The City of Dubuque petitioned the court for title to an abandoned property at 574 Loras
Boulevard, and was granted title to the property in October 2020. Based on the

able to restore the structure. Five of the ten people contacted toured the home but only
one person expressed interest in the property; however, no offer for the property or plan
for its restoration was received so the request for demolition of the historic structure was
brought before the Historic Preservation Commission on November 19, 2020.
One day prior to the meeting, the Housing & Community Development Department
received an offer to purchase the property from John McAndrews, however the offer did
not include a plan for stabilization of the property as requested. This information was
presented to the Commission at the November meeting. Knowing that there was
potential interest in restoring the property by Mr. McAndrews, the Historic Preservation
Commission denied the request for demolition.
Mr. McAndrews withdrew his offer on December 1, 2020, so the Housing & Community
Development Department returned to the Historic Preservation Commission with a
request to demolish the structure on December 17, 2020. The Historic Preservation
Commission reviewed this criterion on December 17th, 2020 and voted to recommend
the demolition to the City Council with a vote of 5-1.
Housing & Community Development Director Alexis Steger recommends City Council
approval of the demolition of 574 Loras Boulevard as recommended by the Housing &
Community Development Department and the Historic Preservation Commission due to
the significant deterioration that no longer makes this a viable structure.

Background
The City of Dubuque petitioned the court for title to an abandoned property at 574 Loras

evaluated, and was not a viable option for rehabilitation due to significant deterioration.
Discussion
Based on the structural deterioration of the foundation, which had failed once already, the
city did not believe the home at 574 Loras Boulevard was able to be saved in its condition;
however, due to its historic nature the Housing & Community Development Department
contacted known preservationist and some no-profit partners to see if they may be able to
restore the structure. Five of the ten people contacted toured the home but only one

Based on the Unified Development Code, the Historic Preservation Commission is
advisory to the City Council when the structure requesting to be demolished is owned by
the City of Dubuque. The Commission can review the following criteria as set by Chapter
10-2(G) of the Unified Development Code:
2. The commission may require that the applicant make submissions concerning the
following information for the proposed site and suitable alternative location(s),
including but not limited to:
a. Fair market value of property.
b. Estimate of the cost of the proposed demolition, including hazardous
material removal and remediation.
c. Fair market value of any property owned by the governmental body that
could be sold if that site is not chosen for the project.
d. Property tax impact of removing private property from the tax rolls at the
proposed location and all alternative locations.
e. Any other factors that contribute to making one location more suitable than
others for the proposed use.
f. Any other information appropriate to evaluating how all conflicting
governmental interests may be accommodated.
g. The need for the use in question, the effect on neighboring property, and
the environmental impact of the proposed use.
The Historic Preservation Commission reviewed this criterion on December 17th, 2020 and
voted to recommend the demolition to the City Council with a vote of 5-1. A letter from the
Historic Preservation Commission is attached providing more detail on the process
required.
The structure located at 574 Loras Boulevard is a contributing structure to the W 11t"
Street Historic District. It is an unusual pre-Civil War structure that can be found on
historical surveys dating back to the 1800's. There is no doubt this is a historic structure
that had been allowed to deteriorate during tenancy and after being abandoned.
Noteworthy deterioration includes a severe leak around the chimney and significant
damage to the rear addition. Additionally, the rear addition has a concrete block foundation
that is collapsing. The rock wall foundation is also bowed, indicating failure. There are
many other features in the building that make it difficult to rehabilitate and meet modern
codes, including ceilings that are 6'5" to 6'8" in height and stairways 25" in width.
Feedback from some of the developers that toured the building was that the structure was
small, needed significant rehabilitation which would include the demolition of the rear
addition. Pictures are attached to show the condition of the structure.
The reason city staff wanted a developer to submit a plan for rehabilitation and stabilization
when determining interest in saving the structure was that this structure is in a state of
collapse due to the condition of the foundation. The determination to demolish or spend
significant money stabilizing the structure needs to be made expeditiously. Additional
weight from snow fall could cause dangerous conditions without some action. Without an
interested developer, the City needs to make the same expeditious decision.
Recommendation
I respectfully recommend City Council approve the demolition of 574 Loras Boulevard as
recommended by the Housing & Community Development Department and the Historic

WHEREAS, the City of Dubuque Historic Preservation Commission recognized
by majority vote that the property at 574 Loras Boulevard is Historically Significant; and,
WHEREAS, the City of Dubuque Historic Preservation Commission voted to
recommend demolition of the property due to deterioration by majority vote on
December 17, 2020; and,
WHEREAS, the City of Dubuque Housing & Community Development
Department solicited ten developers to try to save the historic structure to no avail; and,
WHEREAS, for the safety of the public, the Housing & Community Development
Department is recommending demolition in a timely manner to prevent collapse.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA, AS FOLLOWS:
Section 1. The demolition of 574 Loras Boulevard is hereby approved.

Re-Application for Demolition: This is a staff report for a re-submitted application for
demolition following a chanqe in the status since the demolition was denied bv the
Historic Preservation Commission at the November 19, 2020 meetinq. Any information
that is different from the previous application for demolition is underlined in this staff
report.
Physical Characteristics: This is a squat, two-story side-gable traditional vernacular I-
house. The low story height and roofline are characteristic of early regional modest
structures. It is estimated that this frame structure dates from 1855-60, based on
observation and multiple historic records from later dates. The structure retains its
original massing and shape, but is devoid of original detail and most materials. It has
two columns of windows on the primary facade with an offset left entrance, covered by a
mid-20t" Century aluminum awning. The rear has two early additions (pre-1909 per
Sanborn fire insurance maps) with a back-gabled one-story room at the southeast
corner. A previously open shed roof, one-story porch is now enclosed, located at the
southwest corner. A one-story outbuilding at the southeast corner of the lot is no longer
extant. The structure is clad in wide reveal aluminum siding and has wood windows with
aluminum storms. It has an asphalt roof and limestone foundation, most of which is
covered in aluminum siding.
Ownership and Request for Demolition: The owner is the City of Dubuque, which
took ownership of this vacant structure after petitioning the courts earlier this year. The
Housing & Community Development Department serves as the applicant. Because the
structure is in a City designated historic district, the demolition request comes before the
Commission. This request came before the Commission on November 19, 2020 and

was reiected because it was found to be architecturallv and historicallv siqnificant, and
because there appeared to be a viable offer for restoration on the table. The issue
comes back to the Commission because that offer is now withdrawn. Because this
structure is owned by the City, we are utilizinq the appropriate clause in our ordinance
for the review and consideration. It is located under Section 16-10-5: G: Guidelines and
Review Criteria for Applications by State or Political Subdivision of State.

Historical Siqnificance:
This structure was identified as a contributing structure for a potential National Register
Eligible district in 1978/79, when Bruce Kriviskey performed a city-wide survey. The
same conclusion happened when the West 11t" Street Historic District was listed on the
National Register of Historic Places and when it became a local historic district. The
most recent survey in 2004 by Jim Jacobsen confirms this, although his interpretation is
that the date is later than other historical evidence shows. For more historical evidence,
see the attached Survey and Historic Record Collection document compiled for this
application.
Staff Analysis: The structure dates from on or before 1855-1860, but has been
modified through removal and obliteration of character defining features. It is listed on
the National Register of Historic Places, and is a contributing structure within the West
11t" Street local and National Register historic districts and the conservation district of
the same name. It is architectural significant as a result. This analvsis has not chanaed
since the November 19, 2021 meetinq.
Role of the Commission: The Role of the Historic Preservation Commission is to
review the information and make a recommendation as to the following, according to
Section 16-10-5 of the Universal Development Code.
We are not requestina that the Commission vote on whether this structure is
architecturally or historicallv siqnificant aqain, as the November analysis is still relevant.
The application should be re-evaluated under Subsection G for a request bv a State or
Political Subdivision of State. The application supplied bv the applicant, answerinq the
questions below, remains the same as the November 19, 2020 application.
SUBSECTION G:

Re-Application for Demolition: This is a staff report for a re-submitted application for
demolition following a chanqe in the status since the demolition was denied bv the
Historic Preservation Commission at the November 19, 2020 meetinq. Any information
that is different from the previous application for demolition is underlined in this staff
report.
Physical Characteristics: This is a squat, two-story side-gable traditional vernacular I-
house. The low story height and roofline are characteristic of early regional modest
structures. It is estimated that this frame structure dates from 1855-60, based on
observation and multiple historic records from later dates. The structure retains its
original massing and shape, but is devoid of original detail and most materials. It has
two columns of windows on the primary facade with an offset left entrance, covered by a
mid-20t" Century aluminum awning. The rear has two early additions (pre-1909 per
Sanborn fire insurance maps) with a back-gabled one-story room at the southeast
corner. A previously open shed roof, one-story porch is now enclosed, located at the
southwest corner. A one-story outbuilding at the southeast corner of the lot is no longer
extant. The structure is clad in wide reveal aluminum siding and has wood windows with
aluminum storms. It has an asphalt roof and limestone foundation, most of which is
covered in aluminum siding.
Ownership and Request for Demolition: The owner is the City of Dubuque, which
took ownership of this vacant structure after petitioning the courts earlier this year. The
Housing & Community Development Department serves as the applicant. Because the
structure is in a City designated historic district, the demolition request comes before the
Commission. This request came before the Commission on November 19, 2020 and

was reiected because it was found to be architecturallv and historicallv siqnificant, and
because there appeared to be a viable offer for restoration on the table. The issue
comes back to the Commission because that offer is now withdrawn. Because this
structure is owned by the City, we are utilizinq the appropriate clause in our ordinance
for the review and consideration. It is located under Section 16-10-5: G: Guidelines and
Review Criteria for Applications by State or Political Subdivision of State.

Historical Siqnificance:
This structure was identified as a contributing structure for a potential National Register
Eligible district in 1978/79, when Bruce Kriviskey performed a city-wide survey. The
same conclusion happened when the West 11t" Street Historic District was listed on the
National Register of Historic Places and when it became a local historic district. The
most recent survey in 2004 by Jim Jacobsen confirms this, although his interpretation is
that the date is later than other historical evidence shows. For more historical evidence,
see the attached Survey and Historic Record Collection document compiled for this
application.
Staff Analysis: The structure dates from on or before 1855-1860, but has been
modified through removal and obliteration of character defining features. It is listed on
the National Register of Historic Places, and is a contributing structure within the West
11t" Street local and National Register historic districts and the conservation district of
the same name. It is architectural significant as a result. This analvsis has not chanaed
since the November 19, 2021 meetinq.
Role of the Commission: The Role of the Historic Preservation Commission is to
review the information and make a recommendation as to the following, according to
Section 16-10-5 of the Universal Development Code.
We are not requestina that the Commission vote on whether this structure is
architecturally or historicallv siqnificant aqain, as the November analysis is still relevant.
The application should be re-evaluated under Subsection G for a request bv a State or
Political Subdivision of State. The application supplied bv the applicant, answerinq the
questions below, remains the same as the November 19, 2020 application.
SUBSECTION G:
G. Guidelines and Review Criteria for Applications by State or Political Subdivision
of State:
1. In determining whether to approve or deny the application, the commission
may consider the information set forth in this subsection and any other information
the commission considers relevant to balancing any conflicting governmental
interests.
2. The commission may require that the applicant make submissions concerning
the following information for the proposed site and suitable alternative location(s),
including, but not limited to:
a. Fair market value of property.
b. Estimate of the cost of the proposed demolition, including hazardous
material removal and remediation.
c. Fair market value of any property owned by the governmental body that
could be sold if that site is not chosen for the project.
d. Property tax impact of removing private property from the tax rolls at the
proposed location and all alternative locations.
e. Any other factors that contribute to making one location more suitable than
others for the proposed use.
f. Any other information appropriate to evaluating how all conflicting
governmental interests may be accommodated.

g. The need for the use in question, the effect on neighboring property, and
the environmental impact of the proposed use.

Dear Mayor and City Council Members:
The City of Dubuque Historic Preservation Commission has reviewed the above-cited
request. The application, staff memo, and related materials are attached for your
review.
Discussion
Planning Staff discussed that the demolition request initially came before the Historic
Preservation Commission on November 19th, 2020. At that meeting, the HPC denied
the demolition permit finding that the property is:
1) Architecturally and historically significant to the community; and
2) It is economically viable because there was an offer to purchase the property for
rehabilitation.
Subsequently, the Housing & Community Development Department resubmitted the
application to the HPC because the offer to purchase the property was revoked by the
potential developer.
The HPC reviewed the demolition permit to determine if it met the demolition permit
criteria. Planning Staff noted that the HPC did not need to redetermine if the property
was architecturally and historically significant to the community.
The HPC discussed with Housing Staff the feasibility of rehabbing the structure. The
Housing Staff explained the building is not code compliant. They noted the poor
condition of the building and all the ceilings heights in the building are below the
required height for habitation. The HPC discussed alternate ways the building could be
rehabilitated. The Housing Staff noted they have no offers to rehabilitate the building.

By a vote of 5 to 1, the Historic Preservation Commission approved the demolition
permit as submitted using the criteria 16-10-5 (G) for a Political Subdivision of State.
Requested Action
Based on Title 16-10-5 (G) of the City Code, the city council will also make a
determination as to whether the denial of the application would prevent the state or the
political subdivision from accomplishing its governmental functions as follows:
a. If, after weighing the interests and attempting to accommodate all conflicting
governmental interests, the city council finds that denial of the application would
prevent the state or the political subdivision from accomplishing its governmental
functions, the city council will approve the application.
b. If, after weighing the interests and attempting to accommodate all conflicting
governmental interests, the city council finds that denial of the application would
not prevent the state or the political subdivision from accomplishing its
governmental functions, the city council may deny the application.
If the city council denies the application, it will state its findings in writing and shall
transmit a copy of such findings to the applicant.

The 2020 assessed land value is$7980 and the assessed dwelling value is$31470.
b. Estimate of the cost of the proposed demolition, including hazardous material removal
and remediation.
The cost of demolition is$10,666. Mainline Excavating Inc was the approved bid from an RFP
issued 09/16/2020
c. Fair market value of any property owned by the governmental body that could be sold
if that site is not chosen for the project.

The demolition of this structure will result in lost taxes of approximately$550 per year. We
expect the property to be developed which will ultimately increase the tax revenue generated
from this property.

The structure is vacant and an attractive nuisance. Ten qualified individuals and companies
were contacted to gauge interest in restoring the structure to use. Four interested parties
toured the structure and we received no viable plans. The City of Dubuque is not interested in
restoring the structure for the following reasons:
1. Ceilings throughout the structure lack the required height of 84 inches. The actual height
of the ceilings is between 77 and 78 inches. Other habitability issues include door heights of
74 inches and a stairway width of 25 inches.
2. The structure has several foundation failures. The rear block wall is pushing inward and
the left rock wall is pushing outward. There are also multiple code violations including
multiple roof leaks, deteriorated exterior cladding, etc.

INTRODUCTION
Shane Hoeper, Housing Inspector, provided this information as an addendum to the
application for demolition for 574 Loras Boulevard. It is being included in addition to the
Historic Preservation Commission packet already distributed for the upcoming
Thursday, November 19, 2020 Meeting.
BACKGROUND
Organizations and people contacted by the Housing & Community Development
Department to gauge interest in renovating the 574 Loras Boulevard property included
the following list:
