Mayor Melchior stated that this is
the regular monthly meeting of the
Council for the dispatch of such busi-
ness as may regularly come before
the meeting.
City Council proceedings for the
month of April presented for ap-
proval.
Councilman Yount moved that
they be approved as printed. Sec-
onded by Councilman Maclay. Car-
ried by the following vote:

A communication from the Du-
buque Bridge Co. relative to the con-
dition of the bridge, also to the tolls
charged for crossing on said bridge,
whereby they make comparisons on
the tolls with other bridges, namely:
Lyons, Clinton, Muscatine, Burling-
ton, Sioux City and Council Bluffs,
showing that the fare charged on the
Dubuque bridge, in spite of the fact
that they charge a round trip fare
is cheaper than the fares charged
on any of the other above named
bridges, not excepting the munici-
pally owned bridge at Burlington
and are in their opinion not in need

of regulation or adjustment in the
interest of the communities served.

the communication be received and

Petition and Waiver
The undersigned, being the owner
of all the property to be assessed
for the construction of the improve-
ment herein petition for, does here-
by petition your honorable body, the
City Council of the City of Dubuque,
Iowa, to improve by paving with
concrete pavement, Kirkwood Street
from the end of the improvement
now under construction to the west
line of Lot 13 in Wood's Addition,
said pavement to be constructed on
the north half of said Kirkwood
Street.
Your petitioner further requests
that the contractor now construct-
ing the pavement on Kirkwood
Street, namely James F. Lee Paving
Co., be awarded a contract by the
City Council of the City of Dubuque
to construct said pavement on the
basis that is being charged and paid
for for the construction of the im-
provement now being made on said
street
•In consideration of the granting of
this petition and for the benefit and
convenience which will arise in favor
of the property of the undersigned
because of the improvement being
constructed at this time, the under-
signed hereby expressly waives the
taking of any preliminary steps pro-
vided for by law for the construction
of this improvement, all of such pre-
liminary proceedings, including the
making of a contract without adver-
tising for bids, are hereby expressly
and forever waived and the under-
signed hereby agrees to pay the total
cost of said improvement without
objection for any reason whatsoever
and without any deductions for any
reason, reserving to himself the
right to pay his assessment in in-
stallments, as provided for by law.
The express intention hereby be-
ing to waive any and all errors or
irregularities or omissions in any of
the proceedings necessary to be tak-
en in the construction of public im-
provement and in the levy of assess-
ments to pay for the same, all of
such errors, omissions or irregular-
ities are hereby expressly and for-
ever waived.

Resolution
Whereas, J. H. Rhomberg on the
3rd day of November, 1924, by action
in the District Court, of Dubuque
County, Iowa, obtained an injunction
restraining the tax collection officers
of Dubuque County and the City of
Dubuque from collecting delinquent
taxes and special assessments levied
against certain properties owned by
him in the City of Dubuque, Iowa,
and,
Whereas, in said action said J. H.
Rhomberg petitions the Court to de-
clare irregular and to cancel said
delinquent taxes and special assess-
ments; and
Whereas, after a good deal of ne-
gotiation the said J. H. Rhomberg
offers to pay $1732.82 in full settle-
ment of said delinquent taxes and
special assessments; and
Whereas, it is deemed desirable
and in the best interests of the City
to accept such offer;
Therefore, be it resolved by the
City Council of the City of Dubuque
that said offer of J. H. Rhomberg
to pay $1732.82 in full, complete and
final settlement of all delinquent
taxes and special assessments in-
volved in said action, is hereby ac-
cepted and upon payment thereof
to the City Treasurer, the City At-
torney is authorized and directed to
take all steps necessary to dispose
of said action in the District Court
of Dubuque County, Iowa, on said
basis.

To the Honorable Mayor and City
Council of the City of Dubuque.
Gentlemen: Malethia Mueller, a
minor child, brought suit against the
City of Dubuque in the sum of $3,500,
claiming damages on account of per-
sonal injuries by her when she fell
upon an icy sidewalk on Central
Avenue, on January 15th, 1926. When
this action was started I caused to
be served upon the owner of the
property a notice advising them of

this action and, since the conditions
were claimed to have been caused
by the existence of a water spout
which discharged water upon the
walk, I advised them that the City
would hold them responsible. A
settlement of this case has been
agreed upon, whereby the owners
of the property will pay $250.00 and
costs and the City will pay $150.00.
I recommend the approval of this
settlement and that a warrant be
drawn in favor of R. P. Marshall,
Clerk of the District Court of Du-
buque County, Iowa, in the sum of
$150.00.
A claim was filed by James Mc-
Donald in the sum of $175.00 for per-
sonal injuries which he sustained on
January 3rd, 1927, by falling upon
an icy walk. Mr. McDonald sus-
tained injuries and I have affected
a settlement with him by the pay-
ment of $135.00. I would recommend
that a warrant be drawn in his favor
for the sum of $135.00.

Re Thomas F. Kenneally vs. City
of Dubuque.
Dear Sir: Beg to advise you that
the above entitled case was dis-
missed by the plaintiff some few
days ago.
Under date of August 24th, 1925,
the property of Thomas Kenneally
was assessed for the improving of
South Grandview Avenue, the
amount of the assessment levied
against this property was $1447.15.
Mr. Kenneally desires to pay at
this time an amount equal to the
installments which would be past
due under the installment plan, and
further desires that he be permitted
to pay the balance remaining in in-
stallments, over the period of years
which is permitted by statute at the
time the first payment is made.
Mr. Kenneally at the time he was
required to elect to pay this assess-
ment in installments or a lump sum,
had an appeal pending before the
District Court and was unable there-
fore to make an election at that
time.

the City Manager and Clerk are here-
by instructed to enter into a con-

he is doing the other work on said

Councilman Yount moved that the
rules be suspended to give any one
present who wished to do so to ad-

Tom Farley addressed the Coun-
cil, stating that he was repairing a
garage on 15th St. between Wash-
ington and Elm Streets, and the
Building Inspector stopped him,
claiming that this is a new building
and being put up contrary to the Or-
dinance. Mr Farley stated that the
building was almost finished and
asked the Council to permit him to
leave it there.
Councilman Meuser moved that as
this is a repair job, the building be
allowed to remain and Mr. Farley
must cover the building with sheet
metal and put on a fire proof roof
as provided by ordinance. Second-
ed by Councilman Yount. Carried
by the following vote:

City Solicitor M. H. Czizek report-
ed that on Dec. 3rd, 1923, the City
purchased the N. E. 16 feet of lot
2 Rosedale Add. No. 2 at tax sale
for a delinquent assessment levied
against said property in 1915 for the
improvement of Rosedale Ave., prop-
erty owned by J H. and M. Parker.
Mr. Parker stated they did not know
when they purchased this property
that there was any assessment
against it. They hereby offer the
original assessment and costs,
amounting to $11.46 and that the in-
terest be cancelled.
The City Solicitor recommends
that the Council accept this offer.

recommendation of the City Solicit-
or be approved, and the Treasurer
be instructed accordingly. Second-

Ordinance No. 185
An Ordinance amending an Ordin-
ance entitled, "Ordinance 173. An
Ordinance regulating street traffic
within the City of Dubuque; pre-
scribing rules and regulations for the
use of streets, alleys, boulevards,
and avenues by motor and other ve-
hicles; providing a penalty for the
violation of the provision hereof, des-
ignating this as the traffic ordinance
of the City of Dubuque" and repeal-
ing ordinances No. 102, 122, and 125,
heretofore adopted by the City Coun-
cil of the City of Dubuque by amend-
ing rule 56 paragraph 889, section 2
so as to include Locust Street from
West 8th Street to West 10th Street,
within the restricted parking period.

be considered the first reading of the
Ordinance. Seconded by Councilman
Maclay. Carried by the following

In view of the fact that the
amount of Mr. Kenneally's assess-
ment is large, I ask that you call
this matter to the attention of the
City Council and ask for permission
for my client to pay the balance,
excepting the installments now past
due, in installments over a period of
years, the same as allowed to other
property owners assessed for the
same improvement.

stated that service thereof had been
duly made and that this meeting is
called for the purpose of considering
for adoption Ordinance No. 185
amending the traffic Ordinance, and
acting on any other business that
may regularly come before the meet-
ing.
Petition of Grocers Baking Co.,
referred to the Council by the Board
of Supervisors, asking cancellation
of their 1927 taxes, stating that they
are no longer in business, presented
and read.
Councilman Maclay moved that
the petition be received and filed and
the Board of Supervisors be notified
of the action taken by the Council.

redemption of property purchased by
the City at tax sale, stating that he

in California and therefore did' not
receive notice of this assessment,
the original assessment amounted
to $75.36, interest to date at 8%
$9.79, penalty at 8% $6.03, Audit-
or's fee 25c. He asks that he be
allowed to pay the amount less the
penalty.

Petition ,signed by 34 signers, ask-
ing that Garfield Avenue from Dock
to Marshall Streets, abutting the
play ground of the Marshall School
be closed to traffic during the hours
that base ball games are played on
said grounds, and that Geo. Roepsch
be authorized to act as traffic officer
during said games, he having offered
to do so without compensation.

that part of the petition referring

City Manager Douglas reported
verbally that he had given Joe
Beecher permission to install a gas-
oline filling station at the corner of
Dodge and Nevada Streets.
Action of the City Manager ap-
proved. No motion.
Communication of the Dubuque
Dental Study Club recommending a
joint meeting of the City Council,
School Board, and said Dental Club
for the purpose of discussing a hy-
giene program for Dubuque.
The Council will consider this mat-
ter. No action.
Petition of Wm. Zumhoff asking
that a "No Parking sign be placed
at the northwest corner of West 24th
Street and Central Ave., on the 24th
Street side, stating that the street
is very narrow making it dangerous
for traffic.
Referred to City Manager to take
care of this matter. No motion.
On the matter of vacating the al-
ley from West 3rd Street and Lang -
worthy Ave., back of College Ave.,
City Manager to confer with the
abutting property owners, relative to
the disposal of the property. No
motion.
Councilman Maclay moved that
the rules be suspended for the pur-
pose of allowing anyone present
wishing to do so, to address the
Council. Seconded by Councilman
Meuser Carried by the following

A communication from the Retail
Merchants of the City of Dubuque,
making the following recommenda-
tions, was presented and read by Mr.
Charles Landon:
That automatic traffic signals be
installed at the intersections of the
follows streets:
Fourth and Main Streets, 5th and
Main Streets, 6th and Main Streets,
7th and Main Street, 8th and Main
Streets, 9th and Main Streets, 1(
and Main Streets, 11th and Main
Streets, 8th and Locust Streets. That
the left hand turn be permitted at
all intersections until it is proven
impractical when combined with the
use of the automatic traffic signals.
That traffic be required to stop
before entering or crossing Rockdale
Road and Grandview Avenue.
That traffic be required to stop be-

fore entering or crossing 14th Street
at Locust Street.
That the Boulevard Stop signs at
the above intersections as well as
the Boulevard Stop signs on the
west side of Jackson Street at 14th
Street, on the east and west sides,

on the west side of Jackson Street
at 32nd Street be illuminated.
That all Boulevard Stop signs be
painted with a light yellow back-
ground and black letters.
That the Boulevard Stop signs
now in use be lowered one foot.
That the parking limit signs be
changed to read: Parking Limit 60
min. 9:00 A. M. -6:00 P. M. Except
Sundays and Holidays.
That white lines be painted on
the pavement at the intersection of
Grandview Avenue, Grace and Del-
hi Streets, directing motorists where
to turn and creating a Pedestrial
Safety Zone, in the - intersection.
They state further that they real-
ize that no provisions have been
made in the budget for the installa-
tion of the improvement, but feel
that ways and means may be found
to finance this project, that one of
our local firms is willing to pay for
the automatic traffic signals and
have the City refund them over a
period of ten years, or they offer an-
other plan, which is to pay for the
signals and be refunded by the City
after provisions for the purchase of
such equipment have been placed in
the budget for the next year and the
budget adopted,
Councilman Maclay moved that
action on this matter be deferred
until the City Manager has all the
figures in for the cost of these sig-
nals. Seconded by, Councilman
Meuser. Carried by the following

Mr. F. Olds addressed the Coun-
cil relative to a street. Mr. Olds
offers to donate the land to the City
for a street to open into Kane Street.

the Council view the grounds and
the Clerk to notify Mr. Olds when
the Council will view this property.

for the use of streets, alleys, boule-
vards and avenues by motor and
other vehicles; providing a penalty
for the violation of the provisions
hereof, designating this ordinance
as the "traffic ordinance of the
City of Dubuque," and repealing
ordinances Nos. 102, 122 and 125,
heretofore adopted by the City
Council of the City of Dubuque by
amending rule No. 58, paragraph
889, section 2 so as to include
Locust Street from West 8th to
West 10th Streets within the re-
stricted parking period.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That an ordinance en-
titled "Ordinance No. 173. An or-
dinance regulating street traffic with-
in the city of Dubuque; prescribing
rules and regulations for the use of
streets, alleys, boulevards and aven-
ues by motor and other vehicles;
providing a penalty for the violation
of the provisions hereof, designating
this ordinance as the "traffic ordin-
ance of the City of Dubuque ", and
repealing ordinances Nos. 102, 122
and 125, heretofore adopted by the
City Council of the City of Dubuque"
be and the same is hereby amended
by amending rule No. 58, paragraph
889, section 2 by adding thereto the
following:
"D. Upon Locust Street from West
8th to West 10th Streets."
Section 2. That said rule No 58,
as thus amended, will read as fol-
lows:
"Rule No. 58. No vehicles shall
be parked between the hours of 9:00
A. M. and 6:00 P. M., except Sun-
days and holidays, for a longer per-
iod of time than one hour on the
following named streets:
(a). Upon Main Street from 1st to
13th Streets.
(b). Upon Central Avenue from
13th to 20th Streets and on the east
side of Central Avenue from 20th to
24th Streets.
(c'). Upon West 8th Street from
Bluff to Main Streets.
(d). Upon Locust Street from
West 8th Street to West 10th
Street."
Section 3 This Ordinance shall
be in force and effect ten days from
and after its final passage and ad-
option by the City Council of the
City of Dubuque and publication as
provided by law.

Attorney R. P. Roedell addressed
the Council relative to a petition of
Eugene Forward. Stating that Over-
view Street in the Rudolph Jones
Addition, recently platted, is so situ-
ated that a curve in said street cuts
off the front of the sidewalk of pe-
titioner's premises a distance of
about ten feet, which is at present
the driveway to Mr. Forward's prem-
ises, which is beneficial to Mr. Jones
and detrimental to petitioner, and he
hereby asks that the Council take
such action as may be necessary to
protect him in the proper enjoyment
of his property, and not to permit
the construction as heretofore ap-
proved.

the matter be referred to the Council
to view the grounds. Seconded by

Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of the alley
let west of Madison Street herein-
after described has been completed
and said improvement has been ac-
cepted by the City Council of said
City and the City Engineer has com-
puted the cost and expense thereof
to be $553,32.
June 27th, 1927
And whereas, public notice as pro-
vided by law, has been published
by the City Clerk stating the inten-
tion of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto, and all
objections filed thereto have been
considered and _determined.
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improvement of the alley 1st
west of Madison Street from West
17th Street to Dorgan Place there be
issued improvement bonds to the
amount of $553.32.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1924, which bear date
as of the 27th day of July, A. D.
1927, shall be in the denominations
of $100.00 each, except that there
shall be one bond to the amount of
$53.32: they shall be numbered from
1459 to 1464 inclusive and shall be
divided into ten series of which the
bond numbered 1459 shall constitute
the first series and shall be pay
able on the 1st day of April, A. D.
1928; the bond numbered 1460 shall
constitute the second series and
shall be payable on the 1st day of
April, 1929; the bond numbered
1461 shall constitute the third
series and shall be payable the
1st day of April, 1930; the bond
numbered 1462 shall constitute the
fourth series and shall be payable
the 1st day of April, 1931; the bond
numbered 1463 shall constitute the
fifth series and shall be payable the
1st day of April, 1932; the bond

cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment here-
on of said special tax, the faith and
diligence of said City of Dubuque are
hereby irrevocably pledged.

eer be approved and that said im-
provement be and the same is here-
by accepted and the City Engineer
be and he is hereby directed to pre-
pare a plat and schedule showing
the lots or pracels of real estate sub-
ject to assessment for said improve-
ments and file the same in the office
of the City Clerk subject to public
inspection and said Clerk shall up-
on receipt of such plat and sched-
ule publish the notice of the Coun-
cil's intention to levy special as-
sessments therefor, as required by
law.
Be it further resolved that said
Clerk be and he is hereby directed
to publish a notice of the intention
of the City Council to issue public
improvement bonds to pay the cost
of said improvements and state there-
in the time and place when and
where objections thereto may be
filed by interested parties, the meet-
ing of this Council for said purpose

mend later that the bill for said
treatment be paid by the proper au-

Resolution Providing for the Issu-
ance of Public Improvement
Bonds
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Dorgan
Place, hereinafter described has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to $2,524.31
And Whereas, public notice as
provided by law, has been published
by the City Clerk, stating the in-
tention of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been 'held pursuant thereto, and all
objections filed thereto have been
considered and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost of
improving Dorgan Place from the al-
ley 1st west of Madison Street to
Ellis Street, there be issued Im-
provement bonds to the amount of
$2,524.31. Said bonds shall be issu-
ed under the provisions of Chapter
311 of the Code of Iowa, 1924, which
bear the date as of the 27th of July,
A. D 1927, shall be in the denomina-
tions of $200.00 each,except that there
shall be one bond to the amount of
$124.31; they shall be numbered from
1446 to 1458 incl. and shall be divided
into ten series of which the bonds
numbered 1446 to 1447 shall consti-
tute the first series and shall be pay-
able on the 1st day of April, A. D.
1928; the bond numbered 1448 shall
constitute the second series and
shall be payable on the 1st day of
April, 1929; the bond numbered 1449
shall constitute the third series and
shall be payable the, lst day of April,
1930; the bond numbered 1450 shall
constitute the fourth series and shall
be payable the lst day of April, 1931;
the bond numbered 1451 shall con-
stitute the fifth series and shall be
payable the 1st day of April 1932;
the bond numbered 1452 shall con-
stitute the sixth series and shall be
payable the 1st day of April, 1933, the
bond numbered 1453 shall constitute
the seventh series and shall be pay-
able the 1st day of April, 1934; the
bond numbered 1454 shall constitute
the eighth series and shall be pay-
able the 1st day of April, 1935, the
bonds numbered 1455 to 1456 shall be
payable the 1st day of April, 1936,
the bonds numbered from 1457 to
1458 shall constitute the tenth series
and shall be payable the lst day of
April, 1937.
Said bonds shall bear interest at
the rate of 5 per cent per annum,
which shall be payable semi- annual-
ly, in accordance with the terms of
the coupons thereto attached, and
said bonds shall be payable out of
the proceeds of the special assess-
ment levied for said improvement.
Both principal and interest shall be
payable at the office of the City
Treasurer in the City of Dubuque.

This bond is one of a series of 13

1458, all of like tenor and date, and
issued for the purpose of improving
Dorgan Place from the alley 1st
west of Madison Street to Ellis
Street and described in said resolu-
tion; which cost is assessable and
levied along said improvement, and
is made by law a lien on all abutting
or adjacent property, and payable
in ten annual installments, with in-
terest on all deferred payments at
the rate of five per cent per annum,
and this bond is payable only out of
the money derived from the collection
of said special tax, and said money
can be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to an in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law and
resolution, and for the assessments,
collections and payment hereon of
said special tax, the faith and dili-
gence of said City of Dubuque are
hereby irrevocably pledged.
In witness whereof the City of Du-
buque byits City Council has caused
this bond to be signed by its Mayor
and countersigned by its City Clerk,
with the seal of said City affixed this
29th day of July, 1927, and has au-
thorized the use of their - simile signa-
tures to the interest coupons hereto

Gentlemen:
The consensus of opinion of the
various organizations in the City of
Dubuque seems to be that automatic
traffic signals be installed at several
intersections on Main Street.
There is a diversity of opinion re-
garding the operation of automobile
•signals. First, should left hand turns
b� allowed at all intersections con-
trolled by automatic signals? Second,
should safety zones be laid off at in-
tersections for the protection of per-
sons getting on and off street cars?
Third, should automobiles be allow-
ed to pass street cars taking on and
putting off passengers when the au-
tomatic signal shows clear?
The width of our paving, the num-
ber of street car tracks and the gen-
eral traffic make all of these prob-
lems worthy of consideration before
placing the automatic signals. How-
ever, these are operating problems
and can be worked out and the most
satisfactory method adopted after in-
stallation.
If we install automatic traffic sig-
nals, I would recommend the follow-
ing interesections for the first in-
stallations: 4th and Main Streets,
5th and Main, 6th and Main, 7th and
Main, 8th and Main, 9th and Main,
10th and Main, llth and Main, 8th
and Locust Streets. The intersec-
tions of Bluff and 8th Street and Iowa
and 8th Streets are worthy of con-
sideration at this time, also. How-
ever, they can wait until later date,
after we have had more experience
operating the first group mentioned.
In our original proposition last
Year, we included the intersection of
Rockdale Road and Grandview Av-
enue. It was recommended by the Re-
tail Merchants Bureau of the Cham-
ber of Commerce that Rockdale
Road be made a boulevard and that
all traffic in Grandview Avenue
should stop at the intersection. It
seems that a better solution of this
problem at this time would be to
place a properly designed "Caution"
sign in the interesection which will
call the attention of all traffic to the'
fact that this is an intersection at
which caution is necessary in pass-
ing. A flashing signal design which
allows a light to be on a few seconds
and off a few seconds would attract
more attention than a light burning
continuously. In connection with this
flashing signal would be a large light-
ed sign with the word "Caution"

printed on it. I feel that this or some
similar type would be satisfactory at
this point.

The cost of this equipment will be
the same if the city buys it direct
from the company or through a local
dealer.
The cost of installation will be ap-
proximately the same whether the
city forces do the work or whether
it is done by an outside organization.
Owing to the situation of these
lines that are nearby, it would be
lights and it being possible to con-
nect them with some electric supply
lines that are nearby, it would be
hard to draw up a set of specifica-
tions to receive bids on this work.
I would recommend that as soon
as the city finances are in shape that
the city purchase the above auto-
matic traffic control equipment and
have the same installed.

were present and one of their number
addressed the Council relative to es-

Attorney J. J. Kintzinger address-
ed the Council relative to the petition
of Dubuque Labor Congress, stating
that they have another signer to
their petition, and now have the re-
quired 75 per cent of the property
owners adjacent to Olinger Park,
stating that they have no objection to
a carnival exhibiting in Olinger Park
during the week of July 4th, 1927,
and said Dubuque Labor Congress
hereby ask that the prayer of
their petition asking that said
Carnival be allowed to exhibit at said
Olinger Park, be granted.
.After considerable discussion,
Councilman Yount moved that the
prayer of the petition be granted,
seconded by Councilman Schrempf,
