Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The property owners, Georgia Yiannis and Dave Lugar, spoke in favor of the request. They
explained that they plan to sell seven acres behind PetSmart, divide it, and retain an
easement for the west lot, which will be designated unbuildable. They noted in the future lot
1 will be consolidated with the lots along John F. Kennedy Road.
Staff reviewed the staff report, noting that the submitted Plat of Survey subdivides an
approximately twelve-acre tract into two irregular parcels. Lot 2 has adequate street
frontage and access, and that Lot 1 will be accessed via an easement through Lot 2. Staff
said that both lots exceed the minimum required lot area and Lot 1 would be designated as
non-buildable. Staff noted that in the future, Lot 1 will be consolidated with the lots along
John F. Kennedy Road and the non-buildable status of the lot will be removed at that time.
The Zoning Advisory Commission discussed the request finding it appropriate.
Recommendation
By a vote of 6 to 0, with one abstention, the Zoning Advisory Commission recommends that
the City Council approve the request.
A simple majority vote is needed for the City Council to approve the request.

RE: Plat of Survey of Lot 1 and Lot 2 of Yiannias Place No. 5
INTRODUCTION
The submitted Plat of Survey subdivides one approximately twelve-acre tract into two
irregular parcels. Current zoning of the subject parcels is C-3 General Commercial.
DISCUSSION
The plat as proposed, will result in two irregular lots located behind Petsmart and Staples
along JFK road. Lot 2 has adequate street frontage and access. Lot 1 will be designated
as non-buildable and will be accessed via easement through Lot 2. In the future, Lot 1,
will be consolidated with the lots along John F. Kennedy Road and the non-buildable
status of the lot will be removed at that time. Both lots exceed the minimum required lot
area as required.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Plat of Survey
of Lot 1 and Lot 2 of Yiannias Place No. 5 and recommends approval as submitted
subject to waiving the lot frontage requirement for Lot 1 of Yiannias Place No. 5.

RESOLUTION NO. 339-20
A RESOLUTION APPROVING THE PLAT OF SURVEY OF:
LOT 1 & LOT 2 OF YIANNIAS PLACE NO. 5 IN THE CITY OF DULBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey: Lot 1 & Lot 2
of Yiannias Place No. 5 in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 1 on a public or
approved private street, where street frontage is required by Section 11-14 of Title 16 of
the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they
find that it conforms to the statues and ordinances relatina thereto:
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage for Lot 1
on a public street or an approved private street.
Section 2. That the Plat of Survey: Lot 1 & Lot 2 of Yiannias Place No. 5 in the
City of Dubuque, Iowa is hereby approved, and the Mayor and City Clerk are hereby
authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said
Plat of Survey.
