Regular Session, March 7th, 1927
Council met at 4:30 P. M.
Present, City Manager Douglas,
Mayor Melchior, Councilmen Maclay,
Meuser, Schrempf, Yount.
Mayor Melchior stated that this is
the regular monthly meeting of the
City Council for the purpose of tran-
sacting such business as may prop-
erly come before it, and that this
date has also been set for the pur-
pose of instituting proceedings and
taking action for the issuance of ad -.
ditional Dock Bonds of said City in
the amount of $217,000 for the pur-
pose of constructing works and im-
provements for the harbor and water,
front in said City and purchase of
property for said purpose. It is pro-
posed that of the $150,000 Dock
Bonds heretofore authorized but not
sold or delivered there be issued
only $65,000 of said Dock Bonds and
that proceedings heretofore had for
the issuance of the remaining $85,000
of said bonds be abandoned and that
in lieu of the issuance of said $85,000
of bonds there be issued additional
bonds in the amount of $217,000 so
as to thus produce the necessary
funds in the aggregate amount of
$282,000.
At any time before the date of
said meeting five or more taxpayers
may file a petition in the office of the
City Clerk, setting forth their ob-
jections as relates to said bonds in
the amount of $217,000.

The City Council of the City of
Dubuque met in regular session at
the City Hall in said city at 4:30
' o'clock P. M. The meeting was
called to order and there were pres-
ent H. G. Melchior, Mayor, in the
chair, and the following named
Councilmen: Maclay, Meuser,
Schrempf, Yount.
Absent: None.
This being the time and place
fixed by published notice, the Coun-
cil took up for consideration the mat-
ter of issuing $217,000 Dock Bonds
and found that notice of intention to
take action for the issuance of said
bonds and of the time and place of
this meeting had, according to law
and as directed by this Council, been
published on the 24th day of Feb-
ruary, 1927, in the Telegraph - Herald,
a newspaper of general circulation
published in said City, and that an
affidavit of publication of said notice
is now on file with the City Clerk as
part of the records of this City
Council.
No petition setting forth objections
to said proposed action having been
filed, Councilman Maclay introduced
and caused to be read an ordinance
authorizing the issuance of said
bonds and making provision for the
payment of same, entitled "Ordi-
nance No. 184. An Ordinance auth-
orizing the issuance of $217,000 Dock
Bonds, providing for the payment of
same and declaring an .emergency."
It was moved and seconded that
the rule requiring ordinances of a
'certain character to be fully and dis-
tinctly read on three different days
be suspended by a three - fourths
vote, and that said ordinance be
passed to its second reading. The
Mayor put the question on the mo-
tion and upon the roll being called
the following named councilmen
voted: Aye: Melchior, Maclay,
Meuser, Schrempf, Yount. Nays;
None.
Whereupon the Mayor declared

said motion duly carried and said
ordinance passed on the second read-
ing.
Councilman Maclay moved that
said ordinance be filed with the City
Clerk for public inspection for at
least one week before further con-
sideration or passage and approval;
seconded by Councilman Yount. The
Mayor put the question on the mo-
tion and the roll being called the
following named Councilmen voted:
Aye: Melchior, Maclay, Meuser,
Schrempf, Yount. Nays: None.
Whereupon the Mayor declared the
motion duly carried and said ordi-
nance was ordered placed on file
with the City Clerk.

Councilman Schrempf moved that
the rules be suspended for the pur-
pose of giving anyone present who
wished to do so an opportunity to
address the Council. Seconded by
Councilman Yount. Carried by the
following vote:

Mrs. Kempf addressed the Council,
explaining the bad condition of the
steps at the east end of Mt. Loretta
Ave., stating that these steps are
used by a great many working peo-
ple, that it saves them from walking
the length of said Mt. Loretta Ave. to
Bryant Street, and then down Bryant
and Dodge Streets a distance of sev-
eral miles, and she hereby on behalf
of the residents of this district asks
the City Council to construct new
concrete steps to replace the old
dilapidated wooden steps which have
been condemned by the City. She
was informed that this matter will
be looked into. No motion.
Notice of Claim against the City,
filed by J. H. McDonald, in the sum
of $175.00 on account of personal in-
juries sustained by falling on an icy
street crossing at 8th and Bluff
Streets.

the petition be referred to the City
Solicitor. Seconded by Councilman

Petition of residents and taxpay-
ers living on South Locust Street,
asking that the City cause to be con-
structed a new cement sidewalk in
front of and abutting lot 1 of Sub.
City lot 578a -579, and City lot 578.
This property is owned by Mrs. Mar-
garet Pier Millin. The walk at pres-
ent is in a very bad and dangerous
condition, and in case of accident
the City would be liable to damage
suits. Signed by John Mahoney,

Petition of property owners and
residents on Sheridan Street, from
O'Neil to Davis Streets, stating that
the street is almost impassable, and
they hereby ask that the City place
cinders on the street so that people
can get to their homes. Councilman
Schrempf moved that the matter be
referred to the City Manager and
Engineer. Seconded by Councilman
Yount. Carried by the following
vote:

Petition of Ed. Thompson, request-
ing that he be permitted to operate
a popcorn, peanut and ice cream
wagon on the streets of the city and
that he be exempted, from paying a
license, being an old veteran, and
unable to do heavy work.
Councilman Meuser moved that the
prayer of the petition be granted.
Seconded by Councilman Yount.

To the Honorable Mayor and Council
of the City of Dubuque.
Gentlemen:
Mrs. Geo. L. Kirby, as assignee of
a claim of Geo. L. Kirby, has brought
suit in the District Court of Dubuque
County, Iowa, claiming of the City
$300.00 on account of damages sus-
tained by the removal of a fence
located on her property. I have
effected a settlement with the plain-
tiff and agree to pay her the sum

of $150.00 in full settlement of said
claim, she to pay costs of the suit.
I would recommend that a warrant
be drawn in favor of John L. Duffy,
attorney for plaintiff, in the sum of
$150.00.

City of Dubuque.
Gentlemen:
Some time ago the Temple Securi-
ties Co., a corporation, arranged
with the City Council for the can-
cellation of special assessments
heretofore levied against the sub-
division of lot 1 and the Subdivision
of lot 2 of the Subdivision of lot 8 in
D. N. Cooley's Subdivision of part of
outlots 667 -668 and 669 in the City
of Dubuque, which lots were assess-
ed for the improvement of Montrose
Terrace in the City of Dubuque.
This deed has been prepared and
herewith returned. I would recom-
mend that the same be accepted and
recorded.

Gentlemen:
The petition of J. F. Kircher ask-
ing for the cancellation of tax cer-
tificate held by the City on lot 14,
Simpson's Add., has been referred to
me for investigation and report. I
beg to advise you that this tax cer-
tificate should be cancelled in view
of the fact that the lot had been
previously sold in 1911 for delin-
quent taxes which were delinquent
prior to the date of said previous
sale.
This certificate should be assigned

to the owner cf the lot so that he
may have the same cancelled.

is hereby called a special meeting of
the City Council of the City of Du-
buque, Iowa, to be held at 4:30
o'clock P. M., in the Council Cham-
bers in the City Hall, on the 14th
day of March, 1927. This meeting
will be held for the purpose of tak-
ing up for final consideration and
action an ordinance entitled "Ordi-
nance No. 184. An Ordinance auth-
orizing the issuance of $217,000
Dock Bonds, providing for the pay-
ment of same and declaring an em-
ergency"; also for the purpose of
considering and acting upon bids
which have been received from bond
buyers for the sale of $65,000 Dock

Whereas, notice of sale of sixty -
five Thousand Dollars ($65,000)
Dock Bonds of the City of Du-
buque, Dubuque County, Iowa has
heretofore been given in strict com-
pliance with the provision of Chap-
ter 63 of the Code of Iowa, 1924, by
publication of notice for two or
more successive weeks in one of the
official newspapers of Dubuque
County; and
Whereas, all sealed bids have
been received and placed on file,
after which open bids were called
for and received, the highest of
which was as follows: Par and ac-
crued interest and $730.00, and there-
after such sealed bids were opened,
the substance of the best sealed bid
being par, plus accrued interest and
premium of $726.05.
Now, therefore, Be it resolved by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That upon being advised
in the premises it is hereby deter-
mined that the bid of Geo. Bechtel
& Co., Davenport, Iowa, for the pur-
chase of Sixty -five Thousand ($65,-
000) Dock Bonds, is the highest and
best bid received, and that said
bonds be and the same are hereby
awarded to said Geo.. Bechtel &
Co.
Section 2. That the form of agree-
ment of sale of said bonds to Geo.
Bechtel & Co., be and the same is
hereby approved, and the Mayor,
City Clerk and City Treasurer are
hereby authorized to execute said
agreement for and on behalf of
the City of Dubuque, Iowa, and to
affix the corporate seal of said City
thereto.
Section 3. That all resolutions or
parts of resolutions in conflict here-
with be and the same are hereby re-
pealed.

The City Council of the City of
Dubuque met in regular session at
the City Hall in said City at 4:30
o'clock P. M. The meeting was call-
ed to order and there were present
H. G. Melchior, Mayor, in the chair,
and the following named Council-
men: Schrempf, Maclay, Meuser,
Yount.
Absent: None.
This being the time and place
fixed by published notice the Council
took up for consideration the matter
of bids for the purchase of $65,000
Dock Bonds of said City. After the
receipt of sealed bids and the calling
for open bids, the results thereof
were incorporated in a resolution en-
titled, "Resolution providing for the
sale and award of $65,000 Dock
Bonds and approving and authorizing
the agreement of such sale and
award," which was introduced by
Councilman Meuser, who moved that
said resolution be placed on file
with the City Clerk for public in-
spection, seconded by Councilman
Yount, and the roll being called the
following vote:

Whereupon the Mayor declared
said motion duly carried and ordered
said resolution placed on file with

ORDINANCE NO. 184.
An Ordinance authorizing the issu-
ance of $217,000 Dock Bonds, pro-
viding for the payment of same
and declaring an emergency.
Whereas, this City Council of the
City of Dubuque, in the County of
Dubuque, State of Iowa, has hereto-
fore been petitioned by the Dock
Board of said City to issue the bonds
of said city in the principal amount
of $217,000 for the purpose of con-
structing works and improvements
for the harbor and water front in
said city and the purchose of prop-
erty for said purpose; and
Whereas, the issuing of said bonds
will not cause said City to become
indebted in excess of the limit im-
posed by Section 3 of Article 11 of
the Constitution of Iowa, and it is
now advisable to make provision for
the issuance of said bonds;
Now, Therefore, Be it Ordained by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That bonds of said City
in the amount of Two Hundred Sev-
enteen Thousand Dollars ($217,000)
be issued pursuant to the provisions
of Paragraph 11 of Chapter 303 of
the Code of Iowa, 1924, as amended;
that each of said bonds be designat-
ed as a "Dock Bond," be two hun-
dred seventeen (217) in number,
numbered from 1 to 217 inclusive, be
of the denomination of $1,000 each,
bear date of April 1, 1927, and bear
interest at the rate of four and one -
half per centum (41) per annum
from the date of said bonds until
payment thereof, payable January
1, 1928, and semi - annually thereafter
on the first days of January and July
in each year; that said bonds be
signed by the Mayor and attested by
the City Clerk, and the seal of said
City be attached, and be registered
by the City Treasurer, and a cer-
tificate of registration endorsed
thereon; that interest on said bonds
be evidenced by coupons thereto at-
tached and maturing on the several
days when such interest matures,
such coupons to be executed with
the facsimile signatures of said
Mayor and City Clerk, and said of-
ficials be the execution of said
bonds, shall adopt as and for their
own proper signature their respec-
tive fac - simile signatures appearing
on each of said coupons, and that
both principal and interest be pay-
able at the office of the City Treas-
urer in the City of Dubuque, State
of Iowa, said bonds shall become
due and payable in numerical order

and performed in regular and due
form and time; that the faith, credit,
revenues and resources and all the
real and personal property of said
City are irrevocably pledged for the
regular and due levy, collection and
proper appliance of a tax which
does not exceed the rate authorized
by law, on all the taxable property
within said City for the payment of
the principal and interest of said
series of bonds; and that the total
indebtedness of said City, including
this bond, does not exceed the con-
stitutional or satutory limitations of
indebtedness.
In Testimony Whereof, said City,
by its Council, has caused this bond
to be signed by its Mayor and at-
tested by its City Clerk, with the
seal of said City affixed and the cou-
pons hereto attached to be executed
with the fac- simile signatures of said
Mayor and City Clerk, and said of-
ficials, by the execution of this bond,
do adopt as and for their own proper

Section 3. That when said bonds

have been executed, as aforesaid,
they shall be delivered to the Treas-
urer of said City who shall register
the same in a book provided for that
purpose and shall thereupon deliver
said bonds to the purchasers as may
hereafter be determined by this
Council, upon receipt of the purchase
price, the same to be not less than
the par value of said bonds with ac-
crued interest thereon.
Section 4. That in pursuance of
Chapter 303 of the Code of Iowa,
1924, as amended, there shall be and
there is hereby appropriated and
there shall be annually levied in
each of the years 1927 to 1945 inclu-
sive, for collection in each of the
years 1928 to 1946 inclusive, respec-
tively, a direct annual tax on all of
the taxable property in said City suf-
ficient to pay the interest on said
bonds as the same become due and
to accumulate a sinking fund to pay
the principal of said bonds as the
same mature. Said taxes shall be
collected each year at the same time
and in the same manner and in ad-
dition to all other taxes in and for
said City and when collected shall be
converted into a special fund which
is hereby pledged for and shall be
used only to pay the principal and
interest of said bonds, and the full
faith, credit, revenue and resources
and all the real estate and personal
property of the City shall be and are
hereby irrevocably pledged for the
regular and due levy, collection and
proper application of said tax.
Section 5. That it is deemed nec-
essary and advisable that only
$65,000 Dock Bonds of the issue
heretofore authorized in the prin-
cipal amount of $150,000 be sold and
delivered, and that further action
under the proceedings heretofore
had for the issuance of the remain-
ing $85,000 of said bonds be and the
same is hereby abandoned and that
in lieu of the issuance of said $85,000
of bonds, the Dock Bonds of said
City in the amount of $217,000 be is-
sued as hereinbefore authorized so
as to result in the issuance of Dock
Bonds in the aggregate principal
amount of $282,000.
That because, of the abandonment
of the proceedings heretofore had
for the issuance of the remaining
$85,000 of Dock Bonds as aforesaid
and the issuance of bonds in the
principal amount of $217,000 herein -
before authorized, it is hereby found
and declared that the tax necessary
to pay the principal and interest of
said Dock Bonds in the aggregate
amount of $282,000 is to be at such
claim be referred to the City Man-
ager and Superintendent of the City
Waterworks for investigation. Sec-

that he can pay and settle this mat-

property are as follows: Sewer in
South Hill Street, $81.02; Grandview
Ave. improvement, $638.85; sidewalk
in South Hill Street, 160.65. The
assessor assessed this property for
taxation purposes at $500.00. He
claims that the assessments for the
improvements are much too high,
and therefore asks that this matter
be adjusted.

Herbert McCabe addressed the
Council on behalf of the American
Legion, stating that the Legion had
made a contract with a Carnival
Company to exhibit in this City some
time in May, and that they also
have the sanction of 75 per cent of
the abutting property owners near
Olinger Park, as provided for in the
Ordinance, and that they hereby ask
the Council to defer action on the
proposed amending of the Ordinance,
whereby Carnival Companies will be
prohibited from exhibiting in the
residence districts, until after the
company with whom the Legion has
a contract has fulfilled its contract.

M., and
Whereas, some members of the
different labor organizations would
like to attend some of the meetings
of the City Council of the City of
Dubuque, Iowa.
Therefore be it resolved, by the
members of the Dubuque Trades and
Labor Congress, that we do hereby
respectfully ask the City Council of
the City of Dubuque, Iowa, to hold
their meetings after 7 o'clock P. M.
so as to give all citizens of Dubuque,
who wish to attend their meetings,
without having to lose the time and

Messrs. Adams, Kuehnle, Freeman,
Conlon and Scherr, addressed the
Council relative to the paving of
Plymouth Street, stating that they
want this street paved, and that if
the property owners on the extreme
end of this street do not want the
street improved, they suggest that
the City improve it to where the ob-
jectors' property begins, and they
hereby ask that the Council recon-
sider their former action in this
matter.
Councilman Meuser moved that
this matter be preferred to the Coun-
cil for reconsideration. Seconded by

Mr. Williams addressed the Coun-
cil asking that the Council allow him
to install a gasoline curb pump in
the alley in the rear of the new
Kassler building on 5th and White
Streets, stating that the pmp would
be close to the building and would
not project into the alley as far
as a telephone pole which is lo-
cated there.

City Council, and the City Clerk he
and he is hereby directed to publish
said Budget in the official newspa-
pers of the City at least once, two
weeks in advance of a meeting to be

and award of $65,000 Dock Bonds
and approving and authorizing the
agreement of such sale and award.
Whereas, notice of sale of Sixty -
five Thousand Dollars ($65,000) Dock
Bonds of the City of Dubuque, Du-
buque County, Iowa, has heretofore
been given in strict compliance with
the provision of Chapter 63 of the
Code of Iowa, 1924, by .publication
of notice for two or more successive
weeks in one of the official newspa-
pers of Dubuque County; and
Whereas, all sealed bids have been
received and placed on file, after
which open bids were called for and
received, the highest of which was
as follows: Par, accrued interest
and a premium of $730.00.
Now, therefore, Be it Resolved by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That upon being ad-
vised in the premises it is hereby
determined that the bid of Geo. M.
Bechtel & Co., Davenport, Ia., for
the purchase of Sixty -five Thousand
Dollars ($65,000) Dock Bonds, is the
highest and best bid received, and
that said bonds be and the same are
hereby awarded to said Geo. M.
Bechtel & Co., Davenport, Ia.
Section 2. That the form of agree-
ment of sale of said bonds to Geo.
M. Bechtel & Co. be and the same
is hereby approved and the Mayor,

Judge J. W. Kintzinger addressed
the Council on behalf of Mary and
Catherine Cunningham, owners of
lot 2 of lot 14, Ann O'Hare's Sub.,
relative to the assessment for the
improvement of McCormick Street,
claming that they were erroneously
assessed for more property than is
contained in their lot, The assess-
ment as levied is $1172.00, which
amount they claim is excessive and
unjust. They claim that there is a
strip of ground between their prop-
erty and the Street which they do
not own. This matter has been in
the hands of the Engineer and he
reported that the assessment on the
strip in question would amount to
$382.34.
Councilman Maclay moved that
upon receipt by the City of a quit
claim deed to this strip of property,
the assessment against Mary and
Catherine Cunningham be reduced in
the amount of $382.34. Seconded by
Councilman Schrempf. Carried by
the following vote:

Petition of the Kassler Motor Co.

to the City Manager for investigation
and report. The report being favor-
able, Councilman Schrempf moved
that the prayer of the petition be

provement of Carlotta Street. The

original assessment. The orginal as-
sessment on 2nd description was
$217.46. He hereby offers $50.00 in
full settlement of this claim.

eighteen feet in width and construct-

The undersigned further agree
that said City Council may proceed
with the preparation of plans and
specifications for this improvement
and advertise for bids at this time
without taking the preliminary steps,
such as the preparation of prelimi-
nary schedules, passing a resolution
of necessity and resolution ordering
the construction of the improvement
and any other proceeding or notice
that the law requires preliminary to
the receipt of bids, all of which pro-
ceedings are expressly hereby waiv-

Upon investigation I find that the
Beecher Motor Co. have one pump
on the curb. If the Council wishes
to follow the policy of allowing ad-
ditional pumps where pumps are al-
ready installed on the curb at the
same location, I would recommend
that this be allowed. Allowing an
additional pump at this location
would take up very little more room
on the curb and would' not cause any
more congestion than at present, as
only one car could be filled at one
time.

is called for the purpose of a hear-
ing and considering for adoption
the Budget and expenditures for the
City of Dubuque for the fiscal year
1927. Notice of publication certified
to by the publisher of the publica-
tion of the Budget of expenditures
of the City of Dubuque, for the fis-
cal year of 1927.
There being no remonstrances or
objections filed, Councilman Yount
moved that the notice be received
and filed, seconded by Councilman

Resolution Amending Budget Esti-
mate for the Fiscal Year of 1927.
Be it resolved by the City Council
of the City of Dubuque that the bud-
get estimate of income and expenses
heretofore prepared and published,
as provided, by law, be amended
as follows:
Item -1 Eliminate from antici-
pated miscellaneous revenues the fol-
lowing items:
a. —Sale of municipal property
$2,000.
b —Tax sale certificate redemp-
tions $10,000.
The items hereby eliminated, while
reasonably certain, should be con-
sidered as capital assets and, when
collected, may be used to retire in-
debtedness or pay interest thereon
or for any other purpose that the
Council may deem advisable.
Item -2 Add to suph miscellaneous
revenues the following item:
Departmental earnings, $3,000.
Item -3 Eliminate the item of
travel expense for City Council
amounting to $50.00.
Item -4 Reduce salary of Mana-
ger to $7,600.
Item -5 Reduce the salary of
City Solicitor to $4,200.

Engineer to $3,120.

This will result in reducing the ex-
pense of this department $5,040 the
men hereby removed from the de-
partment are those who are now
serving as tenders of the fire alarm
system. These men had been pre-
viously retired on pension and should
be drawing their pension from the
Fire pension fund and should not
receive a salary from this depart-
ment. It is suggested that since
their duties are light and such as
can be performed by men on the
retired list that the Chief of the
Fire Department assign these' men
to these duties.
Item -12 Reduce salary of Build-
ing inspector to $2,700.
Item -13 Reduce the item miscel-
laneous in Fire Department to $300.
Item -14 Sub - divide the items ap-
pearing in the budget under the
heading of Fire Department and
bearing the serial number 119 -119a-
119b. Subdivision 119a should con-
tain only the items chargeable to
the fire department proper and sub-
division B should contain the item
chargeable to the fire improvement
fund. As thus charged the budget
will read as follows:

urer be instructed to accept $60.00
from Mr. Dax and upon receipt of
same cancel the tax sale certificate.

Petition of John Ludowsky owner

commends that the Council accept
this offer.

the recommendation of the City So-

in full of settlement from Mr. Lu-
dowsky, for said assessments, and
upon receipt of same cancel tax

Wm. Kaiser fell on Jan. 27th, 1927,

icy walk and broke his arm and

prove his action.

the action of the City Solicitor be
approved and the Auditor be in-
structed to draw a warrant in favor
of Mr. Kaiser in the sum of $100.00
in settlement in full for this claim.

the lowest bid for the furnishing of
all labor and materials and per-
forming the work as provided for in
the plans and specifications.
Now Therefore, Be it Resolved by
the City Council of the City of Du-
buque, that the contract for the im-
provement of Dorgan Place from
the Alley 1st West of Madison Street
to the East line of Ellis Street by
paving with 6" Concrete be award-
ed to Uhlrich, Paley Co., of Dubuque
and the Mayor and Manager be and

In regard to the petition of E.
Muntz, regarding the assessments
against his property, Lots 17, 18 and
19 Morgan's Sub., for the improve-
ment of West 16th Street, I wish to
report as follows:
Lot 19 Morgan's Sub, was original-
ly assessed for $122.16. After inves-
tigation the value of this lot was
fixed at $100.00. The corrected as-
sessment therefore would be $25.00
or 1 /4 of the assessed valuation, mak-
ing a reduction of $97.16.
Lot 18 Morgan's Sub., was origin-
ally assessed for $112.11. After in-
vestigation the value of this lot was
fixed at $100.00. The corrected as-

Lot 17 Morgan's Sub., was original-
ly assessed for $61.65. After inves-
tigation the value of this lot was
fixed at $50.00. The corrected as-
sessment therefore would be $12.50
or a reduction of $49.15.
I would recommend that these re-
ductions be granted to Mr. Muntz
and that the City Treasurer be in-
structed to draw a warrant in the
amount of $233.42 in favor of the
Special Improvement Fund. to make
up the shortage incurred by these
reductions.

In regard to the petition of E.
Turner, regarding the assessment
against his property, the west fifty
feet of Lot 3 of Outlot 740 for the
improvement of West 14th Street, I
wish to report as follows.
This lot was originally assessed
for $261.19. Upon investigation the
valuation of the lot was fixed at
$700.00. The corrected assessment
should therefore be $175.00, or 1 /4 of
the valuation, making a reduction
of $86.19.
I would recommend that this re-
duction be granted to Mr. Turner,
and that the City Treasurer be in-
structed to draw a warrant in the
amount of $86.19 in favor of the Spe-
cial Improvement Fund to make up
the shortage incurred by this re-
duction.

Meeting called by order of Mayor
Melchior and Councilman Maclay.

Mayor Melchior read the call and
stated that service thereof had been
duly made and that this meeting
is called for the purpose of consider-
ing the Appropriation Ordinance for
second reading, and acting on any
other business that may come before
a regular meeting of the City Coun-
cil.
Appropriation Ordinance present-

An Ordinance appropriating money
for the various funds and purposes
of the City of Dubuque, for the fis-
cal year 1927.
Councilman Maclay moved that
this be considered the second read-
ing of the ordinance, Seconded by

A RESOLUTION amending a reso-
lution entitled "Resolution amend-
ing budget estimate for the fiscal
year 1927."
Be it resolved by the City Council
of the City of Dubuque that the reso-
lution adopted by this Council on
the 30th day of March, 1927, entitled
"Resolution Amending Budget Esti-
mate for the Fiscal Year 1927 ", be
amended as follows:
Whereas. the resolution herein re-
ferred to and heretofore adopted on
March 30, 1927, provided for the re-
duction of the number of first grade
men on the Fire Department to 32;
and
Whereas, it has been discovered
that a misunderstanding occurred
whereby it was thought that the
three men in charge of the Fire
Alarm System had been previously
retired on pension and now it ap-
pears that only one of such men had
thus been retired; and
Whereas, it is deemed advisable
by this Council to correct. the bud-
get as amended so as to provide
that the number of first grade men
in said department be reduced to
34 instead of 32 as heretofore pro-
vided for in said resolution and that
the reduction herein proposed shall
relate only to the one man who had
been previously retired upon pen-
sion;
Now therefore, Be it resolved by
the City Council of the City of Du-
buque that said resolution hereto-
fore adopted be amended so as to
provide that the number of first
grade men in the Fire Department
be reduced to 34 instead of 32.
Be it further resolved that the
salary of the one man stricken from
the Fire Fund be paid in addition to
his regular pension at the date of
retirement, ,such a sum as this Coun-
cil may determine upon, for services
to be rendered in the Fire Alarm
System, and such amount shall be
paid from the Emergency or Surplus
Fund provided for in the Appropria-
tion Ordinance

City Solicitor Czizek to whom was
referred the petition of automobile
dealers, asking that the ordinance
forbidding the parking of used cars
in front of their places of business,
be amended or repealed, reported
that he had looked up the ordinance
and explained to the Council just
what the ordinance meant. He ex-
plained that it means that dealers
cannot park cars that they have for
sale along the streets, that some
dealers have cars parked not only
in front of their business places but
all along the street for a block and
then some on the opposite side of
the street, making it impossible in
some places for automobile owners
to park in front of their homes.
Councilman Meuser moved that
the petition be received and filet}.
. Seconded by Councilman Maclay.
Carried by the following vote:

Councilman Meuser reported that
residents on Burden and O'Neill
streets, asked him to bring up the
matter of having said streets im-
proved, stating that they have sew-
er constructed but have no water
and they are willing to sign a waiv-
er, that they will pay for this im-
provement, when the work is com-
pleted.
Councilman Meuser moved that
this matter be referred to the City
Manager and Engineer. Seconded
by Councilman Maclay. Carried by
the following vote:
