City Engineer Gus Psihoyos recommends City Council recission of Resolution Nos.
187-21, 188-21, 189-21 and 190-21, resulting in the cancellation of the current public
bidding process for the John F. Kennedy Road Sidewalk Installation Project, and
approving City staff to apply for a $190,000 Transportation Alternatives Program (TAP)
grant through the Dubuque Metropolitan Area Transportation Study (DMATS).
Staff have identified TAP funding source and would like to pursue applying for the grant.
Being this is a federal funded grant the process to apply and obtain approval will take an
extended amount of time. Therefore, the Engineering Department requests to delay the
project to rework the plans, specifications, any assessments and apply for the federally
funded grant.
As a result of going through the federal aid process, engineering costs and construction
costs are expected to increase. This increase in construction costs is due to federal
auditing requirements, required paperwork and Davis -Bacon wages. The higher
engineering costs are due to the increased workload to provide federal aid plans,
administer the project and the auditing process afterwards.
Due to the grant being a federal program, the project plans and specifications will need
to be brought to Iowa DOT standards, go through the bidding process in Ames and
follow the states project development schedule. This means the current bidding
process must be stopped.
Upon approval by the Council of an application for the federal funds an updated
resolution of necessity would come back before the Council in the near future with an
updated scope of work taking into consideration the federal funding source. If a protest
is submitted in accordance with the Iowa Code, then the vote for passage of a
resolution of necessity may require unanimity.
If a resolution of necessity was approved, the project plans and specifications would
come before the Council in the spring for approval, bidding, and construction. The
approval process for this is a simple majority vote.
Housing and Community Development Director Alexis Steger advises that the
Community Development Advisory Commission has approved a financial assistance
program for any impacted property owners at 80% of median income or below
(approximately $56,000 for a family of three).
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed resolutions provide for City Council recission of Resolutions Nos. 187-21,
188-21, 189-21 and 190-21 resulting in the cancellation of the current public bidding
process for the John F. Kennedy Road Sidewalk Installation Project and approving City
staff to apply for a federal grant to assist in project costs.
BACKGROUND
The public bidding process for John F. Kennedy Road Sidewalk Installation Project was
approved and initiated at the June 7, 2021, City Council meeting. The Public Hearing is
currently scheduled for Tuesday, July 6, 2021, during the regular meeting of the City
Council. The bid letting is currently scheduled for July 15, 2021.
DISCUSSION
The Engineering Department is recommending the cancellation of the public bidding
process for John F. Kennedy Road Sidewalk Installation Project through the rescission of
Resolution Nos. 187-21 which gave preliminary approval of the proposed plans,
specifications, form of contract, estimated cost, 188-21 for approving preliminary plats and
schedule of assessments, 189-21 for approving the resolution of necessity and 190-21 for
approving fixing the date of the public hearing.
Staff have identified a funding source and would like to pursue applying for the grant. Being
this is a federal funded grant the process to apply and obtain approval will take an extended
amount of time. Therefore, the Engineering Department requests to delay the project to
rework the plans, specifications, any assessments and apply for the federally funded grant.
GRANT
City staff have discussed funding assistance availability for the sidewalk and retaining walls
on this project. One of the possibilities brought up by the public is Safe Routes to School
funding. Dedicated Safe Routes to School funding was eliminated with the passage of
MAP-21 in 2012. Funds normally used for Safe Routes for School were added to the
Transportation Alternatives Program (TAP). The Dubuque Metropolitan Area
Transportation Study (DMATS) facilitated by East Central intergovernmental Agency
(ECIA) and the Iowa Department of Transportation (IDOT) administer the TAP program.
Historically the City has used TAP funds for trails in the City. This is a federal grant.
There is currently $190,000 in TAP funds that could be used toward this sidewalk project if
awarded. It is proposed this grant would cover the retaining wall costs and the remainder
would assist in reducing the other costs of the project, including assessments.
As a result of going through the federal aid process, engineering costs and construction

Based on this schedule and allowing engineering staff time to develop plans in the
appropriate format, the earliest letting date for the project would be February of 2022. The
public hearing will need to be re -scheduled to accommodate this new development
schedule.

RECOMMENDATION
I recommend that the City Council approve the attached resolution to rescind Resolution
Nos. 187-21, 188-21, 189-21 and 190-21 which would cancel the public bidding process
for John F. Kennedy Road Sidewalk Installation Project through the adoption of the
enclosed resolution.
I also recommend approval to apply for a $190,000 TAP grant through DIVIATS to use
towards this project which will help offset costs on the future project.
Upon approval by the Council of an application for the federal funds an updated resolution
of necessity would come back before the Council in the near future with an updated
scope of work taking into consideration the federal funding source. If a protest is
submitted in accordance with the Iowa Code, then the vote for passage of a resolution of
necessity may require unanimity.
If a resolution of necessity was approved, the project plans and specifications would come
before the Council in the spring for approval, bidding, and construction. The approval
process for this is a simple majority vote.
REQUESTED ACTION
The City Council is requested to give approval to the attached resolutions for applying for
a TAP grant and rescinding the current public bidding process for the John F. Kennedy
Road Sidewalk Installation Project.

Community Development Advisory Commission Approves Financial
Assistance Program for JFK Sidewalk Assessments for Low -Mod Income
Homeowners
Dubuque City Council set a public hearing on July 6, 2021 for a sidewalk installation
project along John F. Kennedy Road. This sidewalk will benefit the community,
specifically children walking to the elementary school located on this busy road. This
school serves a significant population of low -moderate income students who live within
walking distance.
Community Development Block Grant (CDBG) funds have been allocated and utilized in
previous program years to provide assistance for repairing or replacing sidewalks in
low -mod income areas, which provide a benefit to everyone in the community.
Discussion
On Wednesday, June 16, 2021, the Community Development Advisory Commission
(CDAC) discussed and approved funding a program that would provide financial
assistance to low -moderate income homeowners who would be cost -burdened by the
assessments levied on their properties by the installation of the proposed sidewalk
project on JFK.
Because the census tract in the proposed project area is not designated low -moderate
income area, only homeowners who apply and meet eligibility criteria will be able to
receive assistance.
Total assistance available for this program is estimated at approximately $150,000.00.

RESCINDING RESOLUTION NOS. 187-21,188-21,189-21,190-21
WHEREAS, on 7th day of June 2021, the City Council of the City of Dubuque, Iowa
adopted Resolution No. 187-21 for approving the Preliminary Plans and Specifications,
Resolution 188-21 for approving the Preliminary Plats and Schedule of Assessments,
Resolution 189-21 for approving the Resolution of Necessity and Resolution 190-21 for
approving Fixing the Date for the Public Hearing all for the John F. Kennedy Sidewalk
Installation Project; and
WHEREAS, City staff became aware of a federal Transportation Alternative
Program (TAP) that can assist with funding for the John F. Kennedy Sidewalk Installation
Project; and
WHEREAS, the current project development process must stop and follow the
federal aid process to utilize the funding.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF DUBUQUE,
IOWA:
Section 1. Resolution Nos. 187-21, 188-21, 189-21, 190-21 are hereby
rescinded.

RESOLUTION NO. 220-21
RESOLUTION AUTHORIZING THE CITY'S GRANT APPLICATION TO THE
TRANSPORTATION ALTERNATIVES PROGRAM FOR THE JOHN F. KENNEDY
SIDEWALKS INSTALLATION PROJECT AND ASSURANCE THAT THE
IMPROVEMENTS WILL BE MAINTAINED FOLLOWING COMPLETION OF THE
PROJECT
Whereas, the Iowa Department of Transportation (IDOT) has grant funds available
in the Transportation Alternatives (TAP) Program to fund alternative transportation; and
Whereas, the John F. Kennedy Road corridor is part of the Dubuque Metropolitan
Area Transportation Study (DMATS) 2045 Long Range Transportation Plan; and
Whereas, the City of Dubuque has allocated city funds to match the requested
TAP grant funds for construction of the John F. Kennedy Road Sidewalks Installation
Project; and
Whereas, the IDOT requires the City of Dubuque's official endorsement of the
project and the City's stated commitment to maintain the improvements for the intended
public use for a minimum of twenty (20) years following project completion.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The Mayor is authorized to sign and submit an application for TAP
Program Funds to the [DOT for the John F. Kennedy Road Sidewalk Installation Project.
Section 2. That the City Council hereby provides its written assurance that the John
F. Kennedy Road Sidewalk Installation Project will be adequately maintained for its
intended public use for a minimum of twenty (20) years following completion of the project.
