INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Lower Bee Branch Security Network Project.
BACKGROUND
In June of 2010, the City Council awarded the construction contract for the Lower Bee
Branch Creek Restoration Project in the amount of$10,836,588.85. Because the bid was
more than 25% over the engineer's estimate of probable cost, the construction of ancillary
improvements such as the security camera network for the trail system were delayed.
In November of 2013 the City Council passed Resolution 335-13 adopting the 2013
Drainage Basin Master Plan Amendment. The 2013 Amendment did not replace the 2001
Drainage Basin Master Plan. Instead, it built upon its foundation. The amended Drainage
Basin Master Plan outlined several improvements throughout the Bee Branch watershed
to mitigate the effects of future flooding and disasters. Collectively, the improvements
form the basis of the Bee Branch Watershed Flood Mitigation Project.
In December of 2013, the lowa Flood Mitigation Board voted to approve the City's use of
$98,494,178 in state sales tax increment funding for the Bee Branch Watershed Flood
Mitigation Project.
DISCUSSION
Work on the Lower Bee Branch Security Network Project has been completed. The work
consisted of the installation of approximately 10,000 feet of fiber-optic conduit and micro-
duct with 5,600 feet of fiber-optic cable and 5,300 feet of electric conduit along the Lower
Bee Branch Creek. Two network cabinets were installed and integrated into the City-wide
network. A total of 21 cameras were installed to cover the creek, trail, and adjacent
roadways. It also includes the installation of an irrigation controller, back flow preventer,
and 130 linear feet of 2-inch copper water service to provide a permanent irrigation
system for the landscaping along the creek.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of$255,915.25 to Utility Service Contractors of Hiawatha, lowa for
the Lower Bee Branch Security Network Project. Which is 1.35% lower than the bid
amount of$259,414.00

I respectfully request adoption of the attached resolution accepting the improvements,
establishing the final construction contract in the amount of$255,915.25, and authorizing
the payment of the contract amount to Utility Service Contractors of Hiawatha, lowa for
the Lower Bee Branch Security Network Project.

RESOLUTION NO. 72-21
ACCEPTING THE LOWER BEE BRANCH SECURITY NETWORK PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
WHEREAS, the public improvement contract for the Lower Bee Branch Security
Network Project (the Project) has been completed by the Contractor, Utility Service
Contractors, Inc. (Contractor) the City Engineer has examined the work and recommends
that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $255,915.25;
WHEREAS, the Contractor has previously been paid $243,119.49, leaving a
balance of $12,795.76; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $12,795.76 as provided in Iowa Code chapter 573, and to pay
such retainage only in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.

The undersigned City Engineer of the City of Dubuque, lowa, hereby certifies that
he has inspected the Lower Bee Branch Security Network Project, that the Project has
been performed in compliance with the terms of the Public Improvement Contract, and
that the total cost of the completed work is $294,302.54.
