An amendment to the FY 2003 Annual Plan is being proposed to increase funding in the Neighborhood Infrastructure Improvement program and decrease funding in the Accessible Curb Ramp to facilitate payment of street overlay improvements DISCUSSION The FY 2003 Annual Plan currently provides for $50, 507 for the Neighborhood Infrastructure Improvement, which includes 1) Street Overlays in Iow/moderate income neighborhoods and 2) the Sidewalk Program, which provides grants to low and moderate income homeowners, on a case-by-case basis, to pay 75% of the cost to repair public sidewalks in front of their homes. During the past years there had been a decline in the number of street overlays and the sidewalk program expended the majodty of funds in this program. The street overlay programs have expended $13, 356 but only $10,076 is available due to payments for sidewalk improvements. In order to facilitate the payment of these costs, we are proposing to move $3,280 from the Accessible Curb Ramp program, which has no further expenditures anticipated for the remaining fiscal year. RECOMMENDATION The Citizen Participation Plan states a substantial amendment is any change in the use of CDBG funds from one eligible activity to another in excess of $25,000 in one program year. Since the funds requested are less than $25,000, the proposed amendment is non-substantial and can be adopted by resolution of the City Council following review and recommendation of the Community Development Advisory Commission. The Community Development Advisory Commission reviewed the request at their May 28th meeting. There were no public comments regarding the request. By a vote of 5-0, the Commission voted to approve the proposed amendment and recommend City Council approval. RECOMMENDATION I recommend that the City Council approve the above-described Amendment 5 to the City's FY 2003 (Program Year 2002) Annual Action Plan for the use of CDBG funds. These changes will move $3,280 from the Accessible Curb Ramp program to the Neighborhood Infrastructure Improvement program. ACTION STEP The Action Step is for the City Council to adopt the attached resolution. Prepared by Aggie Tauke, Community Development Specialist F:,,Usem,~TAU K~CDBG~nualPlan'~aa'nendments~03amend5-mvm.doc RESOLUTION NO. , -2003 RESOLUTION APPROVING AMENDMENT 5 TO THE FISCAL YEAR 2003 (PROGRAM YEAR 2002) ANNUAL ACTION PLAN FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS Whereas, the City of Dubuque prepared and filed an Annual Action Plan for Fiscal Year 2003; and Whereas, the City of Dubuque now desires to amend said Annual Plan as per the attached Exhibit A; and Whereas, said amendment is a non-substantial amendment as provided in the City's Citizen Participation Plan and must therefore be approved by resolution of the City Council after review by the Community Development Advisory Commission; and Whereas, the Community Development Advisory Commission reviewed the proposed amendment on May 28, 2003, and has voted to approve said amendment and to recommend approval by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Amendment 5 to the Fiscal Year 2003 (Program Year 2002) Annual Action Plan for the Community Development Block Grant Program hereto attached as Exhibit A is hereby approved. Section 2. That the City Manager is hereby authorized and directed to submit a copy of this resolution to the U. S. Department of Housing and Urban Development.
