On July 6, 2021, the Dubuque County Board of Supervisors approved and signed the agreement Amendment No. 2 to partner on the Southwest Arterial Project and agreed to contribute additional funding for the Project. The City Council is requested to review and approve Amendment No. 2 for said agreement. DISCUSSION The original 2013 28E Funding Agreement outlined the 20% local match funding obligation on behalf of the City and County which would allow for 100% obligation expenditure of the Federal appropriated funding for the Southwest Arterial Project. Exhibit A, pages 1 thru 4, provides a summary of the Right -of -Way Property Acquisition for the Southwest Arterial project, listing the parcels acquired, total expenditures and reimbursements, the vested federal funding interest, and the local match funding contributed on behalf of the City and County for each of the parcels acquired. 2. Exhibit A, pages 1 thru 4, shows the parcels that were fully or partially acquired with American Recovery and Reinvestment Act (ARRA) funds, which were 100% funds and required no local match funding. The remainder of the parcels were acquired using Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) funds, which were 80% funds and required a 20% local match, 10% from the City, and 10% from the County. 2 3. When properties are acquired for the Southwest Arterial, said parcels are acquired in fee title in the name of the City of Dubuque. Following the conveyance of highway corridor right-of-way to the State of Iowa, any remnant excess property shall remain in title of the City. The City agrees to keep the County informed of the development of the parcels. 4. If any excess property is sold or leased is acquired using federal title 23 funds, said disposal of property is required to follow Federal Title 23 U.S.C., Chapter 1, Sec. 156. Any revenue generated by said sale may either be used on an eligible federal aid transportation project (road, bridge, trail) or shall reimburse the Federal Highway Administration (FHWA) for the federal vested interest share of the revenue generated from said sale. 5. If any excess property is sold or leased which Dubuque County contributed local match funding, Dubuque County shall either be reimbursed for said vested interest or said vested funds shall be used on an eligible federal aid transportation project (road, bridge, trail). Exhibit A, pages 1 thru 4, shows the parcels that were fully or partially acquired with American Recovery and Reinvestment Act (ARRA) funds, which were 100% funds and required no local match funding. The remainder of the parcels were acquired using Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) funds, which were 80% funds and required a 20% local match, 10% from the City, and 10% from the County. 6 3. When properties are acquired for the Southwest Arterial, said parcels are acquired in fee title in the name of the City of Dubuque. Following the conveyance of highway corridor right-of-way to the State of Iowa, any remnant excess property shall remain in title of the City. The City agrees to keep the County informed of the development of the parcels. 4. If any excess property is sold or leased is acquired using federal title 23 funds, said disposal of property is required to follow Federal Title 23 U.S.C., Chapter 1, Sec. 156. Any revenue generated by said sale may either be used on an eligible federal aid transportation project (road, bridge, trail) or shall reimburse the Federal Highway Administration (FHWA) for the federal vested interest share of the revenue generated from said sale. 5. If any excess property is sold or leased which Dubuque County contributed local match funding, Dubuque County shall either be reimbursed for said vested interest or said vested funds shall be used on an eligible federal aid transportation project (road, bridge, trail).
