Council met at 4:30 P. M.
Present —City Manager Douglas,
Mayor Melchior, Councilmen Maclay,
.Meuser, Schrempf, Yount.
Mayor Melchior stated that this is
the regular monthly meeting of the
Council for the dispatch of such
business as may regularly come be-
fore the meeting.
Councilman Schrempf moved that
the rules be suspended to allow any-
one present to address the Council.
Seconded by Councilman Meuser.
Carried by the following vote:

Nays —None.
A petition of property owners was
then read asking that Plymouth
Street be not included in the 1927
street paving program: signed by
Walter Paisley, J. F. Stampfer Jr.,
C. H. Wilmot et al, signed by 12
property owners. Mr. Paisley ad-
dressed the Council relative to this
petition, stating that the street is
not traveled much and that it is in
good enough condition at present for
all the traffic that there is on it.
The Council will take the matter
under advisement. No motion.
Petition of A. A. Cooper Inc., ask-
ing that the assessment levied
against Lots 41- 40- 39 -38 -10 and parts
of Lots 37- 11 -9 -8 -7 in Cooper Heights
Add., for the improvement of West
5th Street from Bluff Street to what
was formerly John Street, be can-
celled. Total amount of assessment
against these lots is $1,582.46, claim-
ing that these lots receive no ben-
efits from this improvement.
Councilman Meuser moved that the
petition be received and filed. Sec-
onded by Councilman Maclay. Car-
ried by the following vote:

Petition of Kathryn Cooper, asking
that the assessment as levied against
City Lot S. 8 ft. part of Lot 617,
City Lot part of 616A, City Lot part
of 616, City Lot part of Lot 615, for
the improvement of West 5th Street
be cancelled, stating that before the
street improvement was started she
had filed a protest against the "im -
provement and that the property is
not benefitted by the improvement.
Councilman Meuser moved that
the petition be received and filed.
Seconded by Councilman Maclay.

Petition of C. A. Voelker stating
that Lot 33 in Voelker's Add. was
assessed in 1892 for the improve-
ment of Leibnitz Street in the
amount of $59.50; no payments have
been made on this assessment. An
attempt was made in 1921 to sell this
lot to the City for $74.53. For the
purpose of clearing the title in clos-
ing up the Estate of Chris A. Voel-
ker they offer to settle this assess-
ment for $25.00 and ask that the tax
sale certificate held by the City be
cancelled.
Councilman Maclay moved that
the prayer of the petition be granted
and the Treasurer be instructed ac-
cordingly. Seconded by Councilman
Meuser. Carried by the following

Petition of Conrad Mueller stating
that he is owner of Lots S B of 97,
McCraney's 1st Add., Lots 1 and 2
and B of 96, McCraney's 1st Add.,
Lots 1 and 2. The City holds the
tax sale certificate to this property,
dated Decmber 3rd, 1923; on July
29th the City paid the subsequent
regular tax on same for 'the year
1925. He hereby offers to pay all the
taxes and assessments with regular
interest at 6% and asks the City to
accept this and cancel the 8% in-
terest and penalty.
Councilman Maclay moved that the
prayer of the petition be granted and
the Treasurer be instructed accord-
ingly. Seconded by Councilman
Yount. Carried by the following

Gentlemen: The Hartig Drug Co.,
Inc., has made application for a per-
mit to sell cigarettes at 756 Main
Street, having moved to that address
from 630 Main Street at a recent
date. Under the state law, it is
necessary a new bond be filed and
a new permit issued.
Attached herewith is the bond
filed by the Hartig Drug Co. for your
approval.

A communication from the League
of Iowa Municipalities asking Cor-
poration Municipalities to make a
special effort to secure a part of the
motor vehicle license money and
gasoline tax money for the benefit
of cities and towns in Iowa. The
following resolution was read and
adopted.

Be it resolved, that we hereby em-

on all matters before the Legislature
in which Cities and Towns are inter-
ested, and the Clerk is hereby auth-
orized to draw a warrant in the sum

and claims that the assessment

Claim of Fred Fichter against the
City of Dubuque in the sum of
$2,000.00 filed by Kenline, Roedell,
Hoffmann & Tierney, his attorneys,
on account of personal injuries sus-
tained by him in falling on an icy
sidewalk December 18th, 1926, at 12
o'clock (noon) in front of Lot 1 of
775 on the east side of Highland
Place, being at the corner of High-
land Place and Arlington Streets,
(No. 480 Arlington Street).

Gentlemen: I hereby recommend
settlement in the following cases
now pending in the District Court of
Dubuque County, Iowa, on account of
damages resulting from personal in-
juries sustained in falls upon defec-
tive sidewalks:
Dan Delaney. Accident occurred
on November 26th, 1925, at the north-
east corner of 12th and Central Ave-
nue. Plaintiff broke bone in ankle
and brought suit for $1,500.00. I
would recommend settlement in the
sum of $250.00, and plaintiff to pay
the costs. Please have warrant
drawn in favor of Kane & Cooney,
attorneys for plaintiff, in the amount
stated.
Anna Montag. Plaintiff fell on
December 25th, 1925, at the south-
east corner of Main and 7th Streets.
and sustained a broken hip. Suit
was brought in the sum of $5,000.00
and I would recommend a settlement
in the sum of $450.00 and defendant's
costs, and a warrant be drawn for
that amount in favor of Hugh Stuart,
attorney for plaintiff.
I would recommend settlement of
the following claims:
Mary Uthe. Claimant fell in front
of the Federal Bakery on Main
Street on December 18th, 1925, and
broke her wrist. .I would recom-
mend the payment to her of the sum
of $106.75.
Nellie Kelly. Claimant fell on Feb-
ruary 26th, 1925, on the south side
of Grandview Avenue, near the
Washington High School, and broke
her arm. I would recommend pay-
ment to her in the sum of $58.00.
Sarah Cadden. Claimant fell on
Julien Avenue on November 19th,
1926, and broke her arm. I would
recommend payment to her of the
sum of $300.00.

Dubuque Add., levied in 1896 for the
improvement of Elm and Pine
Streets.

the recommendation of the City Soli
citor be approved and the Treasurer
be instructed to accept the various
amounts hereby offered and cancel
the assessments on the assessment

City Manager Douglas reported
that the Dubuque Electric Co., in-
formed him that the City owns a
lot at 8th and Pine Streets that
they could make use of to good
advantage and they hereby offer
to trade a lot situated across
the street for the one the City owns.

Dock Ordinance.
AN ORDINANCE prescribing rules
and regulations for the conduct
and management of the business
of the Department of Public
Docks.
Be it ordained by the Board of
Dodk Commissioners of the City of
Dubuque:
Section 1. That the Dock Board
shall maintain an office in the City
Hall of the City of Dubuque where
all meetings for the transaction of
its official,business shall be held.
Section 2. That the meetings of
said Board shall be held whenever
two members thereof shall issue a
call therefore; provided, however,
that a call for any meeting need not
be issued if all of the members of
the Board are present and consent
thereto. A permanent record shall
be kept by the Secretary of all meet-
ings and the business that was trans-
acted thereat. The meetings of said
Board shall be open to the public.
Section 3. That the City Manager
of the City of Dubuque be and he 'is
hereby appointed assistant to the
Secretary of the Board, for which
services he shall receive no compen-
sation.
Section 4. The Dock Board shall
keep a record of all of its proceed-
ings and acts and books of account
showing all of its financial trans-
actions, which records and books of
account shall at all times be open to
public inspection.
Section 5. The Dock Board shall
discharge all of the powers pre-
scribed by Chapter 303 of the Code
of Iowa, 1924, and all amendments
and additions thereto, as well as
such other powers as may be con-
tained within the general laws of
the State of Iowa; relating to the
administration of a Department of
Public Docks as the same now exist
or may hereafter be enacted.
Section 6. In order to carry out
the intent of the law, as the same
relates to the erection, construction
and maintenance of public docks and
all appurtenances thereto, said
Board shall: 1st: Cause to be pre-
pared a general plan for the improve-
ment of harbor and water front of
the City of Dubuque, making provis-
ion for the needs of commerce and
shipping and providing for the con-
struction of such docks, piers,
wharves, warehouses, belt railways
connecting with all railroad lines
within said city, and such cranes,
dock apparatus and machinery,
equipment as it may deem necessary
for the accommodation and handling
of water craft of all kinds and of
freight and the free interchange of
traffic between the waterway and
the railways and the waterways,
and to that end said Board may en-
gage the services of an engineer or
consulting engineer.
2nd. After such plan is prepared
said Board shall file the same in its
office where it shall be open to pub-
lic inspection, but said plan may be
changed, altered, or amended from
time to time as the requirements of
shipping and commerce may suggest.
3rd. Said Board may acquire per-
sonal property or real estate either
by condemnation or purchase and
hold the same in the name of the
City of Dubuque.
4th. Said Board shall have exclu-
sive charge and control of all wharf
property belonging to the City of
Dubuque.
5th. Said Board shall have exclu-
sive charge and control of the build-
ing, rebuilding, altering, repairing,
operation and leasing of all such
property and of the clearing, grad-
ing, paving, severing, dredging and
deepening necessary in and about
the same.
6th. Said Board shall have juris-
diction and authority over that part
of the streets and alleys and public
grounds of the City of Dubuque
which abut upon or intersect its
navigable waters, lying between the
harbor and the first intersecting
street, if any, measuring back from
high water mark, but only to the
extent of carrying out the powers
vested in it by law and as herein-
after further limited.
7th. Said board shall have exclu-
sive control of the harbor and water
front consistent with the laws of the
United States government relating
to navigation and of all wharf prop-
erty and structures located thereon
and all slips, basins and waters ad-
jacent thereto, and may make such
reasonable rules and regulations
governing the traffic thereon and the
use thereof, with the right to collect
reasonable dockage, wharfage, shed -
age, storage, cranage fees or tolls
thereon and the moneys thus collect-
ed shall be paid to the City Treas-
urer and by him credited to the
Dock Fund.
8th. From and after April 1, 1927,
all persons, firms or corporations
desiring to occupy space with build-
ings, structures or otherwise upon
the water front of the Mississippi

River below high water mark, shall
make application for permit there-
for to said Dock Board and such
Board may issue a permit in its dis-
cretion and may prescribe the space
to be occupied and the rental to be
paid therefor, which rental shall be
paid in advance, but all permits may
be revoked at any time by said
board; provided, however, that no-
thing herein contained shall be con-
strued to apply to any property or
buildings to which the owners there-
of hold title by lease or deed of
conveyance, and, provided, further
that nothing herein contained shall
be construed to apply to the occu-
pants of property occupying the
same under an irrevocable license
or grant heretofore given by the
City of Dubuque.
9th. No new structures or repairs
upon or along said water front shall
be undertaken except upon applica-
tion to the board and upon permit
by it. Before such permit shall be
granted plans and specifications of
the proposed structure shall first be
submitted to said board and ap-
proved by it.
10th. The Board shall fix, regu-
late and make, and from time to
time alter the tolls fees, dockage,
wharfage, cranage, sheddage, stor-
age and all other charges for public
owned docks, levees, belt railways,
wharves and their equipment, or the
use of the water front of the City
of Dubuque, which charges and rents
shall be collected by said Board.
11th. The Board shall enact, by
ordinance, a schedule of such
charges and regulations and a copy
thereof shall be kept in a conspic-
uous place in the office Of the Board.
12th. The Board shall engage such
assistants, employees, clerks, work-
men and laborers as may be neces-
sary in the efficient and economical
performance of all work connected
with the operation, supervision and
government of all property within
its jurisdiction and under its con-
trol. All officers, places and em-
ployers in the permanent service of
the Board shall be provided for by
an ordinance duly passed by said
Board.
13th. Ordinances shall be adopted
by the Board after the same have
been read on at least two separate
days, but this rule may be suspended
by the afrirmnative vote of at least
two members. No ordinance shall
be adopted until not less than a
week has intervened before final
reading. A majority of the Board
voting in favor of the adoption of
the ordinance shall be sufficient to
pass it. No ordinance shall go into
effect until it has been certified to
by the City Clerk of the City of
Dubuque by the President and Sec-
retary of the Board and published
by said clerk, who shall also cause
the same to be recorded in a book
kept for that purpose. A copy of
all ordinances shall be preserved in
a book of proceedings kept by the
Secretary of said Board.
14th. Before the Board shall con-
struct docks, levees, wharves and
their appurtenances and in contract-
ing for the construction of any work
or structure authorized by Chapter
303 of the Code of Iowa, 1924, it shall
have full and complete plans and
specifications prepared therefor and
approved by it, except when the cost
is $500.00 or less, which plans and
specifications shall be filed in the
office of the Board and be at all
times open to public inspection.
Public notice asking for bids for the
construction of such work, based up-
on such plans and specifications,
shall be published by the President
and Secretary of said Board in some
newspaper or newspapers of general
circulation published within the City
of Dubuque. Said publication shall
be made at least 30 days before the
time fixed for the opening of bids
and construction of such work. The
contract may then be let to the low-
est responsible bidder, unless the
Board deems the bids excessive or
unsuitable, in which event it may re-
advertise for bids. All bids shall be
accompanied by a certified check up-
on some solvent bank and shall be
in the amount of not less than 5%
of the bid submitted. The amount
of such check shall be forfeited as
agreed liquidated damages in the
event the successful bidder shall fail
or refuse to enter into a contract if
awarded to him within ten days af-
ter the award has been made, or
should fail or refuse to provide a
performance bond, as herein stated.
Where a contract has been awarded
by the Board, the contractor shall
furnish the Board with a satisfac-
tory surety bond in an amount not
less than 75% of the total contract
price as a guaranty that he will per-
form the work and construct the
improvement in the manner and
within the time provided for in the
contract and plans and specifica-
tions. The bond shall be in the
form prescribed by said Board. The
contract shall be executed by the
President and Secretary of the
Board.
15th. Before any contract is
awarded which is to cost $5,000.00 or
more, the Board shall adopt pro-
posed plans and specifications and
proposed form of contract therefor,
fix a time and place for hearing

thereon, and give notice thereof by
publication in at least one news-
paper of general circulation in the
City of Dubuque at least 10 days be-
lore such hearing. At such hearing
any interested person may appear
and file objections to the proposed
plans and specifications or contract
for, or cost of such improvement.
The Board shall consider such objec-
tions and enter of record its decision
thereon.
16th. In the event bids are re-
jected as excessive, unreasonable or
for any other reason and the Board
does not decide to re- advertise, the
Board may do the work directly by
purchasing such materials and con-
tracting for such labor as may be
necessary without further notice or
proposals for bids; provided, how-
ever, that no purchase of materials
shall be made where the same ex-
ceeds $500.00 except only by public
letting upon ten days' notice, pub-
lished as herein stated, specifying
the materials proposed to be pur-
chased. If, however, no satisfactory
bid is then received for such mater-
ials, or in case of emergency, the.
Board may purchase the same, but
no greater amount shall be paid
therefor than was contained within
the lowest bid submitted. The Board
shall always have the right to reject
any or all bids, and such fact must
be stated in all advertisements for
bids.
Section 7. The Board shall an-
nually on or before the 1st day of
July make a report to the City Coun-
cil showing the receipts and dis-
bursements made by it, and file at
the same time an estimate of the
amounts necessary to be raised by
taxation, if any, to defray the ex-
penses of the Board.
Section 8. Whenever said Board
shall deem it necessary or advisable
to issue bonds for the purpose of
constructing any of the works or
improvements which it has the pow-
er to construct, or for the purchase
of property which it has the power
to buy, it shall petition the City
Council to issue such bonds, stating
the purpose for which said bonds
are required.
Section 9. All funds collected by
the Dock Board, or by the City of
Dubuque for dock purposes from the
proceeds of taxes, bonds or other-
wise, shall be deposited with the
City Treasurer and disbursed by him
Only upon warrants or orders duly
signed by the President and counter-
signed by the Secretary of the Dock
Board and such warrants or orders
shall state distinctly the purpose for
which the same are drawn, and a
permanent record shall be kept by
the Board of all warrants or orders
so drawn, showing the date, amount,
consideration and to whom payable.
The fund into which all moneys shall
be deposited shall be designated as
the Dock Fund.
Section 10. The books of the
Board shall be audited by the City
Auditor at such times and in stich
manner as the City Council may
direct.
Section 11. All of the hooks and
records of the Board shall be at all
times open to public inspection.
Section 12. This ordinance shall
be in force and effect from and after
its final passage and adoption by the
members of the Dock Board and af-
ter the same has been duly certified
to by the City Clerk and by him pub-
lished as herein provided.

RESOLUTION for a petition to the
City Council of the City of Du-
buque for the issuance of bonds.
Whereas, this Dock Board of the
City of Dubuque, Dubuque County,
Iowa, has heretofore, pursuant to
the provisions of Chapter 303 of the
Code of Iowa, 1924, caused to be
prepared a comprehensive general
plan for the improvement of the har-
bor and water front of said City by
making provision for the needs of
commerce and shipping, by con-
structing docks, basins, piers, quay
walls, wharves, warehouses and
such cranes, dock apparatus and
machinery equipment as may be nec-
essary for the convenient and ac-
curate accommodation and handling
of water craft of all kinds and the
free interchange of traffic between
the waterway and the railways,
which comprehensive general plan
has been on file in the office of this
Dock Board and open to public in-
spection; and
Whereas, estimates have been pre-
pared and filed with this Dock Board
showing the aggregate cost of such
works and improvements together
with the purchasing of such prop-
erty as may be necessary for said
purpose, and it has been determined
that such cost will be in excess of
$150,000; and
Whereas, this Dock Board deems
it necessary andadvisable that bonds
of said City of Dubuque be issued
for the purpose of the works and
improvements contemplated by said
general plan or as said general plan
may from time to time be changed,
altered or amended;
Now, therefore, be it resolved by
the Dock Board of the City of Du-
buque, Dubuque County, Iowa, as
follows:
Section 1. That this Dock Board
petition the City Council of said
City of Dubuque to issue bonds of
said City in the principal amount
of $150,000 for the purpose of con-
structing the works and improve-
ments hereinbefore referred to and
purchasing such property as may be
necessary for said purposes, said
petition to be in substantially the fol-
lowing form:

of Public Docks constituting the
Dock Board of the City of Dubuque,

(2) mills on the dollar of valuation

lected each year at the same time
and in the same manner as and with
and in addition to all other taxes

lected shall be converted into a
special fund.

on the 17th day of January, 1927, at

Hall, within said City at 4:30 o'clock
P. M. at which time and place any
person subject to such tax shall be
heard in favor or against the, same
or any part thereof.
Section 4. That the Mayor and
City Clerk are hereby directed to
give notice of said supplemental es-
timate, setting forth the time when
and the place where said hearing
will be held, by publication at least
ten days before said hearing in the
Telegraph- Herald, a newspaper pub-
lished in said City. Said notice
shall be in substantially the follow-

The City Clerk presented a peti-
tion of the Dock Board of said City,

City, which petition was duly con-
sidered by the City Council and
found to be legally sufficient.
Thereupon Councilman Maclay in-
troduced and caused to be read a
resolution hereinafter set out en-
titled, "Resolution proposing a sup-
plemental estimate of dock fund
taxes" and moved its adoption; sec-
onded by Councilman Yount. After
due consideration of said resolution
by the Council, the Mayor put the
question and upon the roll being
called the following voted:

Whereas, this City Council of the
City of Dubuque, in the County of
Dubuque, and State of Iowa, a City
situated on a natural navigable wa-
terway upon the state of Iowa, here-
tofore pursuant to and in strict com-
pliance with all laws applicable and
particularly Chapter 303 of the Code
of Iowa, 1924, has lawfully created
a department known as the Depart-
ment of Public Docks to be adminis-
tered by the Dock Board of said
city; and
Whereas, said Dock Board has
caused to be prepared a comprehen-
sive general plan for the improve-
ment of the harbor and water front
of said City and has petitioned this
City Council to issue the bonds of
said City in the principal amount
of $150,000 for the purpose of con-
structing the works and improve-
ments and purchasing property to
be used in connection therewith:
and
Whereas, it is deemed necessary
and advisable that said bonds be
issued at this time and it has been
found that by the issuance of said
bonds in the principal amount of
$150,000 said City will not thereby
become indebted in excess of any
constitutional or statutory limits of
indebtedness, or taxation; and
Whereas, it is necessary and ad-
visable to make provision for the
payment of said bonds and to make
a supplemental estimate for taxes
for future years pursuant to the pro-
visions of Chapter 24 of the Code of
Iowa, 1924, as amended;
Now, therefore, be it resolved, by

Dear Sir: Some time ago I wrote
to you and also spoke to you about
the bill filed with the City by the
James F. Lee Paving Company for
grading done in the Cooper Addition.
The amount of this bill is $331.03.
I have investigated the facts sur-
rounding this claim and am satisfied
that it should be paid. However,
the City is not obligated to pay the
same because the A. A. Cooper In-
corporated agreed to pay all expense
of improving this subdivision. By an
error this amount was not included
within the original assessment.
I am writing to you to request
that you arrange to pay this bill
either to the City or to Mr. Lee
within the next few days. It is my
duty also to advise you that unless
the bill is paid the Council will levy
an assessment upon the property
within the subdivision for the
amount of this bill and you will be
required then to pay interest upon
the account. Maybe that is the way
you want it handled, but at any rate
I must know what your intentions
are with respect to the claim within
the next four days, on or before
November 24, 1926. I trust you will
give this your attention and oblige.

AN ORDINANCE providing for an
Annual Tax for Dock Purposes
and declaring an emergency.
Whereas, the Dock Board of the
City of Dubuque, in the County of
Dubuque, and State of Iowa, has
heretofore petitioned this City Coun-
cil of said City to issue bonds of
said City in the principal amount of
$150,000 for the purpose of construct-
ing works and improvements for the
harbor and water front in said City
and the purchase of property for
said purpose, and it is now available
to make provision with respect to
the levying of taxes to pay said
bonds.
Now, therefore, be it Ordained by
the City Council of the City of Du-
buque:
Section 1. That in pursuance of
Paragraph 10 of Section 5902 of the
Code of Iowa, 1924, there shall be
and there is hereby levied in each
of the years. 1927 to 1936, inclusive,
and there shall be assessed and col-
lected in each of the years 1928 to
1937, inclusive, a direct annual tax
upon all the taxable property with-
in said City of two (2) mills on the
dollar, or such portion thereof as
may be necessary to produce the net
annual sum of $19,576.50 each year.
Section 2. Said taxes shall be
collected each year at the same time
and in the same manner, and in ad-
dition to all other taxes in and for
said City, and when collected shall
be converted into a special fund
which is hereby pledged for and
shall be used only to pay the prin-
cipal and interest of Dock Bonds of
said City presently proposed to be
issued.
Section 3. That a certified copy
of this ordinance be filed with the
County Auditor of Dubuque County
and that said Auditor be and he is
hereby instructed in and for each
of the years 1927 to 1936, inclusive,
to levy and assess the tax hereby
authorized.
Section 4. That all ordinances or
resolutions or parts thereof in con-
flict herewith be and the same are
hereby repealed.
Section 5. That it is hereby found
and declared that an emergency ex-
ists and that it is necessary for the
immediate preservation of the pub-
lic peace, health and safety that this
ordinance become effective upon its
passage, approval and publication,
and it is so ordered.

RESOLUTION providing for the is-
suance of bonds in the sum of

Whereas, this City Council of the
City of Dubuque, in the County of
Dubuque, State of Iowa, has hereto-
fore been petitioned by the Dock
Board of said City to issue the bonds
of said City in the principal amount
of $150,000 for the purpose of con-
structing works and improvements
for the harbor and water front in
said City and the purchase of prop-
erty for said purpose; and
Whereas, the issuing of said bonds
will not cause said City to become
indebted in excess of the limit im-
posed by Section 3 of Article 11 of
the Constitution of Iowa, and it is
now advisable to make provision for
the issuance of said bonds;
Now therefore, be it resolved by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That bonds of said
City in the amount of One Hundred
Fifty Thousand Dollars ($150,000) be
issued pursuant to the provisions of
Paragraph 11 of Chapter 303 of the
Code of Iowa, 1924; that each of
said bonds be designated as a "Dock
Bond ", be one hundred fifty (150) in
number, numbered from 1 to 150 in-
clusive, be of the denomination of
$1,000 each, bear date of January 1,
1927, and bear interest at the rate
of four and one -half per centum
(4'/ per annum from the date of
said bonds until payment thereof,
payable July 1, 1927, and semi -an-
nually thereafter on the first days of
January and July in each year; that
said bonds be signed by the Mayor
and attested by the City Clerk, and
the seal of said City be attached,
and be registered by the City Treas-
urer, and a certificate of registration
endorsed thereon; that interest on
said bonds be evidenced by coupons
thereto attached and maturing on
the several days when such inter-
est matures, such coupons to be ex-
ecuted with the facsimile signatures
of said Mayor and City Clerk and
said officials, by the execution of
said bonds, shall adopt as and for
their own proper signatures their
facsimile signatures appearing on
each of said coupons, and that both
principal and interest be payable at

Councilman Maclay moved that
the rule requiring ordinances of a
certain character to be fully and
distinctly read on three different
days be suspended by a three- fourths
vote and that said ordinance be now
placed upon its final adoption.
Councilman Meuser seconded the
motion, and after due consideration
thereof by the Council the Mayor
put the question on the motion and
upon the roll being called the fol-

The Council took up for consider-
ation the resolution entitled "Reso-
lution providing for the issuance of
bonds in the sum of $150,000 for
dock purposes" which had been
filed with the City Clerk for public
inspection since Jan. 17th, 1927.
Councilman Maclay moved that
said resolution be adopted, second-
ed by Councilman Meuser, and after
due consideration thereof by the
Council, the Mayor put the question
on the passage and adoption of said
resolution and the roll being called

Whereas, a plat and schedule has
been duly prepared by the City
Council of the City of Dubuque and
now on file in the office of the Clerk
thereof, showing the boundaries of
the district, the streets to be im-
proved, the width of the improve-
ments, each lot proposed to be as-
sessed, an estimate of the cost of the
proposed improvement for each dif-
ferent type of construction and kind
of material to be used, and in each
case the amount thereof which is
estimated will be assessed against

Be it, therefore, resolved by the
City Council of the City of Dubuque,

Alta Vista Street from the end of
present improvement at Alta Vista
and Kirkwood Streets about 100 feet
north.

sist of grading, paving, curb and
gutter, such curb and gutter to be
constructed of concrete or old curb

the district, the streets to be im-
proved, the width of the improve-
ments, each lot proposed to be as-
sessed, an estimate of the cost of
the proposed improvement for each
different type of construction and
kind of material to be used, and in
each case the amount thereof which
is estimated will be assessed against
each lot, for the improvement of the
streets named in this resolution.
Be it, therefore, resolved by the
City Council of the City of Dubuque,
Iowa, on its own motion:
That it is deemed necessary and
advisable to build, construct and put
in place certain street improve-
ments, as hereinafter described, in,
upon and along the following streets,
to -wit:
Plymouth Street, Linden Street and
Victoria Street from Plymouth
Street to the north line of Lot 40,
Grand View Heights Add., all in
Grandview Heights Add.
Said street improvement shall con-
sist of grading, paving, curb and
gutter, such curb and gutter to be
constructed of concrete or old curb
reset, if advisable, and the paving
to be constructed of one or more of
the following materials and methods,
to -wit:
By paving with sheet asphalt or
6 -inch concrete.
Said paving, curb and gutter shall
be constructed, and all grading done
in strict accordance with the plans
and specifications therefor, which
have been prepared by the City
Engineer and approved by the City
Council and Manager.
That the cost and expense of mak-
ing and constructing said improve-
ments shall be assessed upon and
aganist all privately owned property
whether abutting or not and lying
within the assessable distance pre-
scribed by law, according to the area
thereof, and in proportion to the
special benefits conferred, and any
deficiency shall be paid out of the
General Fund or Improvement Fund
and bonds shall be issued and 'sold
in anticipation of deferred payment
of assessments and the proceeds
thereof used to pay the contractor.
The railway portion of said street
shall be assessed to and paid by
said street railway.
Be it further resolved that the
above and foregoing street improve-
ments are hereby proposed to be
made and constructed as herein -
before set forth, and that this pro-
posed resolution, except this para-
graph, be and the same is hereby
set down for further and final hear-
ing, consideration and determination
at a meeting of this Council to be
held on the 14th day of February,
1927, at 4:30 o'clock P. M., in the
Council Chamber of the City Hall of
this city, and the City Clerk be and
he is hereby instructed to cause no-
tice of the pendency of the above
resolution, and of the time and place
when and where said proposed reso-
lution will be considered for pass-
age, to be given for publication in
the official newspapers of said city,
in the manner and for the time pre-
scribed by law, at which time the
owners of property subject to assess -

The City Solicitor reported on the
petition of Louisa Boldt referred to
him at a previous meeting. He re-
ports and recommends that on the
gas connections levied against south
565 feet of lot 5 Hosford's Sub., as-
sessed $27.26, plus $2.36, plus 75c,
totaling $30.77, that the City accept
this amount in settlement of this as-
sessment without further penalty or
interest.
Councilman Maclay moved that

view Avenue in 1912 there was an
assessment of $123.51 each against
lots 12 and 14 Grandview Heights
Add., owned by the Voelker Realty
Co. The City holds tax sale cer-
tificates dated Sept. 9th, 1921. They
hereby offer $35.00 each in surrend-
er of same. The City Solicitor rec-
ommends that the City accept this
offer.

licitor be approved and the Treas-
urer be notified to accept said sums
of $35.00 each and upon receipt of
same surrender the tax sale cer-

property at tax sale Dec. 7th, 1925
for special 2nd assessment $39.35
and paid subsequent taxes July 29th
$140.64, and third installment $44.30.
Total paid by City $224.29. She
hereby petitions the Council to can-
cel the 8 per cent interest and 8
per cent penalty and allow her to
redeem this at the straight rate of
6 per cent interest. On recommend-
ation of the City Solicitor the pe-
tition was received and filed.

Ordinance No. 183
An Ordinance amending an Ord-
inance entitled, "An Ordinance es-
tablishing a Building Code for the
City of Dubuque, creating the office
of building commissioner, fixing the
salary of said officer and defining
the powers and duties of such build-
ing commissioner, prescribing pen-
alties for violation thereof. The
same being known as the building
code of the city of Dubuque, Iowa,"
presented and read.

this be considered the first reading
of the Ordinance. Seconded by Coun-
