisors and the Dubuque Public Works Director shall consult with the Dubuque City Manager on matters related to this Agreement. No real or personal property shall be acquired by either party under the provisions of this Agreement. SECTION 7. City shall defend, indemnify and hold harmless County, its officers, agents and employees, from any and all causes of action, suits at law or in equity, losses, damages, claims or demands, and from any and all liability and expense of whatsoever nature, arising out of or in connection with City's performance or failure to perform its winter maintenance duties on such roadways pursuant to this Agreement. 080420ba1 County shall defend, indemnify and hold harmless City, its officers, agents and employees, from any and all causes of action, suits at law or in equity, losses, damages, claims or demands, and from any and all liability and expense of whatsoever nature, arising out of or in connection with County's negligence in its duties on such roadways. SECTION 8. In consideration for City providing snow and ice control service as provided in this Agreement, County will pay City $11,000 annually, due upon receipt of a statement from City but not later than June 30th of each year.
