CITY OF DUBUQUE, IOWA
CITY COUNCIL PROCEEDINGS
SPECIAL SESSION
The Dubuque City Council met in special session at 6:30 p.m. on March 24, 2021.
Due to the COVID-19 pandemic and mandates for social distancing, this meeting was
conducted virtually via GoToMeeting and aired live on CityChannel Dubuque (Mediacom
cable channels 8 and 117.2), streamed live on the City's website at
www.cityofdubuque.org/media, and streamed live on the City's Facebook page at
www.facebook.com/cityofdubuque.
Present: Mayor Buol; Council Members Cavanagh, Farber, Jones, Resnick, Roussell,
Sprank; City Manager Van Milligen, City Attorney Brumwell.
Mayor Buol read the call and stated this is a special session of the City Council called
for the purposes of adopting the City of Dubuque Annual Budget for Fiscal Year 2022 and
conducting such business that may properly come before the City Council.
CONSENT ITEMS
Council Member Cavanagh requested Consent Item #2: Landlord Incentives for
Accepting Housing Assistance be held for separate discussion. Motion by Resnick to
receive and file Consent Item #1: 2020 Dubuque Crime Statistics Handout. Seconded by
Roussell. Motion carried 7-0.
1. 2020 Dubuque Crime Statistics Handout: City Manager transmitted the 2020
Dubuque Crime Statistics Handout. Upon motion the documents were received and filed.
2. Landlord Incentives for Accepting Housing Assistance: City Manager transmitted
information regarding the release of new programs to incentivize landlords to accept
housing assistance. Housing and Community Development Director Alexis Steger
provided a summary of the programs. Ms. Steger responded to questions from the City
Council regarding the programs' start date and the verification process for appliance
replacements. City Manager Van Milligen stated that City Council will receive an update
on these programs before their August goal setting per City Council's request. Motion by
Cavanagh to receive and file the documents. Seconded by Jones. Motion carried 7-0.
PUBLIC HEARINGS
1. Adopting the Fiscal Year 2022 Budget Recommendation as Amended: Proof of
publication on notice of public hearing to consider approval of the City of Dubuque
Fiscal Year 2022 Annual Budget and Five-Year Capital Improvement Program as
amended, and City Manager recommended approval. Motion by Jones to receive and
file the documents and adopt Resolution No. 87-21 Adopting the City of Dubuque Fiscal
Year 2022 Annual Budget and Resolution No. 88-21 Adopting the City of Dubuque Five

Year Capital Improvement Program. Seconded by Roussell. City Manager Van Milligen
made a presentation. Highlights included: Amended FY22 Recommended Tax Rates;
American Rescue Plan; American Rescue Plan (ARP) Impact; ARP Fund Priorities;
Amended FY22 Recommended Property Tax Rate Comparison; City Portion of Property
Tax Rate Comparison; Amended FY22 Recommended Taxable Value Per Capita;
Taxes Per Capita Comparison; City Utilities; and Storm Water Rate Comparison. City
Manager Van Milligen responded to questions from the City Council regarding how
American Rescue Plan funds will be utilized, pending State legislation that may impact
City revenue sources, the City staff and community partners who are communicating
with State legislatures about pending legislation, and the funding strategy for currently
frozen positions. City Council members individually expressed their support for the
budget recommendation. Staff stated that no online public input had been received for
this item. Motion carried 7-0.
ACTION ITEMS
1. Code of Ordinance Amendments - Title 13 Public Utilities - Fixing Water Rates:
Residential, Commercial, Industrial and other uses; Fire Sprinkler Service. Motion by
Jones to receive and file the documents and that the requirement that a proposed
ordinance be considered and voted on for passage at two Council meetings prior to the
meeting at which it is to be passed be suspended. Seconded by Resnick. Motion carried
7-0.
Motion by Resnick for final consideration and passage of Ordinance No. 6-21
Establishing City of Dubuque Code of Ordinances Title 13 Public Utilities, Chapter 1
Water Use and Service, Article C Rates, Section 13-1 C-1(A) Fixing Water Rates for
Residential, Commercial, Industrial, and all other uses and Ordinance No. 7-21
Establishing the City of Dubuque Code of Ordinances Title 13 Public Utilities Chapter 1
Water Use and Service, Article C Rates Section 13-1 C-2 Fixing Water Rates for Fire
Sprinkler Service. Seconded by Jones. Motion carried 7-0.
2. Code of Ordinance Amendment-Title 13 Public Utilities - Establishing Sewer Rates.
Motion by Cavanagh to receive and file the documents and that the requirement that a
proposed ordinance be considered and voted on for passage at two Council meetings
prior to the meeting at which it is to be passed be suspended. Seconded by Roussell.
Motion carried 7-0.
Motion by Cavanagh for final consideration and passage of Ordinance No. 8-21 City of
Dubuque Code of Ordinances Title 13 Public Utilities, Chapter 2 Sewers and Sewage
Disposal, Article C Rates, Section 13-2C-3 Rates Established for Fiscal Year 2022.
Seconded by Roussell. Motion carried 7-0.
3. Code of Ordinance Amendments - Title 13 Public Utilities - Solid Waste. Motion by
Jones to receive and file the documents and that the requirement that a proposed
ordinance be considered and voted on for passage at two Council meetings prior to the
meeting at which it is to be passed be suspended. Seconded by Resnick. Motion carried
7-0.

Motion by Jones for final consideration and passage of Ordinance No. 9-21
Amending City of Dubuque Code of Ordinances Title 13 Public Utilities, Chapter 6 Solid
Waste, Sections 13-6-1 Definitions; 13-6-3 Container Requirements; Collection
Restrictions; 13-6-6 Storage and Accumulation Restricted; 13-6-7 Hazardous and
Prohibited Wastes Regulated; and Title 13 Public Utilities, Chapter 6 Solid Waste,
Article A City or Private Collection Service, Sections 13-6A-2 Availability Of Collection
Services; 13-6A-3 Frequency, Time And Areas Of Collection; 13-6A-4 Placement Of
Containers For Collection; 13-6A-6 Rates And Charges Established; Exceptions; 13-6A-
8 Yard Waste And Food Scraps; 13-6A-9 Private Collection Service. Seconded by
Resnick. Motion carried 7-0.
4. Code of Ordinance Amendment - Title 13 Public Utilities - Stormwater Management
Utility Fee Rate Change. Motion by Jones to receive and file the documents and that the
requirement that a proposed ordinance be considered and voted on for passage at two
Council meetings prior to the meeting at which it is to be passed be suspended. Seconded
by Sprank. Motion carried 7-0.
Motion by Jones for final consideration and passage of Ordinance No. 10-21 Amending
City of Dubuque Code of Ordinances Section 13-4-5 (D) SFU Rate, Charges; Utility
Revenues. Seconded by Sprank. Motion carried 7-0.
5. Five-Year Street Construction Program for Fiscal Years 2022 — 2026. Motion by
Resnick to receive and file the documents and adopt Resolution No. 89-21 Adopting the
Five-Year Street Construction Program for Fiscal Years 2022 — 2026. Seconded by
Farber. Motion carried 7-0.
There being no further business, Mayor Buol declared the meeting adjourned at 7:45
p.m.
