Public Works Director John Klostermann recommends City Council approval of a cost
share agreement with the City of Asbury for the asphalt overlay of a segment of
roadway on Pennsylvania Avenue from Radford Road to Seippel Road. For this
segment of roadway, the City of Dubuque and the City of Asbury both have pavement
maintenance responsibility.
The cost share agreement is as follows:
1. Dubuque agrees to provide for this project all labor, material, equipment, and
traffic control necessary to place a less than 2-inch asphalt mat using Public
Works department staff, on two sections of Pennsylvania Ave in the City of
Asbury.
2. Asbury agrees to pay the City of Dubuque a lump sum of $48,155 for this project.

INTRODUCTION
The purpose of this memorandum is to request that you endorse the attached agreement with
the City of Asbury.
DISCUSSION
The 2021 Public Works Department Asphalt Overlay program includes a section of Pennsylvania
Avenue from Radford Road to Seippel Road. In this segment of roadway, both the City of
Dubuque and The City of Asbury have pavement maintenance responsibilities. A joint cost
share agreement with the City of Asbury was developed by City Attorney Crenna Brumwell and
was approved by the Asbury City Council at its meeting on March 23� 2021. The cost share
agreement is as follows;
1. Dubuque agrees to provide for this project all labor, material, equipment, and traffic
control necessary to place a less than 2-inch asphalt mat using Public Works department
staff, on two sections of Pennsylvania Ave in the City of Asbury. The two sections are
approximately 1,350' of the west bound lane, from the west property line of 5255
Pennsylvania to Heacock Road. The other section is on the Seippel Road end which
includes the west bound lane from approximately 270' east of the entrance to Sandpiper
Lane to Seippel Road (1,320 ft) and 225' in the east bound lane in front of 7916
Pennsylvania. Lane marking will be completed by a private contractor at a cost to the City
of Dubuque as it currently is.
2. Asbury agrees to pay the City of Dubuque a lump sum of$48,155 for this project.

ASPHALT PAVING AGREEMENT
BETWEEN
THE CITY OF ASBURY, IOWA
AND
THE CITY OF DUBUQUE, IOWA
This Agreement, dated for reference
2021, is made and entered into by and between City of Asbury,
lowa (Asbury) and the City of Dubuque, lowa (Dubuque) to define the duties and
responsibilities of Asbury and Dubuque for the installation of an asphalt
maintenance mat on Pennsylvania Avenue between Radford Road and Seippel
Road.
1. Dubuque agrees to provide for this project all labor, materiai, equipment,
and traffic control necessary to place a less then 2" asphalt mat using

3. Nothing in this Agreement shall be construed to transfer any liability from one
jurisdiction to the other, except as herein specified.
4. This Agreement shall take effect upon approval by both parties and shall
terminate upon completion of this project on or before June 30, 2021.
5. This Agreement may be terminated at any time prior to the start of the project
by either party upon thirty (30) days written notice to the other party.
6. The City of Asbury Public Works Director and the City of Dubuque Public
Works Director shall administer this Agreement. In doing so, the Asbury
Public Works Director shall consult with the Asbury City Administrator and the
Dubuque Public Works Director shall consult with the Dubuque City Manager
on matters related to this Agreement. No real or personal property shall be
acquired by either party under the provisions of this Agreement.
7. Dubuque shall defend, indemnify, and hold harmless Asbury, its officers,
agents and employees, from any and all causes of action, suits at law or in
equity, losses, damages, claims or demands, and from any and all liability

Dubuque's negligent performance of its duties related to said roadway
pursuant to this Agreement.
