Van Milligen, City Manager SUBJECT: Iowa Department of Transportation Agreement for an Extension of US 20 Public Works Director Mike Koch recommends City Council approval of a pre-design agreement between the City of Dubuque and the Iowa Department of Transportation for improvements to US 20 relating to the proposed new US 20 Mississippi River Crossing Project. This project provides for improvements to US 20, including a new bridge with a bikeway across the Mississippi River. US 20 would be improved from approximately 0.5 miles west of Locust Street to approximately 0.5 miles southeast of Sixth Street in East Dubuque. The new US 20 bridge alignment would be located approximately 115 feet south of the existing Julien Dubuque Bridge. The Iowa side of the project will include grading, paving, and approach structures with an interchange at Locust Street. US 20 and Locust Street traffic will be maintained throughout the construction with the use of staging and traffic control. US 20 traffic will be detoured onto the new on-off ramps, while construction progresses on the Locust Street interchange and other ramps. A new connection betWeen Bissell Ddve and the Dublin Connector will be constructed. Existing bluff Street aCcess to westbound US 20 will be closed and a cul-de-sac constructed at the southerly end of Bluff Street. The agreement describes the current project concept as well as defines the responsibilities for both the City and the Department in the development and funding of the project. The project plans include storm sewer installation, relocation of utilities, traffic signalization, and the construction of interchange lighting at Locust Street. Koch, Public Works Director Iowa Department of Transportation Agreement for an Extension of US 20 INTRODUCTION Enclosed is a pre-design agreement between the City of Dubuque and the Iowa Department of Transportation (IDOT) for improvements to US 20 relating to the proposed new US 20 Mississippi River Crossing Project. BACKGROUND This project provides for improvements to US 20, including a new bridge with a bikeway across the Mississippi River. US 20 would be improved from approximately 0.5 miles west of Locust Street to approximately 0.5 miles southeast of Sixth Street in East Dubuque. A new connection between Bissell Drive and the Dublin Connector will be constructed. Existing Bluff Street access to westbound US 20 will be closed and a cul-de-sac constructed at the southerly end of Bluff Street. Main Street and Terminal Street will incur a short-term closure during construction activities. Sidewalks will be replaced or constructed as necessary. A bikeway will be constructed between the Locust Street interchange area and Main Street. DISCUSSION The agreement describes the current project concept as well as defines the responsibilities for both the City and the Department in the development and funding of the project. The project plans include storm sewer installation, relocation of utilities, traffic signalization, and the construction of interchange lighting at Locust Street. An amended agreement will be prepared by IDOT prior to the construction to outline any costs that the City will need to assume. IDOT and the City will share propor[ionately on the cost of storm sewer installation. The City will be responsible for relocation cost of all utilities. IDOT will assume the cost of any traffic signalization construction within the area and the interchange lighting at Locust Street. After this project is completed, the City will be responsibility for the maintenance of access control, parking restrictions, utilities, sewer, traffic signalization, and street lighting. RECOMMENDATION I recommend that the City Council approve the pre-design agreement between the City of Dubuque and IDOT for the proposed new US 20 Mississippi River Crossing Project. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution authorizing the Mayor to execute two copies of the pre-design agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the pre-design agreement between the City of Dubuque and the Iowa Department of Transportation for the proposed new US 20 Mississippi River Crossing Project be and is hereby approved. Section 2. District Engineer Attachment Staff Action No: PREDESIGN AGREEMENT County Dubuque City Dubuque Project No. BRF-20-9(149)~38-31 Iowa DOT Agreement No. 2003-P-127 This AGREEMENT, is entered into by and between the Iowa Department of Transportation, hereinafter designated the *'DOT", and the City of Dubuque Iowa, hereafter designated the "CITY" in accordance With 761 Iowa Administrative Code, Chapter 150 and Iowa Code sections 28E. 12 and 306A.7; WlTNESSETH; that WHEREAS, the DOT proposes to establish or improve an extension of Primary Road No. U.S. 20 as a controlled access facility within the City of Dubuque in Dubuque County, Iowa; and WHEREAS, the DOT and the CITY are willing to jointly participate in said project, in the manner hereinafter provided; and WHEREAS, this Agreement reflects the current concept of this project, subject to consideration of any changes in'the major elenients of planning or design which would affect the project's final concept; NOW, THEREFORE, IT IS AGREED as follows: 1. Iowa and Illinois have jointly agreed to develop and construct a new U.S. 20 bridge crossing, of the Mississippi River, between the Cities of Dubuque, Iowa and East Dubuque, Illinois. As part of the proposed new crossing, the DOT will also design and develop the appropriate bridge approach connections within the CITY, including a new interchange at Locust Street. IT IS FURTHER agreed that the division of responsibilities will be as follows: 2. The DOT will prepare project plans for the Iowa approach work located within the CITY. Right of Way - The CITY and DOT previously entered into Agreement 2003-1-026 for the acquisition of fight of way and access control as part of the above referenced project (see Section 1 herein). Said Agreement was signed by the CITY and DOT on September 16 and 20, 2002 respectively. Subject to the provisions hereof, the CITY in accordance with 761 Iowa Administrative Code Sections 150.3(1)c and 150.4(2) will remove or cause to be removed all encroachments or obstructions within the limits of existing primary highway right of way within the CITY project limits. The CITY will also prevent the erection and/or placement of any structure or obstruction on said right of way or any additional right of way which is acquired for this project including but not limited to private signs, buildings, pumps, and parking areas. The CITY shall permit the removal of any trees within the existing and/or proposed limits of any established street or primary highway that will interfere with the construction of the project or establishment of the clear zone. The CITY shall take whatever steps may be required to legally establish grade lines of the new highway facilities constructed under said project (within the CITY), in accordance with the provisions of Iowa Code Section 364.15. Storm Sewers - The DOT shall be responsible for the costs of construction of longitud'mal and outlet storm Sewers (if any) in the proportion that the street right of way of the primary extension bears to the total drainage area (within the CITY) served by the proposed sewers. The CITY shall be responsible for the remainder of the costs. A final cost sharing estimate shall be determined by the DOT and included in a Preconstmction Project Agreement which will be submitted to the CITY prior-to construction of the project. 8. Limits of storm sewer improvements shall be specified by the DOT. All storm sewers constructed as a part of the project shall become the property of the CITY which shall be responsible for their maintenance and operation. The CITY shall not make any connections to said storm sewers without prior written approval of the DOT. The CITY shall take all appropriate measures to prevent use of such storm sewers as a sanitary sewer. 2 10. 11. 12. 13. 14. 15. Utilities - Subject to the approval of and without expense to the DOT, the CITY agrees to perform or cause to be performed, all relocations, alterations, adjustments or removals of existing utility facilities within the CITY including but not limited to power, telephone and Cable television telecommunication (fiber optic lines), natural gas pipelines, water mains and hydrants, curb boxes, utility accesses, sanitary sewers, and related poles, installations and appurtenances, whether privately or publicly owned, and all parking meters, traffic signals and other facilities or obstructions which are located within the limits of an established street or alley and which will interfere with construction of the project and the cIear zone, all in accordance with the Utility Accommodation Policy of the DOT. With the exception of service connections no new or furore utility occupancy of project right of way (within the CITY), nor any future relocations of or alterations to existing utilities within sUCh limits, shall be permitted or undertaken by the CITY without the prior written consent of the DOT. All work shall be performed in accordance with the Utility Accommodation Policy and other applicable requirements of the DOT. Access Control, Parking - The CITY shall promptly impose, continue and maintain access control and parking restrictions after the new or modified facilities constructed for said project have been completed and made operable. No new side road entrances or modification of existing entrances shall be permitted by the CITY within :the project limits (including access control) without the prior written consent of the Department. The CITY and the DOT agree that this project will be constructed and future additional entrances or modifications of existing entrances, if authorized, shall be in accordance with 761 Iowa Administrative Code Chapter 112 (306A). Parking - Parking shall be prohibited along both Sides of proposed U.S. 20 withih the project limits and along Locust Street for a distance of 750 feet north and south of the new U.S. 20 centefline respectively. New lighting and/or traffic signal construction which may be accomplished (within this project area) as part of or incident to this project shall be provided under guidelines established in 761 Iowa Administrative Code Ch. 150. If warranted, the DOT shall construct traffic Signals all at no cost to the CITY. Lighting installations will not be constructed as part of the project unless specifically requested by the CITY (except as described below). Lighting which is requested by the CITY will also be paid for entirely by the CITY at no cost to the DOT or project. If constructed, the CITY shall accept ownership of and responsibility for future energy and maintenance costs of those lighting 3 16. 17. 18. 19. 20. 21. and/or traffic signal units which lie within the CITY'S corporate boundaries. The current design calls for construction of interchange lighting at Locust Street. This proposed lighting will be constructed at project cost (no expense to the CITY). Upon completion of construction, the CITY will accept responsibility for furore ownership of said lighting including maintenance and energy costs associated therewith, all at no additional expense or obligation to the DOT. No other lighting construction is proposed at this time. The CITY, in accordance with Iowa Code Sections 306.10 through 306.14, will hold a public hearing for the permanent closure of all U.S. 20 street crossings and access points not perpetuated as part of the construction of this project. The hearing proceedings will be conducted by the CITY, all at no expense or obligation to the DOT or project. For situations where the CITY has completed a Flood Insurance Study (FIS) for an area which is affected by the proposed Primary Highway project area; If after the date of this Agreement the FIS is modified, amended or revised in an area affected by the project, the CITY shall promptly provide notice of the modification, amendment or revision to the DOT. For situations where the CITY does not have a detailed Flood Insurance Study (FIS) for an area which is affected by the proposed Primary Highway project area; If afier the date of this Agreement the CITY does adopt an FIS in an area affected by the project, the CITY shall promptly provide notice of the FIS to the DOT. A Preconstmction Project Agreement shall be prepared by the DOT prior to the project constrdction letting. This agreement shall address any participation by the CITY in the costs of the project (if any). It is the intent of both parties that no third party beneficiaries be created by this Agreement. If any section, provision, or part of this Agreement shall be fotmd to be invalid or unconstitutional, such finding shall not affect the validity of the Agreement as a whole or any section, provision, or part thereof not found to be invalid or unconstitutional, except to the extent that the original intent of the Agreement cannot be fulfilled. This Agreement may be executed in two counterparts, each of which so executed shall be deemed to be an original. 4 22. This document, as well as the provisions of Agreement 2003-1-026 (see Section 3 herein), represents the entire Agreement between the CITY and DOT regarding this project. Any subsequent change or modification to the terms of this Agreement will be in the form of a duly executed amendment to this document. IN WITNESS WHEREOF, each of the parties hereto has executed Predesign Agreement No. 2003-P-127 as of the date shown opposite its signature below.
