As part of the new Maintenance Garage Facility, the lowa DOT is paying for the construction and extension of new water main and sanitary sewer along Olde Davenport. During the plan development for the utility extensions, the City determined the water main should be increased in size from an 8-inch to a 16-inch main to accommodate potential annexation growth and future demand in the area. BACKGROUND The lowa DOT is currently constructing a new Maintenance Garage Facility at the corner of the Southwest Arterial US61-151 interchange and Olde Davenport Road. During the plan development for the new garage, the lowa DOT requested and collaborated with the City for the extension of public water main and sanitary sewer to serve the new facility. DISCUSSION As part of the new Maintenance Garage Facility, the lowa DOT is paying for the construction and extension of new water main and sanitary sewer along Olde Davenport. Upon completion of the utility extensions, the water main and sanitary sewer will become the property of the City as public utilities. During the plan development for the utility extensions, the City determined the water main should be increased in size to a 16-inch main to accommodate potential annexation growth and future demand in the area. The minimum water main size required to serve the new lowa DOT Maintenance Facility would be an 8-inch main. The City agreed to pay the incremental cost difference between an 8-inch water main and the 16-inch water main to be installed. Breitfelder, City Clerk July 2014 IOWA DEPARTMENT OF TRANSPORTATION Preconstruction Agreement For Primary Road Project County Dubuque City Dubuque Project No. BG-9D30(004)--80-31 lowa DOT Agreement No. 2021-2-020 Staff Action No. This Agreement, is entered into by and between the lowa Department of Transportation, hereinafter designated the "DOT", and the city of Dubuque, lowa, a Local Public Agency, hereafter designated the "LPA" in accordance with lowa Code Chapters 28E, 306, 306A and 313.4 as applicable; The DOT proposes to establish or make improvements to the water and sanitary sewer facilities serving the Dubuque Maintenance Garage near U.S. 61 within Dubuque County, lowa; and The DOT and the LPA are willing to jointly participate in said project, in the manner hereinafter provided; and This Agreement reflects the current concept of this project which is subject to modification by mutual agreement between the LPA and the DOT; and Therefore, it is agreed as follows: 1. Project Information a. The DOT will design, let, and inspect construction of the following described project in accordance with the project plans and DOT standard specifications: The DOT intends to construct an extension of municipal water and sanitary sewer from the existing main lines in the right of way for U.S. 61 along Olde Davenport Road to the driveway access for the house at 9491 Olde Davenport Road. This is a project for the Dubuque Maintenance Facility. b. As part of the project, the LPA has requested the water main size be increased from an 8-inch main to a 16-inch main. The LPA will pay the incremental cost difference for the 16-inch pipe and installation, all at no cost to the DOT. The contractor shall bill the LPA directly for their incremental costs (See Exhibit A for location and Exhibit B for costs). 2. Project Costs a. The DOT will bear all costs except those allocated to the LPA under other terms of this Agreement. b. The LPA will waive the connection fees. 3. Traffic Control a. U.S. 61 through-traffic will be maintained during the construction. 2021-2-020_Dubuque.docx 1 July 2014 4. Right of Way and Permits a. The DOT will be responsible for the coordination of utility facility adjustments for this project. 5. Construction 8� Maintenance a. Upon completion of the project the LPA shall take ownership of and assume all maintenance responsibility for the water and sewer main lines. 6. General Provisions a. If the LPA has completed a Flood Insurance Study (FIS)for an area which is affected by the proposed Primary Highway project and the FIS is modified, amended or revised in an area affected by the project after the date of this Agreement, the LPA shall promptly provide notice of the modification, amendment or revision to the DOT. If the LPA does not have a detailed Flood Insurance Study(FIS)for an area which is affected by the proposed Primary Highway project and the LPA does adopt an FIS in an area affected by the project after the date of this Agreement, the LPA shall promptly provide notice of the FIS to the DOT. b. The LPA will comply with all provisions of the equal employment opportunity requirements prohibiting discrimination and requiring affirmative action to assure equal employment opportunity as required by lowa Code Chapter 216. No person will, on the grounds of age, race, creed, color, sex, sexual orientation, gender identity, national origin, religion, pregnancy, or disability, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which State funds are used. c. It is the intent of both parties that no third party beneficiaries be created by this Agreement. d. If any section, provision, or part of this Agreement shall be found to be invalid or unconstitutional, such finding shall not affect the validity of the Agreement as a whole or any section, provision, or part thereof not found to be invalid or unconstitutional, except to the extent that the original intent of the Agreement cannot be fulfilled. e. This Agreement may be executed in (two)counterparts, each of which so executed will be deemed to be an original. f. This Agreement, as well as the unaffected provisions of any previous agreement(s), addendum(s), and/or amendment(s); represents the entire Agreement between the LPA and DOT regarding this project. All previously executed agreements will remain in effect except as amended herein.
