the regular monthly session of the
Council for the transaction of such
business as may regularly come be-
fore the meeng.

cil's intention to levy a special as-
sessment and authorize the issuance
of bonds to provide for the payment
of a sanitary sewer in Overview
Court, from Grandview Avenue west
to the end of Overview Court, and a
lateral running south from said
sewer in and across the divison line
between Lots 12 and 13, Jones Sub.,
thence a lateral running west from
Lot 10, Grandview Heights Add., in
and across Lot 10- 11 -12 -13 in Grand-
view Heights Add.
There being no remonstrance,
Councilman Gabriel moved that the
notice be received and filed. Second-

cost and expense thereof to be
$1,615.00.
And Whereas, public notice as pro-
vided by law has been published by
the City Clerk stating the intention
of the City Council to issue bonds to
pay the cost of said improvement and
a public hearing has been held pur-
suant thereto, and all objections filed
thereto have been considered and
determined:
Now therefor, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of con-
structing sanitary sewer in Overview
Court from Grandview Avenue west
to the end of Overview Court, and a
lateral running south from said
sewer in and across the division line
between Lots 12 and 13, Jones Sub.,
thence a lateral running west from
Lot 10, Grandview Heights Add., in
and across Lots 10, 11, 12 and 13 in
Grandview Heights Add., there be is-
sued Sewer Bonds to the amount of
$1,615.00. Said bonds shall be issued
under the provisions of Chapter 311
of the Code of Iowa, 1924, which bear
date as of the lst day of March, A.
D. 1926, shall be in the denomina-
tions of $200.00 each, except that
there shall be one bond to the
amount of $15.00; they shall be num-
bered from 1202 to 1210 inclusive,
and shall be divided into 10 series of
which the bond numbered 1202 shall
constitute the first series and shall
be payable on the lst day of April,
A. D. 1926; the bond numbered 1203
shall constitute the second series
and shall be payable on the lst day
of April, 1927; the bond numbered
1204 shall constitute the third series
and shall be payable on the 1st day
of April, 1928; the bond numbered
1205 shall constitute the fourth se-
ries and shall be payable on the 1st
day of April, 1929; the bond num-
bered 1206 shall constitute the fifth
series and shall be payable on the
1st day of April, 1930; the bond
numbered 1207 shall constitute the
sixth series and shall be payable on
the 1st day of April, 1931; the bond
numbered 1208 shall constitute the
seventh series and shall be payable
on the 1st day of April, 1932; the
bond numbered 1209 shall constitute
the eighth series and shall be pay-
able on the 1st day of April, 1923;
the bonds numbered 1210 shall con-
stitute the ninth series and shall be
payable on the 1st day of April, 1934.
Said bonds shall bear interest at
the rate of 5 per cent per annum,
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment. Both principal and interest
shall be payable at the office of the
City Treasurer in the City of Du-
buque. Said bonds shall be substan-
tially in the following form:

CITY OF 'DUBUQUE
Sewer Bond.
The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer hereof,
on the first day of April, A. D. 19
or any time before that date at the
option of the City the sum of Two
Hundred Dollars with interest there-
on at the rate of 5 per cent per an-
num, payable on the presentation
and surrender of the interest cou-
pons hereto attached, both interest
and principal are payable at the of-
fice of the City Treasurer in the City
of Dubuque in the State of Iowa.
This bond is issued by the City of
Dubuque pursuant to and by virtue
of Chapter 311 of the Code of Iowa,
1924, and in accordance with a reso-
lution of the City Council of said
city, duly passed on the lst day of
February, 1926. This bond is one of
a series of nine bonds, eight for
$20.00 each, numbered from 1202 to
1209 inclusive, and one for $15.00,
numbered 1210, all of like tenor and
elate and issued for the purpose of
constructing a sanitary sewer in
Overview Court, and described in
said resolution; which cost is assess -
able and levied along said improve-
ment, and is made by law a lien on
all abutting or adjacent property,
and payable in ten annual install-
ments, with interest on all deferred
payments at the rate of five per cent
per annum, and this bond is payable
only out of the money derived from
the collection of said special tax,
and said money can be used for no
other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be clone prec-
edent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment here-
on of said special tax, the faith and
diligence of said City of Dubuque
are hereby irrevocably pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 1st day of March, 1926, and
has authorized the use of their fac-

liver them to the City Treasurer
who will also register them in a book
to be kept by him for that purpose.
Be it further resolved taht the
City Treasurer be and he is hereby
instructed to sell said bonds in the
manner provided for in Section 845
of the Code of Iowa, the proceeds of
said sale to be kept in a special fund
to be known as Sewer Fund.
Be it further resolved that the in-
terest coupons'attached to the bonds
be signed with the fac- simile signa-
ture of the Mayor and countersigned

Ordinance No. 71. An Ordinance
requiring all persons, firms or cor-
porations to procure a permit for
excavating in streets, alleys, side -.
walks or public places; having pass-
ed upon first and second reading,
presented for final reading and adop-
tion.
Ordinance No. 171.
AN ORDINANCE requirng all per-
sons, firms or corporations to pro-
cure a permit for excavating in
streets, alleys, sidewalks or public
places; providing for the execution
of a bond; repealing all ordinances
or parts of ordinances in conflict
with the terms hereof and provid-
ing a penalty for' violation hereof.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That hereafter, before
any person, firm or corporation shall
do any excavating in streets, alleys,
sidewalks or public places in the
City of Dubuque, such party shall
first procure a permit therefor from
the City Engineer, which • permit
shall describe the location of such
excavation.
Sec. 2. That a fee of $1.00 shall
be charged for each permit issued
as herein stated, and when collected
shall be paid•into the City Treasury.
Sec. 3. That, as a condition prec-
edent to the granting of any permits
for excavations in streets, alleys,
sidewalks or other public places by
any person, firm or corporation, such
person, firm or corporation shall
cause to be filed with the City Clerk
and approved by the City Council, a
bond executed by a Surety Company
in the sum of $5,000.00, the condition
of which shall be to hold the City
harmless from any and all damages
to persons or property that may oc-
cur by reason of the making of any
such excavation or maintaining the
same, or by reason of any negligence
in the manner of making such exca-

lights or barriers as a warning to the
traveling public or by reason of plac-
ing any dirt, stone or other obstruc-
tions in such places resulting from
such excavations.
Sec. 4. That any person, firm or
corporation who causes to be made
any such excavations without a per-
mit and without having filed the
bond herein provided for shall be
deemed guilty of a misdemeanor and
be fined not to exceed One Hundred
Dollars ($100.00) or imprisonment
not to exceed thirty (30) days in jail.
Sec. 5. All ordinances or parts of
ordinances in conflict herewith are
hereby repealed.
Sec. 6. This Ordinance shall be in
force and effect ten (10) days from
and after its final passage and adop-
tion of the City Council and publi-
cation as provided by law.

Know all men by these presents,
That the First National Bank of Du-
buque, Iowa, does hereby agree to
indemnify the City of Dubuque, Iowa,
for any loss which it may sustain in
the following respects, to -wit:
The First National Bank having
had the care and custody of certain
municipal bonds belonging to Cora
Lippman of Danville, Ill., and certain
interest coupons thereto attached
having been lost or mislaid, it is
agreed that the City of Dubuque
shall pay said interest coupons just
as if the same had been regularly
presented, and if any claim or de-
mand should at any time hereafter
be made by any person, firm or cor-
poration upon said City to again pay
the same, and if it should be found
that said City is respectfully obliged
to pay the same, then said First Na-
tional Bank does hereby agree to re-
pay the amount of said interest cou-
pons to said City and also whatever
expense or cost may have been in-
curred to have the question of right-
ful ownership of such interest cou-
pons determined.

To the Honorable Mayor and Coun-
cil of the City of Dubuque:
Gentlemen: At the present term
of the District Court of Dubuque
County, Iowa, two cases involving
personal injuries have been disposed
of. The nature of these actions is
as follows:
Josephine Gantenbein vs. City of
Dubuque. This case was brought to
recover damages on account of a bro-
ken leg which plaintiff sustained by
falling on a sidewalk abutting the
tin shop of F. C. Luther, 2230 Central
Avenue. Plaintiff sustained rather
serious injuries and brought suit for
$10,000. After all of the evidence
had been introduced, 1 made a mo-
tion to direct a verdict in favor of
the City which the Court sustained.
May Phillips vs. City of Dubuque.
This action was based upon personal
injuries which plaintiff sustained on
the night of May 2, 1925, when an
automobile in which she was riding
struck and run onto a pile of dirt
located at the corner of Delhi and
Algona Streets. An excavation was
made in the street at that point by
Mr. Rellihan, plumber, and the dirt
thrown up onto the street. The auto-
mobile turned over and Miss Phil-
lips sustained terrible injuries, most
of which are permanent and have
renderd her a cripple. Damages were
asked in the sum of $25,000. I no-
tified Mr. Rellihan to defend in the
suit as he was covered to the extent
of $1,000.00 by a bond in the Fidelity
and Deposit Company of Maryland.
The case went to trial and after
plaintiff had introduced a great part
of her testimony, negotiations for
settlement were undertaken. The
result was that I agreed to pay
$3,500.00 plus the costs. Of this
amount, however, the bonding com-
pany will pay $750.00 and the City
will be reimbursed to that extent.
Under all of the circumstances sur-
rounding this action, I consider this
settlement very advantageous to the
City and trust that it will meet with
your approval. If is does, I respect-
fully recommend that a warrant . for
$3,500.00 be orderd issued upon the
Treasurer in favor of John Knoll and
Milton Glenn, attorneys for May
Phillips, and the amount of the costs
will be reported to you as soon as I
learn what the amount is.

Petition of Jos. Bertsch to change
the voting place of the 13th District,
stating that the present voting place
is situated in the extreme southeast
corner of this district, which makes
it very inconvenient for the voters
of said precinct, and furthermore it
being in the factory district near the
railroad tracks, and there being no
sidewalks around this place, that in
rainy or thawing weather the mud is
ankle deep, and he recommends a
vacant store, which he thinks could
be rented at 2920 Central Avenue,
which is more centrally located.
Councilman Gabriel moved that
the Clerk be instructed to look into
this matter and procure this building
if available. Seconded by Council-

Main Sewer Bonds in the sum of
$29,563.41 a sale was conducted and
held at which various bids were sub-
mitted, resulting as follows:
One sealed bid was received from
A. C. Allyn & Co. of Chicago, Ill..
Before this bid was opened, bids
were -requested and there were only
two bidders present, namely, White -
Phillips Co. and Geo. C. Bechtel Co.
of Davenport, Iowa.
The result of the open bidding was
as follows:
The White-Phillips 'Co. par and ac-
crued interest and a premium of
$285.00, including printing of bonds.
Geo. M. Bechtel Co. par and ac-
crued interest and a premium of
$290..00 including the printing of the
bonds.
The sealed bid submited by A. C
Alyn & Co. of Chicago, Ill., par and
accrued interest and a premium of
$153.59 including the printing of the
bonds.
Each bidder submitted with his bid
a certified check in the sum of
$900.00. The bid of Geo. M. Bechtel
& Co. was the highest received, and
if this bid is acceptable to the Coun-
cil, the Treasurer should be instruct-
ed to return the certified checks to
the other bidders.

M. The meeting was called to order
and there were present James Alder-
son, City Mayor, in the Chair and the

This being the time and place
fixed by published notice, the •Coun-
cil took up for consideration the mat-
ter of bids for the purchase of
$29,563.41 Main Sewer Bonds of the
said City.
After the receipt of sealed bids
and the calling for open .bids, the re-
sults thereof were incorporated in a
resolution, entitled "Resolution pro-
viding for the sale and award of
$29,563.41 Main Sewer Bonds and ap-
proving and authorizing the agree-
ment of such sale and award," which
was introduced by Councilman L. H.
Brede, who moved that the resolu-
tion be placed on file with the City
Clerk for public inspection. Second-
ed by Councilman H. G. Melchior,
and the roll being called the follow-
ing voted:

Report of the City Treasurer on
the petition of Mrs. Caroline Hafner
relatie to her assessment for the
improvement of White Street against
Lot South 1 /Z of Lot 2, L. H. Lang -
worthy's Add., Sub. Lot 171. Mrs.
Hafner claimed that she did not re-
ceive the proper notice. The Treas-
urer states that the notice was duly
nailed, that Mrs. Hafner had moved
out of the City and left no forward-
ing address, consequently the notice
came back to the Treasurer, marked
unclaimed. Mrs. Hafner signified
that she intends to pay this assess-
ment in full and asked that the in-
terest and penalty thereon be can-
celled.
Councilman Brede moved that the
penalty be cancelled and that Mrs.
Hafner be notified that she must pay
the assessment and interest to date,
and the Treasurer be instructed ac-
cordingly. Seconded by Councilman

Petition of Edward Milligan asking
permission to redeem property in
Yates Sub. Lot 9, which was sold to
the City for sewer tax, also asking

deem same. The improvement was
made in 1921.
Councilman Brede moved that the
petition be referred to the City Man-
ager, Engineer and Clerk to look up
this matter and see what report had
been previously made on this mat -.
ter, he claiming that he had peti-
tioned the Council relative to this

that King Street he made passable,

recommendation of the City Solicitor
be approved and the Auditor be in-
structed to draw a warrant in the
sum of $10.00 in favor of Max Bot-

Petition of the Dubuque Baseball
Club, by Fred J. Leiser, president,
stating that they hereby petiton for
the use of the Municipal Athletic
Field for the seasons of 1926 and
1927, under conditons similar to
those contained in a lease granted
the club in' 1925, which conditions re-
quired the Dubuque Baseball Club to
maintain the park during the base-
ball season for which the club was
granted the use of the park and
given control of the concessions for
the season, including the fences and
the right to dispose of refreshments
in the stands on all occasions.
This petition is late in being pre-
sented, but this was caused by a
misunderstanding, the present owner
of the club believing the Dubuque
Baseball Club's lease of the park ex-
tended through the present baseball
season. On suspension of the rules,
President Leiser addressed the Coun-
cil relative to the petition.
Councilman Brede moved that the
prayer of the petition be granted.

able to pay, he being sick with tuber-
culosis; they have three small chil-
dren, Mrs. Hansen has these to sup-
port. The Board of Supervisors rec-
ommends that the assessment be re-
duced to $1,400.00 instead of $2,800.00
and hereby refers the petition to the
Council for its approval.

At a session of the City Council
held February 10th, 1926, the petition
of Edward Milligan asking to redeem
his property sold to the City at tax
sale was referred to the City Man-
ager, Engineer and Clerk, the Clerk
to look up record of the action taken
at a previous meeting on a petition
filed by Mr. Milligan on this matter.
The Clerk reports that the assess-
ment was levied against this prop-
erty for the construction of a sani-
tary sewer in West 17th Street, De-
cember 20th, 1921, a remonstrance
was filed against this assessment by
property owners along said street,
signed by Edward Milligan, W. F.
Neuman et al. On motion and vote
the remonstrance was received and
filed at said meeting of December
20th, 1921.
The Clerk was instructed to notify
Mr. Milligan relative to this report.
No further action was taken by the
Council at this time.

filed by Henry C. Winders, on ac-
count of person injuries sustained by

26th, 1926, at 909 Spruce Street,

thigh, hip and other parts of his
body.

25 per cent valuation of the property.
The number of the lot is 29, on Val-

Petition of Mrs. Chris Ingwerson
stating that she is the owner of Lot

11 and of the easterly 5 feet of Lot
10 in Porter's Add. A special asess-
ment for the improvement of Semin-
ary Street levied November 23rd,
1893, was levied and the records
show that it was not paid. The ab-
stract shows that this lot was sold
on December 5th, 1899, for taxes of
1898 and .conveyance made by the
City of Dubuque December 4th, 1907,
and said deed is recorded in book 69,
TL page 336. An attempt was made
to sell and on July 8th, 1921, this lot
was sold to the City of Dubuque for
the special assessment above men-
tioned. The County Auditor's and
Treasurer's books report it as Lot
11, but the City Treasurer's Bonded
Special book reports it as Lot 10.
The sale book for 1921 does not show
the sale. The petitioner hereby re-
quests the cancellation of said sale
certificate as it is of no value and
only a source of annoyance.

that last fall in making his payment

ments are due this March. Inasmuch
as this was a misunderstanding on
his part, he hereby asks that he be
granted permission to pay the assess-
ments on the installment plan.
