Minutes City Council 7 28 03CITY OF DUBUQUE, IOWA COUNCIL PROCEEDINGS OFFICIAL City Council, Special Session, July 28, 2003 Council met in Special Session at 6:00 P.M. in the Library Auditorium Present: Mayor Duggan, Council Members Buol, Cline, Connors, Markham, Michalski, Nicholson, City Manager Michael Van Milligen, Corporation Counsel Lindahl Mayor Duggan read the call and stated this is a special session of the City Council called for the purpose of conducting a public hearing to consider adoption of a Utility Franchise Fee. Upon motion the rules were suspended to allow anyone present to speak. Utility Franchise Fee: Proof of publication on notice of hearing to consider the adoption of a Utility Franchise Fee and City Manager recommending approval, upon motion received and filed. Communications from citizens regarding the proposed franchise fee, upon motion received and filed. Joe Ertl, of Dyersville, spoke and objected to the proposed franchise fee tax stating tax revenue is being lost to other cities in the county. Randy Roy of the Police Protective Association spoke in support of the franchise fee. Upon motion the rules were reinstated limiting discussion to the Council. Ordinance No. 58-03 Establishing a franchise fee of 2% of the gross revenue of Interstate Power Company, its successors and assigns, generated from the sale of electricity within the City of Dubuque, and authorizing exemptions or rebates for certain properties, presented and read. Michalski moved that the requirement that a proposed Ordinance be considered and voted on for passage at two Council Meetings prior to the meeting at which it is to be finally passed be suspended and further moved final consideration and passage of the Ordinance. Seconded by Cline. Motion carried 7-0. Ordinance No. 59-03 Establishing a franchise fee of two percent (2%) and the gross revenue of People’s Natural Gas Company, its successors and assigns, generated from the sale of natural gas or mixed gas within the City of Dubuque, and authorizing exemptions or rebates for certain properties, presented and read. Michalski moved that the requirement that a proposed Ordinance be considered and voted on for passage at two Council Meetings prior to the meeting at which it is to be finally passed be suspended and further moved final consideration and passage of the Ordinance. Seconded by Cline. Motion carried 6-0 with Markham abstaining. Michalski moved adoption of Resolution No. 254-03 Rescinding Resolution No. 212-03 and Resolution No. 234-03 as they relate to the wage plan and compensation package for non-bargaining unit employees for Fiscal Year 2004 and reinstating the wage plan and compensation package for Fiscal Year 2004. Seconded by Cline. Motion carried 7-0. Michalski moved to approve the amendment to the Collective Bargaining Agreement between the Dubuque Professional Firefighters Association, Local #353, and the City of Dubuque. Seconded by Cline.
