Meeting called by order of Coun-
cilmen John H. Maclay, Earl Yount.
Council met at 8:30 A. M.
Present —City Manager Douglas,

Mayor Melchior read the call and
stated that notice thereof had been
duly made and that this meeting is
called for the purpose of adopting
resolutions, ordering the improve-
ment of McCormick Street from the
South property line of Grace Street
to the South property line of Ben-
net Street; East 27th Street from
the West property line of Jackson
Street to the East property line of
Central Avenue; Finley Street, by
constructing curb and gutter from
the West property line of McCor-
mick Street to the East property line
of West Street; Prospect Street by
constructing an 8 -inch tile sanitary
sewer from the alley first north of
West 5th Street from the end of the
present sewer in Prospect Street,
458 feet north in Prospect street and
west in the alley.
Resolution Ordering Construction of
Paving, Curb and Gutter and
Directing Clerk to Adver-
tise for Bids.
Be it resolved by the City Coun-
cil of the City of Dubuque that pur-
suant to a Resolution of Necessity,
proposed at a meeting of this Coun-
cil on the 9th day of August, 1926,
and duly passed on the 30th day of
August, 1926, it is hereby ordered by
this Council, upon its own motion
and without petition of property
owners, that the street improve-
ments described in said rsolution be
constructed, the same consisting of
grading, paving, curb and gutter in,
upon and along the following named
street, to -wit:
McCormick Street from the South
property line of Grace Street to the
South property line of Bennett
Street.
The curb and gutter shall be of
concrete construction, or old stone
curb may be reset where advisable.
All underground connections with
sewer, water and gas mains shall be
made to the curb lines in the man-
ner and within the time specified in
a resolution heretofore adopted
therefor. The street shall be paved
with 6 -inch plain concrete.
All of the work shall be construct-
ed in accordance with the plans and
specifications heretofore adopted

and now on file in the office of the
City Clerk.
Be it further resolved that the
City Clerk be and he is hereby or-
dered and directed to advertise for
proposals for the construction of
said improvements, as provided by
law, which improvements shall be
completed on or before the 15th day
of October„ 1926.
The cost and expense of said im-
provements will be paid for by levy-
ing special assessments against the
privately owned property abutting
upon said improvement and also
against property which does not
abutt, but which lies within the as-
sessable distance prescribed by law,
according to the area thereof and in
proportion to the special benefits
conferred, and paymetn will be made
to the contractor out of funds real-
ized from the sale of bonds to be
issued in anticipation of deferred
payment of assessments as provided
by law and any deficiency will be
paid out of the General Fund or the
Improvement Fund, or partly from
each of said funds.
This resolution being deemed ur-
gent and of immediate necessity,
shall be in force and effect from and
after its passage and adoption by the
City Council.

Sewers and Directing Clerk to
Advertise for Bids.
Be it resolved by the City Council
of the City of Dubuque, that pursu-
ant to a resolution of necessity,
proposed at a meeting of this Coun-
cil on the 9th day of August, 1926,
and duly passed on the 30th day of
August, 1926, it is hereby ordered by
this Council, upon its own motion,
and without petition of property
owners, that the sewer described in
said resolution be constructed, the
same being 8 -inch tile sanitary
sewer in Prospect Street from the
alley first north of West 5th Street
from the end of the present sewer
in Prospect Street, 458 feet south of
Prospect Street and west in alley.
Said sewer shall be constructed in
accordance with the plans and spec-
ifications heretofore adopted and
now on file in the office of the City
Clerk.
Be it further resolved that the
City Clerk be and he is hereby or-
dered and directed to advertise for
proposals for the construction of
said sewer, as provided by law,
which sewer shall be completed on
of before the 15th day of October,
1926.
The cost and expense of said
sewer will be paid for by levying
special assessments against the pri-
vately owned property abutting up-
on said sewer and also against such
adjacent property as might be bene-
fited thereby and in proportion to
such benefits, and payment will be
made to the contractor out of funds
realized from the sale of bonds to
ue issued in anticipation of deferred
payment of assessments, as pro-
vided by law, and any deficiency will
be paid out of the General Fund or
the Sewer Fund, or partly from each
of such funds.
This resolution being deemed ur-
gent and of immediate necessity,
shall be in force and effect from
and after its passage and adoption
by the City Council.

Mayor stated that this is the regular
monthly meeting of the Council for
the purpose of transacting such
business as may regularly come be-
fore the meeting.
Petition of John Faig, for exemp-
tion of taxes on his two lots on
lempsead Street, stating that he is
an invalid and unable to work, and
that the lots are being used by the
City as a street, owing to the fact
that the street in this part of the
City is a ditch and cannot be used
unless filled.
Councilman Maclay moved that
the petition be referred to the City
Solicitor and City Engineer. Sec=
onded by Councilman Yount. Car-
ried by the following vote:

Bond of the De Laval Steam Tur-
bine Co., Inc., No. 3286443, covering
the contract for the Waterworks

Subject: Acceptance of gas connec-
tions in Race Street.
The undersigned hereby certifies
that the contract for the installation
of gas connections in the improve-
ment of Race Street from West 11th
Street to Rose Street, Key City Gas
Co., contractors, has been completed.
I further certify that said improve-
ment has been done in accordance
with the plans, specifications and
stipulations of said contract and I
would therefore recommend its ac-
ceptance by the City Council.

A Resolution Accepting Improve-
ments and Directing the City
Clerk to Publish Notices.
Whereas, the contract for the im-
provement of Race Street from West
11th Street to Rose Street, by the
installation of gas connections, has
been completed and the city Engi-
neer has examined the work and
filed his certificate stating that the
same has been completed according
to the terms ofthe contract, plans
and specifications and recommends
its acceptance, now therefor
Be it resolved by the City Council
of the City of Dubuque, that the
recommendation of the City Engi-
neer be approved, and said improve-
ment be and the same is hereby ac-
cepted and the City Engineer be and
he is hereby instructed to prepare a
plat and schedule showing the Iots
or parcels of real estate subject to
assessment for said improvements
and file the same in the office of the
City Clerk subject to public inspec-
tion, and said City Clerk shall upon
receipt of such plat and schedule
publish the notice of the Council's
intention to levy special assessments
therefor, as required by law.
Be it further resolved that said
Clerk be and he is hereby directed
to publish a notice of the intention
of the City Council to pay the cost
of said improvements and state
therein, the time and place when
and where objections thereto may
be filed by interested parties, the
meeting ofthis Council for said pur-
pose to be held on the same date
that thespecial assessments herein
provided for are to be levied.
Be it further resolved that the
City Treasurer be and he is hereby
directed to pay to the contractor for
the funds to be realized from the
special assessments collected upon
the above described improvements
an amount equal to the amount of
his contract, less any retained per-
centage provided for therein.

Councilman Maclay moved the

Henry Kiene, of the Quality Oil
Co., addressed the Council relative
to four lights at their filling station
on 10th and Locust Streets, stating
that by some mistake the lights
were placed too near to the side-
walk and that the Company will
move them nearer to the curb if the
Council so desires. He was advised
to move them nearer to the curb,
which he promised to do. No furth-
er action was taken.
Mr. Martin, representing Howe,
Snow & Bertels Co., Chicago, ad-
dressed the Council and submitted a
verbal bid with a split interest rate
on the $75,000 Grading Bonds, some
of them to bear 41/4% interest and
some of them to bear 41 /a% interest.
City Manager Douglas explained
that when the bids for the two bond
issues were received some of the
firms were desirous of submitting
bids on the split rate basis, other
firms were not prepared to bid on
that basis. Therefore the City Man-
ager, who was receiving the oral
bids, eliminated this bidding.
The firm of Howe, Snow & Bar-
tels, who was low bidder with the
straight interest rate, refused at
that time to submit a split rate bid.
Mr. Martin told the Council that he
is submitting a split rate bid simply
to give the City a preference on
either the split or straight rate bas-
is. The bid of Howe, Snow & Ber-
tels for the $275,000 issue is, par,
accrued interest, cost of printing the
bonds and a premium of $6,770.
Their bid for the $75,000 issue is
par, accrued interest, cost of print-
ing bonds and a premium of $1,031.
The original resolution for the is-
suance of the $75,000 of grading
bonds provided that $50,000 of the
issue be in denomination of $1,000.
The bonding company desires the
entire issue in bonds of $1,000
denomination.

Whereas, notice of sale of $275,000
City Improvement Bonds of the City
of Dubuque, Dubuque County, Iowa,
has heretofore been given in strict
compliance with the provisions of
Chapter 63 of the Code of Iowa, 1924,
by publication of notice for two or
more successive weeks in the official
newspapers of the County of Du-
buque; and
Whereas, no sealed bids have been
received in response to said notice,
and thereafter open bids were called
and received, and after comparison
of said bids and when all bidding
ceased it was found that Howe,
Snow & Bertels, of Chicago, Ill., sub-
mitted the best bid for all the bonds,
the same being par plus accrued in-
terest, furnishing the bonds and a
premium of $6,770; now, therefor,
be it resolved by the City Council of
the City of Dubuque, Iowa, as
follows:
Section 1. That upon being ad-
vised in the premises it is hereby
determined that the bid of Howe,
Snow & Bertels, of Chicago, I11., for
the purchase of $275,000 City Im-
provement Bonds, is the highest and
best bid received and that said
bonds be and the same are hereby
awarded to said Howe, Snow & Ber-
tels, of Chicago, Ill.
Sec. 2. That the form of agree-
ment of sale of said bonds to Howe,
Snow & Bertels be and the same is
hereby approved, and the Mayor,
City Clerk and City Treasurer are
hereby authorized to execute said
agreemnt for and on behalf of the
City of Dubuque, Iowa, and to affix
the corporate seal ofthe City there-
to;
Sec. 3. That all resolutions or
parts of resolutions in conflict here-
with be and the same are hereby
repealed.

of the City of Dubuque, Iowa, as
follows:
Section 1. That Section 2 of the
resolution referred to in the pre-
amble hereof be and the same is
hereby amended to read as follows:
"Section 2. That the bonds of said
City, in the amount of $75,000, be
issued in anticipation of the collec-
tion of said grading fund taxes, pur-
suant to the provision of Chapter
320 of the Code of Iowa, 1924; that
each of said bonds be designated as
a City Grading Bond, be 75 in num-
ber, numbered from 1 to 75 inclu-
sive, be dated July lst, 1926; bear
interest at the rate of four and one -
half percent (4 %) per annum,
payable May lst, 1927, and semi-
annually thereafter on the first days
of May and November in each year;
that said bonds be signed by the
Mayor and attested by the City
Clerk and the seal of said City be
attached, and be registered by the
City Treasurer and a crtificate of
registration endorsed thereon; that
the interest on said bonds be evi-
denced by coupons attached and ma-
turing on the several days when
such interest matures, such coupons
to be executed with the facsimile
signatures of said Mayor and Clerk,
and said officials, by the execution
of said bonds, shall adopt as and for
their own proper signatures, their
respective facsimile signatures ap-
pearing on each of said coupons, and
that both principal and interest be
payable at the office of the City
Treasurer in the City of Dubuque,
State of Iowa; that said bonds in
the denomination of One Thousand
Dollars ($1,000) each, and become
due and payable in numerical order,
$15,000 on the first day of November
of each year of the years 1933 to
1937 inclusive."
Sec. 2. That all resolutions or
parts thereof in conflict herewith be
and the same are hereby repealed,
and that the resolution hereby
amended be and the same is hereby
in all respects ratified and confirmed
in its amended forni.

Resolution amending a resolution
entitled, Resolution providing for
the issuance of bonds in the sum of
$75,000 for the purpose of defraying
the cost of grading improvements.
Whereas, The City Council of the
City of Dubuque, in Dubuque Coun-
ty, heretofore, under date of August
9th, 1926, duly and finally adopted a
resolution entitled "Resolution pro-
viding for the issuance of bonds in
the sum of $75,000 for the purpose
of defraying the cost of grading im-
provements," which said resolution
was duly approved by the Mayor on
August 9th, 1926, and which said
resolution authorized the issuance
and delivery of City Improvement
Bonds in the aggregate principal
amount of $75,000, to be dated July
lst, 1926, and to bear interest at the
rate of four and one -half percent per
annum, payable May 1st, 1927, and
semi- annually thereafter on the first
days of May and November in each
year; and
Whereas, the City Treasurer of
the City has reported a proposal for
the purchase of said bonds at a
price not less than par and accrued
interest, but with all bonds of the
denomination of $1,000 each, which
reported proposal appears advantag-
eous to said City, and it is therefore

Be it resolved by the City Council
of the City of Dubuque, that pur-
suant to a resolution of necessity,
proposed at a meeting of this Coun-
cil on the 9th day of August, 1926,
and duly passed on the 8th day of
September, 1926, it is hereby order-
ed by this Council, upon its own
motion, and without petition of prop-
erty owners, that the sewer de
scribed in said resolution be con-
structed, the same being an 8 inch
tile sanitary sewer in West 8th
Street from the end of the present
sewer to a point, westerly about 327
feet.
Said sewer shall be constructed in
accordance with the plans and speci-
fications theretofore adopted and
now on file in the office of the City
Clerk.
Be it, further, resolved that the
City Clerk be and he is hereby or-
dered and directed to advertise for
proposals for the construction of
said server, as provided by law,
which sewer shall be completed on
or before the 1st day of November,
1926.
The cost and expense of said sew-
er will be paid for by levying spe-
cial assessments against the private-
ly owned property abutting upon
said sewer and also against such ad-
jacent property as might be bene-
fired thereby and in proportion to
such benefits, and payment will be
made to the contractor out of funds
realized from the sale of bonds to
be issued in anticipation of deferred
payment of assessments, as provided
by law and any deficiency will be
paid out of the general fund or the
sewer fund, or partly from each of
such funds.
This resolution being deemed ur-
gent and of immediate necessity,
shall be in force and effect from and
after its passage and adoption by
the City Council.

Mayor Melchior read the call and
stated that this meeting is called for
the purpose of adopting a resolution
of necessity for the construction of
a sanitary sewer in West 8th Street,
from the end of the present sewer
to a point 327 feet west, and acting
on any other business that may
come before the meeting,.
Resolution of Necessity for Construc-
tion of Sewer
Whereas, a plat and schedule has
been duly prepared by the City
Council of the City of Dubuque and
now on file in the office of the Clerk
thereof, showing the boundaries of
the district, the streets and alleys
and other places along which the
sewers are to be constructed, the ter-
minal points of the same, each lot
proposed to be assessed therefor, an
estimate of the cost of the same for
each different type of construction
and the kind of materials to be used
and in each the amount thereof
which it is estimated will be as-
sessed against each lot.
Be it therefore, resolved by the
City Council of said City, on its own
motion:
That it is deemed necessary and
advisable to construct, lay and put
in place an 8 inch tile sanitary sew-
er in West 8th Street from the end
of the present sewer, westerly about
327 feet.
Said sewer shall be provided with
manholes and any other appurten-
ances that may be necessary. Said
sewer shall be constructed in accord-
ance loth the plans and specifica-
tions prepared by the City Engin-
eer, having been duly approved by
the City Council and Manager and
State Board of Health and now on
file in the office of the City Clerk.
That the cost and expense of mak-
ing and constructing said sewer
shall be assessed against the pri-
vately owned property abutting
thereon not to exceed the amount
provided by law and upon such ad-
jacent property as might be bene-
fited thereby and in proportion to
such benefits, and and deficiency
September 8th, 1926
shall be paid out of the general fund
or sewer fund, or partly from each
of said funds and bonds shall be
issued and sold in anticipation of
deferred payment of assessments
and the proceeds thereof used to
pay the contractor.
Be it further resolved that the
above and foregoing sewers are
hereby proposed to be constructed
as hereinbefore set forth, and that
this proposed resolution, except this
paragraph, be and the same is here-
by set down for further and final
hearing, consideration and determin-
ation, at a meeting of this Council
to be held on the 30th day of Aug-
ust, 1926, at 4:30 o'clock P. M. in
the Council chamber of the City Hall
of this city, and the City Clerk be
and he is hereby instructed to cause
notice of the pendency of the above
resolution, and the time and place,
when and where said proposed reso-
lution will be considered for pass-
age, to be given by publication in
the official newspapers of said city,
in the manner and for the time pre-
scribed by law, at which time the
owners of property subject to assess-
ment for said proposed sewer may
appear and make objection to the
boundaries of the proposed district,
if any, to the cost of the proposed
sewers, to the amount proposed to
be assessed against any lot, and to
the passage of the proposed reso-
lution, and unless property owners
at the time of thea final considera-
tion of said resolution have on file
with the Clerk objections to the
amount of the proposed assessments,
they shall be deemed to have waived
all objections thereto.
The above resolution was ap-
proved and ordered placed on file
for final action and notice of its
pendency ordered given this 9th day
of August, 1926.

RESOLUTION amending a resolu-
tion entitled "Resolution providing
for the issuance of bonds in the sum
of $75,000 for the purpose of defray-
ing the cost of grading improve-
ments."
WHEREAS, this City Council of
the City of Dubuque, in the County
of Dubuque, heretofore, under date
of August 9, 1926, duly and finally
adopted a resolution entitled "Reso-
lution providing for the issuance of
bonds in the sum of $75,000 for the
purpose of defraying the cost of
grading improvements," which said
resolution was duly approved by the
Mayor on August 9, 1926, and which
said resolution authorized the issu-
ance and delivery of City Improve-
ment Bonds in the aggregate prin-
cipal amount of $75,000, to be dated
July 1, 1926, and to bear interest
Special Session, September 14th, 1926
at the rate of four and one -half per
cent annum, payable May 1, 1927,
and semi - annually thereafter on the
first days of May and November in
each year; and
WHEREAS, the City Treasurer of
this City has reported a proposal for
the purchase of said bonds at a price
not less than par and accrued in-
terest but with all bonds of the de-
nomination of $1,000 each, which re-
ported proposal appears advantage-
ous to said City, and it is therefore
to the best interests of said City
that the denomination of said bonds
be so changed;
NOW, THEREMORE, Be it and it
is hereby resolved by the City Coun-
cil of the City of Dubuque, Iowa, as
folloWs:
Section 1. That Section 2 of the
resolution referred to in the pre-
amble hereof be and the same is
hereby amended to read as follows:
"Section 2. That bonds of said
City, in the amount of Seventy -five
Thousand Dollars ($75,000), be issu-
ed in anticipation of the collection
of said grading fund taxes, pursu-
ant to the provisions of Chapter 320
of the Code of Iowa, 1924; that each
of said bonds be designated as a
'City Grading Bond', be seventy -five
(75) in number, numbering from 1
to 75 inclusive, be dated July 1,
1926, bear interest at the rate of
four and one -half per centum
(4 %) per annum, payable May 1,
1927, and semi - annually thereafter
011 the first days of May and No-
vember in each year; that said
bonds be signed by the Mayor and
attested by the City Clerk and the
seal of said City be attached, and
be registered by the City Treasurer,
and a certificate of registration en-
dorsed thereon; that interest on said
bonds be evidenced by coupons
thereto attached and maturing on
the several days when such interest
matures, such coupons to be execut-
ed with the fac- simile signatures of
said Mayor and City Clerk, and said
officials, by the execution of said
bonds, shall adopt as and for their
own proper signatures, their respec-
tive fac- simile signatures appearing
on each of said coupons, and that
both principal and interest be pay-
able at the office of the City Treas-
urer in the City of Dubuque, State
of Iowa; that said bonds be of the
denomination of One Thousand Dol-
lars ($1,000) each, and become due
and payable in numerical order,
$15,000 on the first day of November
of each of the years 1933 to 1937
inclusive."

Section 2. That all resolutions or
parts thereof in conflict herewith be
and the same are hereby repealed,
and that the resolution hereby
amended be and the same is hereby
in all respects ratified and confirmed
in its amended form.

o'clock P. M. The meeting was
called to order and there were pres-
ent H. G. Melchior, Mayor in the
chair and the following named

The Council took up for consider-
ation the resolution entitled "Reso-
lution amending a Resolution" en-
titled "Resolution providing for the

ments" 'which had been filed with
the City Clerk for public inspection

Councilman Meuser moved that

stating that they are owners of lot
2 of 16 and lot 1 of 1 of 16 of Mc-
Clain's Sub., abutting on McClain
Street, on the northerly side there-
of, and also lot 2 of Mineral lot 150
abutting said McClain Street on the
south side thereof. That they are
also owners of lot 7 of Sub. of lot
1 of 1 of Mineral lot 150. They state
that they desire to re -plat this prop-
erty providing for new lot descrip-
tions and also a new street extend-
ing into the same from Dodge Street.
All as shown in the plat submitted,
they further state that there is some
question about the dedication of ac-
ceptance of McClain Street above re-
ferred to, and further because of the
new proposed street which they in-
tend to dedicate and ask the accept-
ance thereof, and pray that this body
take such steps as will properly va-
cate McClain Street, granting title
in and to petitioners therein, and for
such further proceedings as may be
necessary and proper in the prem-

west of the west line of the property
and lots owned by the Rainbo Oil Co.
The attention of the Council is
called to the fact that should they
be compelled to connect with the
C. B. & Q. R. R. inestimable damage
would be done to said Rainbo Oil
Co. in that the cost of making such
connection will be much higher than
to connect with the I. C. R. R. Co.
tracks as petitioned for. Therefore
they again petition the Council to
take favorable action on the peti-
tion filed May 4th, 1926.

W. E. Wells addressed the Coun-
cil, stating that he is the owner of
lot 8 Sisters Add., that several years
ago he bought this property thi ugh
a bank that the abstract showed no
delinquent assessments, he left the
matter entirely to the bank and as-
sumed that all assessments were
paid. He was told when he wanted
to pay his taxes, that the property
had been sold to the City at tax
sale. He now asks the Council to
permit him to pay the installments
due to date with interest, and pay
the balance on the installment plan,
and that the tax sale certificate be
cancelled.
Councilman Maclay moved the
prayer of the petitioner be granted,
and the Treasurer be instructed to
accept the installments due to date
with interest, spread the balance of
the installments on the tax books
to be paid in installments, and
cancel the tax sale certificate. Sec-
onded by Councilman Meuser. Car-
ried by the following vote:

Payson Berg addressed the Coun-
cil relative to the exposition which

street corners in the City on which
to give free exhibitions.
Councilman Meuser moved that
the request of Mr. Berg be granted.

Clarence Carney addressed the
Council, stating that he is the own-
er of the north 33 feet of lot 21 cor-

at tax sale Dec. 7th, 1924. He here-
by asks that he be allowed to re-
deem this property by paying the
full assessment thereon with inter-
est less the penalty.
Councilman Meuser moved that

to accept the assessment with in-
terest less the penalty, and upon re-

the cancellation by the City Council
of the City of Dubuque of the un-
paid special assessment levied for
the construction of the sanitary and
storm sewer in the Southern Avenue
District against Lot 1 of the Sub-
division of Lot 1 of the Subdivision
of Lot 33, Levin's Addition, levied
on the 3rd day of August, 1925, the
undersigned owner of said described
real estate, does hereby agree to per-
mit owner of abutting or adjacent
property to connect with said sewer
where the same is located upon the
property of the undersigned as here-
in described without exacting any
compensation from such parties for
the making of such connections.
Providing, however, that should any
such parties make such connections
in, upon and across the lot herein
described, as a condition to the mak-
ing of such connections, such parties
shall at their own expense, restore
the sod, lawn or ground or surface
of the ground removed to as good
condition as the same was in prior
to the time of its disturbance.' The
terms of this agreement having been
heretofore orally agreed to by the
City Council of the City of Dubuque,
the same shall now become effective
from and after the approving of the
same by said Council.

case of Clifford Addyman.
To the Honorable Mayor and City
Council.
Gentlemen: Several years ago one
Clifford Addyman and three other
parties were fined in the Police
Court for operating and frequenting
a disorderly house. Cash was de-
posited as bail bond in the sum of
$270.00 and notice of appeal given.
The transcript in the case was not
certified to the District Court and
after some time had elapsed the bail
money was ordered paid to the City
Treasurer. Demand has now been
made for the money and a compro-
mise has been arrived at whereby
the City is to retain $150.00, to be
applied in satisfaction of the fine,
and the remaining $120.00 is to be
paid to the Beneficial Loan Society
of Dubuque, Iowa, to whom said
money has been assigned. I would
respectfully recommend that a war-
rant be drawn in favor of the Bene-
ficial Loan Society in the sum of
$120.00, which will be in full satis-
faction of any further claim upon
said fund by any persons interested
therein.

That the building of a sanitary
sewer is now contemplated begin-
ning at the intersection of Lawther
Street and Windsor Avenue, thence

St. Francis to. their buildings. Your
petitioners therefore pray that your
honorable body grant a franchise to
extend the city sewer from its pres-
ent location at Windsor Avenue and
Lawther Street, along Windsor Ave-
nue to the city limits and thence to
their building at their own expense
and that permission be granted for
the connection there of the sewer
about to be built as above stated
with the city sewer, all of said work
to be done under the direction of the
City Engineer.
The above franchise to be granted
with the provision that the property
owners abutting on Windsor Avenue
and Davis Avenue have permission
to connect with said sewer upon pay-
ment to the petitioners of their pro-
portionate part of the cost of con-
structing said sewer based on the
lineal frontage of their property on
said streets, said cost to be on rec-
ord in the City Engineer's office.

Whereas, a plat and schedule has
been duly prepared by the City
Council of the City of Dubuque and
now on file in the office of the Clerk
thereof, showing the boundaries of
the district, the streets to be im-
proved, the width of the improve-
ments ,each lot proposed to be as-
sessed, an estimate of the cost of
the proposed improvement for each
different type of construction and
kind of material to be used, and in
each case the amount thereof which
is estimated will be assessed against
each lot, for the improvement of the
streets named in this resolution:
Be it, therefore, resolved by the
City Council of the City of Dubuque,
Iowa, on its own motion:
That it is deemed necessary and
advisable to build, construct and put
in place certain street improve-
ments, as hereinafter described, in,
upon and along the following streets,
to wit:
Alta Vista Street from Kirkwood
Street to a point 100 feet north.

Said stret improvement shall con-
sist of grading, paving, curb and
gutter, such curb and gutter to be
constructed of concrete or old curb
reset, if advisable, and the paving.
to be constructed of one or more
of the following materials and meth-
ods, to wit:
By paving with 6 inch plain con-
crete.
Said paving, curb and gutter shall
be constructed, and all grading done
in strict accordance with the plans
and specifications therefor, which
have been prepared by the City En-
gineer and approved by the City
Council and Manager.
That the cost and expense of mak-
ing and constructing said improve-
ments shall be assessed upon and
against all privately owned property
whether abutting or not and lying
within the assessable distance pre-
scribed by law, according to the area
thereof, and in proportion to the
special benefits conferred, and any
deficiency shall be paid out of the
general fund or improvement fund
and bonds shall be issued and sold
in anticipation of deferred payment
of assessments and the proceeds
thereof used to pay the contractor.
Be it further resolved that the
above and foregoing street improve-
ments are hereby proposed to be
made and constructed as hereinbe-
fore set forth, and that this proposed
resolution, except this paragraph, be
and the same is hereby set down for
further and final hearing, considera-
tion and determination at a meeting
of this Council to be held on the 17th
day of September, 1926, at 4:30
o'clock P. M. in the Council Cham-
ber of the City Hall of this city,
and the City Clerk be and he is
hereby instructed to cause notice of
the pendency of the above resolu-
tion, and of the time and place,
when and where said proposed reso-
lution will be considered for pass-
age, to be given for publication in
the official newspapers of said city,
in the manner and for the time pre-
scribed by law, at which time the
owners of property subject to assess-
ment for said proposed improvement
may appear and make objection to
the boundaries of the proposed dis-
trict, if any, to the cost of the pro-

All underground connections with

with 6 -inch plain concrete.
The street railway portion of the
street shall be paved with
between the rails and one foot, out-
side thereof. All of the work shall
be constructed in accordance with
the plans and specifications hereto-
fore adopted and now on file in the
office of the City Clerk.
Be it further resolved that the
City Clerk be and he is hereby or-
dered and directed to advertise foi•
proposals for the construction of
said improvements, as provided by
law, which improvements shall be
completed on or before the 1st day
of November, 1926.
The cost and expense of said im-
provements will be paid for by levy-
ing special assessments against the
privately owned property abutting
upon said improvement and also
against property which does not
abutt, but which lies within the as-
sessable distance prescribed by law,
according to the area thereof and in
proportion to the special benefits
conferred, and payment will be made
to the contractor out of funds real-
ized from the sale of bonds to be is-
sued in anticipation of deferred pay-
ment of assessments as provided by
law, and any deficiency will be paid
out of the General Fund or the Im-
provement Fund, or partly from each
of said funds.
This resolution being deemed ur-
gent and of immediate necessity,
shall be in force and effect from and
atter its passage and adoption by

Resolution Ordering Construction of
Paving, Curb and Gutter and
Directing Clerk to Adver-
tise for Bids.
Be it resolved by the City Coun-
cil of the City of Dubuque that pur-
suant to a Resolution of Necessity,
proposed at a meeting of this Coun-
cil on the 30th day of August, 1926,
and duly passed on the 17th day of
September, 1926, it is hereby or-
dered by this Council upon its own
motion and without petition of prop-
erty owners, that the street improve-
ments described in said resolution
be constructed, the same consisting
of grading, paving, curb and gutter

Special Session, September 17th, 1926
in, upon and along the following
named street, to -wit:
Kirkwood Street from Alta Vista
Street about 146 feet west.
The curb and gutter shall be of
concrete construction, or old stone
curb may be reset where advisable.
All underground connections with
sewer, water and gas mains shall be
made to the curb lines in the man-
ner and within the time specified in
a resolution heretofore adopted
therefor. The street shall be paved
with 6 -inch plain concrete.
The street railway portion of the
street shall be paved with
between the rails and one foot out-
side thereof. All of the work shall
be constructed in accordance with
the plans and specifications hereto-
fore adopted and now on file in the
office of the City Clerk.
Be it further resolved that the
City Clerk be and he is ,hereby or-
dered and directed to advertise for
proposals for the construction of
said improvements, as provided by
law, which improvements shall be
completed on or before the 1st day
of November, 1926.
The cost and expense of said im-
provements will be paid for by levy-
ing special assessments against the
privately owned property abutting
upon said improvement and also
against property which does not
abutt but which lies within the as-
sessable distance prescribed by law,
according to the area thereof and in
proportion to the special benefits
conferred, and payment will be made
to the contractor out of funds real-
ized from the sale of bonds to be
issued in anticipation of deferred
payment of assessments as provided
by law, and any deficiency will be
paid out of the General Fund or the
Improvement Fund, or partly from
each of said funds.
This resolution. being deemed ur-
gent and of immediate necessity,
shall be in force and effect from and
after its passage and adoption by
the City Council.

Theodore Brent, of Memphis,
Tenn., traffic manager for the In-
land Waterways Corporation, which
operates the barge service on the
lower river and which will operate
the Upper Mississippi River Barge
Line Company beginning next year,
explained in detail the plans which
have been laid by the federal body
to make Dubuque one of the princi-
pal rail and river freight inter-
change points on the upper river.
A fund of $600,000 originally was
raised by the Upper Mississippi
River Barge Line, Mr. Brent stated,
to construct the fleet of barges and
tow boats which will ply the upper
stream. Since that time an addi-
tional $200,000 has been raised. Un-
der federal direction this money is
being spent for the construction of
a fleet which when completed will
be composed of 15 barges, built at a
cost of $165,000 each, and three tow
boats, built at a cost of $21,650
each.
The upper river line, when in
operation, will syncronize with the
Mississippi - Warrior Service on the
lower river, so that there will be
Continuous water transportation
from tidewater, at New Orleans, to
Minneapolis, Mr. Brent stated.
Referring to the site selected for
the construction of the Dubuque ter-
minal, the city -owned property
south of the harbor, and to the na-
tural advantages of a location which
the city possesses, Mr. Brent point-
ed to the necessity of constructing
a thoroughly modern and efficient
terminal in order that freight may
be handled at a minimum of cost.
The terminal, when completed, is
to be turned over to the federal
barge line, which will operate it
for • a period of years, at the end
of which it will have the privilege
of purchasing it at a contract price.
Meanwhile the federal line will pay
for maintenance of the terminal and
will pay the city a tonnage cost of
15 cents, which it is said, will be
sufficient to meet interest on any
bonds which may be issued for its
construction and to provide a sink-
ing fund with which to redeem the
bonds when they mature. This, Mr.
Brent said, will insure against the
levying of special taxes after the
terminal has been completed and
has been in operation long enough
to develop an average business.
W. F. Schultz, of Memphis and
New Orleans, discussed the design
of terminals, and declared that the
construction of a terminal not prop-
erly arranged results in a high cost
of handling freight and possible loss
through damage and claims.
The terminal which has been de-
signed by Mr. Schultz is made up of
a "package type" unit, for the hand-
ling of package merchandise, a unit
for handling bulk shipments, a
wharf boat, a warehouse, side track-
ing and a conveyor. To this will lat-
er be added grain elevators and
facilities for the handling of other
bulk shipments in large quantities.
Following the explanation of the
government corporation's plans. For-
mer Councilman L. H. Brede spoke
briefly to the Council, at the request
of Mayor Harlan Melchior, and de-
clared that the barge line's proposi-
tion presented an opportunity "such
as Dubuque never has had before ".
and urged the Council to act favor-
ably upon the proposal.
Theodore P. Gabriel, also a for-
mer member of the Council, express-
ed a like opinion. P. S. Fawkes,
president of the Dubuque Shippers'
Association and a member of the
Chamber of Commerce committee on
the development of river naviga-
tion, declared that "Dubuque, as a
city, will be very handsomely repaid
for any outlay which it may Make to
further freight revision in western
trunk line territory as an added rea-
son why all river cities should lend

material support to barge line devel-
opment.
Among others Who spoke in favor
of the plan and Urged steps for the
construction of the terminal, were
George McLean, R. V. McKay, John
A. Kerper, Ira N. Davenport and
Peter McCarthy. Sentiment of the
gathering of business men and ship-
pers gathered in the Council Cham-
ber, as expressed by these spokes-
men, unanimously favored steps by
the Council which would hasten the
revival of river shipping here.
Mr. McLean suggested that as it
was proposed to compensate the
city for the use of the terminal on
the basis of tonnage handled it
would be desirable to require a re-
sponsible guarantee of a minimum
rental sufficient to cover the city's
carrying charges for deprecitation
and interest; although he thought a
part of the interest charge might be
remitted during the period of early
development.
The necessity of immediate ac-
tion by the city was emphasized by
both Brent and Schultz, who point-
ed out that the navigation season
probably will open prior to May 1
of next year, and that terminal facil-
ities planned for immediate con-
struction should be completed be-
fore that time in order that they
may be ready for service when the
first barges touch at Dubuque.
Councilman Maclay moved that
the City Solicitor prepare a resolu-
tion whereby the question be submit-
ted to the voters to create a Dock
Commission, and incorporate author-
ization to employ an Engineer to
complete plans for the proposed
Terminal. Seconded by Councilman
Meuser. Carried by the following

the City limits, prescribing the con-
ditions of this giant and regulating
future connections with said sewer.

Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Wartburg
Place, hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council, and the City Engineer has
computed the cost and expense
thereof to be $2,867.75.
And whereas, public notice as pro -
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all 'objections
filed thereto have been considered
and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost of
improving Wartburg Place from the
end of the present improvement to
Lull Street, there be issued Improve-
ment Bonds to the amount of

Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Seminary
Street, hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City, and the City
Engineer has computed the cost and
expense thereof to be $3,120.59.
And Whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now therefor, be it resolved by
the City Council of the City of Du-
buque that to provide for the cost of
iinprobing Seminary Street from the
west property line of Heeb Street to
the East property line of Main
Street, there be issued Improvement
Bonds to the amount of $3,120.69.

Said bonds shall be issued under the
provisions of Chapter 311 of the
Code of Iowa, 1924, which bear date
as of the 20th day of October, A. D.
1926, shall be in the denomination of
$300.00 each, except that there shall
be one bond to the amount of
$120.59; they shall be numbered
from 1243 to 1253 inclusive, and
shall be divided into 10 series, of
which the bonds numbered 1243 to
1244 shall constitute the first series
and shall be payable on the 1st day
of April, A. D. 1927; the bonds num-
bered from 1245 shall constitute the
second series and shall be payable
on the lst day of April, 1928; the
bonds numbered 1246 shall consti-
tute the third series and shall be
payable the 1st day of April, 1929;
the bonds numbered 1247 shall con-
stitute the fourth series and shall be
payable the 1st day of April, 1930;
the bonds numbered 1248 shall con-
stitute the fifth series and shall be

Said bonds shall bear interest at

shall be payable at the office of the

The City of Dubuque in the State

at the option of the City the sum of
Three Hundred Dollars, with inter-
est thereon at the rate of 5 per cent
per annum, payable on the presenta-
tion and surrender of the interest
,_oupons hereto attached, both inter-
est and principal are payable at the
office of the City Treasurer in the
City of Dubuque in the State of
Iowa. This bond is issued by the
City of Dubuque pursuant to and by
virtue of Chapter 311 of the Code of
Iowa, 1924, and in accordance with
a resolution of the City Council of
said city, duly passed on the 20th
day of September, 1926.. This bond
is one of a series of eleven bonds„
ten for $300.00 each, numbered 1243
to 1252, and one for $120.59, num-
bered 1253, all of like tenor and date,
and issued for the purpose of im-
provement of Seminary Street from
the west property line of Heeb
Street to the east property line of
Main Street, and described in said
resolution; which cost is assessable
and levied along said improvement,
and is made by law a lien on all
abutting or adjacent property, and
payable in ten annual installments,
with interest on all deferred pay-
ments at the rate of five per cent per
annum, and this bond is payable
only out of the money derived from
the collection of said special tax,
and said money can be used for no
other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done prec-
edent to and in the issuing of this
series of bonds, have been done, hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment
hereon of said special tax the faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.
In witness whereof the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 20th day of October, 1924,
and has authorized the use of their
fac - simile signatures to the interest
coupons hereto attached.

to the City limits, prescribing the
conditions of this grant and regu-
lating future connections with said

Whereas, Sisters. of St. Francis
Convent have petitioned the City
Council of the City of Dubuque for
Special Session, September 27th, 1926
permission to construct and main-
tain an eight (8) inch sanitary sewer
in Windsor Avenue from the end of
the present sewer at the intersection
of Lawther Street and Windsor Ave-
nue, thence northerly to the City
limits, said sewer to be then ex-
tended to serve the buildings owned
by said petitioners, and this Coun-
cil, after due consideration, finds no
objection to the granting of said re-
quest.
Be it Ordained by the City Coun-
cil of the City of Dubuque:
Section 1. That Sister of St.
Francis Convent, their successors
and assigns be and they are hereby
granted the right to construct and
maintain an eight (8) inch sanitary
se'Yer in Windsor Avenue from the
end of the present sewer at the in-
tersection of Lawther Street and
Windsor Avenue, thence northerly
to the City limits, said sewer then
to be extended to serve the property
of said grantees.
Sec. 2. That the total cost of con-
structing said sewer shall be paid
by the grantees and said sewer shall
be built under the supervision of the
City Engineer.
Sec. 3. That before commencing
any excavation in the street pre
paratory to the laying of the sewer
mains said grantees or the con-
tractor to whom the work shall be
awarded, shall cause to be filed with
the City of Dubuque a Surety Bond
to be approved by said City in the
sum of $10,000.00, which bond shall
be so conditioned that it will save
the City of Dubuque harmless from
any and all damages which may be
sustained by persons or property by
reason of the construction of said
improvement for liability there-
under shall continue until all
ditches have been refilled, obstruc-
tions removed from the street, and
the surface of the street replaced to
as good condition as it was in before
disturbed.
Sec. 4. As a further condition to
this grant, it is understood that
after said sewer is completed the
City of Dubuque shall have the right
to make extensions thereto into
other streets or districts without be-
ing required to pay any part of the
cost of the original construction of
the sewer herein authorized.
See. 5. All maintainence and re-
pairs on this sewer shall be paid by
the grantees herein, their successors
or assigns; provided, however, that
should the City at any time exer-
cise its right to extend said sewer,
as provided in Section 4 hereof and
thereafter for the purpose of main-
tenance and repairs, and sewer

shall be considered a public sewer
and such expense shall be borne by
the said City.
Sec. 6. After said sewer has been
completed and the total cost thereof
determined, such cost shall be cer-
tified to as correct and filed in the
office of the City Engineer, where
the same shall remain as a perma-
nent record. Any person or per-
sons desirng to connect with said
sewer shall first apply to the City
Council for permission to do so, and
such permission shal be granted
upon condition that such property
owner pay to the grantees herein,
their successors or assigns, such a
part of the total original cost of
construction of said sewer as the
linear feet of the property to be
connected bears to the same.
Sec. 7. That after said sewer has
been constructed it shall not be re-
moved or its free use interfered with
by the grantees herein, their suc-
cessors or assigns.
Sec. 8. That within ten (10) days
after the final adoption of this ordi-
nance said grantees, through their
authorized representative, shall ac-
cept the terms hereof by filing a
written acceptance with the City
Clerk of the City of Dubuque and
unless such acceptance is filed this
ordinance shall become of no fur-
ther force or effect.
Sec. 9. This Ordinance being
deemed urgent and of immediate
necessity shall be in force and ef-
fect from and after its final pass-
age, adoption and approval and pub-
lication as provided by law.

Mr. E. Scheppele addressed the
Council and stated that his property,
N. 2/5 of Lot 455, on Iowa Street, is
assessed too high and asks that it be
reduced from $10,000 to $8,000; also
Lot 8 in Hooper's Add. he asks that
it be reduced from $6,800 to $5,000.
He stated that he had taken this
matter up several times with the
Board of Review, but can get no
satisfaction. The Council informed
him that this is a matter that he
can appeal to the Courts, that the
Council has no jurisdiction in this
matter and can do nothing for him.
The petition of C. J. Schrup ask-
ing permission to excavate in street
to make water connection to his new
home, referred to Engineer at a
previous meeting, was on his recom-
mendation granted.
Councilman Maclay moved that
the recommendation of the Engineer
be approved and permission to ex-
cavate granted. Seconded by Coun-
