(2007 Code § 8 -11) 2 -8 -2: MISSION: The mission of the commission is to build the community of Dubuque through arts and cultural programs by developing visibility, funding, audiences, information and partnerships. (2007 Code § 8 -12) 2 -8 -3: GOALS: The goals of the commission shall be as follows: A. To promote, educate and create awareness for arts and cultural activities in the Dubuque community; B. To develop and increase the market for arts and cultural activities in the Dubuque community; C. To facilitate and convene partnerships for arts and cultural activities in the Dubuque community; and D. To develop funding options and allocate budgeted funding for arts and cultural activities in the Dubuque community. (2007 Code § 8 -13) 2 -8 -4: PURPOSE: The purpose of the arts and cultural affairs advisory commission shall be to plan, promote and encourage programs to further public awareness of, accessibility to, participation in and support for the artistic and cultural development of the city and to make recommendations to the city council regarding the establishment of arts and cultural policies and programs, the expenditure of budgeted city funds on arts and cultural activities and the implementation of programs for arts and culture. (2007 Code § 8 -14) 2 -8 -5: POWERS: The commission shall have the following powers: A. To act in an advisory capacity to the city council in all matters pertaining to the arts and cultural environment of the city; B. To hold regular public meetings and maintain a written record of its proceedings; C. To make recommendations to the city council on the allocation of budgeted city funding for arts programs and services; D. To recommend to the city council applications and solicitations for grants, gifts and donations from individuals, groups, organizations and agencies, both private and public, for any purpose consistent with the purposes of the commission; E. To make recommendations to the city council regarding city sponsorship of public programs to further the development of public awareness of and accessibility to arts and culture programs and activities; F. At the request of the city council, to work with area organizations on broad community issues in which a cultural perspective is relevant and desirable; and G. To engage in comprehensive planning for the cultural development of the city. (2007 Code § 8 -15) 2 -8 -6: COOPERATION WITH OTHER AGENCIES: The commission shall cooperate with the Dubuque Cultural Alliance and other groups interested in the promotion and implementation of arts and cultural activities which are in the best interest of the city. (2007 Code § 8 -16) 2 -8 -7: SOLICITATION AND ACCEPTANCE OF DONATIONS: The commission may solicit and otherwise accept donations and gifts of money, personal and real property and personal services on behalf of the city. All such donations and gifts received shall become the property of the city for the general use or support of arts and cultural programs of the city as determined by the city council unless such items have been designated by the donor for specific purposes. (2007 Code § 8- 17) 2 -8 -8: MEMBERSHIP; APPOINTMENT: A. Membership; Terms: The commission shall comprise seven (7) members. The initial term of four (4) of the members shall be for three (3) years and the initial term of three (3) of the members shall be two (2) years. Thereafter, all terms shall be three (3) years. The expiration date for all terms of office shall be June 30 of the appropriate year. B. Qualifications: Four (4) members of the commission shall have significant knowledge and demonstrated interest in one or more areas of the arts including music, dance, literature, visual arts, theater, folk arts, media arts, design, arts education or be a member of the Dubuque Cultural Alliance. Two (2) members shall be from the business and professional community, one of whom lives or works in the cultural and entertainment district. One member shall be at large who lives or works outside the cultural and entertainment district. C. Vacancies: Vacancies caused by death, resignation or otherwise shall be promptly filled by the city council for the unexpired term of office. (2007 Code § 8 -18) 2 -8 -9: ATTENDANCE: A. Attendance Requirement: Members of the commission shall attend at least two - thirds ( of all regularly scheduled and held meetings within any consecutive twelve (12) month period. If any member fails to attend such prescribed number of meetings, it shall be grounds for the commission to recommend to the city council that the position be declared vacant and a replacement appointed. B. Attendance Entered On Minutes: The attendance of all commission members shall be entered upon the minutes of all meetings by the secretary. (2007 Code § 8 -19) 2 -8 -10: COMPENSATION: Members of the commission shall serve without compensation except for reimbursement of necessary expenses. (2007 Code § 8 -20) 2 -8 -11: ORGANIZATION: At the initial meeting of the commission and at the first meeting in July of each year, the commission shall elect a chairperson, a vice chairperson and a secretary to serve one year terms of office. All officers shall be eligible to serve successive terms of office. (2007 Code § 8 -21) 2 -8 -12: MEETINGS: A. Regular Meetings: The commission shall hold a minimum of six (6) meetings a year. Meetings shall be held on the fourth Tuesday of each month at four thirty o'clock (4:30) P.M. B. Special Meetings: Special meetings may be called by the chairperson or at the written request of three (3) members. C. Open Meetings: All meetings shall be called and held in conformance with the Iowa open meetings law. D. Minutes Filed With City Council: A copy of the minutes of all regular and special meetings of the commission shall be filed with the city council within ten (10) working days after each such meeting. E. Quorum: Four (4) members of the commission shall constitute a quorum for the transaction of business. The affirmative vote of at least four (4) members shall be necessary for the adoption of any resolution. (2007 Code § 8 -22) 2 -8 -13: RULES AND REGULATIONS: The commission shall adopt such rules and regulations to govern its internal organization and procedure as it may deem necessary and which are not in conflict with this chapter or this code. Copies of such rules and regulations upon their adoption shall immediately be provided to the city council. (2007 Code § 8 -23) 2 -8 -14: ADMINISTRATIVE AND OTHER CITY POLICIES: All administrative, personnel, accounting, budgetary and procurement policies of the city shall govern the commission in all of its operations. (2007 Code § 13 -11) 2 -4 -2: PURPOSES, OBJECTIVES GENERALLY: A. The commission is charged with development of the optimum utilization of the civic center facility by the widest possible range of users and uses to respond to community needs and demands at the least possible cost to the city. B. It is intended that the commission shall have that authority and responsibility essential to assure that its general purpose is fulfilled subject to this chapter and subject to the approval of the city council in matters of policy. (2007 Code § 13 -12) 2 -4 -3: SPECIFIC PURPOSES: The specific purposes of the civic center advisory commission shall be to: A. Provide the city council as necessary with recommendations that further the general and specific purposes of the commission. B. Develop effective leadership for efficient planning, control and administration of policies and programs to realize optimum use of the civic center. C. Foster the development of financial and other resources to support the short and long term needs of the civic center facility and its programs. D. Develop programs to provide a variety of year round intellectual, cultural, enjoyable and attractive leisure time activities which contribute to the physical and mental well being of residents and visitors. E. Develop programs which contribute to the economic base of the community by encouraging business use of the civic center facility. (2007 Code § 13 -13) 2 -4 -4: DUTIES AND RESPONSIBILITIES: The duties and responsibilities of the commission are as follows: A. Development of an administrative plan and operating policies to assure the maximum effectiveness in the use of all facilities and resources. B. Development of schedules of fees and charges for special building services, equipment, special building features, rental rates, admissions, and concessions. C. Development of informational and promotional programs to secure the full support and participation of the community. D. Development of accurate, timely and understandable financial data and measurements of effectiveness necessary to assure sound policy formulation for operation and management. E. Development of the annual operating budget and an ongoing capital improvements budget. F. Development of a maintenance program to provide a safe, secure, sanitary, clean and attractive facility. G. Serve as a personnel advisory committee to the city manager in the selection of civic center personnel. H. Participate with the Dubuque area chamber of commerce, the hotel and restaurant industry and other interest groups to promote and develop the convention and tourism business for the Dubuque area. I. Execution of contracts and agreements for the use, operation and maintenance of the civic center facility; contracts and agreements for the use of the facility may be signed by the city manager, except that all contracts for usage of the facility involving a term of longer than five (5) days shall be signed by the mayor with the approval of the city council. (2007 Code § 13 -14) 2 -4 -5: PROGRAMS, PROJECTS AND SERVICES: All programs, projects and services to be developed by the commission must conform to the policies of the city and to applicable local, state and federal laws, rules and regulations. (2007 Code § 13 -15) 2 -4 -6: MEMBERSHIP; APPOINTMENT: A. Membership; Terms: The commission shall be comprised of a membership of five (5) persons, who shall be appointed by the city council for terms of three (3) years. B. Serve Until Successor Appointed: Upon completion of the term of office, a member of the commission shall continue to serve in the member's full capacity until a successor has been duly appointed. (2007 Code § 13 -17) 2 -4 -7: VACANCIES IN MEMBERSHIP: A vacancy caused by death, resignation or otherwise on the commission shall be promptly filled by the city council for the unexpired term of office. (2007 Code § 13 -18) 2 -4 -8: ATTENDANCE AT MEETINGS: A. Frequency of Attendance: Members of the commission shall attend at least two - thirds ( of all regularly scheduled and held meetings within any twelve (12) month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the commission to recommend to the city council that said member be replaced. B. Record of Attendance: The attendance of all commission members shall be entered upon the minutes of all meetings by the secretary. (2007 Code § 13 -19) 2 -4 -9: COMPENSATION: All members of the commission shall serve without compensation except for reimbursement of necessary expenses. (2007 Code § 13 -20) 2 -4 -10: ORGANIZATION; ELECTION OF OFFICERS: A. Officers Designated: The officers of the commission shall be a chairperson, a vice chairperson, and a secretary. All officers shall be members of the commission. B. Election by Commission: At the initial meeting of the commission and at the first meeting of each calendar year thereafter, the commission shall elect the above identified officers to serve one year terms of office. All officers shall be eligible to serve successive terms of office. (2007 Code § 13 -21) 2 -4 -11: DUTIES OF OFFICERS: A. Chairperson: The chairperson shall preside at all meetings of the commission and shall perform all duties incident to the office of chairperson. B. Vice Chairperson: The vice chairperson shall perform the duties of the chairperson in the absence or incapacity of the chairperson. In the event of such absence or incapacity, the vice chairperson shall perform such duties as are imposed upon the chairperson until such time as the commission designates a new chairperson. C. Temporary Chairperson: In the event of the absence of the chairperson or vice chairperson at any meeting of the commission, the then present members of the commission shall select a temporary chairperson for that meeting. D. Secretary: The secretary shall record votes, keep a record of all proceedings of the commission and perform such other duties incident to the office of secretary. E. Absence of Secretary: In the event of the absence of the secretary at any meeting of the commission, the chairperson shall appoint one of the then present commission members to serve as secretary pro tem for that meeting. (2007 Code § 13 -22) 2 -4 -12: MEETINGS: A. Monthly Meetings: The commission shall meet not less than monthly. B. The commission shall issue subpoenas for witnesses in the same manner and for the same purpose on behalf of the respondent upon the respondent's request. Miller Attachment to Library Board of Trustees Application September 22, 2008 Reasons for applying: I began using the library around age 7 and I consider it almost a sacred resource. At present, I use the library often, and am involved with several programs there. I have friends and acquaintances among the library staff and management, and regularly talk to them to keep in touch with what's happening with projects, programs, trends, policies and practices, etc. New, I'm at the stage in life where I wish to take the "tons" of broad work and life experiences I've been blessed with and "pass it on and give something back' to the people and the community where I was born and raised. My goals are to promote usage, to educate and encourage all our citizens — people who can learn, grow with, and enjoy this major public resource —to take full advantage of the library. I have great respect for the current Board of Trustees, who have done a good job in leading the growth and facing the challenges that we've seen over recent years, and I feel we can do even better going forward with the kind of progressive spirit and talented leadership that we're currently blessed with (not only on the library Board, but moreover in City government and City Council leadership as well). I have met with Diane Gunns and David Hammer to discuss these ideas and my goals, and I'm eager to pitch in (first as a "junior" member) to add value and to represent the people's trust, interests, and sustainability now and in the future. A couple of items that I failed to place on my application are: My wife and I are avid campers and use the parks in the area (city, county and elsewhere). We see ideas that other parks use and look for ways to improve our parks. In 2009 I organized a communication tool for our subdivision (Harvest View Coommunication Alert), 124 families. One hundred eighteen familes are able to alert the entire subdivision by use of personal computers in the event an unusaual event took (takes) place. All families have been instructed to contact the police dept in the event of an illegal act. I worked with Scott Baxter, Info officer for the police dept. Scott helped kick off our program at the Dubque Retirement Community. Each month we test our communication tool so people will remember the tool exists. The sixteen families without PCs are alerted by neighbors via telephone or word of mouth and those 16 families contact one another by use of the pyramid alert. (2007 Code § 44 -231) 11 -3C -2: COMMISSION ESTABLISHED; PURPOSES AND DUTIES: A. Established: The city council hereby establishes a commission to be known as the cable regulatory commission, and which shall exist throughout the term of the cable franchise. B. Purposes And Duties: The commission shall have the following purposes and duties: 1. To keep abreast of developments in cable technologies, services and programming. 2. To become competent in cable regulation, finances and standards of operation. 3. To act through the cable franchise administrator as the local regulatory agent of the cable franchise. 4. Appointments; Qualifications: The commission shall consist of five (5) members appointed by the city council. The council shall appoint only residents of the city and shall attempt to give preference to applicants who possess professional or experiential backgrounds in law, finances, administration, public relations, or telecommunication technologies. What contributions can you make or state reason for applying ?: Over the past 2 years, I have come to a realization of my personal beliefs regarding the rezoning of property and approval of potential subdivisions. These can be summarized in four points. 1. I strongly believe that property should not be rezoned against the will of the property owner. 2. I believe that issues such as stormwater runnoff management and potential crime are topics for City departments to resolve and ensure compliance. These are not reasons to allow or not allow a property owner to develop a parcel of property. 3. Short term solutions to land use problems have long term impacts. The long term impacts must be taken into consideration when making decisions. This is especially true when blending zoning classifications to create more diverse neighborhoods. 4. Finally, I strongly believe that requirements for developing property need to be clearly communicated to the developer up front. We need to be fair and consistent on our decisions, regardless of economics and political influences. Changing the requirements as a project evolves does not create an environment that encourages private development, which is very much needed in today's economy. This is especially true when you consider the lack of affordable market rate housing in Dubuque.
