Shot Tower photo shootINDEMNIFICATION AGREEMENT
BETWEEN
THE CITY OF DUBUQUE, IOWA
AND
BACK ON THE MISSISSIPPI, LLC
This Agreement is made and entered into thisr /day of
2003, by and between the City of Dubuque, Iowa (City) and Ba
Mississippi, LLC (Mississippi).
WHEREAS, City is the owner of the Shot Tower in the City of Dubuque,
Iowa; and
WHEREAS, Mississippi desires access to the Shot Tower on August 13,
2003, for the purpose of videotaping the interior of the Shot Tower; and
WHEREAS, City agrees to grant access to Mississippi upon the terms and
conditions set forth herein.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES
AS FOLLOWS:
1. City hereby grants access to Mississippi to the Shot Tower August 13,
2003 for the purpose of videotaping the interior of the Shot Tower.
2. Mississippi shall coordinate its access to the Shot Tower with City's
representative, Robert Schiesl, Engineering Department, City Hall, Dubuque,
Iowa, 52001, 563 589-4270.
3. Mississippi agrees to defend, indemnity and hold City, its officers and
employees harmless from and against any claims of any kind arising out of
Mississippi's access to the Shot Tower. City shall provide prompt notice of any
such claims to Mississippi to the attention of J. Charles Strinz, President, 4769
Hauge Circle, Eagan, MN 55122.

Enclosed is a request from Back On The MiSsissippi, LLC to allow access by a film crew
to the Shot Tower on August 13, 2003, for the purpose of a one-hour television
.program.
Back On The Mississippi, LLC has signed the appropriate Indemnification Agreement
and provided a copy of the Certificate of Insurance.
I would recommend apprOval of the request and authorization for the City Manager to
.sign the Indemnification Agreement.

Your Honor and Council Members,
On Wednesday, August 13, 2003, our film crew will be in Dubuque filming segments for
"Back On The ~fississ/pp/- Hidden Trails, Of/beat Tales," a one-hour television program that
explores how people, places and events along the Mississippi River helped shape
contemporary America. The program is slated to air on public television stations across the
Upper Midwest in the summer of 2004.
One of the program's segments deals with the Dubuque Shot Tower and I am writing to
request permission to access the interior of the Tower for filming purposes. We intend to
photograph the Tower from the ground, and at no time will we climb in, on or around the
Tower.
In addition to the enclosed and signed Indemnification Agreement between the City of
Dubuque, Iowa, and Back On The Mississippi, LLC, I am including a Certificate of Insurance,
showing the City of Dubuque, Iowa, as Also Insured, as proof of our $t ,000,000.00 general
liability insurance coverage for the project.
