Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report, and related materials are attached for your
review.
Discussion
Dave Schneider, Schneider Land Surveying & Planning, represented and spoke on
behalf of the applicants. He spoke in favor of the request, stating that the owners are
seeking to reconfigure five parcels into two parcels so they could deed the proposed Lot
2 to the applicant's daughter and son-in-law to build a house and leave access for
agricultural uses.
Staff detailed the staff report, noting the Regan Farm Subdivision creates two new lots
out of five existing lots. Staff said that Lot 2 is substandard with no street frontage and
will be accessed through an easement on Lot 1. Staff said reconfiguring the lots should
have little effect on surrounding development or residential density and will allow a
single-family residence to be constructed on the property. Staff recommended approval
as submitted subject to waiving the lot frontage requirement for Lot 2.
There were no public comments.
The Zoning Advisory Commission discussed the request and found it appropriate.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving the lot frontage requirement for Lot 2.
A simple majority vote is needed for the City Council to approve the request.

A RESOLUTION APPROVING THE FINAL PLAT
REGAN FARM SUBDIVISION DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat Regan Farm
Subdivision, Dubuque County, Iowa that is within the City's 2-mile extraterritorial
jurisdiction; and
Whereas, said Final Plat has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage for Lot 2
on a public street or an approved private street.
Section 2. That the Final Plat Regan Farm Subdivision, Dubuque County, Iowa
is hereby approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said Final Plat of Survey.

INTRODUCTION
The submitted Final Plat of Regan Farm Subdivision reorganizes five parcels with a
total of approximately 41.5 acres into two lots. Lot 1 is approximately 23 acres and will
have frontage along North Cascade Road. Lot 2 is approximately 18.5 acres in area and
will not have frontage along a platted public or private street as required by Article 5-2.7
of the Unified Development Code. Lot 2 will be accessed from a 30' wide access and
utility easement across Lot 1 from the North Cascade Road frontage.
DISCUSSION
The applicant proposes to reconfigure five lots into two, enabling them to provide property
for a single-family residence. Lot 2, the substandard 18.5-acre lot, will be accessed from
a 30' wide access and utility easement across Lot 1. The entire property is located in the
County within the City's 2-mile Extraterritorial Jurisdiction.
The property is currently used as agricultural ground. Reconfiguring the five lots to two
lots as requested will have little effect on the status of the subject property or surrounding
properties or on residential density and will enable the property owner to construct a
single-family residence. The subdivision in all other respects complies with the City of
Dubuque's subdivision regulations contained in the Unified Development Code with the
exception of required lot frontage for Lot 2.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Regan Farm Subdivision and recommends approval as submitted subject to waiving the
lot frontage requirement for Lot 2.
