Van Milligen, City Manager SUBJECT: Millwork District Parking Lot 1 (12th and Elm) Acceptance of Public Improvement Construction Contract CIP 3602250 DATE: March 8, 2021 City Engineer Gus Psihoyos is recommending acceptance of the construction contract for the Millwork District Parking Lot 1 Project, as completed by Eastern lowa Excavating & Concrete, LLC, in the final contract amount of $478,984.71 and authorize payment of the contract amount to Eastern lowa Excavating & Concrete, LLC. The final contract amount was $10,154.59 over the award amount of$468,830.12 due to additions/ modifications to the landscape plantings, watering, pavement removal, base stone and asphalt patches. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Millwork District Parking Lot 1 (12th and Elm) Acceptance Public Improvement Construction Contract CIP 3602250 DATE: March 5, 2021 INTRODUCTION The enclosed resolution provides for the acceptance of the construction contract for the Millwork District Parking Lot 1 Project. BACKGROUND In 2010, Gronen Properties, Wilmac Property Co and Warehouse Trust provided a letter to the City requesting public development of 470 off-street parking spaces to assist with attraction of commercial and residential tenants in the newly developed district. The 12tn & Elm St surface parking lot will bring the total number of City-owned parking spaces in the Historic Millwork District to 580 spaces. It should also be noted the Development Agreement with Dupaco Voices, LLC and the City of Dubuque states "City shall develop an additional City surface parking lot at 12tn and Elm Street on the east side of Elm Street, on or before December 31, 2020." DISCUSSION The project consisted of the construction of a 71-stall concrete parking lot. The parking lot construction also includes storm sewer, lighting, surveillance cameras, fiber optics, conduit and landscaping. Also, included in this project is the landscaping and surveillance cameras for the parking lot the City built in 2018 east of the Volv Fitness (formally True Fitness) as part of the City's commitment to parking in the Millwork District. The project was over the awarded amount due to additions/modifications to the landscape plantings, watering, pavement removal, base stone and asphalt patches. RECOMMENDATION I recommend that the City Council accept the improvements and authorize the payment of the contract amount of $478,984.71 to Eastern lowa Excavating & Concrete, LLC for the Millwork District Parking Lot 1 Project. Breitbelder, City Clerk, 50W 13t" Street, Dubuque, IA 52001 (563)589-4100 RESOLUTION NO. 71-21 ACCEPTING THE MILLWORK DISTRICT PARKING LOT #1 PROJECT AND AUTHORIZING THE PAYMENT TO THE CONTRACTOR WHEREAS, the public improvement contract for the Millwork District Parking Lot #1 Project, (the Project) has been completed by the Contractor, Eastern Iowa Excavating & Concrete, LLC, (Contractor), the City Engineer has examined the work and recommends that the Project be accepted; and WHEREAS, the final contract amount for the Project is $478,984.71; WHEREAS, the Contractor has previously been paid $455,035.47, leaving a balance of $23,949.24; and WHEREAS, the City Council finds that the recommendation of the City Engineer should be accepted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Engineer is approved, and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $23,949.24 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
