Regular Session, October 3, 1927.
Council met at 4:50 P. M.
Present —Mayor Melchior, Council-
men Maclay, Schrempf and Yount.
Absent — Councilman Meuser.
Mayor Melchior stated that this
is the regular monthly meeting of
the Council for the purpose of acting
on any business that may properly
come before the meeting.
Councilman Yount moved that the
rules be suspended for the purpose
of allowing any one present, who
wished to do so to address the Coun-
cil. Seconded by Councilman Ma-
clay. Carried by the following vote:
Yeas —Mayor Melchior, Council-
men Maclay, Schrempf and Yount.
Nays —None.
Absent — Councilman Meuser.
Mrs. Robert Jungk addressed the
Council, objecting to the assessment
against her property on Madison
Street for the improvement of Dor-
gan Place, and the alley from West
17th Street to Dorgan Place. Stat-
ing that her property does not abutt
these improvements, that she has
no outlet to either the street or al-
ley and therefore she derives no
benefits from these improvements,
and her property should not be as-
sessed.
Councilman Schrempf moved that
this matter be referred to the Coun-
cil to view the grounds. Seconded
by Councilman Maclay. Carried by
the following vote:
Yeas —Mayor Melchior, Council-
men Maclay, Schrempf and Yount.
Nays —None.
Absent — Councilman Meuser.
L. Howell addressed the Council,
stating that West 17th Street, owing
to the heavy rains recently, is bad-
ly washed out and that he is unable
to drive his car to his garage, and
he hereby asks that the street be
repaired and made passable.
City Engineer Cullen stated that
he had this on his program and the
street will be repaired as soon as
he can get to it, that he has quite
a few places in the same condition
and that the Engineering Depart-
ment is having these streets re-
paired as fast as it can de done.
Resolution Awarding Contract
Whereas, proposals have been sub-
mitted by contractors for the con-
struction of a 6 inch tile sanitary
sewer in the alley between Balke
Street from Groveland Place to Law -
ther Street and in Lawther Street
from the alley between Balke Street
and Brunswick Street, and Uhlrich-
Paley Company, contractor, has sub-

mitted the lowest bid for the fur-
nishing of all labor and materials
and performing the work as provid-
ed for in the plans and specifica-
tions; now therefore,
Be it resolved by the City Council
of the City of Dubuque that the con-
tract for the construction of a 6 inch
tile sewer in the alley between
Balke and Brunswick Streets from
Groveland Place to Lawther Street
and in Lawther Street from the alley
between Balke and Brunswick
Streets to be awarded to Uhlrich-
Paley Company, and the Mayor and
Manager be and they are hereby di-
rected to execute a contract on be-
half of the City of Dubuque for the
complete performance of said work.
Be it further resolved that this
resolution being deemed urgent and
of immediate necessity become ef-
fective from and after its passage
and adopted by the City Council.
Resolution approved and ordered
placed on file for not less than one
week for public inspection, Sept. 26,
1927.

Resolution Awarding Contract
Whereas, proposals have been sub-
mitted by contractors for the con-

hole in Lowell Street to a point
about 260 feet south, and Cook &
Kean, contractor, has submitted the
lowest bid for the furnishing of all
labor and materials and performing
the work as provided for in the
plans and specifications; now there-
fore,
Be it resolved by the City Council
of the City of Dubuque that the con-
tract for the sewer in Schroeder
Street from manhole in Lowell
Street to a point about 260 feet
south be awarded to Cook & Kean,
and the Mayor and Manager be and
they are hereby directed to execute
a contract on behalf of the City of
Dubuque for the complete perform-
ance of said work.
Be it further resolved that this

of immediate necessity become ef-
fective from and after its passage

Petition of D. S. Cameron, stating
that the 2900 block on Pinard Street
has no outlet, and that the City
Council viewed this about a year ago
and investigated the advisability of
opening 30th Street, and suggested
that a better way would be to grade
the street at the end of said 2900
block, so that automobiles could turn
around instead of backing out, as
Pinard Street is very narrow, but
nothing has been done. He also
states that street intersection at
29th and Pinard Streets is badly
washed out owing to the heavy rains
recently, and the residents in this
neighborhood ask that the street be
repaired and made passable.
Councilman Schrempf moved that
the petition be referred to the City
Engineer. Seconded by Councilman
Maclay. Carried by the following

Petition of P. A. Petrakis,' with
bond attached for permit to sell cig-
arettes at 998 Central Avenue,
(Grand Cafe), presented for approv-

permit be granted. Seconded by
Councilman Maclay. Carried by the

Petition of the N. W. Bell Tele-
phone Co., stating that they find that
the city owns lots 8 and 24 of Grand-
view Heights Add., and it is their
desire to run underground cable
from north to south along the back
line of these lots, and they hereby
ask the Council to enter into a right
of way agreement with said Com-
pany.

the petition be referred to the City
Solicitor. Seconded by Councilman

Be it further resolved that should
the owners of said property fail or
refuse to construct said sidewalks
within the time stated herein, then
contract therefore shall be let as
provided by ordinance and the cost
thereof assessed as in cases of spe-
cial assessment.

Terrace, asking that a street light
be installed at the intersection of
said streets. • Stating that this is a
dark place and a loafing place for
hootch drinkers as empty bottles
found there will verify, also in win-
ter it is dangerous for pedestrians,
as the crossing is covered with ice
and snow. Signed by Geo. W. Glab,

Mayor Melchior read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of awarding
the contract for grading O'Neill
Street, Brunswick Street and Grove -
land Place, and acting on any other
business that may come before the
meeting.
Councilman Maclay moved that
the rules be suspended for the pur-
pose of giving anyone present who
wished to do so, an opportunity to
address the Council. Seconded by
Councilman Meuser. Carried by the

Mrs. Franz Otto, et al, addressed
the Council on behalf of the Daugh-
ters of the Civil War Veterans, ask-
ing that steps be taken to build a
Memorial Hall in the . City. They
were advised to take this matter up
with other civic societies in the city
and devise some definite plans for
such a building.

on property owners in various parts
of the City to construct cement side-
walks.

sig, stating that she received a no-
tice to construct a sidewalk in front

Street. She states further that when
the Bee Branch sewer was construct-
ed, the sidewalk was torn up about
50 feet and was never replaced, and
she hereby petitions the City Coun-
cil to replace that portion of the
sidewalk which was removed.

stating that he was notified to con-
struct a 5 foot sidewalk in front of

asks that he be allowed to put in
a 4 foot sidewalk.

Petition of Henry Trenkle, stat-
ing that he is the owner of lot 8 in
Grandview Heights Add., situated on
the N. E. corner of Grandview Ave.
and Dillon Street. Dillon Street is
not improved. He further states
that after a rain the water flows
from Grandview Avenue to Dillon
Street, and the condition of Dillon
Street is such that the water flows
over his lot and caried off a great
amount of the filled ground. He
hereby asks the Council to take such
action, and remedy this condition
by changing the course of the water
to flow down Dillon Street and pre-
vent further damage to his property.

the petition be referred to the City
Manager and Engineer. Seconded
by Councilman Maclay. Carried by

Petition of Frank Sieg, referred
to the City Council by the Board
of Supervisors, asking that the 1926

the lots at the 1927 session.

the petition be received and filed
and the Board of Supervisors be no-
tified of the Council's action. Sec-

Petition of Mrs. Martha M. For-
ward, referred to the City Council

ing that she paid the 1925 tax on
a valuation of $3,100.00, that the
Board of Review in 1927 reduced the
valuation for taxation to $2,000.00
and she hereby asks that the 1926
tax be reduced and she be allowed
11, 1927
to pay the 1926 tax on this valua-
tion.

Melchior and Councilman Schrempf.
Councilmet at 4:30 P. M.

Mayor Melchior read .the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of adopting.
a resolution relative to the sale of
certain property in the Industrial
Subdivision and acting on any other
business that may come before the
meeting.
RESOLUTION providing for the
sale to Maizewood Building Com-
pany of lots 4 and 3 in Block B,
Industrial Subdivision in the city
of Dubuque and lot 4 in Block C,
in said subdivision and also that
part of Charter Street lying east
of the west line of lot 4 Block C,
produced to the west line of lot
3 Block B, in said subdivision, to
the west line of Salina Street;
also granting a right and option
to said Maizewood Building Com-
pany to purchase lots 1 and 2 of
Block B and lot 1 of Block C, in
said Industrial Subdivision, also
that part of ,Charter Street lying
west of the west line of lot 4,
Block C, produced to the west line
of lot 3, Block B, to the east line
of Harrison Street.
WHEREAS, the city of Dubuque
is the owners of lots 1, 2, 3 and 4
of Block B of Industrial Subdivision
in the city of Dubuque, Iowa; and,
lots 1 and 4 of Block C of said Sub-
division, and,
WHEREAS, Maizewood Building
Company, a corporation of Iowa, de-
sire to purchase lots 4 and 3 in
Block B in said subdivision (being
the east half of said Block B) ; and
also lot 4 of Bock C in said subdi-
vision (being the east half of the
southerly portion of said Block C) ;
and also that part of Charter Street
lying east of the west line of lot 4
of Block C produced to the west
line of lot 3 of Block B, easterly
to the west line of Salina Street,
said Charter Street to be hereafter
vacated from Harrison Street to
Salina Street; and, whereas,
Maizewood Building Company,
aforesaid, desire of said city of Du-
buque the right and option, within
five years from January 1st, 1928,
to purchase at the same price paid
for said lots 3 and 4 in Block B and
lot 4 in Block C, said subdivision,
the following lands which lie west-

erly thereof, to wit: Lots 1 and 2
of said Block B, Lot 1 of said Block
C, and that part of Charter Street
lying west of the westerly line of
Lot 4 Block C produced to the west-
erly line of lot 3 of Bock B westerly
to the east line of Harrison Street;
and whereas,
It is deemed advisable by the city
council of the city of Dubuque to
sell the lots above described and to
grant the option requested:
Nov, therefore, be it resolved by
the city Council of the city of Du-
buque, that, in consideration of the
sum of $11,423 to be paid by said
Maizewood Building Company, there
be sold to said Maizewood Building
Company lots 4 and 3 of Block B,
lot 4 of Block C, all in Industrial
Subdivision aforesaid, and also that
part of Charter Street lying east of
the westerly line of lot 4 Block C,
produced to the westerly line of lot
3 Block B, easterly to the west line
of Salina Street, and the Mayor and
Clerk of said city of Dubuque are
hereby authorized and directed to
execute and deliver to said Maize -
wood Building Company a warranty
deed of said city, conveying to said
Grantee said lots and part of Chart-
er Street herein described.
Be it further resolved that, in con-
sideration of the sum of $1.00 (one)
there be and there is hereby granted
to said Maizewood Building Com-
pany the right and option at any
time within five years from January
1, 1923 to purchase at the same price
paid for lots 4 and 3, Block B, and
lot 4 in Block C, said subdivision,
lots 1 and 2 of Block B and lot 1
of Block C, said subdivision, and
also that portion of Charter Street
lying west of the westerly line of
lot 4 Block C produced to the west-
erly line of lot 3 Block B westerly
to the east line of Harrison Street.
Be it further resolved that this
resolution be taken and construed as
an option agreement between the
city of Dubuque and the Maizewood
Building Company, and the provis-
ions hereof shall be binding upon
said city and said Maizewood Build-
ing Company when and after said
Maizewood Company shall have paid
the consideration herein stated and
when the acceptance of the provi-
sion of said option shall have been
endorsed hereon by the proper offic-
ers of said Company.
Be it further resolved that a prop-
er ordinance be adopted by this
Council providing for the vacation
of said Charter Street easterly from
the east line of Harrison Street to
the west line of Salina Street.

buque this 21st day of October, 1927.

Petition of Fred Hanselman, stat-
ing that he received notice to con-
struct a sidewalk in front of lot
west 45.16 feet of lot 1 of 108 Me-
chanic's Add. He stated that he
bought this lot from Emil Feigner
under contract, and furthermore, he
had two deaths in his family during
the year and that it will work a
great hardship on him to have this
sidewalk constructed at this time.
He hereby asks the Council to ex-
tend the time on this, until next
spring, he will then construct the
walk.
Councilman Schrempf moved that
the prayer of the petition be grant-
ed. Seconded by Councilman Meus-
er. Carried by the following vote:

Communication from the Engineer-
ing Extension Department Iowa
State College, at Ames, Iowa, stat-
ing that a conference on Sewage
Treatment is held at Ames once a
year for the purpose of instructing
plant operators and city officials in
the proper operation of municipal
and industrial plants. Asking that
the city be represented.
Councilman Meuser moved that
the City Engineer be authorized to
attend this meeting, to be held at
Ames, Iowa, Nov. 8, 9 and 10, 1927.

feet north, levied June 10, 1926, be
cancelled, and the Treasurer be no-
tified accordingly. Seconded by
Councilman Maclay. Carried by the
