Chief of Police Mark Dalsing requests City Council approval to apply for the 2021 JAG
Justice Assistant Grant Application. The two-year grant amount is $20,322 and requires
no cash match.
The grant application requests overtime funding for special projects targeting negative
trends as determined by monthly supervisor review, with the remaining funding being
requested for safety items for tactical and specialty teams, enforcement equipment and
training aids.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to request approval to apply for 2021 JAG Justice
Assistance Grant Application.
DISCUSSION
For the past several years, the police department has participated with the Edward
Byrne Memorial Justice Assistance Grant allowing the department to obtain overtime
funds, equipment, and supplies for various prevention and enforcement activities not
covered through the regular budget. Again this year, the 2021 Edward Byrne Memorial
Justice Assistance Grant (JAG) Program provides federal criminal justice funding to
state and local jurisdictions. JAG funds support all components of the criminal justice
system, from multijurisdictional drug and gang task forces to crime prevention and
domestic violence programs, courts, corrections, treatment, and justice information
sharing initiatives.
The purpose of the Edward Byrne Memorial Justice Assistance Grant is to assist local
units of government with grant funds for local initiatives, technical assistance, training,
personnel, equipment, supplies, contractual support, and information systems for
criminal justice for any one or more of the following purpose areas:
• Law Enforcement Programs
• Prosecution and Court Programs
• Prevention and Education Programs
• Corrections and Community Corrections Programs
• Drug Treatment and Enforcement Programs
• Planning, Evaluation, and Technology Improvement Programs
• Crime Victim and Witness Programs (other than compensation)
Agency allocations are based on a JAG formula and involved agencies have been
notified of their potential allocations. The Dubuque Police Department is eligible for
$20,322. Agencies are then requested to outline their intentions for the funds. Agencies
must submit application materials outlining their intentions for the funds and will then be
notified of the results.
The grant application requests overtime funding for special projects targeting negative

GRANT OBJECTIVE
The purpose of this memorandum is to request City Council consideration for the
approval of the 2021 Justice Assistance Grant (JAG) application. The two-year grant
amount is $20,322 and requires no cash match. The Dubuque Police Department is the
fiscal agent for JAG grant funds, with joint allocation funds awarded to the disparate
jurisdiction which includes both the City of Dubuque and Dubuque County. The
Dubuque County Sheriff's Office, though eligible for funding by its inclusion in a
disparate jurisdiction, was not allocated any direct grant funds this year. The two
departments will collaborate and mutually agree to support municipal law enforcement
operations and any county related projects. In past years, Dubuque County has agreed
to support municipal law enforcement operations with 100% of the funds directed to the
City of Dubuque Police Department projects.
There is a future opportunity to reapply for these funds, at this time.

Edward Byrne Justice Assistance Grant Program FY 2021 Local Solicitation
Certifications and Assurances by the Chief Executive of the Applicant Government
On behalf of the applicant unit of local government named below, in support of that locality's application for an award
under the FY 2021 Edward Byrne Justice Assistance Grant ("JAG") Program, and further to 34 U.S.C. § 10153(a), I
certify to the Office of Justice Programs ("OJP"), U.S. Department of Justice (°USDOJ" ), that all of the following are
true and correct:
1. 1 am the chief executive of the applicant unit of local government named below, and I have the authority to make
the following representations on my own behalf as chief executive and on behalf of the applicant unit of local
government. I understand that these representations wf11 be relied upon as material in any OJP decision to make
an award, under the application described above, to the applicant unit of local government.
2. 1 certify that no federal funds made available by the award (if any) that OJP makes based on the application
described above will be used to supplant local funds, but will be used to increase the amounts of such funds
that would, in the absence of federal funds, be made available for law enforcement activities.
3. 1 assure that the application described above (and any amendment to that application) was submitted for review
to the governing body of the unit of local government (e.g., city council or county commission), or to an
organization designated by that governing body, not less than 30 days before the date of this certification.
4, 1 assure that, before the date of this certification-- (a) the application described above (and any amendment to
that application) was made public; and (b) an opportunity to comment on that application (or amendment) was
provided to citizens and to neighborhood or community -based organizations, to the extent applicable law or
established procedure made such an opportunity available.
5. 1 assure that, for each fiscal year of the award (if any) that OJP makes based on the application described
above, the applicant unit of local government will maintain and report such data, records, and information
(programmatic and financial), as OJP may reasonably require.
6. 1 have carefully reviewed 34 U.S.C. § 10153(a)(5), and, with respect to the programs to be funded by the
award (if any), I hereby make the certification required by section 10153(a)(5), as to each of the items specified
therein.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF DUBUQUE, IOWA, AND COUNTY OF DUBUQUE
2021 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD
This Agreement is made and entered into this 8th day of July, 2021, by and between The
COUNTY of DUBUQUE, acting by and through its governing body, the Board of Supervisors,
hereinafter referred to as COUNTY, and the CITY of DUBUQUE, acting by and through its
governing body, the City Council, hereinafter referred to as CITY, both of Dubuque County,
State of Iowa, witnesseth:
WHEREAS, the CITY is part of a disparate jurisdiction which includes the COUNTY: and
WHEREAS, the CITY is the fiscal agent for 2021 JAG grant funds, with joint allocation funds
awarded to the disparate jurisdiction which includes both the CITY and the COUNTY: and
WHEREAS, each governing body finds that the performance of this Agreement is in the best
interests of both parties, that the undertaking will benefit the public, and that the division of costs
fairly compensates the performing party for the services or functions under this agreement: and
WHEREAS, the CITY agrees to provide the COUNTY $ 0 from the 2021 JAG award for the
Dubuque 2021 Law Enforcement, Prevention, Investigative and Tactical Response Project: and
WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate the JAG
funds of $20,322 as per the 2021 Iowa Local JAG Allocations in support of the Municipal
program.
NOW THEREFORE, the COUNTY and CITY agree as follows:
Section1.
CITY agrees to pay COUNTY a total of $ 0 of JAG funds.
Section 2.
CITY agrees to use $20,322 for the Dubuque 2021 Law Enforcement, Prevention, Investigative
and Tactical Response Project.
Section 3.
By entering into this Agreement, the parties do not intend to create any obligations express or
implied other than those set out herein; further, this Agreement shall not create any rights in any
party not a signatory hereto.
