I respectfully request that this item be tabled.
If, at public hearing, the Franchise Fee is not adopted, I would recommend that this
funding be denied so the available funds can be used to fund the FY 2004 cuts and fare
increases that had been proposed to solve the current budget shortfall.
Should the Franchise Fee be approved, I would ask that this item stay tabled until after
the Iowa Supreme Court decision on gaming taxes to see if there is any money to fund
these projects.

The City of Dubuque Historic Preservation Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review~
Discussion
Dave Stuart, member of the Downtown Neighborhood Council spoke in favor of the
request. He indicated that the Downtown Neighborhood Council is proposing to install
trasll receptacles, benches, planters and street trees in the public right-of-way and
Jackson Park. Mr. Stuart noted that the trash receptacles will be similar to the ones
located on Main Street. He indicated tliat the C~ty will take over ownership of the trash
receptacles and Operations and Maintenance Department has agreed to maintain and
provide waste removal services. Mr. Stuart indicated that he has received permission
from Leisure Service Manager Gil Spence to replace the benches and waste
recePtaCleS in JaCkSon Park. He discussed the installation of planters and a couple of
street trees in the public right-of-way throughout the Jackson Park Histodc District. Mr.
Stuart stated that the DowntOwn Neighborhood Council re~ved a neigl~borhood grant
to use as the required match for the program.
Assistant Planner Wally Wemimont presented the staff report noting that the trash
receptacles, benches, planters and street trees are consistentwith the City' of Dubuque
Streetscape and Landscape Guidelines. He indicated that the Downtown Neighborhood
Counc~ is requesting $15,905.80 from the HiStOric District Public Improvement Program.
There were no public comments.

The Historic Preservation Commission discussed the request noting that the request
meets the requirements of the Historic District Public Improvement Program.
Recommendation
By a vote of 6 to 0, the Historic Preservation Commission recommends that the City
Council approve funding from the Histodc District Public Improvement program to the
Downtown Neighborhood Council to install planters, benches, trash receptacles and
street trees in the public right-of-way with the conditions that: (1) they receive
Engineering Department approval; (2) the local match to be obtained within six months;
and (3) the Histodc Preservation Commission be given authority to authorize an
additional six months, if needed.
A simply majority vote is needed for the City Council to approve the request.

A. Project Summary. Discuss the project and the key project work elements of the
proposed streetscape improvements.
Project will add litter receptacles on Bluff, Locust and Main Streets and replace receptacles in
Jackson Park. Old wooden benches in Jackson Park will be replaced. Planters and street trees
will be added in the "planting lawn" (the grass area between sidewalk and curb) at selected
locations on Locust and Main Streets.
The Downtown Neighborhood Council has chosen Victor Stanley litter receptacles and benches
for this project. Litter receptacles will be of the "Ironsites Series" (the black strap -type currently
used in the Main Street revitalization project~ in a black color. The design was chosen to be
common to the improvements going on elsewhere in the Historic Districts and Downtown.
Three different sizes/variants of the receptacle will be used:
1) S-42 with S-2 lid: 36-gallon with Steel Dome Lid
2) S-35 with S-1 lid: 24-gallon with Steel Dome Lid
3) PS-35 with S-1 lid: 24-gallon center post mount with Steel Dome Lid
The following locations have been selected for the litter receptacles:
a) PS-35/S-1: Grass strip on 17th Street, SE comer of West Locust and 17t~ Street
b) PS-35/S-1: Grass strip on West Locust, NE comer of Locust and 16t~
c) S42/S-2: Lawn area north of*'15th Street" steps on Bluff Street
d) S-35/S-1: NE comer of Loras Blvd and Bluff Street (near where telephone booth was).
e) PS-35/S-1: Grass strip on Locust Street, NW comer of Locust Street and 12t~.
f) PS-35/S-1 Grass between Library sign and bench, SW comer of Locust Street and 11~.
g) PS-35/S-1: Grass strip on Loras Blvd., NW comer of Loras and Main Street
h) PS-35/S-1: Grass strip on 13th Street, NW comer of 13t~ and Main Streets

The old wooden benches in Jackson Park are long past needing replacement. The Victor Stanley
~'Classic Series CR-196 bench, six feet in length, in black was selected to tie in with the trash
receptacles. The Leisure Services Depa~nent will install the receptacles and benches in Jackson
Park. Those items will be transferred to City ownership (under the cognizance ufthe Leisure
Services Department). Either the city, or Downtown Neighborhood CoUncil members will install
the receptacles outside of Jackson Park. The City will assume ownership and maintenance of
those receptacles.
Planters and trees in the planting lawn area next to the street will beautify and improve the
streetscape in the neighborhood. Funding constraints limit the number of planters that can be
purchased in this first round of improvements. Individual property owners selected planter
designs based on a number of factors including their building style, agricultural features, size,
and the width of the planting lawn. Additional locations are planed for the future. The first
locations were chosen to improve the areas seen by the numerous visitors to our neighborhood,
specifically Locust Street between 1 Ith and 17t~ Streets and Main Street between Loras and 17th
Street. Owner-occupied properties that have been attractively maintained with emphasis on
landscaping received a higher priority, but not all properties that met those characteristics were
chosen due to funding constraints. Volunteer Downtown Neighborhood Council members will
drill, install and level the precast bases and anchor the planters to thc bases to help minimize
vandalism. Property owners will be required to maintain the planters with a common
flower/plant color scheme to help tie the neighborhood together. The Downtown Neighborhood
Council will transfer ownership of the planters to the city, under the cognizance of the Leisure
Services Department Iwhich has control of landscaping on the public-right-of-way). Before the
planters are placed, property owners will be required to sign an agreement with the Downtown
Neighborhood Council promising to maintain the planters and allowing the Downtown
Neighborhood Council to relocate the planters for any reason. The Downtown Neighborhood
Council agrees to relocate planters if the Leisure Services Depathnent determines that a location
is unsuitable for any reason or that the abutting property owner is not maintaining the planter.
B. Neighborhood Impact and support. Describe the current conditions and how the project
will improve the neighborhood and/or project area. Discuss the level of neighborhood and
property owner support.
Currentlv the areas on Bluff, Locust and Main Streets have a problem with litter. (This is
especialiy hue of the area of Bluff Street fi.om 17th to Loras Blvd.) There are few litter
receptacles in the area and lots of litter A number of property owners have complained about
the problem and the lack of receptacles. This is the Downtown Neighborhood Council's number
one priority.
Additionally the litter receptacles in Jackson Park are in poor condition. The wooden benches
are in disgusting shape and the Neighborhood Association wishes to "upgrade" our
nmghborhood park, especially since it is used for a number of gatherings such as our Music in
the Park series, as well as a staging point for parades.
Planters in the planting lawn area next to the street are a much desired enhancement to the
strectscape. That area has in numerous cases been neglected or is too small for effective use. A
number of the property owners have committed to modifications (narrowing sidewalks)
necessary to increase this green area and effectively benefit fi.om the installation of planters in
that area.

The Downtown Neighborhood Council met on 8 June 2003 to consider two Historic
District Public Improvement Program applications. One for litter receptacles, benches
and planters, the other for brick sidewalks. The completed application packages were
remewed in cletail. Members present voiced their unanimous approval of the packages
and thanked the people who assisted in putting the grant application packages together.

Physical Characteristics: The right-of-way located in the Jackson Park Historic District
borders many historic buildings. The buildings located throughout the Jackson Park
Historic Distdct are primarily mixed use residential, commercial and office. The bulk of
the Jackson Park Historic District is primarily residential. The right-of-way and
sidewalks in the Jackson Park Historic Distdct are both narrower than those found in the
nearby commercial area downtown.
Property History: The Downtown Neighborhood Council has been active in keeping their
neighborhood free of litter and started the annual downtown neighborhood clean-up a
number of years ago. As a group, they have suggested that placement of additional
trash receptacles in this densely populated downtown neighborhood would be beneficial
in their efforts at maintaining a clean and inviting neighborhood.
Staff Analysis: The applicants are applying for funding from the Historic District Public
Improvement Program for proposed streetscape improvements in the public right-of-
way. The Downtown Neighborhood Council has proposed the installation of trash
receptacles, planters, trees in the public right-of-way. They are also proposing to install
benches and trash receptacles in Jackson Park.
The role of the Histodc Preservation Commission in reviewing this project is to serve as
an advisory design rewew body to the City Council for review of public works projects
which have historic preservation implications in historic districts. The Commission is

also responsible for providing a recommendation to the City Council about funding
projects from the Historic District Public Improvement Program The Commission's
recommendation will go on to the City Council with the application materials for their
review and approval of the project.
Compliance with Design Guidelines: In 2002, the Streetscape and Landscape
Guidelines were created to help provide recommendations for public improvements in
the public right-of-way. Trash receptacles, planters, benches and trees were taken into
consideration with the Streetscape and Landscape Guidelines.
