Monday, Sept. 3rd, being a Na-
tional Holiday (Labor Day), the
meeting was held Sept. 4th.
Council met at 5:00 o'clock P. M.
Present —City Manager Kratz,
Mayor Maclay, Councilmen McEvoy,
Meuser, Schuckert.
Absent — Councilman Yount.
Mayor Maclay stated that this is
the regular monthly meeting of the
Council for the dispatch of such
business as may properly come be-
fore the meeting, and that this date
was also fixed for the considering of
bids for the improvement of the
Alley first east of Center Place from
the north property line of Julien
Avenue .to south property line of
Rose Street.
Notice of publication, certified to
by the publishers, of Notice to Con-
tractors of the receipt of proposals
for the construction of Alley im-
provements and the making of un-
derground connections on the Alley
first east of Center Place from the
north property line of Julien Ave-
nue to the south property line of
Rose Street, presented.
Councilman Meuser moved that
the notice be received and filed.
Seconded by Councilman Schuckert.

ment, bids were received at 10 A. M.
Monday, September 3rd, for the im-
provement of alley first east of Cen-
ter Street from north property line
of Julien Avenue to south property
line of Rose Street.
Jas. F. Lee Paving Co.— Concrete
paving, $1.83; grading, 70c; sewer,
$3.00; total, $2,657.00.
Uhlrich -Paley Co. — Concrete pav-
ing, $1.82; grading, 60c; sewer,
$1.00; total, $2,598.00.
Engineer's Estimate, $2,856.00
I would respectfully recommend
that the contract for the improve-
ment of this alley with concrete, also
grading and sewer connections, be
awarded to Uhlrich -Paley Co., as
their bid is the lowest one received.

Whereas, proposals have been
submitted by contractors for the im-
provement of Alley first east of
Center Street from the north prop-
erty line of Julien Avenue to the
south property line of Rose Street
by grading, paving with six -inch
plain concrete and constructing un-
derground connections with sewer
main and Uhlrich -Paley Co., con-
tractors, have submitted the lowest
bid for the furnishing of. all labor
and materials and performing the
work as provided for in the plans
and specifications; now therefore,
Be it resolved by the City Council
of the City of Dubuque, that the
contract for the improvement of the
Alley first east of Center Street from
the north property line of Julien
Avenue to the south property line
of Rose Street for the grading, pav-
ing and installing underground con-
nections with the sewer main be
awarded to Uhlrich -Paley Co. and the
Mayor and Manager be and they are
hereby directed to execute a con-
tract on behalf of the City of Du-
buque for the complete performance
of said work.
Be it further resolved that this
resolution being deemed urgent and
of immediate necessity become ef-
fective from and after its passage
and adoption by the City Council.

The undersigned hereby certifies
that the contract for the construc-
tion of the sanitary sewer in Division
Street from a point about ninety
feet north of the sanitary sewer in
West 24th Street to a point about
one hundred seventy -six feet north,
Cook & Kean, contractors, has been
completed.
I further certify that this work
has been done in accordance with
the plans and specifications and
stipulations of the contract and I
Councilman Schuckert moved that
the rules requiring an ordinance to
be read on three separate days be
suspended. Seconded by Council-
man McEvoy. Carried by the fol-

Whereas, the contract for the con-
struction of the sanitary sewer in
Division Street from a point about

City Engineer has examined the
work and filed his certificate stat-
ing that the same has been complet-
ed according to the terms of the
contract, plans and specifications
and recommends its acceptance;
now therefore
Be it resolved by the City Council
of the City of Dubuque, that the rec-
ommendation of the City Engineer
be approved and that said improve-
ment be and the same is hereby ac-
cepted and the City Engineer be and
he is hereby directed to prepare a
plat and schedule showing the lots
or parcels of real estate subject to
assessment for said improvement
and file the same in the office of the
City Clerk subject to public inspec-
tion and said Clerk shall upon re-
ceipt of such plat and schedule pub-
lish the notice of the Council's in-
tention to levy special assessments
therefor as required by law.
Be it further resolved that the
City Treasurer be and he is hereby
directed to pay to the contractor
from the funds to be realized from
the sale of improvement bonds is-
sued upon the above described im-
provements an amount equal to the
amount of his contract, less any re-
tained percentage provided for
therein.

ors of Dubuque County, Iowa, asking
that the City Council rescind their
action in levying a bridge tax for
City Bridge purposes for the year
1928. Action deferred.
Council to meet with Board of Su-
pervisors at an informal meeting to
be held Friday, Sept. 7th, 1928.
Clerk instructed to notify said
Board. No motion.
Representatives of the 'felegraph-
Herald and Times- Journal newspa-
per were also notified to attend this
meeting for conference relative to
advertising rates for printing Offi-
cial Notices and Council Proceed-

ready paved, by paving, construct-
ing driveways, sidewalks, downspout
drains and the installing of under-
ground connections with sewer and
water mains, has been completed
and the City Engineer has examined
the work and filed his certificate
stating that the same has been com-
pleted according to the terms of the
contract, plans and specifications
and recommends its acceptance, now
therefore,
Be it Resolved by the Cityl Coun-
cil of the city of Dubuque, That the
recommendation of the City Engi-
neer be approved and that said im-
provement be and the same is here-
by accepted and the City Manager
be and he is hereby directed`to pre-
pare a plat and schedule showing the
lots and parcels of real estate sub-
ject to assessment for said improve-
ments and file the same in the of-
fice of the City Clerk, subject to pub-
lic inspection, and said Clerk shall
upon receipt of such plat and sched-
ule publish the notice of the Coun-
cil's intention to levy special assess-
ments therefor, as required by law.
Bt it further resolved that the
City Treasurer be and he is hereby
directed to pay the contractor from
the funds to be realized from the
sale of improvement bonds issued
upon the above described improve-
ments, namely the paving and con-
struction of driveways, an amount
equal to the amount of his contract,
less any retained percentage pro-
vided for therein; and also that the
City Treasurer be and he is hereby
directed to pay to the contractor
with certificates for the construction
of sidewalks, downspout drains and
for the •installing of underground
connections with the sewer and
water mains, in amounts equal to
the amount of his different contracts,
less any retained percentage pro-
vided for therein.

Chamber of Commerce, stating that
at a meeting of the Maritime Com-
mittee of the Chamber of Commerce.
there was a discussion with regard
to the conference to be held at the
Nicollet Hotel, Minneapolis, Minn.,
at 10:00 A. M. Friday, Sept. 14, 1928.
This meeting is for the purpose
of discussing and preparing a pres-
entation to the U. S. Board of En-
gineers for Rivers and Harbors in
Washington, in opposition to the un-
favorable report of Major C. L. Hall,
District Engineer of Rock Island,
and in favor of a nine -foot channel
for the Upper Mississippi river.
It was the consensus of opinion of
this board, that Dubuque should be
represented at this meeting by two
representatives from the City of Du-
buque and two from the Chamber of
Commerce. The subject matter of
this meeting, a nine -foot channel for
the Upper Mississippi river is of first
importance to the Mississippi valley,
that in the river transportation sys-
tem of the country they would be on
a parity with the Ohio, the Illinois,
the lower Mississippi and the Mis-
souri rivers, and they urge that the
Council appoint a committee to rep-
resent the City.
Councilman Meuser moved that the
communication be filed, and that Mr.
S. G. Creswick of the Dubuque Ship-
pers' Assn. be appointed to repre-
sent the City of Dubuque at this
Conference and the Clerk be in-
structed to notify Mr. Creswick of

A communication from the Realty
Investors Corporation, owner of lot
1 of 22, protesting and objecting to
any action by the City of Dubuque
relative to any proposed contrac,
order, undertaking or proceedings
relative to the construction of a
concrete walk on the Johnson Street
side of lot 1 of lot 22 of High Street
Sub. and giving reasons therefor.
One of the reasons being that by
reason of the street construction
work the existing sidewalk was dis-
placed and torn up for a consider-
able distance, necessitating relaying
and filling joints with sand, but no
changes, substitutions or addition of
material, or replacements, altera-
tions or reconstructions of the hard
paving brick units making up same
were required, and that no new
walk or parts of walk would have
been required, and no relaying ne-
cessitated, except for the tearing up
of the walk by reason of said street
improvement.

City Solicitor Czizek reported on
the claim of Sylvia Mathis, on ac-
count of personal injuries sustained
by her in falling on a defective side-
walks on Broadway, stating that he
has had an interview with Mr. and
Mrs. Mathis relative to this `claim
and that he had personally viewed
the place where this accident hap-
pened. He states further that they
were perfectly satisfied to settle
this claim for the actual expense
that they were put to on account of
this accident, which amounts to
$380.50, and he recommends that the
Council settle for this amount, and
if agreeable that the Auditor be in-
structed to draw a warrant in this
amount in favor of Mrs. Sylvia
Mathis.
Councilman Schuckert moved that
the recommendation of the City So-
licitor be approved and the Auditor
be instructed to draw a warrant in
favor of Mrs. Sylvia Mathis for
$380.50, settlement in full of this

To the Honorable Mayor and City
Council of the City of Dubuque:
Gentlemen: As I understand the
Council has indicated its willingness
to have submitted to the electors of
the City of Dubuque the question of
the purchase of Olinger Park for
playground purposes providing the
price was fixed at $27,500.00, and in-
as much as such price has now been
agreed to by the owners of this
property, I immediately prepared a
petition and had a large number of
them printed so that the same may
be circulated at once for the neces-
sary signatures. Before the Council
is authorized to call a special elec-
tion for this purpose, a petition
signed by at least 25% of the total
number of votes cast at the last
regular municipal election must be
submitted to the Council, requesting
the calling of such election. In order
that the election may be held in
conjunction with the general elec-
tion to be held on November 6, 1928,
these petitions must be put into cir-
culation at once so that they will be
on file not later than the last day of
next week, since the resolution call-
ing the election must be acted upon
by the Council and adopted at its
regular meeting in October. The no-
tice calling the election must be
published once a week for four con-
secutive weeks and the election can-
not be held less than five days nor
more than 20 days after the last
publication. So you will be impress-
ed with the necessity of having all
petitions signed and filed before the
first day of October next. Judges
and Clerks of Election and registra-
tion officials must also be appointed
at this time and arrangements
should be made whereby the same
judges and clerks and registration
officials who will have charge of the
general election will also serve for
this election. This was done in con-
nection with the submission of the
creation of a Dock Board in 1926
and worked satisfactorily. It ought
to be arranged again.
I have prepared an option agree-
ment which the owners of the prop-
erty, through their authorized attor-
ney in fact, Mr. Elfmann, afe ready
to sign and the same is herewith
submitted. In order to give the
Mayor authority to execute this
agreement on behalf of the city a
resolution should be adopted, and I
have prepared such resolution and
recommend its adoption at this
meeting. You will observe that this
option provides that the city may
purchase this property for $27,500
and is so conditioned that it is de-
pendent upon the affirmative vote of
the electors at the special election
to be held on November 6, 1928. It
continues in force until December
15, 1928, at which time it is expected
that all of the proceedings will be
taken by the Council which are nec-
essary to authorize the issuance of
the bonds and that the bonds will be
sold by that time. I have figured
out the time and believe all pro-
ceedings can be completed by the
time stated if the Council acts
promptly upon all matters connected
therewith.

Whereas, the owners of the real
estate commonly known as Olinger
Park and located in the City of Du-
buque, have agreed to sell the same
to said city for the sum of $27,500
and are willing to give to such city
an option to purchase the same at

thereof vote in favor of such pur-
chase at a special election to be held
on November 6, 1928; and
Whereas, this Council believes that
such price is reasonable and that a
splendid opportunity is now afforded
this City to acquire said property for

Mayor be, and he is hereby authoriz-

buque, a municipal corporation of
Iowa, for the sale of said real estate;

tate has been agreed upon between

which is hereby acknowledged, said
W. H. Elfmann hereby grants to the
City of Dubuque the right and op-
tion to purchase said real estate for
the sum of $27,500.00, the same be-
ing described as Lots No. 1 to No. 46,
both inclusive in Boulevard Addition
to the City of Dubuque, Iowa, and it
is agreed between the parties hereto
that should the electors of the City
of Dubuque vote favorably upon the
proposition of acquiring said real
estate at said election, said City of
Dubuque will purchase the same
for the price stated, but if said
proposition is defeated at said elec-
ton this option shall expire and
there shall be no obligation upon
the part of either party to continue
the same in effect.
Said W. H. Elfmann further agrees
that should said proposition be
adopted then the time for the pay-
ment of said purchase price shall
be stipulated to be when and after
all necessary proceedings have been
taken by the City Council for the is-
suance and sale of bonds and the
proceeds to be derived therefrom
shall be used for the purchase of
said real estate, it is expressly un-
derstood that all matters in relation
hereto shall be fully completed on
or before December 15, 1928.
This agreement is dulty executed
by the parties hereto this 19th day
of September, 1928, the Mayor of the
City of Dubuque being authorized to
sign the same on behalf of said City
under direction of the City Council.

Report, of S. G. Creswick, Who Was
Appointed to Represent the City of
Dubuque at Conference Relative
to Project of Nine -Foot Channel on
Upper Mississippi River.
The conference convened at the
Nicollet Hotel, Minneapolis, 10 A.
M. September 14th, C. C. Webber, of
Minneapolis, presiding. It was called
for the purpose of arousing interest
in the Mississippi Valley Cities and
to file protest with the Board of En-
gineers, Washington, D. C., against
the report of Major Hall, U. S. Army
Engineers, Rock Island, Ill., who re-
cently submitted to his superiors a
report unfavorable to the construc-
tion of a nine -foot channel on the
Mississippi river, St. Louis to the
Twin Cities inclusive. The basis of
the adverse report of Major Hall is
that "the maximum savings per ton
mile due to transportation on a nine -
foot channel over those of a six -foot
depth, multiplied by the potential
ton mileage of barge traffic, are en-
tirely insugicient to repay the min-
imum cost of the proposed improve-
ment."
The interest aroused by the ad-
verse report is very keen. Represen-
tatives from all principal cities
along the Mississippi river, including
Chicago, St. Louis, Kansas City and
Sioux City were present and letters

were received from other cities en-
dorsing the conference, but unable
to send representatives. The ser-
iousness of the conditions created by
the report were not minimized. It
was recognized that prompt and
careful preparation is necessary not
only to over turn the adverse report
but also to convince the Board of
Engineers that the construction of a
nine -foot channel is necessary and
vital to the welfare of the middle
west.
The report is made pursuant to
Act of Congress and must be ap-
proved by the Board of Engineers
and General Judwin, Chief of En-
gineers, and finally approved by the
Rivers and Harbors Committee of
Congress. Considerable discussion of
the situation was manifested at the
conference. It was felt that Major
Hall had gone beyond his knowledge
when basing his report on the po-
tential tonnage available for barge
line movement, his experience fitting
him to cover the engineering feat-
ures only. The report does not state
that a ninefoot channel is impossible
from an engineering standpoint.
Some of the reasons set out in fav-
or of a nine -foot channel on the Up-
per Mississsippi River are: (1) The
necessity for an economic outlet for
the commerce of the middle -west and
as an aid to the farmer. (2) The
co- ordination of all major inland
waterway improvements on a uni-
form depth, the lower Mississippi
and Ohio rivers now having, or in
the process of construction, nine -
foot channels; the proposals to build
nine -foot, channels on the Illinois
River and on the Missouri from St.
Louis to Kansas City, and 3rd the
discriminatory freight rates and ad-
justment against the middle -west
cities created by the construction of
the Panama Canal.
It was the unanimous decision of
the conference that action should be
taken to defeat the adverse report of
Major Hall. The protest to be filed
with the Board of Engineers will be
supported by engineering and ton-
nage data. The conference elected
an executive committee which ■s ar-
ranging hearing before the Board on
October 15th. The tonnage data from
Dubuque is being gathered together
by the Dubuque Shippers' Associa-
tion.
The City of Dubuque is vitally in-
terested in the successful outcome
of this fight for a nine -foot channel.
A six -foot channel on the Upper
river means that we will be on the
"narrow gauge division" of a great
transportation system with all its
operating difficulties and inability to
handle a maximum volume of ton -
nige. The real success of transpor-
tation on the Upper Mississippi river
which is of tremendous importance
to our local industries and the indus-
trial development of Dubuque as
well as to this territory generally,
depends upon a nine -foot channel
and this reason coupled up with our
investment in river terminals neces-
sitates our full support be placed
behind the efforts now being made
for an adequate channel, which will
enable maximum development of the
Upper river for commercial traffic
to be attained.

Gentlemen: Your petitioner re-
spectfully represents that she was on
or about the 18th day of January,
1901, appointed, and thereabouts
qualified. and is now, and has been
since said date, the duly acting ad-
ministratrix of the Estate of Mar-
garet O'Shea, deceased.
That said Margaret O'Shea, de-
ceased, left city property title to
which vested in her heirs at the time
of her death, known and described as
follows, to -wit:
Lot No. 5 of the Subdivision of
Subdivision of Mineral Lot 28, in the
City of Dubuque, Iowa.
That said described lot is now
known and designated as "Mineral
Lot 28, Lot 4, and abuts on South
Grandview Avenue, in the City of
Dubuque."
The undersigned respectfully rep-
resents that the City has assessed or
attempted to assess to said property,
for water connections, a sum aggre-

gating Four_ Hundred and 62 -100
Dollars, ($400.62), with accumulated
interest.
That the said City of Dubuque on
or about the 23rd day of December,
1926, paid the delinquent assessment
and took a certificate of sale, at-
tempting thereby to attach by said
act a lient to said property to cover
the assessment so levied.
The undersigned now claims that
said certificate is null and void and
of no force and effect, by reason of
the failure in the part of the City of
Dubuque, and its duly constituted of-
ficers to secure service of the notice
upon the undersigned in her repre-
sentative capacity as Administratrix
of the Estate of said Margaret
O'Shea, deceased.
That by reason of the failure of
said City to give said notice as re-
quired by law, the heirs holding title
to this real estate had no knowledge
of the contemplated action on the
part of the City to levy said assess-
ment.
The undersigned further repre-
sents that the City Council failed to
comply with the provisions of the
law as set out in Section 5982 of the
Code of 1924, in the following par-
ticulars, to -wit:
First: There is no report on file
by the City Manager, who, under
Chapter 328, Section 66669, Par. 12,
is charged with the management of
the Municipal Water plants, showing
that he made a report to the Council
of Lots and names of the owners,
and the requirements in respect to
connections from any water main or
pipes to the curb line of the abutting
and adjacent property, on Grand-
view Avenue where this property is
located.
Second: An investigation of the
files fails to disclose any notice
served upon, the undersigned as Ad-
ministratrix of the Estate of Mar-
garet O'Shea, deceased.
Third: There is no report on file
showing that the Water Works Trus-
tees, or the Manager put in said con-
nections, and no certificate as to the
cost of same returned by the Mana-
ger, or said Water Works Depart-
ment.
Fourth: The resolution directing
that these connections be made, and
the paragraph with relation thereto,
reads as follws:
"Install sewer, water and gas con-
nections to every lot; in case a lot
has more than 50 foot frontage ad-
ditional connections to be installed
to furnish one connection for every
50 fe
The City Map, and the Plat rec-
ords of this property, in the Record
of Plats, Dubuque County, Iowa,
show that it is acreage property and
not sub - divided.
Therefore, the City Council ex-
ceeded its authority under the law
in directing or attempting to make a
connection for every 50 feet, and
charging same against this particu-
lar property.
Our Supreme Court has said, with
relation to this matter, the follow-
ing:
"It therefore follows, that where
more than one sewer or water con-
nection is charged against any in-
dividual lot or acreage which has not
been subdivided, the town is acting
wholly without jurisdiction, and that
an injunction should issue accord-
ingly."
I have paid to date for gas con-
nections Seventy -seven and .01 -100
Dollars ($77.01). I have paid for
sewer connections an aggregate of
Two Hundred Thirty -seven and
70 -100 Dollars ($237.70). On the
street improvement Seven Hundred
Four and .05 -100 Dollars ($704.05) ;
or aggregating One Thousand Eigh-
teen and 76 -100 Dollars, $1,018.76).
I refuse to pay the illegal assess-
ment for water connections but am
willing and do hereby offer to tender
to the City, in lieu of taking this
matter into court, the actual expense
or cost of one connection, less any
interest charge, as I do not believe
I should be charged with interest in-
asmuch as I have always been pre-
pared to pay, without admitting that
I am now legally liable for same,
just what the law allows to be
charged against my property.
I am aged and feeble; my means
are very limited and I respectfully
submit this petition, tendering set -
tlemen on a legal basis, in the hope
that it may receive favorable consid-
eration at the hands of your honor-
able body.
While I claim that the Estate, with
the objections pointed out herein, is
not liable for any sum, I am never-
theless willing out of my own funds
to reimburse the City for one water
connection from the water main to

Bonds.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer in Division Street, hereinafter
described, has been completed and
said improvement has been accepted
by the City Council of said City and
the City Engineer has computed the
cost and expense thereof to be
$247.08.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, therefore, be in resolved by
the City Council of the City of Du-
buqque, that to provide for the cost
of constructing a sanitary sewer in
Division Street from a point about
ninety feet north of the sanitary
sewer in West 24th Street to a point
about ninety feet north of the sani-
tary sewer in West 24th Street to a
point about one hundred and seven-
ty -six feet north, there be issued
sewer' bonds to the amount of
$247.08.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1927, which bear date
as of the 27th day of Sept., A. D.
1928, shall be in the denominations
of ,$100.00 each, except that there
shall be one bond to the amount of
$47.08; they shall be numbered from
1548 to 1550 inclusive and shall be
divided into three series of which the
bond numbered 1548 shall constitute
the first series and shall be payable
on the 1st day of April, 1929; the
bond numbered 1549 shall constitute
the second series and shall be pay-
able on the 1st day of April, 1930;

And it is hereby certified and re-
cited that all the acts and condition
and things required to be done prec-
edent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably

City Manager Kratz reported that
he had discharged Jas. Maclnerney

with a resolution attached. That as
a protest to the Federal Radio Com-
mission, in the injustice to station
W -H -O, Bankers Life Des Moines,
and the radio listeners in the terri-
tory served by them, we respectfully
petition the Federal Radio Commis-
sion to reconsider its action, and re-
assign to Station W -H -O a clear
channel, full time and a minimum of
5,000 watt power. That the City
Clerk of the City of Des Moines he
and he is hereby authorized and di-
rected to certify a copy of this reso-

Mr. O. Perleth addressed the Coun-
cil, stating that Rosalind Street is
in a bad condition, asking that it
be resurfaced, stating that if some
macadam and tarvia is put on, the
street would be good for some time
to come.
The City Manager stated that
there are a great many streets in
the City just as bad and worse and
if the .City started to repair these
streets there would not .be money
enough in the budget to pay for
them, the street repair appropriation
being already proportionately over-
drawn.
Councilman Meuser moved that
this be referred to the Council to
be taken up when the Council dis-
cusses other streets. Seconded by
Councilman Schuckert. Carried by

Mayor Maclay stated that this is
the regular monthly meeting of the
City Council for the transaction of
such business as may properly come
before the meeting.
Ordinance No. 209, an ordinance
providing for the licensing of pumps
and tanks and vehicles used to sell
and dispense gasoline upon the pub-
lic streets, alleys, sidewalks and oth-
er public places of the City of Du-
buque, and providing a penalty for
violation hereof, having passed upon
first and second reading, presented
for final reading and adoption.
Councilman McEvoy moved that
the rules be suspended to allow any-
one present who wished to do so to
address the Council. Seconded by
Councilman Schuckert. Carried by
the following vote:

Wm. B. Martin addressed the
Council on behalf of the gasoline dea-
lers objecting to the passage of said
ordinance, and submitted a petition

the passage of said ordinance, and
also submitted the legal opinions of
Attorney Hugh Stuart and -Attorney
John J. Kintzinger, stating that the
ordinance is illegal, and should not
be adopted.

Petition requesting the City Coun-
cil of the City of Dubuque to call a
Special Election for the purpose of
voting upon the question of estab-
lishing juvenile playgrounds and ac-
quiring lands for such purpose and
issuing bonds to pay for the same
and providing a tax levy to pay the
bonds and interest.
To the Honorable Mayor and Council
of the City of Dubuque, Iowa:
The undersigned, being qualified
electors of the City of Dubuque, here-
by petition your Honorable Body to
call a special election in the City of
Dubuque, whereat there shall be sub-
mitted to the electors thereof the
following questions:
"Shall the City of Dubuque estab-
lish a Juvenile Playground in said
city ?"
"Shall the City of Dubuque acquire
by purchase lands to be used as Ju-
venile Playgrounds, and contract in-
debtedness for such purposes not
exceeding $27,500.00 and issue bonds
for such purposes not exceeding
$27,500.00 and levy a tax annually
upon the taxable property in said
City not exceeding one (1) mill per
annum for the payment of such
bonds and the interest thereon ?"
The lands to be acquired are those
lots in the block bounded on the
south by East 24th Street, on the
east by Washington Street, on the
north by East 25th Street, and on
the west by Jackson Street, and com-
monly referred to as "Olinger Park."
The petition containing more than
the proper number of signers (2,667
signers), Councilman Meuser moved
that it be received and placed on file.
