A resolution, plat, and staff report are attached. DISCUSSION The Final Plat of Felderman Subdivision subdivides an existing 10.2 acres site into 14 lots for single - family dwellings and provides for the construction of a new public street, Arboretum Court. The preliminary plat for Felderman Subdivision was reviewed and approved by the Zoning Advisory Commission at their February 3, 2010, and by the City Council at their February 15, 2010 meeting. The City Council reviewed the preliminary plat as the developers proposed a 27 -foot wide public street rather than the 31 -foot wide standard residential street, which required a waiver from the City Council. The submitted Final Plat of Felderman Subdivision is in substantial compliance with the Unified Development Code, including meeting the 40 points required for sustainable development. The developers have used a variety of sustainable subdivision development tools to meet the criteria. The submitted Final Plat has been reviewed by the City's Planning, Building, Water, Engineering, and Fire Departments, and found to be in substantial compliance with the relevant City of Dubuque Codes. The public improvement plans have been reviewed and approved by the Engineering Department. Environmental Quality Goals: 1.4., 1.5, 2.3, 2.5 and 5.8. Impact of Request on: Utilities: Existing City utilities can handle the proposed 14 -lot subdivision. Traffic Patterns: The 14 single - family building lots will generate approximately 140 additional vehicle trips. Access to and from the proposed subdivision is by way of Arboretum Drive. Public Services: Existing public services are adequate to serve the proposed subdivision. Environment: Staff does not anticipate any significant impact to the environment provided the sustainable measures proposed by the applicant are installed and maintained appropriately, and that appropriate erosion control and storm water control is provided throughout development of the subdivision. Adjacent Properties: Planning staff anticipates the most likely impact to adjacent property is an increase in vehicle trips traveling on Arboretum Drive. Proposed Sustainable Development Tools: 27 -foot wide street (reduced impermeable area), concrete street (reduced heat island affect), street trees, infill development, LED street lights, infiltration of storm water in detention basin, greater than 40% of parcel undisturbed, and rain gardens on over 50% of lots. Recommended Conditions on Plat: None. Staff Analysis: The Final Plat of Felderman Subdivision subdivides approximately 10 acres of property at the east of Arboretum Drive into 14 single - family lots. Three of the . single - family Tots will have frontage on Arboretum Drive, while the remaining 11 building lots will take their access from a new public street to be named Arboretum Court. The proposed subdivision includes construction of a new public street to be named Arboretum Court that will be built to a 27 -foot width with a 50 -foot right -of -way. The street will be constructed with a concrete roadway and standard curb and gutter. A majority of the proposed building lots are too low to access the existing sanitary sewer main with gravity flow laterals. A lift station and force main will be necessary to serve 10 of the building lots; three lots can utilize gravity flow laterals, and one lot will need an individual El pump. The lift station and force main will be built by the developer and maintained by the City. City water is available to this site and will be extended through Arboretum Court. The developer is providing for a storm water detention basin (Lot C) Subdivision Staff Report — Arboretum Development, LLC Page 3 • as part of Lot 8 and will provide the necessary access easements for the City to provide long -term maintenance of the facility. The Unified Development Code requires that each new subdivision utilize sustainable development tools to achieve a minimum 40 point score. The developer has scored 40 points with a mixture of these tools. The developer looked at a variety of sustainable development tools because the size, topography and subsoil characteristic presented a challenge in meeting the new sustainability standards in the UDC. The Final Plat of Felderman Subdivision will use these sustainability measures: 1. A 27 -foot wide street, which reduces the amount of impervious area of the development (5 points). 2. A concrete street that reduces the heat island effect (5 points). 3. Planting street trees within the parkway between the sidewalk and back of curb (5 points). 4. The proposed subdivision is located on an infill lot. The City Planner has determined that it is an appropriate sustainability measure (5 points). 5. LED street lights will be used on Arboretum Court, with 50% energy savings and twice the Iifespan. The City Engineer has determined this is an appropriate sustainability measure (5 points). 6. Storm water will be allowed to infiltrate in the bottom of the detention basin. The City Engineer has determined this is an appropriate sustainability measure (5 points). 7. 40% or more of the parcel will remain undisturbed after grading for the street, utilities, and building lots. The City Planner has determined this is an appropriate sustainability measure (5 points). 8. Rain gardens required by covenant installed on greater than 50% of the platted lots (5 points). The owner must continue to own and maintain Lot C and stormwater detention facility until (1) the facility has been fully completed, (2) 80% of the platted lots in Felderman Subdivision, and subdivisions thereof have been fully developed, and (3) adequate erosion control measures, as approved by the City have been installed on the remaining 20% of the lots. Acceptance of Lot C and the detention facility must be by the City Council as required by the Unified Development Code. Upon the City's acceptance of the detention facility, the inspection, administrative and maintenance expenses incurred by the City of Dubuque for the storm water detention facility (Lot C) shall be assessed against the lot owners of Felderman Subdivision as indicated above, and the preliminary plat, in proportion to the acreage of each lot, excluding Lots A, B and C, and the City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to the Dubuque County Treasurer, and such costs shall then be collected with and in the same manner as general property taxes in accordance with provisions of law. Section 5. Owners of Lots 7,'8, 9, 10, 11, 12, 13 and 14 shall construct and maintain permanent rain gardens in accordance with the subdivision improvement plans on file with the City Engineer, in accordance with design standards for rain gardens in Iowa, and in a manner acceptable to the City Engineer. Said lot owners shall allow access to the City of Dubuque for inspections of the rain gardens. Section 6. That the planting of street trees shall be coordinated with the City Forester. Any trees planted within the street right -of -way must be chosen and planted by the City of Dubuque Leisure Services Department. Section 7. That the final acceptance of the public improvements shall occur upon certification of the City Engineer to the City Council that the public improvements have been completed in accordance with the approved improvement plans and City standards and specifications and accepted by City Council Resolution. Section 8. That in the event Arboretum Development, LLC fails to execute the acceptance and furnish the guarantees provided in Sections 2 and 3 hereof within 180 days after the date of this Resolution, the provisions hereof shall be null and void and the acceptance of the dedication and approval the plat shall not be effective.
