Owing to the fact that Monday, Sept.
5th was a national holiday, the meet-
ing was held Sept. 6th, 1927.
Council met at 4:30 P. M.
Present —City Manager Douglas,
Mayor Melchior, Councilmen Maclay,
Meuser, Schrempf and Yount.
Mayor Melchior stated that this is
the regular monthly meeting of the
Council for the transaction of such
business as may properly come be-
fore the meeting, and that this date
was also fixed for final hearing, con-
sideration and determination on the
resolutions of necessity for the con-
struction of sanitary sewers in the
alley between Balke and Brunswick
Streets from Groveland to Lawther
Streets and in Lawther Street from
the said alley to Balke Street. And
a sanitary sewer in Schroeder Street
from Lowell Street to a point about
260 feet south.
Notice of pendency of resolution
of necessity certified to by the pub-
lisher that it be deemed necessary
and advisable to construct a sanitary
sewer in the alley between Balke
and Brunswick Streets, from Grove -
land to Lawther Streets, and in Law -
ther Street from the alley between
Brunswick and Balke Streets to
Balke Street.
There being 'no remonstrance,
Councilman Schrempf moved that
the notice be received and filed. Sec-
onded by Councilman Maclay. Car-
ried by the following vote:
Yeas —Mayor Melchior, Council-
men Maclay, Meuser, Schrempf and
Yount.
Nays —None.
Resolution of Necessity for Con-
struction of Sewer
Whereas, a plat and schedule has
been duly prepared by the City
Council of the City of Dubuque and
now on file in the office of the Clerk
thereof, showing the boundaries of
the district, the streets and alleys
and other places along which the
sewer are to be constructed, the ter-
minal points of the same, each lot
proposed to be assessed therefor, an
estimate of the cost of the same
for each different type of construc-
tion and the kind of materials to be
used and in each the amount there-
of which it is estimated will be as-
sessed against each lot.
Be it therefore, resolved by the
City Council of said City, on its own
motion:
That it is deemed necessary and
advisable to construct, lay and put
in place a 6 inch sanitary sewer in
the alley between Balke and Bruns-
wick Streets from Groveland Place
to Lawther Street and in Lawther
Street from the alley between Balke
and Brunswick Street to Balke
Street.
Said sewer shall be provided with
manholes and any other appurten-
ances that may be necessary. Said
sewer shall be constructed in ac-
cordance with the plans and speci-
fications prepared by the City En-
gineer, having been duly approved
by the City Council and Manager
and State Board of Health and now
on file in the office of the City Clerk.
That the cost and expense of mak-
ing and constructing said sewer
shall be assessed against the pri-
vately owned property abutting
thereon not to exceed the amount
provided by law and upon such ad-
jacent property as might be bene-
fited thereby and in proportion to
such benefits ,and any deficiency
shall be paid out of the general fund
or sewer fund, or partly from each
of said funds and bonds shall be is-
sued and sold in anticipation of de-
ferred payment of assessments and
the proceeds thereof used to pay
the contractor.
Be it further resolved that the
above and foregoing sewers are
hereby proposed to be constructed
as hereinbefore set forth, and that
this proposed resolution, except this
paragraph, be and the same is here-
by set down for further and final
hearing, consideration and determin-
ation, at a meeting of this Council to
be held on the 6th day of Septem-
ber, 1927, at 4:30 o'clock P. M. in
the Council Chamber of the City
Hall of this city, and the City Clerk
be and he is hereby instructed to
cause notice of the pendency of the
above resolution, and the time and
place when and where said proposed
resolution will be considered for
passage, to be given by publication
in the official newspapers of said
city, in the manner and for the time
prescribed by law, at which time the
owners of property subject to assess-
ment for said proposed sewer may
appear and make objection to the
boundaries of the proposed district,
if any, to the cost of the proposed
sewers, to the amount proposed to
be assessed against any lot, and to
the passage of the proposed resolu-
tion, and unless property owners at
the time of the final consideration
of said resolution have on file with
the Clerk objections to the amount
of the proposed assessments ,they
shall be deemed to have waived all
objections thereto.

Form of Contract for Sewer
Improvements.
Whereas, sewer improvement as
herein described has been ordered
invade and constructed by the City
Council of the City of Dubuque, and
plans, specificatons and form of con-
tract have been duly prepared, now
therefore:
Be it resolved by the City Council
of the City of Dubuque that the
plans, specifications and form of
contract heretofore prepared be and
the same are hereby adopted and
approved for the construction of the
following improvements, to -wit:
Sanitary Sewer in the Alley be-
tween Balke and Brunswick Streets,
from Groveland Place to Lawther
Street, and in Lawther Street from
the Alley between Balke and Bruns-
wick Streets to Balke Street.
Be it further resolved that on the
6th day of September, 1927, a public
hearing will be held at 4:30 o'clock
P. M. in the Council Chambers of
the City of Dubuque, for the purpose
of hearing objections which may be
filed by any interested persons to
the proposed plans or specifications
or form of contract for, or cost of
any of such improvement, and the
City Clerk be and he is hereby di-
rected to cause a notice of the time
and place of such hearing to be pub-
lished in the official newspapers of
the City of Dubuque, , at which hear-
ing the Council will hear such ob-
jections and enter on record its final
decision thereon.
Be it further resolved that the
plans, specifications and form of con-
tract be preserved 6n file in the
office of the Clerk for public inspec-
tion.

Sewers and Directing Clerk to
Advertise for Bids.
Be it resolved by the City Council
of the City of Dubuque, that pur-
suant to a resolution of necessity,
proposed at a meeting of this Coun-
cil on the 15th day of August, 1927,
and duly passed on the 6th day of
September, 1927, it is hereby order-
ed by this Council, upon its own
motion, and without petition of prop-
erty owners, that the sewer de-
scribed in said resolution be con-
structed, the same being a 6 -inch
sanitary sewer in the Alley between
Balke and Brunswick Streets from
Groveland Place to Lawther Street,
and in Lawther Street from the Al-
ley between Balke and Brunswick
Streets to Balke Street.
Said sewer shall be constructed in
accordance with the plans and spec-
ifications heretofore • adopted and
now on file in the office of the City
Clerk.
Be it, further, resolved that the
City Clerk be and he • is hereby or-
dered and directed to advertise for
proposals for the construction of
said sewer, as provided by law,
which sewer shall be completed on
or before the let day of December,
1927.
The cost and expense of said sew-
er will be paid for by levying spe-
cial assessments against the private-
ly owned property abutting upon
said sewer and also against such ad-
jacent property as might be bene-
fited thereby and in proportion to
such benefits, and payment will be
made to the contractor out of funds

realized from the sale of bonds to
be issued in anticipation of deferred
payment of assessments, as provided
by law and any deficiency will be
paid out of the general fund or the
sewer fund, or partly from each of
such funds.
This resolution being deemed ur-
gent and of immediate necessity,
shall be in force and effect from
and after its passage and adoption
by the City Council.

An Ordinance, (No. 190), Amend-
ing an Ordinance, entitled "An Or-
dinance regulating street traffic with-
in the City of Dubuque; prescribing
rules and regulations for the use of
streets, alleys, boulevards, and av-
enues by motor and other vehicles;
providing a penalty for violation of
the provisions hereof; designating
this Ordinance as the traffic ordin-
ance of the City of Dubuque, and re-
pealing Ordinances Numbers 102,
122 and 125, heretofore adopted by
the city council of the City of Du-
buque," by establishing a residence
district; by extending the boulevard
system, by repealing certain provi-
sions of said ordinance relating to
suburban districts. Having passed
first and second reading, presented
for final reading and adoption.

other vehicles; providing a penalty
for violation of the provisions here-
of; designating this ordinance as the
"Traffic Ordinance of the city of Du-
buque" and repealing ordinances No.
102, 122 and 125 heretofore adopted
by the city council of the City of Du-
buque,' by establishing a residence

Subject: Algona Street Repairs.
In answer to the attached petition
I would recommend that only slight
repair% be made on this street this
year and that it be included in the
paving program for next year.

Subject: Brunswick Street Paving.
In connection with the proposed
paving of Brunswick Street, Mr. T.
F. Ris, owner of property on the
west side of Brunswick Street from
Groveland Street north to a point
where Brunswick Street is fifty feet
Wide, offers, in the attached letter,
to deed to the city 25 feet of his'
land on the west side of Brunswick
Street, making Brunswick Street 50
feet in width from Groveland Street
north. Mr. Ris is willing to deed
this land to the city provided the
city will vacate the alley running
through his land. This alley is lo-
cated on the side hill, so steep that.
I can see that it will be of no benefit
to the city. I therefore recommnd
that the city accept this proposition.

Gentlemen: Mr. Fluckinger of
the Fluckinger Motor Co., located on
the southeast corner of Central Av-
enue and Fifth Street requests that
he be allowed to reconstruct the ap-
proach to his garage located on
Fifth Street. This approach is now
constructed out of lumber. He wish-
es to construct the approach out of
concrete and lumber. This approach
extends out into the pavement for
a short distance.
As it is, the only means of en-
trance to his garage and it is the
opinion of the City Engineer and
myself that the type of construction
that he wishes to put in is superior
to that which is now in. I recom-
mend that his petition be granted.

Subject : Brunswick Street Paving.
The plans show that it will be
necessary to grade approximately
4,000 yards to improve O'Neill
Street, Groveland Street and Bruns-
wick Street. The majority of this
grading will be on Brunswick Street.
I recommend that the Council auth-
orize the grading of this street to
be charged against next year's ap-
propriation for grading and that the
legislation for the improvement of
this street be carried through so
that we can have the sewer, water
and gas mains extended and also
have all necessary connections in-
stalled this fall. By the time this
work is done the weather will be
such that it will not be practical to
lay concrete paving. The paving
can be placed on this street in the
spring.

Subject : Bell Telephone Co. re-
quests to cut paving on 14th
Street.
The attached letter from the Bell
Telephone Co., is self explanatory.
As 14th Street is a paving that is
still under maintenance by the con-
tractor and is a main thoroughfare
and it will be necessary for the 'T'ele-
phone Company to cut a trench
through the pavement blocking the
entire street, I do not feel that this
petition should be granted unless
the Council feels that the service
rendered by the Telephone Co. to its
subscribers is such that would war-
rant the granting of this petition.

The petition of J. W. Chappell,
owner of lot 1 of 1 of 1 of City Lot
678, which gives most of the front-
age on one side of Madison Street,
requests that a sanitary sewer be
constructed. It is possible to con-
struct this sewer but as the other
properties have sewer connections
on this street, Mr. Chappell's prop-
erty should bear the entire cost.
Mr. Chappel wishes to have the
city construct this sewer for him if
it is possible for us to do so.

Be it resolved by the city council

tract be awarded to United Electric
Company of Dubuque, Iowa, for the
installation of the following equip-
ment and materials, to wit:
24 G. E. Traffic Signal brackets;
6 automatic timers; all necessary
cable, posts and connections for the
installation of traffic signals at 4th
and Main Streets, 7th and Main
Streets, 8th and Main Streets, 9th
and Main Streets and llth and Main
Street; and 8th and Locust Streets.
In the installation of parkway
cables such cables shall have enough
conductors to take care of the in-
stallation and one spare conductor
in each cable. All parkway cables
shall have conductors color corded.
The installation of the above mater-
ials shall be done in accordance
with the General Electric Company
specifications now on file in the
office of the city manager at the
agreed total price of $2,860.
Be it further resolved that work
on the installation of such materials
shall commence as soon as possible
and shall be fully corhpleted on or
before the 15th day of November,
1927.
Be it further resolved that the
city manager be and he is hereby
directed to execute on behalf of said
city of Dubuque a contract with said
United Electric Company for the in-
stallation of the materials herein
stated and such other materials as
may be incident thereto as provided
for in the specifications.

stated that service thereof had been
duly made, and that this meeting is
called for the purpose of adopting
Ordinance No. 190 regulating street
traffic in the City of Dubuque, ad-
opting resolutions awarding con-
tracts for the furnishing of mater-
ials and supplies, and installing traf-
fic signal controls and acting on any
other business that may come before
the meeting.
Ordinance No. 190 regulating
street traffic in the City of Dubuque,
having passed first and second read-
ing Sept. 6th, 1927, presented for
final reading and adoption.
• ORDINANCE NO. 190
AN ORDINANCE amending an or-
dinance entitled "An Ordinance reg-
ulating street traffic within the city
of Dubuque; prescribing rules and
regulations for the use of streets, al-
leys, boulevards and avenues by mo-
tor and other vehicles; providing a
penalty for violation of the provi-
sions hereof; designating this ordin-
ance as the "Traffic Ordinance of the
City of Dubuque," and repealing or-
dinances Nos. 102, 122 and 125 here-
tofore adopted by the City Council
of the City of Dubuque" by estab-
lishing a residence district and pre-
scribing the speed - limits therein,
providing for the erection of signs
in the business and residence dis-
trict; by extending the boulevard
system so as to include other streets
and those provided for in the ordin-
ance; by repealing Subdivision M,
Paragraph 888, Section 1, Subdivi-
sion A, Rule 51, Paragraph 889, and
Rule 52, Paragraph 889 of said ordin-
ance.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Par. 927. Section 1. RESIDENCE
DISTRICT. That an ordinance en-
titled "An Ordinance regulating
street traffic within the city of Du-
buque, prescribing rules and regula-
tions for the use of streets, alleys,
boulevards and avenues by motor
and other vehicles; providing a pen-
alty for violation of the provisions
hereof; designating this ordinance
as the "Traffic Ordinance of the
City of Dubuque," and repealing or-
dinances numbers 102, 122 and 125,
heretofore adopted by the city coun-
cil of the city of Dubuque" be and
the same is hereby amended by re-
pealing Subdivision (M) Par. 888,
Section 1, and substituting therefor
the following:
(M). Residence district shall
mean all the territory lying outside
of the business district."
Par. 928. Section 2. Speed lim-
its in residence districts. That said
ordinance be further amended by re-
pealing Subdivision (a) of Rule 51,
Par. 889, Section 2, and substituting
therefor the following:
(a). "In the residence district
the maximum rate of speed shall be
twenty -five miles per hour."
Par. 929. Section 3. That said or-
dinance be further amended by re-
pealing Subdivision B, Par. 896, Sec-
tion 9, and substituting therefor the
following:
(b). "East 8th Street from White
Street to the west line of Central
Avenue; and West 8th Street from
west line of Central Avenue to west
line of Julien Avenue; Hill Street
from West 8th Street to north line
of West 3rd Street; West 5th Street
from east line of Wilson Street to
the west line of Coolege Street."
Par. 930. Section 4. That said or-
dinance be further amended by strik-
ing out Subdivision D of Par. 896,
Section 9 and substituting therefore
the following:
(d) "West 14th Street from the
west line of Locust Street to the
west line of Algona Street."
Par. 931. Section 5. Same. That
said ordinance be further amended
by adding to paragraph 896, section
9, the following subdivisions:
(e) "Rockdale Road from the

Signs. That said ordinance be fur-
ther athended by repealing Rule 52,
Paragraph 889, Section 2, and 'sub-
stituting therefore the following:
"That there shall be erected suit-
able signs, in the residence and busi-
ness district, showing th'e points at
which the rate of speed changes and
the maximum rate of speed in the
district which the vehicle is enter-
ing."
Section 7. That this ordinance
being deemed urgent and of imme-
diate necessity shall be in force and
effect from and after its final pass-
age, adoption and approval by the
City Council of the City of Dubuque
and publication as provided by law.

ditional intersections which the

order within 10 months from the

accordance with the specifications

commence work upon the installa-
tion of the equipment herein stated
as soon as possible and that all work
under this contract shall be fully
completed on or before November

this neighborhood, and furthermore
during heavy rains this refuse
washes over the neighboring prop-
erties.

Petition of Mary J. Sullivan and
H. J. Hoffman as executors of the
Estate of Elizabeth Byrne, deceased,
and Rachel O'Brien and Michael
O'Brien, stating that Elizabeth
Byrne died testate June 2nd, 1927,
the owner of Lots 81 -82, Union Add.,
in the City of Dubuque.
That subsequently the executors
above named sold the North 160 feet
of said lots to Rachael O'Brien and
Michael O'Brien conveyed the same
by warranty deed, subject to unpaid
special assessments. The said lots
comprise a frontage of 200 feet on
Holly Street, the south 40 feet have
been retained by this estate. It is
desired that authortiy be given to
again assess these lots proportion-
ately to the frontage and area in-
volved, to the end that the owners
of either piece, that is, either the
owner of the North 160 feet or the
owner of the South 40 feet may at
any time pay the street improve-
ment assessment against that parcel
owned by them and discharge the
real estate therefrom.

While traveling on said street on his

motorcycle, one of the wheels of his
motorcycle dropped into a hole or
depression in said street causing
him to be thrown from his motor-
cycle to the street and dislocating
the bones of his right foot and other-
wise bruising and lacerating his
body.

nue is $66.54 with penalties. That
he has been unable to meet the pay-
ments on these assessments, and
nothing has been paid thereon, be-
ing a laboring man. He feels that
this assessment is excessive and
asks the Council to view the prem-
ises and reduce the assessment to a
reasonable amount, and he will at-
tempt to secure by loan to pay the
same in cash.

Heim's Hollow, • should be turned
northward to the little Maquoketa,
which they claim was at one time
its natural course.

trix.
The City Solicitor recommends
that the Citizen's Investment Co.
who purchased the property be re-
imbursed by the City and County
and the tax sale certificate be can-
celled.

tion of said improvement could not
be begun or completed at the time
provided for, as herein stated:
Now, therefore, be it resolved by
the City Council of the City of Du-
buque that the time for completion
of the construction of said improve-
ment be and the same is hereby ex-
tended to the fifteenth day of No-
vember, 1927, and such completion
date shall take the place of and be
substituted for the said date of July
1st, 1927, which was provided for in
the resolution ordering the construc-
tion of said improvement.

in its path, this they believe is due
to bad intakes into Roosevelt sewer,
corner of Rhomberg Avenue and
Roosevelt Street. They suggest
that this intake be changed and ad-
ditional intakes be provided on
Roosevelt Street near Lincoln
Avenue or further west.

the rules be suspended to allow any
one present who wishes to do so to
