Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Acceptance of Sanitary Sewer Improvements along Julien Dubuque Drive (Julien Dubuque Drive Sanitary Sewer Extension Project) DATE: October 12, 2020 INTRODUCTION The enclosed resolution provides for the acceptance of the Public Improvement Contract for the Julien Dubuque Dr. Sanitary Project. DISCUSSION BVM-PHS Senior Housing, Inc. is proposing to improve the Mt. Carmel Campus by adding new skilled nursing, assisted living, memory care facilities (Phase 1 improvements), and independent senior living units (Phase 2 improvements) over the next several years. By resolution number 274-19, the City approved a Memorandum of Agreement with BVM-PHS for the construction of a sanitary sewer extension to serve the existing mother house building and the new skilled nursing, assisted living, and memory care facilities at the Mt. Carmel Campus. The approved MOU states that BVM-PHS will construct a private sewer from the BVM Phase 1 facilities to Julien Dubuque Drive. The City will then construct a public sewer from the existing sewer serving Shady Oaks to the end of the private BVM-PHS sewer along Julien Dubuque Drive. The project included construction of 1,617 linear foot of public 8-inch diameter sanitary sewer and eight (8) new manholes. RECOMMENDATION I recommend that the City Council accept the improvements and authorize the payment of the contract amount of $121,590.41 to Drew Cook & Sons Excavating Company, Inc. for the Julien Dubuque Dr. Sanitary Project. The final contract amount is 8.63% below the bid amount of$133,070.00. SANITARY PROJECT AND AUTHORIZING THE PAYMENT TO THE CONTRACTOR WHEREAS, the public improvement contract for the Julien Dubuque Dr. Sanitary Project, (the Project) has been completed by the Contractor, Drew Cook & Sons Excavating Company, Inc. (Contractor), the City Engineer has examined the work and recommends that the Project be accepted; and WHEREAS, the final contract amount for the Project is $121,590.41; and WHEREAS, the Contractor has previously been paid $115,510.89, leaving a balance of $6,079.52; and WHEREAS, the City Council finds that the recommendation of the City Engineer should be accepted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The recommendation of the City Engineer is approved, and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $6,079.52 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
