1926 July Council ProceedingsCITY COUNCIL (Official) Regular session July 5th, 1926. There being no quorum present, Council adjourned to July 6th, 1926. Council met at 4:30 P. M. Present —City Manager Douglas, Mayor Melchior, Councilmen Meus- er, Schrempf and Yount. Absent—Councilman Maclay. Mayor Melchior stated that this is the regular monthly meeting of the Council for the dispatch of such business as may regularly come be- fore -the meeting. Petition of Mary and Catherine Cunningham, objecting to the im- provement of McCormick Street. Stating that their property will not stand the assessment, presented. Councilman Meuser moved that the petition be received and filed. Seconded by Councilman Schrempf. Carried by the following vote: Yeas —Mayor Melchior, Council- men Meuser Schrempf and Yount. Nays —None. Absent — Councilman Maclay. Petition of Patrick O'Shea protest- ing against the improvement of Wartburg Place, from the end of the present improvement to Lull Street, presented. Stating that this is acreage property, and the improve- ment of the street would cost in excess of 25% of the value of the property. He states further that there is very little traffic on this street and the improvement will work a hardship on the abutting property. Councilman Schrempf moved that the petition be received and filed. Seconded by Councilman Meuser. Carried by the following vote: Yeas —Mayor Melchior, Council- men Meuser Schrempf and Yount. John Quinn addressed the Council and stated that the elevator at the Canfield Hotel has been removed and a new elevator is being placed therein, and this is not being put in as the Building Code requires it to be done, and that he is hereby call- ing the Council's attention to this fact. Councilman Meuser moved that this matter be referred to the City Manager and the Building Commis- sioner. Seconded by Councilman Yount. Whereas, a plat and schedule has been duly prepared by the City Coun- cil of the City of Dubuque and now on file in the office of the Clerk thereof, showing the boundaries of the district, the streets to be im- proved, the width of the improve- ments, each lot proposed to be as- sessed, an estimate of the cost of the proposed improvement for each different type of construction and July 5th, 1926 kind of material to be used, and in each case the amount thereof which is estimated will be assessed against each lot, for the improve- ment of the streets named in this resolution: Be it, therefore, resolved by the City Council of the City of Dubuque, Iowa, on its own motion: That it is deemed necessary and advisable to build, construct and put in place certain street improve- ments, as hereinafter described, in, upon and along the following streets, to wit: Rhomberg Avenue from the north property line of Lincoln Avenue to the high bridge. Said street improvement shall consist of grading, paving, curb and gutter, such curb and gutter to be constructed of concrete or old curb_ reset, if advisable, and the paving to be constructed of one or more of the following materials and meth- ods, to wit: By paving with concrete. Said paving, curb and gutter shall be constructed, and all grading done in strict accordance with the plans and specifications therefor, which have been prepared by the City En- gineer and approved by the City Council and Manager. The street railway portion of said street shall be paved with between the rails and one foot outside there- of. That the cost and expense of mak- ing and constructing said improve- ments shall be assessed upon and against all privately owned property whether abutting or not and lying within the, assessable distance pre- scribed by law, according to the area thereof, and in proportion to the special benefits conferred, and any deficiency shall be paid out of the general fund or improvement fund and bonds shall be issued and sold in anticipation of deferred pay- ment of assessments and the pro- ceeds thereof used to pay the con- tractor. The railway portion of said street shall be assessed to and paid by said street railway. Be it further resolved that the above and foregoing street improve- ments are hereby proposed to be made and constructed as hereinbe- fore set forth, and that this pro- posed resolution, except this para- graph, be and the same is hereby set down for further and final hear- ing, consideration and determination at a meeting of this Council to be held on the 25th day of June, 1926 at 4:30 o'clock P. M, in the Council Chamber of the City Hall of this city, and the City Clerk be and he is hereby instructed to cause notice of the pendency of the above resolu- tion, and of the time and place, when and where said proposed reso- lution will be considered for pass- age, to be given for publication in the official newspapers of said city, in the manner and for the time pre- scribed by law, at which time the owners of property subject to as- sessment for said proposed improve- ment may appear and make objec- tion to the boundaries of the pro- posed district if any, to the cost of the proposed improvement, to the amount proposed to be assessed against any lot, and to the passage of the proposed resolution and un- less property owners at the time of the final consideration of said reso- lution have on file with the Clerk objections to the amount of the pro- posed assessments, they shall be deemed to have waived all objec- tions thereto. Resolution Adopting and Approving Plans and Specifications and Form of Contract for Street Improvements Whereas, street improvement as herein described has been ordered made and constructed by the City Council of the City of Dubuque, and plans, specifications and form of contract have been duly prepared, now therefore: Be it resolved by the City Coun- cil of the City of Dubuque that the plans, specifications and form of contract heretofore prepared be and the same are hereby adopted and approved for the construction of the following improvements, to wit: Rhomberg Avenue from the north property line of Lincoln Avenue to the high bridge. Be it further resolved that on the 9th day of July, 1926 a public hear- ing will be held at 4:30 o'clock P. Absent — Councilman Maclay. i a 1 216 Regular Session, July 5th, 1926 Resolution Ordering Construction of Paving, Curb and Gutter and Directing Clerk to Ad- vertise for Bids. Be it resolved by the City Coun- cil of the City of Dubuque that pur- suant to a Resolution of Necessity, proposed at a meeting of this Coun- cil on the 7th day of June, 1926, and duly passed on the 6th day of July, 1926, it is hereby ordered by this Council upon its own motion and without petition of property owners, that the street improve- ments described in said resolution be constructed, the same consisting of grading, paving, curb and gutter in, upon and along the following named street, to wit: Rhomberg Avenue from the north property line of Lincoln Avenue to the high bridge. The curb and gutter shall be of concrete construction, or old stone curb may be reset where advisable. All underground connections with sewer, water and gas mains shall be made to the curb lines in the manner and within the time speci- fied in a resolution adopted there- for. The street shall be paved with 6 inch plain concrete. The street railway portion of the street shall be paved with between the rails and one foot out- side thereof. All of the work shall be constructed in accordance with the plans and specifications hereto fore adopted and now on file in the office of the City Clerk. Be it further resolved that the City Clerk be and he is hereby or- dered and directed to advertise for proposals for the construction of said improvements, as provided by law, which improvements shall be completed on or before the 1st day of October, 1926. The cost and expense of said im- provements will be paid for by levy- ing special assessments against the privately owned property abutting upon said improvement and also against property which does not abutt but which lies within the as- sessable distance prescribed by law, according to the area thereof and in proportion to the special bene- fits conferred, and payment will be made to the contractor out of funds realized from the sale of bonds to be issued in anticipation of deferred payment of assessments as provid- ed by law and any deficiency will be paid out of the general fund or the improvement fund, or partly from each of said funds. This resolution being deemed ur- gent and of immediate necessity, shall be in force and effect from and after its passage and adoption by the City Council. Resolution Ordering Underground Connections Whereas the City Council of the City of Dubuque heretofore adopted a resolution ordering the paving of Rhomberg Avenue from the north property line of Lincoln Avenue to the high bridge and otherwise per- manently improving the same, and it is necessary and desirable that all underground connections in and upon said streets be made to the curb line of adjacent property be- fore such permanent improvements are installed: Be it therefore, resolved by the City Council of the City of Dubuque, that all connections from gas, wat- er and sewer mains to the curb line of property adjacent to the proposed street improvements be made and completed by July 15, all such con- nections to be made according to the plans and specifications on file in the office of the City Engineer. Be it further resolved that in case any such connections are not made to the curb line of adjacent proper- ty in the manner and within the time herein prescribed, then the Council shall cause the same to be made and assessed the cost there- of against the property for which they are made. Be it, further resolved that the City Engineer cause a notice to be given to the owner or owners of all property to which such connections are to be made, stating the time within which the same shall be made, but not more than one of such connections shall be required for each 50 feet of any lot, or par- cel of land, unless the conditions in each instance warrant a greater number of connections, and, in any event, the notice to the property owners shall state the number of connections proposed or required to be made. Absent — Councilman Maclay. Mr. C. E. Douglas, City Manager, Dubuque, Iowa. Dear Mr. Douglas: I am briefly outlining herewith some of the more important subjects which are now before the Dubuque Shippers' Asso- ciation for consideration and action. It is our opinion that these subjects are the most vital in the history of the Association and have a direct bearing on our industry welfare. On the outcome of these subjects rests to a large extent the future of our jobbing industry and the importance of Dubuque as a trade center. 1. The Eastern Class Case in- volves our rates to and from points east of the Illinois Indiana State line. The carriers have proposed to increase the rates from points east of Pittsburgh about 20 %. We have with other cities, opposed this in- crease. We have also asked the In- terstate Commerce Commission to remove the present basis of making rates to Dubuque 117% of the Chi- cago rate suggesting that our rates be graded over the Chicago rate, to about 110 %. A revision from and to points in Indiana, Michigan and Ohio and Dubuque was also put for- ward by us. The present basis makes Dubuque pay rates higher than St. Louis when the distance is greater and the same rate when our distance is less. No advantage ac- crues to us for our lesser distance from Northern Indiana and Michi- gan, as it does to St. Louis for their lesser distances from Southern Ohio and Southern Indiana. This subject is now before the Commission for its decision. We have spent considerable amount so Regular Session, July 5th, 1926 217 far and indications are that it will cost still more money before its conclusion. 2. Western Trunk Line Case. This case contemplates a complete revision of rates in the territory be- tween Chicago - Missouri River Du- iuth-St. Paul with an approximate increase of about 15 %. Rate groups on which the cities in the Middle West have built up their business are to be abolished. Iowa state sates are to be increased as high as 100% narrowing the spread as between interstate and state traffic to our disadvantage. The proposals in this case are revolutionary and if carried out will disrupt business connections of years standing and necessitate a relocation of buying and selling ter ^story. The river cit- ies are vitally interested. Whatever bass is f'stabiished will be perman- ent and it is absolutely essential that Dubuque carefully consider its proposed situation and exact from the carriers a basis to which it is properly entitled, otherwise our trade disadvantage will be difficult, to overcome and the plans of Du- buque for industrial expansion will he defeated before they are prac- tically started. It is stated on the best authority that Dubuque can will afford to spend $10,000 on this case above in protection of its in- terests. This case is pending before the carrier and Commission. A number of meetings have been held and indications are that there will be many more before the case is decided. The expense to the Asso- ciation has so far been heavy and the case is far , from being con- cluded. 3. Missouri River Cities Cases. These cases filled with the Inter- state Commerce Commission by the Missouri River Cities - Kansas City to Sioux City inclusive, vitally affect Dubuque. The Commission is asked to establish rates from all eastern and southern territory to these cit- ies, in lieu of the present rates which are a two rate combination of locals over the Mississippi River. In other words, instead of taking the local rate New York to Dubuque and the local rate Dubuque to Oma- ha adding them together to make the through rate, they ask that one rate, much less than the combina- tion be applied. Should the case be decided favor- ably the rates to the Mississippi River Cities will be substantially reduced which reduction will spread to the interior Iowa cities without J e 218 Regular Session, July 5th, 1926 any reduction in our rates. It needs no explanation to clearly see that such an adjustment will eliminate the jobbers of Dubuque from busi- ness in the territory very far west of the river because the rates to the interior Iowa and Missouri river cities would only be slightly higher than our rates. These cases have not yet been assigned for hearing by the Com- mission but it is expected that they will come up soon and whatever the outcome Dubuque must present its situation to the Commission in its own interests. Hard Coal Rates. This case has just been decided by the Commis- sion reducing our rates on anthra- cite coal by 52 cents per net ton. The case was filed with the Inter- state Commerce Commission in 1924. Dubuque asked for a rate on the same level of St. Louis or $5.57 per ton our rate being $7.32 although the distances from the mines in Pennsylvania to Dubuque are prac- tically the same as to St. Louis. The Commission did not grant all we asked for, stating that they con- sidered the rates to St. Louis de- pressed rates through conditions not existing at the upper river cities, but they did recognize we were en- titled to through rates and made the reduction stated. This case is a direct benefit to the citizens of Du- buque who use hard coal. Soft Coal Rates. The Association filed with the I. C. C. in 1924, com- plaint asking for reduction in rates from Illinois, Indiana and western Kentucky field and also the estab- lishment of rates on fine coal less than the rates on lump coal, in ac- cordance with the basis the carriers have published to competitive cities in the territory. This case is prob- ably one of the most important for Dubuque, that we have had. If the Commission should grant what we ask it will mean a saving to Du- buque from . $50,000 to $100,000 a year without consideration of a pos- sible reduction in our domestic sizes. This case has cost the Association a lot of time and money and we are hopeful that the Commission will see the justice of our request and grant us the relief that we have asked for. The Association has been actively engaged in the readjustment of rates from this territory into the Southeast which readjustment is al- most concluded. We have taken ac- tive part in the cases, termed the Southwestern cases, in which our rates to the southwestern states are involved, and pleaded our interest before the Commission for a prop- er basis from Dubuque. We have been and are watching closely proposed changes in rates on a great many commodities be- tween Illinois and the river cities which will seriously affect our in- dustries if carried out. We have briefly cited herein some of the more important subjects now under consideration by the Associa- tion. We are constantly engaged in questions which are of community interest as you no doubt already know. The revival of transportation on the upper river will, without doubt, necessitate supervision of rates and service which this association will be called upon to perform, especial- ly the questions of rates to, from and through Dubuque. We could mention other things which the Association has done and is doing which are of a community nature, all to the end that our indus- tries and city will obtain a rate structure to which we are properly and logically entitled and through which we will progress as we should. The cases .mentioned, how- ever, will give you a comprehensive view of our work. • Yours very truy, S. G. CRESWICK, Commissioner. City Council, Dubuque, Iowa. Gentlemen: Attached you will find a copy of a letter received by me from the Dubuque Shipper's As- sociation. It will be noted that con- siderable stress is placed upon the fact that rate adjustments are apt to be made that will seriously affect the welfare of this city as a manu- facturing and distributing center, and it is therefore, a matter that requires our most serious and care- ful consideration. I recall reading, just a few days ago, a survey , of Dubuque made in 1889. This survey shows that Du- buque was at that time the leading city of the State of Iowa, and that its freight rates had been adjusted so as to give it supreme and un- disputed control of an immense ter- ritory. Conditions have changed considerable since that report was made back in 1889, and I am confi- dent that the adjustments that have been made in the freight rate struc- ture have resulted in other cities, that are competitors of Dubuque, re- ceiving rates that have enabled their manufacturers and wholesalers to operate in a. territory that should belong to Dubuque. We will take the cases that are described in the letter received from the Commissioner of the Du- buque Shippers Association: 'first, we have the Eastern Class Case, which involves an increase of about twenty per cent in rates, and even at the present time, without the in- crease, statement is made that Du- buque pays rates higher than St. Louis, when the distance is greater and the same rate when the distance is less, and that no advantage ac- crues to us for our lesser distance from Northern Indiana and Michi- gan, as it does to St. Louis for their lesser distances from Southern Ohio and Southern Indiana. This matter is up before the In- terstate Commerce Commission for decision and, of course, it is too late for any further action to be taken in this case. Still it clearly shows the great injustice that has been done Dubuque in favor of other com- munities. And my experience has taught me that the mere fact that a community protests a rate adjust- ment is not sufficient when it has such great effect upon the commer- cial life of the community. Case No. 2, cited by the Dubuque Shippers Association known as the Western Trunk Line Case. Here it is stated that rates on which the people of Dubuque have built up their business, are to abolished. And that the rates in the State of Iowa may be increased as high as 100 %, and if the rates were to go into effect, that it would disrupt business connections of years stand- ing. When you think of this situation, gentlemen, you will realize the im- portance of this litigation. It does not affect manufacturing, wholesal- ing and retailing business of the city alone, but reaches into every home in the community. It makes this traffic situation a matter of first importance to Dubuque as a city and should become a subject for the con- sideration of the Municipality on be- half of all the people. Next is described the Missouri River Cities cases, wherein it states that should the case be de- cided favorably the rates to the Missouri River cities will be reduced and reduction will extend to the in- terior Iowa cities without any re- duction in Dubuque's rates. It will, Regular Session, July 5th, 1926 219 therefore, interfere with the distrib- uting business of Dubuque houses. These cases have not been assigned for a hearing by the Interstate Commerce Commission and when they are assigned and hearings held, Dubuque should be represent- ed by the very best counsel obtain- able. It would appear to me that we have a problem as serious as any that will ever come before this Council. It involves the identity of Dubuque. It involves the destiny of our Manufacturers and Wholesalers, it affects every wage earner in this city and it is my opinion that this Council should on its own initiative go to the seat of Government in Washington and employ the best traffic counsel to use his talent in presenting Dubuque's cause before the Interstate Commerce Commis- sion in order that full justice might be done for our city. Other cities gladly make appropri- ations for legal talent when their freight rates are jeopardized, and it would seem to me that this is the least that we can do when we have so much at stake. During the period that I was Man- ager at Newport News, it was nec- essary for appropriations to be made in order to enable that city to main- tain its freight rate situation. That city was jealous of its freight rate position and never permitted an ad- justment to be made that would place it as a disadvantage with its competitors. Just a short time ago, the rail- roads proposed an increase in freight rates on tobacco which would have seriously interfered with New- port News as a storage center. The city immediately appropriated funds to place the matter before the Inter- state Commerce Commission and stood ready to spend $10,000 if nec- essary, to have this one case ad- justed. Knowing as it did that should a decision be handed down by the Commission whereby rates would be increased and Newport News placed at a disadvantage, business would be diverted from that city to other cities and the city as a whole, would suffer some loss. The Shippers Association are now planning to increase their activities and ask for an appropriation by the Council to assist in the work that they are doing. At first I was im- pressed with the idea of the City making an appropriation to assist them in their work, but now I am convinced that the problem is such • CITY COUNCIL (Official) Special session, July 9th, 1926. R. Co., relative to the Switch and Spur Track, Ordinance granting the C. B. Q. R. R. Co. to build and operate said track on 6th Street. The Com- munication states that in Section 2 of said Ordinance it reads that the C. B. & Q. shall switch, spot, and place cars of all other Railroad Corn - panies over and upon said tracks, the C. B. & Q. to have the right to fix uniform charge for services per- formed. In 1897 the City passed an ordin- ance, granting the I. C. R. R. Co. the right to construct and operate spur track on Washington Street, in the City of Dubuque. Section 6 of this ordinance, the City gives to all railroads, operating in Dubuque, the privilege of switching their own cars on and off the track whenever they may desire to do so, with their own engines, upon payment to the I. C. R. R. Co., of a sum as may be fixed by the City Council. It seems that inasmuch the City gave all R; R. Companies operating in the City the right to switch cars on our tracks with their own en- gines, that this privilege should be granted over the C. B. & Q. tracks serving any industry located on City property on the same terms, substantially. Councilman Schrempf moved that the petition be referred to the City Manager and City Solicitor. Petition of the Dubuque Stone Products Co., stating that in their quarry operations it is necessary to do more or less blasting, and they hereby respectfully ask that a per- mit be granted to said Company to carry on such operations. Nays —None. Petition of property owners in the vicinity of the Stand pipe on Delhi Street objecting to the construction of a new stand pipe to be construct- ed in the rear of the present one. They give the following reasons: First. If this tank is erected on the City lot on Delhi Street, the value of the surrounding property will depreciate to a great extent. Second. The residents of this sec- tion of the City have beautiful well kept homes, and look upon the building of another tank in this par- ticular block with disfavor as the appearance of the neighborhood will be completely ruined. Third. The space now unoccupied on this 50 by 140 foot lot is inade- quate for the building of another huge tank, which will darken the houses and shade the gardens of the nearby homes. Fourth. On the adjoining hills there is an abundance of room avail- able where a water tank may be erected, which would supply water for the western part of the City. Fifth. Two tanks will double the hazard. That Section 278 of the Ordinance entitled "An Ordinance establishing a building code for the City of Dubuque; creating the office of building commissioner, fixing the salary of said officer and defining the powers and duties of such build- ing commissioner, and prescribing penalties and violations thereof" be and the same is hereby repealed. Section 2. That, in lieu of said section hereby repealed there be and there is hereby enacted the fol- lowing section: Section 278. Roof covering of all buildings within the fire limits and all buildings except as given in the preceding section, shall have roof coverings of approved standard quality, such as brick, concrete, tile or slate, or highest grade of tin roof, or of asbestos or asphalt, or of built up roofing felt with gravel or slag surface or of built up as= bestos roof or other roof of like grade, or a covering of 15 pounds to a square of asbestos felt laid over wooden boards or shingles and 90 pounds to- a square of mineral sur- facing roofing laid on top of said asbestos felt or standard asphalt shingles, provided, however, where the covering is of slate or tin the asbestos felt herein provided for shall not be required. Any of the roof covers herein prescribed shah be considered as falling within the classification of Class ,A or B." Section 3. Nays —None. In a communication read before a special session of the City Council Tuesday afternoon, City Solicitor M. 11. Czizek made a complete state- ment of the facts in connection with the controversy involving the Illin ois Central and Chicago, Burlington & Qunicy railroads, over the use of spur tracks constructed on city property. Several months ago the City Council passed an ordinance giving the Chicago, Burlington & Quincy the right to construct a spur track across Bodjeda Street to the prop- erty of the Rainbo Oil Company. The ordinance also prescribed that only the C. 13. & Q. would have the right to switch cars of other roads on the spur track, and that a uni- form fee should be charged for such switching and spotting. The switch- ing was to be done with the Bur- lington's engines. The Illinois Central then regis- tered a protest charging that when the right to build similar tracks was given the Illinois Central several years ago it was specified that any railroad might use its own engines to switch cars upon the tracks, up- on the payment of an agreed uni- form charge to the Illinois Central. The ordinance giving the Burling- ton the .right to build the track, the I. C. officials claimed, was unfair, as it placed the other railroads un- der the handicap of paying heavy fees for the use of Burlington en- gines. City officials were not certain as to the exact provision of the Illinois Central ordinance, and City Solicitor Czizek was instructed to prepare a brief of the facts in the case. "At a recent meeting of your Honorable Body I was instructed to prepare for you a list of the streets in the city of Dubuque whereon the Illinois Central Railroad Company has rights to maintain switch and team tracks, and to advise you of the provisions in the ordinance rela- tive to the right of the other rail- roads to use such switch and team tracks. "On October 10, 1922, the City Council adopted an ordinance which defined the streets over which the Illinois Central was permitted to maintain switch and team tracks and also prescribed a condition un- der which such tracks were to be used by the other roads. Ilinois Central Spur Tracks "These tracks are described to be as follows: "Washington Street from the high bridge near Fifth Street over Wash- ington Street to the south line of Eleventh Street. This is called the Washington spur track. "Side track on Washington Street from its connection with said Wash- ington Street track near Sixth Street to Washington Street, then on the easterly side of Washington to a point 30 feet south of Eighth Street. This is called the Martin - Strelau track. "A side track on the easterly side of Washington Street, from its con- nection with Washington Street track at the north line of Eighth Street, thence along the westerly line of Washington Street, to a point 57 feet north of Tenth Street. This is called the Marshall Boiler track. "Side track from its connection with the Washington Street track, 77feet south of Eighth Street thence on the easterly side of Washington Street to the north line of Eighth Street. This is called the Klauer Manufacturing Company track. "From the bridge near Fifth Street northerly to Jackson Street, thence on Jackson Street to Eighth Street. This is called the Jackson Street track. "Side track from its connection with the Jackson Street track 130 feet south of Seventh Street and thence northerly on the east side of Jackson Street to Eighth Street. This is called the Farley and Loet- scher Company track. "Side track from its connection with Jackson Street track, for 10 feet south of Seventh Street, thence on westerly side of Jackson Street to Ninth Street. This is called the Farley and Loetscher Company track No. 2 and 3. "In this ordinance all railroads have the right to switch cars upon any of these tracks by paying an agreed uniform charge to the Illin- ais Central railroad. It is also agreed that the Illinois Central rail- road may switch cars of other rail- roads by having such railroads pay to it an agreed uniform charge for such services. "On September 25, 1924, the Coun- cil adopted an ordinance giving to the Chicago, Burlington and Quincy railroad the right to maintain a track to serve the Quality Oil com- pany. In this ordinance the Bur- lington alone switches all cars over these tracks and receives pay from other railroads for switching cars for them. "In the ordinance recently adopt- ed giving to the Burlington the right to maintain a track to serve the Rainbo Oil company the same pro- vision was incorporated in the or- dinance as is found in the Quality Oil company case. But the terms of these ordinances no other rail- road has the right to switch cars with their own engines over these tracks. Such service must be per- formed by the Burlington for which Special Session, July 27th, 1926 249 other roads must pay a uniform charge.." Respectfully submitted, M. H. CZIZEK, City Solicitor. Mrs. Welsch, owner of property on Rosedale Avenue, which was sold to the City at a tax sale in August, 1921, for the Rosedale Avenue im- provement, hereby offers to settle this matter by paying the original assessment, amounting to $139.64, and she asks the City to accept this amount and cancel the interest and penalty. This was levied against the property in 1894 for the improving of West 14th' Street from Alta Vista Street to Atlantic Avenue and purchased by the City at tax sale Sept. 2, 1921.
