Present —City Manager Douglas, Mayor Melchior, Councilmen Maclay, Meuser, Yount, Absent — Councilman Schrempf. Mayor Melchior read the call and stated that service thereof had been duly made and that this meeting is called for the purpose of considering bids for fire apparatus and acting on any other business that may come before the meeting. Councilman Meuser moved that the City Manager be given power to enter into a contract with the Mack Truck Co. for a new fire apparatus for $7,400.00 net and the old appar- atus in exchange. Seconded by Councilman Maclay. Carried by the following vote: Yeas —Mayor Melchior, Council- men, Maclay, Meuser, Yount. Nays —None. Absent — Councilman Schrempf. Councilman Maclay moved that the City Solicitor be empowered to take such legal steps as may be nec- essary to secure the cancellation of the assessment of the Julien Ho- tel Company from $300,000 to $100,- 000 as made by the Board of Review. In compliance with the provisions of the statutes of Iowa, the Park board of the City of Dubuque, by resolution duly adopted the 7th day of July, 1927, has fixed the tax need- ed to be levied or certified for levy for park purposes by your Honorable Body for the coming year to be at the rate of 2% mills on the dollar of the assessable property of the city and that said amount expressed in dollars is $30,000.00, and herewith enclosed for consideration and ac- tion is a properly signed copy of the resolution duly adopted. The following resolution was duly adopted by the Park Board of the City of Dubuque by unanimous vote of the members present at said meeting held July 7th, 1927, in the City of Dubuque, Iowa. Resolved as required by the sta- tutes of Iowa providing for levy of taxes for cities of the state for park needs and purposes, the Park Board of the City of Dubuque, Iowa, on the 7th day of July, 1927, fixes and cer- tifies to the Honorable City Council of Dubuque, Iowa, as the tax needed to be levied by said City Council for park needs and purposes for the coming year including the sum need- ed to pay the Park Bonds coming due May 1st, 1928, and the interest then due on the remaining park bonds to be at the rate of 2% mills on the dollar of the assessed value of the taxable property of the City of Dubuque and that said amount of said taxes so required expressed in dollars is $30,000.00. Mrs. Robert Jungk appeared be- fore the Council and remonstrated (verbally) against the assesment as levied against her property on Madison Street for the improve- ments of Dorgan Place and the Alley first west of Madison Street, stating that her property has no outlet on this alley and street, and therefore her property derives no benefit from these improvements and asks that her assessments be cancelled. Absent — Councilmen Maclay, Schrempf. July 11th, 1927. Mr. C. E. Douglas, City Manager, Dubuque, Iowa. Dear Sir: I am submitting a re- port and recommendation on the 282 Special Session, July building located at 220 -228 Iowa Street, now owned by the Dubuque Ilide and Fur Co. Front wall from grade to be taken down and rebuilt; back wall to be taken down and re- built; the roof over this whole build- ing should be taken off and replaced with a new roof; side wall at the north side is in bad condition, same should be rebuilt and roof joists an- chored into structural work. Code requirements for floor loads in warehouses, Section No. 64, calls for 150 lbs. to the square foot on all floors over the first floor Section 531 of Code specifies that the reconstruction of old buildings shall conform in every detail to the regulations for new structure and shall be classified according to the purpose and location for which they are used. The building in question, known as the Clark Awning Company's work shop, at 220 -228 Iowa Street, has been purchased by the Dubuque Aide and Fur Co. It is their inten- tion to make minor repairs, enough to get in. This would be contrary to our Code as the building is in very bad condition and requires ex- tensive repairs, or be taken down altogether and replaced with a new structure, something that would at least be sanitary and not detrimen tal to public health. Meeting • called by order of Mayor Melchior and Councilman Schrempf. Council met at 4:30 P. M. Present —Mayor Melchior, Council- men Maclay, Schrempf, Yount. Absent — Councilman Meuser. Mayor Melchior read the call and stated that this meeting is called for the purpose of actng on the petition of the Macabees asking for the priv- ilege of putting on a carnival at Olinger Park, and acting on any oth- er business that may come before the meeting. Notice of suit, Julia E. Kemler and Minnie L. Kemler against the City of Dubuque, in the sum of $725.00 on account of damage to property, Lots 1 -2 -3, College Sub., by cutting down the established grade of the alley abutting these lots, contrary to the established grade, without an ordin- ance or resolution authorizing the same to be done. Councilman Schrempf moved that the petition be referred to the City Solicitor. Seconded by Councilman Maclay. Councilman Maclay moved that the rules be suspended to allow any- one present who wishes to do so to address the Council. Seconded by Councilman Yount. Fosselman, Marshall, Bar- ringer et al, addressed the Council objecting to any more carnivals to exhibit in Olinger Park, stating that they are a nuisance and a menace to health, and stated that they had their doubts about the promoters havng the signatures of 76% of the abutting property owners giving their consent thereto. Mr. George Hendricks, representing the Maca- bees, who had a petition in the Coun- cil several weeks ago for permission to stage a carnival at said Olinger Park, addressed the Council relative to their petition stating that they had the same number of signers as the Dubuque Labor Congress had, and that their petition was present- ed to the Council before the Labor petition and could see no reason why the Council should not grant the Macabees the same privilege under the .same conditions. Messrs. Brede, Roshek, Miles, Euechele et al addressed the Council relative to the deplorable condition of Rhomberg Avenue, from Lincoln Avenue to the Eagle Point High Bridge, and urged that this stretch of street be improved or repaired, and asked the Council not to delay action as the street as it now is, is a disgrace to the City. The Council will consider this matter at their not meeting which will be held July 21st. Petition of Jos. W. Froelich com- plaining against the existence of a barn in the alley on the premises owned by Mrs. Chas. Fosselman and situated on the property designated as 2320 and 2322 Jackson Street, stating that this barn is in a dilap- idated condition and is a fire hazard and a nuisance and ought to be removed. Councilman Schrempf moved that the petition be referred to the Health Officer for investigation and report. Seconded by Councilman Maclay. Petition of Ed Muntz objecting to the assessment levied against Lots 8 and 19, Morgan's Sub., on account of water connections, stating that assessments are $50.93 against each lot, a total of $101.86, claiming that this is far in excess of the valua- tion of the property. He hereby of- fers to settle these assessments by paying $50.00 in full. Councilman Maclay moved that the petition be referred to the City Manager and Engineer for investi- gation and report. Kretschmer, agent for S. P. Rider Estate, asking permission to construct a fireproof shed, 7 by 8 feet by 7 feet high, on the roof of building known as 1775 and 1779 Central Avenue as a stor- age room for tenants. Councilman Schrempf moved that the petition be referred to the Build- ing Commissioner for investigation and report. Seconded by Council- man Yount. Carried by the follow- ing vote: Yeas—Mayor Melchior, Council- men Maclay, Schrempf, Yount. Nays —None. Special Session, July 19th, 1926 283 Absent— Councilman Meuser. Report of Building commissioner. To the Honorale Mayor and City Council. Gentlemen: Relative to the Hol- land Chimne's flue. It is only 3 inches wide and of the same thick- ness as common brick. This is laid without any lining and is not in my cpinion as good as a good common brick flue, laid single and plastered on the inside. The City Code calls for all flues to be lined with flue lining or built of double brick. This so- called inter - locking system as used by the l ol- land Co, flue has no merit; it is lia- able to be set without much mortor at a joint, thereby leaving a danger- ous joint and fire exposure. The question of cost is another item for consideration. The Holland flue costs more than a plain double brick flue and is not nearly as safe. P. S. —Our present system of flue construction is safe and satisfac- tory, and this system has the appro- val of the best authority in the country (The National Board of Underwriters, and the Bureau of Standards). He now calls attention to the fact that Lots 316 and 317, immediately adjoining the lots referred to, are precisely in the same predicament and respect- fully asks that the assessments be reduced in a similar manner and would suggest that in order to sim- plify matters that the amounts over- paid on Lots 316 and 317 be credited to Lot 318, which is also owned by Lim and assessed for the same sewer. AN ORDINANCE regulating Cir- cuses, Menageries, Carnivals and Shows and prescriing a penalty for violation hereof. Be It Ordained by the City Council of the City of Dubuque: Par. 922. Excluded from residence neighborhoods. Section 1. No person, firm, assoc- iation or corporation shall be per- mitted to conduct or operate a cir- cus, menagerie, carnival or show anywhere within the City of Du- buque in residence neighborhoods or districts; providing, however, that where such circus, menagerie, car- nival or show is to be conducted for one day only this restriction shall not apply. Par. 923. Terms defined. Section 2. The term, "residence neighborhood or district" as used herein, shall be defined to be any part of the city which is built up with residences, homes, churches or 286 Special schools where such buildings are within 260 feet in any direction of the place where it is proposed to hold or conduct such performances. Par. 924. Manner of conducting. Section 3. Circuses, menageries, carnivals and shows, whether the same are held within or without residence districts, shall at all times be conducted in an orderly, peaceful, lawful and quiet manner and so as not to interfere with or obstruct streets and highways near and ad- jacent to where such performances are being held. Par. 925. License fees. Section 4. No circus, menagerie, carnival or show shall be held with- in the City of Dubuque without a permit having first been procured therefor from the City Manager and no permit shall be issued until the follownig license fees have been paid in advance: For each circus or menagerie $200.00 for the first day and $100.00 for each succeeding day. For each wild west show $125.00 for the first day and $75.00 for each succeeding day. For each day and pony show $50.00 for the first clay and $25.00 for each succeeding day. For each carnival $50.00 for the first day and $25.00 for each suc- ceeding day. The City Council reserves the right to impose additional conditions and restrictions as a condition to the issuance of the license as the cir- cumstances, from time to time, may require. Par. 926. Penalty. Section 5. Any person, firm, asso- ciation or corporation who violates any of the provisions of this ordin- ance shall be punished by a fine of not to exceed $100.00 or imprison - ment not to exceed 3Q days for each offense, and each day that any of the provisions of this ordinance are not complied with shall be consid- ered a separate offense. Section 6. This ordinance being deemed urgent and of immediate ne- cessity for the preservation of the health, peace and comfort shall be in force and effect from and after its passage by the City Council and publication as required by law. A., the High- way Commission of the State of Iowa has jurisdiction to improve by g rading and hard surfacing high- ways within cities which are a con- tinuation of primary roads for a width of twenty feet; and Whereas, it is deemed advisable and necessary to take advantage of such provisions of the law; now, therefore Be it resolved by the City Council of the City of Dubuque that the Highway Commission of the State of Iowa be and it is hereby requested to improve, or pay the cost of im- proving, by grading and hard surfac- ing Rhomberg Avenue from the north line of Lincoln Avenue to the Eagle Point Bridge in the City of Dubuque, Iowa, Said street within the described limits being a contin- uation of State Highway No. 61, plans and specifications for said im- provement having heretofore been adopted by the Council of said City and are now on file in the office of the City Clerk, said highway to be improved by said Commission for a width of twenty feet. Be it further resolved that, since said high }vay forms the entrance to the City of Dubuque from the State of Wisconsin and a vast amount of travel passes over the same, in the event said Commission cause said highway to be improved or pay the cost thereof for a width of twenty feet, then this Council will cause said highway to be further improved for an additional six feet, making the entire improvement twenty -six feet in width.
