Council met at 4:30 P. M.
Present —City Manager Douglas,
Mayor Melchior, Councilmen Ma-
clay, Schrempf, Yount.
Absent — Councilman Meuser.
Mayor Melchior stated that this
is the regular monthly meeting of
the Council for the purpose of trans-
acting such business as may prop-
erly come before the meeting, and
that this date was also fixed for the
levying of special assessments as
provided by law, and the issuance
of improvement bonds to provide the
cost of the improvements of Green
Street, from Asbury to Avoca
Streets, Alta Vista Street from the
present improvement of Alta Vista
and Kirkwood Streets, north, about
100 feet, Perry Street from South
Grandview Avenue to Rider Street, -
and Kirkwood Street from Alta Vis-
ta Street to the east property line
of lot 10 A. P. Wood's Add.
Notice of publication certified to
by the publisher of the City Coun-
cil's intention to levy a special as-
sessment as provided by law for the
improvement of Green Street, from
the east property line of Asbury
Street to west property line of
Avoca Street, and to issue public
improvement bonds to provide for
the cost of said improvement.
There being no remonstrance,
Councilman Maclay moved that the
notice be received and filed. Sec-
onded by Councilman Yount Car-
ried by the following vote:

Resolved by the City Council of
the City of Dubuque: That to pay for
curb and gutter on the improvement
of Green Street from the east prop-
erty line of Asbury Street to the
west property line of Avoca Street,
by Jas. F. Lee Paving Co., contractor,
in front of and adjoining the same, a
special tax be and is hereby levied
on the several lots, and parts of
lots, and parcels of real estate here-

Resolution Providing for the Issu-
ance of Public Improve-
ment Bonds
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Green Street
(curb and gutter), hereinafter de-
scribed has been completed and said
improvement has been accepted by
the City Council of said City and the
City Engineer has computed the cost
and expense thereof to be $816.75.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now therefore, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improving Green Street from the
east property line of Asbury Street
to the west line of Avoca Street by
constructing curb and gutter, there
be issued Improvement bonds to the
amount of $816.75.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1924, which bear date
as of the 1st day of September, A. D.
1927, shall be in the denominations
of $100.00 each, except that there
shall be one bond to the amount of
$16.75; they shall be numbered from
1465 to 1473 inclusive and shall be
divided into 10 series of which the
bond numbered 1465 shall constitute
the first series and shall be payable
on the 1st day of April, A. D. 1929;
the bond numbered 1466 shall con-
stitute the second series and shall

be payable on the lst day of April,
1930; the bond numbered 1467 shall
constitute the third series and shall
be payable the 1st day of April,
1931; the bond numbered 1468 shall
constitute the fourth series and
shall be payable the 1st day of April,
1932; the bond numbered 1469 shall
constitute the fifth series and shall
be payable the lst day of April,
1933 ;the bond numbered 1470 shall
constitute the sixth series and shall
be payable the 1st day of April,
1934; the bond numbered 1471 shall
constitute the seventh series and
shall be payable the 1st day of April,
1935; the bond numbered 1472 shall
constitute the eighth series and
shall be payable the 1st day of April,
1936; the bond numbered 1473 shall
constitute the ninth series and shall
be payable the 1st day of April,
1937.
Said bonds shall bear interest at
the rate of 5% per annum which in-
terest shall be payable semi- annual-
ly, in accordance with the terms of
the coupons thereto attached; and
said bonds shall be payable out of
the proceeds of the special assess-
ment levied for said improvement.
Both principal and interest shall be
payable at the office of the City
Treasurer in the City of Dubuque.
Said bonds shall be substantially in

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
19 ; or any time before that date
at the option of the City the sum of
One Hundred Dollars with interest
thereon at the rate of 5% per an-
num, payable on the presentation
and surrender of the interest coup-
ons hereto attached, both interest
and principal are payable at the of-
fice of the City Treasurer in the City
of Dubuque in the State of Iowa.
This bond is issued by the City of
Dubuque pursuant to and by virtue
of Chapter 311 of the Code of Iowa,
1924, and in accordance with a reso-
lution of the City Council of said
city, duly passed on the 1st day of
August, 1927.
This bond is one of a series of 8
bonds, for $100.00 each and number-
ed from 1465 to 1472 inclusive and
one for $16.75 numbered 1473, all of
like tenor and date, and issued for
the purpose of improving Green
Street from the east property line
of Asbury Street to the west line
of Avoca Street by constructing curb
and gutter and described in said
August 1st, 1927 293
resolution; which cost is assessable
and levied along said improvement,
and is made by law a lien on all
abutting or adjacent property, and
payable in ten annual installments,
with interest on all deferred pay-
ments at the rate of five per cent
per annum, and this bond is payable
only out of the money derived from
the colelction of said special tax,
and said money can be used for 110
other purpose.
And it is hereby certified and re-
cited that all the acts and condi-
tion and things required to be done
precedent to and in the issuing of
this series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of Du-
buque by its City Council has caused
this bond to be signed by its Mayor
and countersigned by its City Clerk,
with the seal of said City affixeu
this 1st day of September, 1927, and
has authorized the use of their fac-
simile signatures to the interest cou-
pons hereto attached.

Be it further resolved that the
City Treasurer be and he is hereby
instructed to sell said bonds in the
manner provided for in Section 845
of the Code of Iowa, the proceeds of

to be known as Improvement Fund.
Be it further resolved that the in-
terest coupons attached to the bonds
be signed with the fac- simile signa-

ance of Public Improve-
ment Bonds
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improving of Perry Street
(curb and gutter), hereinafter de-
scribed has been completed and said
improvement has been accepted by
the City Council of said City and
the City Engineer has computed the
cost and expense thereof to be
$1,451.20.
And whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
led thereto have been considered
and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improving Perry Street from the
west line of S. Grandview Avenue
to Rider Street, there be issued im-
provement bonds to the amount of
$1,451.20.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1924, which bear date
as of the 1st day of September,
A. D. 1927; shall be in the denomin-
ations of $200.00 each, except that
there shall be one bond to the
amount of $51.20; they shall be num-
bered from 1481 to 1488 inclusive
and shall be divided into ten ser-
ies of which the bond numbered
1481 shall constitute the first series
and shall be payable on the 1st day
of April, A. D. 1928; the bond num-
bered 1482 shall constitute the sec-
ond series and shall be payable on
the 1st day of April, 1929; the bond
numbered 1483 shall constitute the
third series and shall be payable
the lst day of April, 1930; the bond
numbered 1484 shall constitute the
fourth series and shal be payable
the 1st day of April, 1931; the bond
number 1485 shall constitute the
fifth series and shall be payable the
1st day of April, 1932; the bond

Dear Sir: This is to certify that
at a meeting of State Highway Com-
mission on July 26th, consideration
was given to a resolution passed
by your City Council July 21st, re-
questing the Commission to con-
struct pavement on Rhomberg Av-
enue from the north line of Lin-
coln Avenue to the Eagle Point
bridge in the City of Dubuque. The
following motion was adopted by the
Commission:
1 —That the Commission advise
the City of Dubuque that the Com-
mission does not see its way clear
to proceed to the construction of
pavement on Rhomberg Avenue in
the City of Dubuque, from the north
line of Lincoln Avenue to the Eagle
Point bridge, but that the Commis-
sion is willing to co- operate with the
City of Dubuque in the construction
of a pavement on said street and
to pay not to exceed one -half of the
cost of said paving out of the pri-
mary road fund, as provided in Sec-
tions 6044 to 6049 inclusive, Code
of 1924.
2 —That there is hereby appropri-
ated from the primary road fund an
amount sufficient to pay one -half of
said paving on said portion of Rhom-
berg Avenue in the City of Dubuque.
3 —That before proceeding with

said pavement the city shall secure
the approval of the Commission of
the plans, specifications and con-
tract for said proposed improvement
as provided in said law (Section
6044 to 6049 Code of 1924).
We have just received in this
office the copies of the plans and
specifications submitted by your city

We will check over these plans
and specifications as quickly as pos-
sible and will advise you of any
changes therein, if any, necessary
to secure our approval.
Your City should not proceed with
the construction work of this pro-
ject until you have our approval on
the plans, specifications and con-
tract.

the petition, that the barn is unsan-
itary, a fire hazard and a menace
to the neighborhood and ought to be
removed.

to prepare the proper resolution for

Whereas, the City Council of the
city of Dubuque, Iowa, caused to be
prepared and published, as provided
by law, the budget estimate of ex-
penditures for the fiscal years, 1928,
which estimate was fixed for final
hearing and consideration by the
City Council on the 8th clay of Aug-
ust 1927; and,
Whereas, on said date a public
hearing was duly had on said esti-
mate, and said estimate was taken
up for final determination by said
Council, and no objections having
been filed or made thereto, said es-
timate was confirmed and approved.
Be it therefore, resolved, by the
City Council of the city of Dubuque
that the budget estimate heretofore
prepared and published be and the
same is hereby finally approved and
the Mayor and Clerk are hereby di-
rected to certify the same to the
County Auditor of Dubuque County,
Iowa.

to maintain the same in good con-

nothing has been done to cause the
repairs and improvements to be
made; now therefor,
Be it resolved by the City Council
of the City of Dubuque that it be and
it is hereby declared that the fore-
going repairs and improvements are
deemed necessary and that said
Railroad Company be and it is here-
by directed to make the same, said
repairs and improvements to be con-
structed in the following manner

satisfaction of the City Engineer

1st. The bottom of the storm
sewer on East 17th Street shall be
rebuilt to permit water to flow
through the same from West to East
and a new drain or sewer shall be
constructed on the south side of
East 16th Street under the right -of-
way.
2nd. The right -of -way crossings
at East 4th and East 6th Streets
shall be repaired with Kyrock As-
phalt.

by ordered to be started not later

Whereas, the Chicago Great West-
ern Rairoad Company is charged
with the duty to maintain the via-
duct crossing its right of way on
East 22nd Street or the Peru Road
in the City of Dubuque and the ap-
proaches thereto; and
Whereas, the floor of said viaduct
and said approaches are in need of
immediate repair to avoid serious
accidents occurring thereon; and
Whereas, the right of way of said
railroad company as it crosses
Rhomberg Avenue and East 22nd
Street is rough and out of repair
and it is the duty of said railroad
company to maintain the same in
good condition; and
Whereas, the storm sewer under
the right of way of said Company as
it crosses East 17th Street is in need
of repair and a new sewer or drain
is necessary to be built on the south
side of East 16th Street, and it is
the duty of said railroad company to
maintain said sewers in good condi-
tion and to construct Whatever
drains or sewers are found to be
necessary under its right of way;
and
Whereas, the attention of sail rail-
road company has been called re-
peatedly to the above matter, but
nothing has been done by said Com-
pany to cause the repairs to be
made; now, therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque that it be
and it is hereby declartd that the
foregoing repairs and improvements
are deemed necessary and that said
railroad company be and it is here-
by directed to make the same, said
repairs to be constructed in the fol-
lowing manner and of the following
materials to. the satisfaction of the
Manager and Engineer, to -wit:
1st. A new floor of substantial
plank or other satisfactory materials
shall be laid in the viaduct.
2nd. The East and West ap-
proaches to the viaduct shall be re-
paired with Tarvia or other satis-
factory materials.
3rd. The right of way crossings
at Rhomberg Avenue and East 22nd
Street shall be repaired with Kyrock
Asphalt.
4th. The bottom of the storm
sewer on East 17th Street shall be
rebuilt to permit water to flow
through the same from West to East
and a new drain or sewer shall be
constructed on the south side of
East 16th Street under the right of
way.
Be it further resolved that said
repairs are hereby ordered to be

started not later than the 15th day
of August, 1927, and to be completed
not later than the first day of Sep-
tember, 1927.
Be it further resolved that a copy
of this resolution be served upon the
resident Agent or Superintendent of
said Railroad Company by the City
Clerk and in the event the repairs
and improvements above outlined
are not made or construction there-
on if not begun within the time
above stated then this Council will
order the improvements and repairs
to be made and charge the cost
thereof to said railroad company.

Attorney Geo. Lyon addressed the
Council relative to the special as-
sessment against the Clara Hether-
ington property for the improvement
of Dorgan Place, the remonstrance
against this assessment having been
received and filed at a previous
meeting, after the Council had view-
ed the grounds. He stated that the
property received no benefit from
this improvement and asks that if
the Council cannot cancel the assess-
ment, they should make a substan-
tial reduction. No action taken by
the Council at this meeting.
Messrs. Henry Gniffke and Chas.
McLean addressed the Council rela-
tive to the appropriation made by
the Council for the Library, stating
that instead of reducing the appro-
priation the Council should have in-
creased it, that the building needs
repairs, a new roof, and paniting,
and that the present appropriation
is not adequate to meet all of these
expenses. They were informed that

the budget estimate as advertised
cannot be increased, but that it
would be possible for the Council
next year to appropriate additional
funds from the General Fund for
Library purposes. No further action
taken by the Council at this time.
Petition of Peter H. McCarthy, re-
ferred to the City Council by the
Dubuque County Board of Supervis-
ors, asking for a refund on the 1921,
1922, 1923, 1924 and 1925 taxes, and
to have the valuation of 1926 for
taxation purposes reduced on lots in
the Dubuque Harbor Improvement
Company's Addition, on account of
being over- assessed.
Councilman Maclay moved that
the petition be received and filed
and the Board of Supervisors be
notified of the Council's action.

Resolution Providing for the Issu-
ance of Public Improvement
Bonds
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of West Street
(curb and gutter) hereinafter de-
scribed has been completed and said
improvement has been accepted by
the City Council of said City and
the City Engineer has computed the
cost and expense thereof to be
$786.19; and,
Whereas, public notice as provid-
ed by law, has been published by the
City Clerk stating the intention of
the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined;
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improving West Street with curb
and gutter from the west line of
Finley Street to the west line of
Gilliam Street, there be issued im-
provement bonds to the amount of
$786.19. Said bonds shall be issued
under the provisions of Chapter 311
of the Code of Iowa, 1924, which
bear date as of the 15th day of
September, A. D., 1927, shall be in
the denominations of $100.00 each,
except that there shall be one bond
to the amount of $86.19; they shall
be numbered from 1495 to 1502 in-
clusive, and shall be divided into 8
series of which the bond numbered
1495 shall constitute the first series
and shall be payable on the 1st day
of April, A. D., 1928; the bond num-
bered 1496 shall constitute the sec-
ond series and shall be payable on
the 1st day of April, 1929; the bond
numbered 1497 shall constitute the
third series and shall be payable the
1st day of April, 1930; the bond
numbered 1498 shall constitute the
fourth series and shall be payable
the 1st day of April, 1931; the bond
numbered 1499 shall constitute the
fifth series and shall be payable the
1st day of April, 1932; the 'bond
numbered 1500 shall constitute the
sixth series and shall be payable
the 1st day of April, 1933; the bond
numbered 1501 shall constitute the
seventh series and shall be payable
the 1st day of April, 1934; the bond
numbered 1502 shall constitute the
eighth series and shall be payable
the 1st day of April, 1935.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessment levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City of
Dubuque. Said bonds shall be sub-
stantially in the following form:

City of Dubuque pursuant to and by
virtue of Chapter 311 of the Code of
Iowa, 1924, and in accordance with
a resolution of the City Council of

one of a series of 8 bonds, 7 for
$100.00 each and numbered from
1495 to 1501, inclusive, and one for
$86.19 numbered 1502, all of like
tenor and date, and issued for the
purpose of constructing curb and
gutter on West Street from the west
line of Finley Street to the west line
of Gilliam Street, and described in
Special Session, August 15th, 1927
said resolution; which cost is as-
sessable and levied along said im-
provement, and is made by law a
lien on all abutting or adjacent
property, and payable in ten annual
installments, with interest on all de-
ferred payments at the rate of five
per cent per annum, and this bond
is payable only out of the money
derived from the collection of' said
special tax, and said money can be
used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done
precedent to and in the issuing of
this series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably pledg-
ed.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 15th day of September,
1927, and has authorized the use of
their fac - simile signatures to the in-
terest coupons hereto attached.

Resolution Providing for the Issu-
ance of Public Improvement
Bonds
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Overview
Court, hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost and
expense thereof to be $2,947.94; and,
Whereas, public notice as provid-
ed by law, has been published by the
City Clerk stating the intention of
the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined;
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost of
improving Overview Court, from the
west line of South Grandview Ave-
nue to the end of said street, there
be issued improvement bonds to the
amount of $2,947.94. Said bonds
shall be issued under the provisions
of Chapter 311 of the Code of Iowa,
1924, which bear date as of the 15th
day of September, A. D., 1927, shall
be in the denominations of $300.00
each, except that there shall be one
bond to the amount of $247.94; they
shall be numbered from 1513 to 1522,
inclusive, and shall be divided into
10 series of which the bond num-
bered 1513 shall constitute the first
series and shall be payable on the
1st day of April, A. D., 1928; the
bond numbered 1514 shall constitute
the second series and shall be pay-
able on the 1st day of April, 1929;
the bond numbered 1515 shall con-
stitute the third series and shall be
payable the 1st day of April, 1930;
the bond numbered 1516 shall con-
stitute the fourth series and shall
be payable the 1st day of April,
1931; the bond numbered 1517 shall
constitute the fifth series and shall
be payable the 1st day of April,
1932; the bond numbered 1518, shall
constitute the sixth series and shall
be payable the 1st day of April, 1933;
the bond numbered 1519 shall con-

stitute the seventh series and shall
be payable the 1st day of April,
1934; the bond numbered 1520 shall
constitute the eighth series and shall
be payable the 1st day of April,
1935; the bond numbered 1521 shall
constitute the ninth series and shall
be payable the 1st day of April,
1936; the bond numbered 1522 shall
constitute the tenth series and shall
be payable the 1st day of April, 1937.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable
semi - annually, in accordance with
the terms of the coupons thereto at-
tached; and said bonds shall be
payable out of the proceeds of the
special assessment levied for said
improvement. Both principal and
interest shall be payable at the of-
fice of the City Treasurer in the
City of Dubuque. Said bonds shall
be substantially in the following

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.,
19....; or any time before that date
at the option of the City the sum of
Three Hundred Dollars with inter-
est thereon at the rate of 5 per cent
per annum, payable on the presen-
tation and surrender of the interest
coupons hereto attached, both in-
terest and principal are payable at
the office of the City Treasurer in
the City of Dubuque in the State of
Iowa. This bond is issued by the
City of Dubuque pursuant to and by
virtue of Chapter 311 of the Code of
Iowa, 1924, and in accordance with
a resolution of the City Council of
said City, duly passed on the 15th
day of August, 1927. This bond is
one of a series of 10 bonds, 9 for
$300.00, numbered from 1512 to 1520,
inclusive, and one for $247.94, num-
bered 1521, all of like tenor and
date, and issued for the purpose of
improving Overview Court, from
the west line of South Grandview
Avenue to the end of said street,
and described in said resolution;
which cost is assessable and levied
along said improvement, and is
made by law a lien on all abutting
or adjacent property, and payable
in ten annual installments, with in-
terest on all deferred payments at
the rate of five per cent per annum,
and this bond is payable only out of
the money derived from the collec-
tion of said special tax, and said

of the 1926 tax on the east one -half
of Lot 5, Yates' and Pickett Sub.,
that she is a widow and has very -
little income, outside of what she
earns, and finds it almost impossible
to pay the full amount, she there-
fore asks that the County Treasurer
be instructed to accept $110.00 in
full of settlement of the 1926 tax.

Telegraph Co., stating that they have
received notice to remove the
messenger's bicycle rack from the
sidewalk in front of their office. The
only reason that this rack is provid-

ed by the Company is for keeping
the bicycles away from the curb and
they hereby ask that the rack be
permitted to remain in its present
location. Councilman Maclay moved
that the petition be referred to the
Chief of Police. Seconded by Coun-

lars of this was for a license and

grounds after the carnival had left.
They state that they have lost money
on this venture or they would not
ask for the return of the money.

signed owners of Lots 20 and 21 of
O'Neil's Second Addition to the City
of Dubuque, Iowa, which lots are
abutting on College and Edith
Street in the City of Dubuque, Iowa;
and the undersigned being the own-
ers of all of the property abutting
on that part of the alley first North
of Langworthy, and running Easter-
ly from College Ave. to the Westerly
line of Edith Street in said City,
hereby consent to the vacation of
said alley from College Street to the
Westerly line of Edith Street, and

and diligence of said City of Du-
buque are hereby irrevocably pledg-

moved that the rules be suspended
to allow anyone present to address

City Solicitor Czizek reported that
the Citizens' Investment Co. hold a
tax sale certificate for the 1922 tax-

City of Dubuque. This lot was pur-
chased by the City from Emily Hin-
trager May 18th, 1922. Sale of the
1922 taxes took place Dec. 3rd, 1923.
He recommends that the Treasurer
be instructed to redeem this prop-
erty. Councilman Meuser moved
that the recommendation of the City
Solicitor be approved and the City

Resolution of Necessity for
Construction of Sewer
Whereas, a plat and schedule has
been duly prepared by the City
Council of the City of Dubuque and
now on file in the office of the Clerk
thereof, showing the boundaries of
the district, the streets and alleys
and other places along which the
sewers are to be constructed, the
terminal points of the same, each
lot proposed to be assessed therefor,
an estimate of the cost of the same
for each different type of construc-
tion and the kind of materials to be
used and in each the amount thereof
which it is estimated will be assess-
ed against each lot.
Be it therefore, resolved by the
City Council of said City, on its own
motion
That it is deemed necessary and
advisable to construct, lay and put
in place a six -inch sanitary sewer in
the alley between Balke and Bruns-
wick Streets, from Groveland Place
to Lawther Street and in Lawther
Street from the alley between Balke
Special Session, August 15th, 1927
and Brunswick Streets to Balke
Street.
Said sewer shall be provided with
manholes and any other appurten-
ances that may be necessary. Said
sewer shall be constructed in ac-
cordance with the plans and speci-
fications prepared by the City Engi-
neer, having been duly approved by
the City Council and Manager and
State Board of Health and now on
file in the office of the City Clerk.
That the cost and expense of mak-
ing and constructing said sewer
shall be assessed against the pri-
vately owned property abutting
thereon not to exceed the amount
provided by law and upon such ad-
jacent property as might be bene-
fited thereby and in proportion to
such benefits, and any deficiency
shall be paid out of the general fund
or sewer fund, or partly from each
of said funds and bonds shall be is-
sued and sold in anticipation of de-
ferred payment of assessments and
the proceeds thereof used to pay the
contractor.
Be it further resolved that the
above and foregoing sewers are
hereby proposed to be constructed
as hereinbefore set forth, and that
this proposed resolution, except this
paragraph, be and the same is here-
by set down for further and final
hearing, consideration and determi-
nation, at a meeting of this Council
to be held on the 6th day of Septem-
ber, 1927, at 4:30 o'clock P. M. in the
Council chamber of the City Hall of
this City, and the City Clerk be and
he is hereby instructed to cause
notice of the pendency of the above
resolution, and the time and place
when and where said proposed reso-
lution will be considered for passage,
to be given by publication in the
official newspapers of said City, in
the manner and for the time pre-
scribed by law, at which time the
owners of property subject to as-
sessment for said proposed sewer
may appear and make objection to
the boundaries of the proposed dis-
trict, if any, to the cost of the pro-
posed sewers, to the amount propos-
ed to be assessed against any lot,
and to the passage of the proposed
resolution, and unless property own-
ers at the time of the final consider -
ation of said resolution have on file
with the Clerk objections to the
amount of the proposed assessments,
they shall be deemed to have waived

Resolution Providing for the Issu-
ance of Public Improvement Bonds
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Pearl Street,
hereinafter described has been com-
pleted and said improvement has
been accepted by the City Council of
said City and the City Engineer has
computed the cost and expense
thereof to be 1,856.51; and,
Whereas, public notice as provid-
ed by law, has been published by the
City Clerk stating the intention of
the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost
of improvement of Pearl Street,
from the west line of O'Hagen
Street to the end of said street,
there be issued improvement bonds
to the amount of $1,856.51. Said
bonds shall be issued under the pro-
visions of Chapter 311 of the Code
of Iowa, 1924, which bear date as
of the 22nd clay of September, A. D.,
1927, shall be in the denominations
of $200.00 each, except that there
shall be one bond to the amount of
$56.51; they shall be numbered from
1503 to 1511, inclusive, and shall be
divided into 10 series of which the
bond numbered 1503 shall consti-
tute the first series and shall be
payable on the first day of April,
A. D., 1928; the bond numbered
1504 shall constitute the second
series and shall be payable on the
first day of April, 1929; the bond
numbered 1505 shall constitute the
third series and shall be payable the
first day of April, 1930; the bond
numbered 1506 shall constitute the
fourth series' and shall be payable
the first day of April, 1931; the bond
numbered 1507 shall constitute the
fifth series and shall be payable the
first day of April, 1932; the bond
numbered 1508 shall constitute the
sixth series and shall be payable
the first day of April, 1933; the
bond numbered 1509 shall consti-
tute the seventh series and shall be
payable the first day of April, 1934;
the bond numbered 1510 shall con-
stitute the eighth series and shall be
payable the first day of April, 1935;
the bond numbered 1511 shall con-
stitute the ninth series and shall be
payable the first day of April, 1936;
the bond numbered 1512 shall consti-
tute the tenth series and shall be
payable the first day of April, 1937.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable
semi - annually, in accordance with
the terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessment levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City of
Dubuque. Said bonds shall be sub-
stantially in the following form:

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.,
19....; or any time before that date
at the option of the City the sum of
Two Hundred Dollars, with interest
thereon at the rate of 5 per cent per
annum, payable on the presentation
and surrender of the interest cou-
pons hereto attached, both interest
and principal are payable at the
office of the City Treasurer in the
City of Dubuque in the State of
Iowa. This bond is issued by the
City of Dubuque pursuant to and by
virtue of Chapter 311 of the Code of
Iowa, 1924, and in accordance with
a resolution of the City Council of
said City, duly passed on the 22nd
day of August, 1927. This bond is
one of a series of ten bonds, 9 for
$200.00 each, numbered from 1503 to
1511, inclusive, and one for 56.51
numbered 1512, all of like tenor and
date, and issued for the purpose of
improving Pearl Street, from the
west line of O'Hagen Street to the
end of said street, and described in
said resolution; which cost is assess-
able and levied along said improve-
ment, and is made by law a lien on
all abutting or adjacent property,
and payable in ten annual install-
ments, with interest on all deferred
payments at the rate of five per cent
per annum, and this bond is payable
only out of the money derived from
the collection of said special tax,
and said money can be used for no
other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done
precedent to and in the issuing of
this series of bonds, have been done,
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and. diligence of said City of Du-
buque are hereby irrevocably pledg-
ed.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 22nd day of September,
1927, and has authorized the use of
their fac - simile signatures to the
interest coupons hereto attached.

Whereas, all of the owners of the
lots and real estate abutting upon

worthy Street and running easterly
from College Avenue to the westerly

City Council of the City of Dubuque

Mayor Melchior read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of considering
the purchasing of signal system for
controlling traffic and acting on any
other business that may come be-
fore the meeting.

City Council, Dubuque, Iowa:
' Gentlemen: The following bids
were received for furnishing equip-
ment and installing the six traffic
control signals located at 4th and
Main, 7th and Main, 8th and Main,
9th and Main, 11th and Main and 8th
and Locust Streets.
The bid of the United Electric Co.,
proposing to use the General Elec-
tric type of traffic signal is as fol-
lows: For installing at the six in-
tersections complete equipment, $7,-
750.00. If fire control is used add
$540.00. If signals are equipped with
bull's eyes add $420.00.
Keller Electric Co. bid for the in-
stallation of electric traffic controls
at the six intersections, including
fire alarm control, $8,450.00. The
same installation including double
lights, $9,850.00.
Interstate Power Co. bid, using
Crouse -Hinds Co. equipment. As
they did not have their prices all
complete they put in an approxi-
mate bid of $8,000.
It is recommended that the bid of
the United Electric Co., using Gen-
eral Electric equipment, be accept-
ed, using the fire control and not in-
stalling the bull's eyes.

RESOLUTION
Whereas, the City of Dubuque ac-
quired Tax Deed to Lots Nos. 35, 36
and 37, Rosedale Addition, in the
City of Dubuque, Iowa; and
Whereas, the owners of said Lots
desire to have the same reconveyed
to them; now, therefor,
Be it resolved by the City Council
of the City of Dubuque that, in con-
sideration of the sum of $100.00 to
be paid to said City of Dubuque by
Chris. A. Voelker, Jr., Elizabeth
Corpstein, Mary Keller and Rose
Voelker, said City of Dubuque, by its
Mayor and Clerk, will cause to be
executed a Quit Claim Deed to said
Chris. A. Voelker, Jr., Elizabeth
Corpstein, Mary Keller and Rose
Voelker of the above described real
estate.
Be it further resolved that, in ad-
dition to the payment of said $100.00
above stated, said grantees will as-
sume the payment of the remaining
unpaid installments of the special
assessments which have been levied
for the constructioft of a sanitary
sewer in Audubon Street in said
City, and said City of Dubuque, on
its part, will cause to be cancelled
or assigned to said grantees tax
certificates on said real estate of
which it is the owner.

ance entitled "An Ordinance regu-
lating street traffic within the city
of Dubuque; prescribing rules and
regulations for the use of streets,
alleys, boulevards and avenues by
motor and other vehicles; providing
a penalty for violation of the pro-
vision hereof; designating this or-
dinance as the traffic ordinance of
the city of Dubuque, and repealing
Ordinances Numbers 102, 122 and
125, heretofore adopted by the c ity
council of the city of Dubuque," by
establishing a residence district; by
extending the boulevard system; by
repealing certain provisions of said
ordinance relating to suburban dis-
tricts.
