Connors, Economic Development Director SUBJECT: Resolution for the proposed North Grandview Estates Housing Urban Renewal Area DATE: March 3, 2021 INTRODUCTION This memorandum presents for City Council consideration a Resolution of Necessity that: 1) finds that an Amended and Restated Urban Renewal Plan for the North Grandview Estates Housing Urban Renewal Area is both necessary and appropriate; and 2) sets a public hearing on the proposed plan for April 19, 2021. BACKGROUND The Dubuque City Council approved the North Grandview Estates Urban Renewal Plan on February 1, 2021 by Resolution No. 28-21. The North Grandview Estates Housing Urban Renewal Area (the "Area") is an urban renewal area which allows the City of Dubuque to capture tax increment revenue from improvements made in the Area in order to promote housing and residential development activities. The Area was created primarily for the development of a residential district (North Grandview Estates Subdivision) and infrastructure improvements. The Amended and Restated Urban Renewal Plan for the Area describes the specific use of tax increment funds, reflecting the utilization of tax rebates, the construction of public infrastructure, and other planned expenditures. DISCUSSION The primary goal of the Amended and Restated Urban Renewal Plan is to stimulate, through public involvement and commitment, private investment in new housing and residential development as defined by the lowa Code Section 403.17(12). Due to several plats being recorded during the process of approving the original Plan, the Plan must be amended to include the proper legal description of the Area. The boundaries themselves have not changed — only the legal description of portions of the Area. The attached Resolution directs staff to prepare an Urban Renewal Plan for the North Grandview Estates Housing Urban Renewal Area, setting forth the area to be included and the urban renewal projects that are currently expected to be undertaken in the Area, and for LMI households in the community at large. Additionally, staff is required to hold a consultation process, required by law, with the affected taxing entities concerning the proposed Plan. A City Council public hearing on the Amended and Restated Urban Renewal Plan will be scheduled April 19, 2021. The public notice will be published four to twenty days before the meeting to allow for the appropriate publication requirements. This will allow time for preparation of the Plan and the consultation process with the taxing entities. RECOMMENDATION/ ACTION STEP I recommend the City Council adopt the attached Resolution of Necessity that begins the process of creating the Amended and Restated Urban Renewal Plan for the North Grandview Estates Housing Urban Renewal Area. Breitfelder, City Clerk, 50 W. 13th St., Dubuque, IA 52001, (563) 589-4100 RESOLUTION NO. 81-21 AUTHORIZING AND DIRECTING THE CITY MANAGER TO PREPARE AN AMENDED AND RESTATED URBAN RENEWAL PLAN FOR THE NORTH GRANDVIEW ESTATES HOUSING URBAN RENEWAL AREA AND SETTING THE DATE FOR A PUBLIC HEARING AND CONSULTATION ON THE PROPOSED AMENDED AND RESTATED URBAN RENEWAL PLAN FOR SAID DISTRICT WHEREAS, the City Council of the City of Dubuque, Iowa, after public notice and hearing as prescribed by law and pursuant to Resolution No. 28-21 passed and approved on the 1st day of February, 2021, adopted an Urban Renewal Plan (the "Urban Renewal Plan") for an urban renewal area known as the North Grandview Estates Housing Urban Renewal Area (the "Urban Renewal Project Area"); and WHEREAS, Attachment D to the Urban Renewal Project Area contains an error in the legal description; and WHEREAS, Iowa Code Chapter 403 requires that before urban renewal authority may be exercised, a City Council must adopt a resolution of necessity finding that the area in question is a slum, blighted or economic development area, and that so designating such area is necessary in the interest of the public health, safety or welfare of the residents of the municipality. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the area referred to herein as the North Grandview Estates Housing Urban Renewal Area, as generally described in Exhibit "A" and Exhibit "B" to this Resolution and to be included in the Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal District, is an economic development area as defined by Iowa Code Chapter 403 and is appropriate for an urban renewal project. Section 2. That the development of the North Grandview Estates Housing Urban Renewal Area is necessary and appropriate to facilitate the proper growth and development of the community in accordance with sound planning and local community objectives. Section 3. That the development of this area will provide new opportunities for quality housing and job creation in the community. Section 4. That the City Manager is authorized and directed to prepare an Urban Renewal Plan for the North Grandview Estates Housing Urban Renewal Area, and to begin the consultation process required by law with affected taxing entities. Section 5. That the City Clerk is directed to publish notice of a public hearing on the adoption of an Amended and Restated Urban Renewal Plan for the North Grandview Estates Housing Urban Renewal Area to be held on the 19t" day of April, 2021, at 6:30 p.m. in the form attached hereto. The notice of said hearing shall generally identify the areas covered by the proposed Urban Renewal Plan and the general scope of the urban renewal activities planned for such areas and said notice shall be published in a newspaper having general circulation within the City not less than four days nor more than twenty days before the date of said meeting. A copy of the notice of public hearing shall be sent by ordinary mail to the affected taxing entities. Section 6. That the City Clerk is further directed to send by ordinary mail a copy of the proposed Amended and Restated Urban Renewal Plan, the notice of public hearing, a notice of consultation, and, to the extent the Amended and Restated Urban Renewal Plan includes the use of tax increment revenues for a public building, an analysis of alternative development and funding options for such public buildings, to the Dubuque Community School District Board of Education and Dubuque County Board of Supervisors, as the affected taxing entities. The proposed Plan, if approved, would continue to include public improvements related to housing and residential development within public rights-of-way and project activities that may be undertaken in order to achieve the objectives of the Plan. The North Grandview Estates Housing Urban Renewal Area generally includes an area known as the North Grandview Estates Subdivision. The Area is legally described as follows: Lot 1 of North Grandview Place; and Lot 1 of North Grandview Estates; and Lot A and Lots 1 thru 34, inclusive, of North Grandview Estates No. 2; and Lot 1 of North Grandview Estates No. 3; and Lot 1 of North Grandview Estates No. 4; and Lots 1-2 and 2-2 of North Grandview Estates No. 4; and Lot A of Lot B of Sullivan's 2nd Addition; and All that part of the Right of Way of North Grandview Avenue lying south the of the Southerly right of way line of West 32nd Street and lying north of the easterly extension of the south line of Lot 1 of North Grandview Place; and All that part of the right of way of West 32nd Street lying east of the northerly extension of the west line of Lot 37 of North Grandview Estates No. 2 and lying southwest of the northerly extension of the east line of Lot A of Lot B of Sullivan's 2nd Addition. All in the City of Dubuque, lowa Under the Plan, it is expected that a portion of the available tax increment revenues generated within the Area, equal in amount to at least 38.1% of the expected project costs, are to be used for purposes of providing assistance to low- and moderate-income housing in the community at large.
