Department of Transportation, affected public utilities and property owners.
You and each of you are hereby notified that pursuant to Iowa Administrative Code r.
263- 7.6(2), the City of Asbury has filed a Motion to Amend Voluntary Annexation Application to
Delete Certain Parcels (See attached Resolution #32- 2010). Any interested person or party may
file a resistance to the City of Asbury's motion within 14 days of this Notice. The City
Development Board may grant the motion to amend if it determines that the request serves the
public interest.
You and each of you are hereby further notified that pursuant to Iowa Code Section
368.7 and Iowa Administrative Code r. 263- 7.6(2) and 263- 7.8(3), the City Development
Board will continue the public hearing and consider the City of Asbury's Motion to Amend
Petition in the above - captioned matter. The continued public hearing and review of the Motion
to Amend Petition is scheduled for May 12, 2010, at 11:00 a.m. via the ICN at the Iowa
Department of Economic Development, 200 East Grand Avenue, 2 Floor ICN Conference
Room, Des Moines, and Dubuque Community School District - Forum, 2300 Chaney, Dubuque,
Iowa. If you would like to participate in the continued public hearing and /or the City
Development Board's consideration of the City of Asbury's Motion to Amend via teleconference,

This hearing is being held pursuant to Iowa Code Section 368.7 concerning a proposal
for voluntary annexation of territory to the City of Asbury. This proposal contains some territory

Development Board after a public hearing. You are invited to attend the hearing to present
evidence and /or argument for or against the motion and for or against the proposed annexation.

RESOLUTION NO. 32 -x010
CITY OF ASBURY, IOWA
WHEREAS, the City of Asbury has filed an application for voluntary annexation of
certain territory' with the State of Iowa City Development Board pursuant Iowa Code Section
368.7; and
WHEREAS, the City Development Board held a public hearing on April 14, 2010, to
consider the application for voluntary annexation, NC09 -16 ; and
WHEREAS, the City of Asbury has been advised that the inclusion of certain land north
of Clover Lane without the consent of the owners is inconsistent with Iowa Code Section 368:7.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ASBURY, IOWA:
1. That the Mayor of the City of Asbury is authorized to sign the attached Motion to
Amend Voluntary Annexation Application to Delete .Certain Parcels; and
2. That the City Clerk shall forthwith cause the Motion to Amend Voluntary
Annexation Application to Delete Certain Parcels be submitted to the City Development Board
by electronic .means on April 28, 2010, and make every effort to coordinate with the City
Development Board staff to have this Motion heard by the City Development Board as soon as
practicable, and also coordinate with the City Development Board staff to have the Public
Hearing on the annexation heard by the City Development Board as soon as practicable.
Passed by the City Council of the City of Asbury, Iowa, the 27' y of April, 2010, and
approved this 27 day of April, 2010.
