The proposed Amended and Restated Urban Renewal Plan would expand the District to include the property to be designated as a new Subarea N and authorize the undertaking of an additional urban renewal project in the District with Giese Manufacturing Company, Inc. consisting of developing, constructing and operating a manufacturing facility. Connors, Economic Development Director SUBJECT: Resolution of Necessity for the Amendment of the Dubuque Industrial Center Economic Development District Urban Renewal Plan, version 2021.2 DATE: March 8, 2021 INTRODUCTION This memorandum presents for City Council consideration a Resolution of Necessity that finds that: 1) an Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center Economic Development District ("District") is both necessary and appropriate; and 2) sets a public hearing on the proposed amendment for April 19, 2021. The proposed Amended and Restated Urban Renewal Plan ("Urban Renewal Plan") for the District would expand the District to include the property to be designated as a new Subarea N and authorize the undertaking of an additional urban renewal project in the District with Giese Manufacturing Company, Inc. consisting of developing, constructing and operating a manufacturing facility. BACKGROUND The original Dubuque Industrial Center Economic Development District was created on May 2, 1988. The District is an urban renewal area which allows the City of Dubuque to capture tax increment revenue from improvements made in the District in order to promote economic development activities. The original area included the Dubuque Industrial Center (known as Subarea A) and has been expanded several times over the years to include Dubuque Industrial Center West, the County Farm, the Bergfeld Farm, the North Siegert Farm, the Rail Site, the South Siegert Farm, the Graf Farm, McFadden Farms, small adjacent parcels, and several County-owned parcels (known as Subareas B, C, D, E, F, G, H, I, J, K, L, and M). Before a municipality can exercise the authority conferred by lowa Code Chapter 403 Urban Renewal, a Resolution of Necessity must be adopted finding that the area being considered for urban renewal district designation is either a slum, blighted or economic development area and that the rehabilitation, conservation, redevelopment, development, or a combination thereof, of the area is necessary in the interest of the public health, safety or welfare of the residents of the city. DISCUSSION This proposed expansion and amendment of the Dubuque Industrial Center Economic Development District would result in the addition of property that is currently undeveloped. The parcel added is expected to accommodate the construction of a new manufacturing facility for Giese Manufacturing Company Inc. City staff have negotiated an agreement with Giese Manufacturing Company Inc., a local company that has outgrown its current facility. The company desires to expand, bringing additional jobs to Dubuque, and has identified a parcel in Dubuque Industrial Center that would accommodate its additional facility. In order to provide appropriate business incentives for this local growth, staff wishes to amend and restate the current Urban Renewal Plan to include the property on which this facility would be constructed and identify the agreement with Giese Manufacturing Company Inc. as an urban renewal project. The facility will be an approximately 30,000 SF building —an investment of approximately$6 million. Giese has committed to creating at least 10 high quality jobs in Dubuque as a result of this project. Staff has recommended removal of this parcel from the District as part of a proposed 2021.1 Amended and Restated Urban Renewal Plan to be considered by City Council on April 19, 2021. The parcel is undeveloped, and therefore not creating any increment. Due to legislation in 1995, the collection of tax increment in urban renewal areas designated for economic development purposes is limited to 20 years. This means the Subarea B of the District in which this parcel had been a part of had its "TIF sunset" in June 2019. If the parcel had remained in Subarea B, the City would have been unable to provide an incentive to Giese. By now designating the parcel as a new Subarea N, the City has up to 20 years to provide TI F incentives for any development, although the anticipated length of the TIF agreement is only 10 years. The attached Resolution directs staff to prepare a Version 2021.2 Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center Economic Development District, describing the Giese project as one of the urban renewal projects that are currently expected to be undertaken in the District and including the new Subarea N described above. Additionally, staff is required to hold a consultation process, required by law, with the affected taxing entities concerning the proposed Plan. 2 A City Council public hearing on the 2021.2 Amended and Restated Urban Renewal Plan will be scheduled for April 19, 2021. The public notice will be published four to twenty days before the meeting to allow for the appropriate publication requirements. This will allow time for preparation of the Plan and the consultation process with the taxing entities. Whereas, the City Council of the City of Dubuque has heretofore approved the Amended and Restated Urban Renewal Plan (the "Plan" or "Urban Renewal Plan") for the Dubuque Industrial Center Economic Development District (the "District") in order to provide redevelopment opportunities which will further the purposes and objectives of the foregoing Urban Renewal Plan; and Whereas, City staff has recommended that the Plan be amended to add additional project details; and Whereas, Iowa Code Chapter 403 requires that before a Plan may be modified, the City Council must follow the notification, consultation, and public hearing process set forth therein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City Manager is authorized and directed to prepare an Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center Economic Development District to include in such Plan any appropriate project activities and details, and to determine an appropriate date for and conduct the consultation process required by law with affected taxing entities concerning the proposed. amendment. Section 2. That the City Council hold a public hearing on the adoption of the proposed Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center Economic Development District on April 19, 2021 at 6:30 p.m. in the form attached hereto. The notice of said hearing shall generally identify the areas covered by the Plan and the general scope of the urban renewal activities planned for such areas, and said notice shall be published in a newspaper having general circulation within the City not less than four days nor more than twenty days before the date of said meeting. A copy of the notice of public hearing shall be sent by ordinary mail to the affected taxing entities. Section 3. That the City Clerk is further directed to send by ordinary mail a copy of said Plan, the notice of public hearing, a notice of consultation, and, to the extent the Plan includes the use of tax increment revenues for a public building, an analysis of alternative development and funding options for such public buildings, to the Dubuque Community School District and the Dubuque County Board of Supervisors, as the affected taxing entities. The proposed Plan, if approved, would amend and restate the Plan to create a new Subarea within the District, Subarea N, by adding property to the District. Subarea N includes undeveloped property that was previously a portion of Subarea B, but that was removed from Subarea B by Version 2021.1 of this Plan and includes additional project activities that may be undertaken in order to achieve the objectives of the Plan, including those relating to the expansion of an existing company. The City Council has found that the proposed areas meet the definition of an economic development area as defined in lowa Code Chapter 403 and should be included therein. At the meeting, the City Council will receive oral and written comments from any resident or property owner of said City to the above action. Written comments regarding the proposed Plan may be submitted to the City Clerk's Office on or before said time of public hearing.
