PLEDGE OF ALLEGIANCE PROCLAMATION(S) 1. Trick-or-Treat Night & Planning for Halloween: The City Council discussed infor- mation provided from the Health Services Department, the Dubuque County Public Health Incident Management Team, and Iowa Department of Public Health and determined that Trick-or-Treat Night would be a voluntary event utilizing the health guidelines provided for low-risk activities. Mayor Buol read the proclamation and stated that should residents want to participate, they could do so on Saturday, October 31, 2020 from 5:30 p.m. to 7:00 p.m. 2. Energy Efficiency Day (October 7, 2020) was accepted by Sustainability Coordinator Gina Bell. 3. Indigenous Peoples' Day (October 12, 2020) was accepted by Jody Durnin of the Meskwaki Tribe and Dubuque for Indigenous Peoples' Day Committee. 4. Brain Health Awareness Month (October 2020) was accepted Clara Kaplan of the Brain Health Now Committee. 5. Arts and Humanities Month (October 2020) was accepted by the Arts and Cultural Affairs Coordinator Jenni Peterson Brandt. A brief Colts Youth Band music video was played to mark the proclamation. Disposition of Claims: City Attorney advising that the following claims have been referred to Public Entity Risk Services of Iowa, the agent for the Iowa Communities As- surance Pool: CenturyLink for property damage, Stacey Dudgeon for vehicle damage. Upon motion the documents were received, filed, and concurred. 4. Approval of City Expenditures: City Manager recommending City Council approval for payment of City expenditures. Upon motion the documents were received and filed, and Resolution No. 308-20 Authorizing the Director of Finance and Budget/City Treasurer to make certain payments of bills that must be paid and approved for payment in accord- ance with City procedures was adopted. RESOLUTION NO. 308-20 AUTHORIZING THE DIRECTOR OF FINANCE AND BUDGET / CITY TREASURER TO MAKE CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR PAYMENT IN ACCORDANCE WITH CITY PROCEDURES Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that the Finance Director-City Treasurer shall keep an accurate account of all disbursements, money, or property, specifying date, to whom, and from what fund paid; and Whereas, the invoices, presented by those firms and persons providing such goods and services have been pre-audited by Finance Department personnel in accordance with generally accepted internal control procedures and have been determined to have been requisitioned for a lawful municipal purpose; and Whereas, the Finance Director-City Treasurer has provided a list of Expenditures at- tached hereto, and by this reference made a part hereof, to be drawn to pay for goods and services provided for City purposes; and Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 - 18 adopted May 7, 2018, authorized the Finance Director-City Treasurer to issue checks in payment of certain expenditures known as Exception Expenditures prior to City Council approval and such list is attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The Finance Director-City Treasurer is hereby authorized to issue payment for goods and services provided for City purposes in response to the purchase orders and contracts issued in compliance with state and municipal code requirements as requested by designated requisitioning authorities in accordance with approved budget appropriations. Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Finance Director are hereby authorized and directed to provide the statement of receipts and dis- bursements to the City Council, and to publish a summary thereof. Assignment of Grant Agreement for 2887 Central Avenue : City Manager recom- mending approval of the Assignment of the Grant Agreement with Jenna Manders for the property located at 2887 Central Avenue to HG APT, LLC. Upon motion the documents were received and filed, and Resolution No. 309-20 Consenting to the Assignment of the Grant Agreement between the City of Dubuque and Jenna Manders from Jenna Manders to HG APT, LLC was adopted. RESOLUTION NO. 309-20 CONSENTING TO THE ASSIGNMENT OF THE GRANT AGREEMENT BETWEEN THE CITY OF DUBUQUE AND JENNA MANDERS FROM JENNA MANDERS TO HG APT, LLC Whereas, the City Council of the City of Dubuque, by Resolution No. 267 -20, dated September 8, 2020 entered into a Grant Agreement with Jenna Manders (Grant Recipi- ent); and Whereas, pursuant to the Grant Agreement, Grant Recipient is required to provide certain improvements to real estate owned by Jenna Manders, known locally as 2887 Central Avenue, Dubuque, Iowa (the Property); and Whereas, in order to facilitate rehabilitation of the Property, the Property will be con- veyed by Grant Recipient to HG APT, LLC, an Iowa limited liability company; and Whereas, Grant Recipient desires to assign the Grant Agreement to HG APT, LLC, pursuant to the Assignment attached hereto in order to facilitate the rehabilitation of the Property; and Whereas, the Grant Agreement authorizes the proposed conveyance of the Property and assignment, subject to City Council consent; and Whereas, the City Council finds that it is in the best interests of the City of Dubuque to consent to the conveyance of the Property and the Assignment. RESOLUTION NO. 310-20 CONSENTING TO THE ASSIGNMENT OF THE GRANT AGREEMENT BETWEEN THE CITY OF DUBUQUE AND GABRIEL MOZENA FROM GABRIEL MOZENA TO REAL PROPERTY INVESTMENTS, LLC Whereas, the City Council of the City of Dubuque, by Resolution No. 266 -20, dated September 8, 2020 entered into a Grant Agreement with Gabriel Mozena (Developer) and Whereas, pursuant to the Grant Agreement Developer is required to provide certain improvements to real estate owned by Gabriel Mozena, known locally as 1575 -1577 Washington Street, Dubuque, Iowa (the Property); and Whereas, in order to facilitate rehabilitation of the Property, the Property will be con- veyed to Real Property Investments, LLC, an Iowa limited liability company; and Whereas, Developer desires to assign the Grant Agreement to Real Property Invest- ments, LLC pursuant to the Assignment attached hereto in order to facilitate the rehabili- tation of the Property; and Whereas, in the Grant Agreement the proposed conveyance of the Property and as- signment is authorized subject to City Council consent; and Whereas, the City Council finds that it is in the best interests of the City of Dubuque to consent to the conveyance of the Property and the Assignment. Dubuque County Limited Winter Maintenance Agreement : City Manager recom- mending approval of the Limited Winter Maintenance Agreement with Dubuque County to improve winter maintenance service levels on country roads which provide access to the John Deere Dubuque Plant. Upon motion the documents were received, filed and approved. 8. 2020 Justice Assistance Grant (JAG): City Manager recommending acceptance of the 2020 Justice Assistant Grant (JAG) award. Upon motion the documents were re- ceived, filed, and approved. 9. Requested Endorsement of Americans for the Arts Federal Policy Proposal: City Manager recommending City Council endorsement of Americans for the Arts Federal Policy Proposal per recommendation of the City of Dubuque’s Arts and Cultural Affairs Advisory Commission. Upon motion the documents were received, filed and approved. 10. September 30, 2020 US EPA Semi Annual Consent Decree : City Manager trans- mitting the September 30, 2020 Consent Decree Semi Annual Report as submitted to the U.S. Environmental Protection Agency. Upon motion the documents were received and filed. 11. Accepting the 2020 Asphalt Overlay Ramp Project Three Section A and B : City Manager recommending acceptance of the construction contract for the 2020 Asphalt Overlay Access Ramp Project Three Section A & B as completed by S&S Builders . Upon motion the documents were received and filed, and Resolution No. 311-20 Accepting the 2020 Asphalt Overlay Access Ramp Project Three Section A & B and authorizing the final payment to the contractor was adopted. RESOLUTION NO. 311-20 ACCEPTING THE 2020 ASPHALT OVERLAY ACCESS RAMP PROJECT THREE SECTION A & B AND AUTHORIZING THE FINAL PAYMENT TO THE CONTRACTOR Whereas, the public improvement contract for the 2020 Asphalt Overlay Access Ramp Project Three Section A & B, (the Project) has been completed by the Contractor, S & S Builders (Contractor), and the City Engineer has examined the work and signed a certifi- cate stating that the Project has been completed according to the terms of the Public Improvement Contract and that the City Engineer recommend s that the Project be ac- cepted; and Whereas, the final contract amount for the Project is $73,548.33; and Whereas, the Contractor has previously been paid $69,870.91, leaving a balance of $3,677.42; and Whereas, the City Council finds that the recommendation of the City Engineer should be accepted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The recommendation of the City Engineer is approved, and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor from the Curb Ramp Program CIP appropriations for the contract amount of $73,548.33 less any retained percentage provided for therein as provided in Iowa Code. Section 3. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $3,677.42 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13. Iowa Street and Locust Street Parking Ramp Deck Emergency Repairs: City Man- ager recommending approval of emergency repairs to the Iowa and Locust Street Parking Ramp decks. Upon motion the documents were received and filed, and Resolution No. 312-20 Authorizing Emergency Repairs to the Iowa and locust Street Parking Ramps was adopted. RESOLUTION NO. 312-20 AUTHORIZING EMERGENCY REPAIRS TO THE IOWA AND LOCUST STREET PARKING RAMPS Whereas, portions of the Iowa Street and Locust Street Parking Ramp decks are hav- ing areas of concrete come loose and fall due to the age of the ramp; and Whereas, Iowa Code § 384.103 provides that when emergency repair of a public im- provement is necessary and the delay of advertising and a public letting might cause serious loss or injury to the city, the governing body sha ll, by resolution, make a finding of the necessity to institute emergency proceedings and shall procure a certificate from a competent registered professional engineer or architect, not in the regular employ of the city, certifying that emergency repairs are necessary, and that in that event the governing body may contract for emergency repairs without holding a public hearing and advertising for bids; and Whereas, the City Council finds that the conditions in certain areas of the ramp decks are a potential public hazard and constitute an emergency and that an emergency repair of the parking ramps is necessary and the delay of advertising and a public letting might cause serious loss or injury to the City; and Whereas, the City has procured a certificate from a competent professional engineer registered in the State of Iowa, not in the regular employ of the City, attached hereto, certifying that emergency repairs to the parking ramps are necessary. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The City Council finds that it is necessary to institute emergency proceed- ings to repair the Iowa and Locust Street Parking Ramp decks. Section 2. Greater Downtown Urban Renewal District - Resolution of Necessity: City Manager recommending approval of a resolution that authorizes and directs the City Manager to prepare a proposed Amended and Restated Urban Renewal Plan for the Greater Down- town Urban Renewal District and sets a public hearing on the proposed Amended and Restated Urban Renewal Plan for November 2, 2020. Upon motion, the documents were received and filed, and Resolution No. 314-20 Authorizing and directing the City Manager to prepare an Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal District and setting the date for a public hearing and Consultation on the Proposed Amended and Restated Urban Renewal Plan for said District was adopted. Setting a public hearing for a meeting to commence at 6:30 p.m. on N ovember 2, 2020. RESOLUTION NO. 314-20 AUTHORIZING AND DIRECTING THE CITY MANAGER TO PREPARE AN AMENDED AND RESTATED URBAN RENEWAL PLAN FOR THE GREATER DOWNTOWN UR- BAN RENEWAL DISTRICT AND SETTING THE DATE FOR A PUBLIC HEARING AND CONSULTATION ON THE PROPOSED AMENDED AND RESTATED URBAN RE- NEWAL PLAN FOR SAID DISTRICT Whereas, the City Council of the City of Dubuque has heretofore approved the Amended and Restated Urban Renewal Plan (for the Greater Downtown Urban Renewal District (the “District”) in order to provide redevelopment opportunities which will further the purposes and objectives of the Amended and Restated Urban Renewal Plan; and Whereas, City staff has recommended that the Amended and Restated Urban Re- newal Plan be further amended and restated and that the District be expanded to add an adjacent area which meets the definition of an economic development area in Iowa Code Chapter 403, and that the proposed Amended and Restated Urban Renewal Plan be updated to include such area and to update urban renewal project descriptions and make any other necessary revisions; and Whereas, Iowa Code Chapter 403 requires that before urban renewal authority may be exercised, the City Council must adopt a resolution of necessity finding that the area in question is a slum, blighted or economic development area, and that so designating such area is necessary in the interest of the public health, safety or welfare of the resi- dents of the municipality. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The area referred to herein as the Stafford Street Subarea, as generally described in Exhibit “A” and Exhibit “B” to this Resolution and to be included in the Amended and Restated Urban Renewal Plan for the Greater Downtow n Urban Renewal District, is an economic development area as defined by Iowa Code Chapter 403 and is appropriate for an urban renewal project. Section 2. The development of the above-described Subarea is necessary and appro- priate to facilitate the proper growth and development of the community in accordance with sound planning and local community objectives. Section 3. The City Manager is authorized and directed to prepare an Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal Dis trict to ac- complish the foregoing purposes and objectives, to include in such Amended and Re- stated Urban Renewal Plan any appropriate project activities and details, to determine an appropriate date for and conduct the consultation process required by law with affected taxing entities concerning the proposed Amended and Restated Plan, and submit the proposed Amended and Restated Urban Renewal Plan to the Long Range Planning Ad- visory Commission for review and recommendation as to its conformity with the gene ral plan for the development of the community as a whole. Section 4. The City Clerk is directed to publish notice of a public hearing on the adop- tion of an Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal District to be held on the 2nd day of November, 2020, at 6:30 p.m. in the form attached hereto. The notice of said hearing shall generally identify the areas covered by the proposed Amended and Restated Urban Renewal Plan and the general scope of the urban renewal activities planned for such areas and said notice shall be published in a newspaper having general circulation within the City not less than four days nor more than twenty days before the date of said meeting. A copy of the notice of public hearing shall be sent by ordinary mail to the affected taxing entities. Section 5. The City Clerk is further directed to send by ordinary mail a copy of the proposed Amended and Restated Urban Renewal Plan, the notice of public hearing, a notice of consultation, and, to the extent the Amended and Restated Urban Renewal Plan includes the use of tax increment revenues for a public building, an analysis of alternative development and funding options for such public buildings, to the Dubuque Community School District Board of Education and Dubuque County Board of Supervisors, as the affected taxing entities. Taylor have tentatively entered into a Purchase Agree- ment pursuant to which City will convey the Property to Michael R. COUNCILMEMBER REPORTS Council Member Jones reported on his early voting at the Elections Annex without any issue and that the office is open every day until the November 3, 2020 election. Council Member Roussell reported on Operation New View merging with the Hawkeye Area Community Action Agency (HACAP) and the additional resources that are now of- fered. HACAP might present to the Council at a date in the future. Ms. Roussel recognized the Alliant Energy Roundtable for their sustainability efforts and recommended the re- sources of Dubuque County Early Childhood for assisting with the brain health of children during this time of isolation and virtual interaction. Council Member Resnick reported on witnessing the success of HACAP since being a board member and recognized fellow board members Laura Roussell and Steve Drahozal for their work. Mr. Resnick also reported on touring the new Dupaco Building in the Mill- work District. Council Member Cavanagh also reported on the Dupaco Building adding that he hopes it will create more development in the district. Council Member Sprank requested that the City Council have a bigger discussion around the recent gas explosion on Loras Boulevard as he had conce rns for similar pro- jects taking place around town. CLOSED SESSION Motion by Jones to convene in closed session at 8:11 p.m.to discuss pending litigation pursuant to Chapter 21.5(1)(c) Code of Iowa. Seconded by Lynch.
