Resolution Wage Plan Non-bargaiRESOLUTION NO. 254-03 RESCINDING RESOLUTION NO. 212-03 AND RESOLUTION NO. 234-03 RELATING TO THE WAGE PLAN AND COMPENSATION PACKAGE FOR NON-BARGAINING UNIT EMPLOYEES FOR FISCAL YEAR 2004 AND REINSTATING THE WAGE PLAN AND COMPENSATION PACKAGE FOR FISCAL YEAR 2004 Whereas, on March 6, 2001, the City Council by Resolution No. 92-01 approved a Wage Plan And Compensation Package for non-bargaining unit employees for Fiscal Year 2004 to take effect July 1, 2003; and Whereas, on June 23, 2003, the City Council by Resolution No. 2t2-03 delayed the implementation of the Wage Plan And Compensation Package until July 10, 2003; and Whereas, on July 9, 2003, the City Council by Resolution No. 234-03 rescinded Resolution No. 92-01 which had approved the Wage Plan And Compensation Package; and Whereas, it has been recommended by the City Manager that the Wage Plan And Compensation Package be reinstated. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Resolution No. 212-03 and Resolution No. 234-03 are hereby rescinded and the Wage Plan And Compensation Package for non-bargaining unit employees for Fiscal Year 2004 to take effect July 1, 2003, as approved by Resolution No. 92-01, is hereby reinstated. Van Milligen City Manager Randy Peck Personnel Manager Amendment to the Agreement Between the Dubuque Professional Firefighter's Association, Local #353 and the City of Dubuque, Iowa I have attached an Amendment to the Agreement amending Article 16, Overtime and Callback to provide for compensatory time off in lieu of Fair Labor Standards Act overtime and amending Article 18, Group Insurance to discontinue payment by the City of the single premium for dental insurance. I recommend that the Amendment be approved. The requested action is for the City Council to approve a motion authorizing you to sign the Amendment. RP:bf AMENDMENT TO THE AGREEMENT BETWEEN THE DUBUQUE PROFESSIONAL FIREFIGHTER'S ASSOCATION, LOCAL #353 AND THE CITY OF DUBUQUE, IOWA Article 16, Overtime and Callback, Section 6 When an employee is present for duty for all of his/her assigned shifts within the twenty-seven day work period, as defined by the Fair Labor Standards Act, he/she shall earn twelve (12) hours of compensatory time. The compensatory time shall be accumulated throughout the calendar year and after vacations are selected for the upcoming calendar year, employees will take compensatory time off in twenty-four hour periods for the remaining vacation days available on their respective shifts. Selection of compensatory time off shall be made in the same manner as vacation selection. Upon termination, retirement, or separation from employment for any other reason, unused compensatory time shall be paid al one-half the regular rate of pay. Carryover of compensatory time from calendar year to calendar year shal be limited to twenty-four (24) hours of compensatory time. The use of compensatory time in lieu of payment of overtime shall be mandatory and the definition of compensable hours of work shall be the definition contained in the Fair Labor Standards Act, which means that an employee must ~)e present for duty for over 204 hours in the twenty-seven day work period to be eligible for compensatory time.
