The original contract amount of $233,186.70 was reduced by $1,928.55 due to savings from the erosion control measures bid item, however there were five change orders in the amount of$40,818.60, which increased the final contract amount by a total of $38,890.05. Ware, Leisure Services Manager SUBJECT: Eagle Point Park Environmental Restoration Project: Phase 2) Bioretention Basin Construction, Tree Removal, and Native Vegetation Establishment Project Acceptance DATE: December 9, 2020 INTRODUCTION The purpose of this memorandum is to recommend that the City Council accept the Eagle Point Park Environmental Restoration Project: Phase 2) Bioretention Basin Construction, Tree Removal, and Native Vegetation Establishment Project and approve the attached resolution. BACKGROUND The Eagle Point Park Environmental Restoration Project: Phase 2) Bioretention Basin Construction, Tree Removal, and Native Vegetation Establishment Project was awarded in March of 2020. The general nature of the Phase 2 work was: grading, drainage pipes and creation of three bioretention cells, erosion and sediment control, native landscaping, and vegetation establishment and maintenance. DISCUSSION The Eagle Point Park Environmental Restoration Project: Phase 2) Bioretention Basin Construction, Tree Removal, and Native Vegetation Establishment Project was awarded to Mainline Excavation Co. of Dubuque, lowa in the final amount of $272,076.75. The original contract amount was $233,186.70. The original contract amount was reduced to $231,258.15 due to savings from the erosion control measures bid item. The retainage amount for the project is $13,603.84. The project budget for this phase of the project was $304,516.72. There were five change orders associated with the project at a cost of $40,818.60. Change orders included: replacing two existing storm pipes in order to connect properly with two proposed manholes; modifying the base of the rock flume in cell #1; modifying the limestone flume leading to cell #1 by adding EPDM liner under 1 stone and replacing existing concrete apron while adding integral waterproofing to apron; milling 1030 square feet of asphalt paving, installing 7022 square feet of HMA pavement (2 inch overlay), 250 linear feet of asphalt curbing, and adding 20 cubic yards of topsoil, temporary seeding and mulch. BUDGETIMPACT The IDNR is a major funding partner with $801,300 in state and federal pass-through grants awarded for this project, leveraged by $79,597 from the Leisure Services Department's FY14 Capital Improvement Project (CIP) #7202301 for Eagle Point Park. The City has two Resource Enhancement and Protection (REAP) grants from IDNR, a $175,000 Land and Water Conservation Fund (LWCF) federal pass-through grant from the National Park Service (NPS) to the IDNR, and a State Revolving Fund (SRF) Sponsored Project of$259,722 from the IDNR. Breitfelder, City Clerk, 50 W. 13th St., Dubuque, IA 52001, (563) 589-4100 RESOLUTION NO. 365-20 ACCEPTING THE EAGLE POINT PARK ENVIRONMENTAL RESTORATION PROJECT: PHASE 2 BIORETENTION BASIN CONSTRUCTION, TREE REMOVAL, AND NATIVE VEGETATION ESTABLISHMENT PROJECT AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR Whereas, the Public Improvement Contract for the Eagle Point Park Environmental Restoration Project: Phase 2 Bioretention Basin Construction, Tree Removal, and Native Vegetation Establishment Project (the Project) has been completed by the contractor and Emmons and Olivier Resources has examined the work and filed a certificate stating that the Project has been completed according to the terms of the Public Improvement Contract and that Emmons and Olivier Resources recommends that the Project be accepted; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of Emmons and Olivier Resources is approved, and the Project is hereby accepted. Section 2. The Director of Finance and Budget is hereby directed to pay to the Contractor from the Eagle Point Park Environmental Restoration Project: Phase 2) Bioretention Basin Construction, Tree Removal, and Native Vegetation Establishment Project capital improvement appropriation for the contract amount of $272,076.75 less any retained percentage provided for therein as provided in Iowa Code chapter 573, and to pay such retainage only in accordance with the provisions of Iowa Code chapter 573. Work done was in substantial compliance with the terms of the Contract, Specifications, and Contract Change Orders for the project. With these change orders, the project's total construction cost was revised from $233,186.70 to $274,005.30. Our opinion of probable cost at the time of letting was $273,871.50.The final billed amount of the project was $272,076.75. After direct observations and review of the project, I can confirm that the work of constructing the project has been completed by the Contractor and I recommend that the Owner accept it. Once the project is accepted, final payment can be made to Mainline Excavating Inc. (the Contractor) after waiting a minimum of 30 days.The Contractor has a two-year maintenance bond on this project with the period starting with the City's acceptance of the project. As Engineer for the project, I hereby certify that we have reviewed the completed work and that the above information is correct to the best of my knowledge and recommend that the City formally accept the project.
