to educate citizens of the availability of
Federal, State and locally funded hous-
ing assistance programs;
(10) To assist in the preparation of the hous-
.ing element, of the _City Comprehensive
Plan and the annual Consolidated Plan;
(11) To offer comment, as appropriate, on the
consistency of proposed housing develop-
ment with the Comprehensive Plan,
Consolidated Plan and existing City
housing strategies.
(b)Any proposed low-rent housing project
shall be subject to specific approval by the City
Council and any project reqn/xing a referendum
ns provided in chapter 403A of the 1979 Code of
Iowa shall he submitted to the voters of the
City in accordance with such chapter.
(c)The Housing Commission shall monitor
the City's housing program and conduct hear-
ings on grievances which arise out of the opera-
tion of such program except in the area of hous-
ing code enforcement.

(c) Vacancy caused by death, resignation or
otherwise on the Commission shall be promptly
filled by the City Council for the unexpired
term of office.

experience in real estate development, banking,
finance, accounting, funds management or other
related areas of exper~se. ,
(e) One member of the Commission shall be a
person who is a recipient of tenant-based
assistance under section 8 of the United States
Housing Act of 1937 (42 USC 1437/) whose
name appears on a lease of section 8 property
and who is eighteen (18) years of age or older. If
such member ceases to be a recipient of rental
assistance under section 8, the term of s,~o~
.member shall he deemed tor~ted mud a new
member who meets the requlr~m-~+e of this
subsection (e) shah be appointed for the re-
· ~mainder of the term. (Ord. 53-92, § 2,

§§ 1, 2, 3-20-2000)
(d) The Housing Commission shall undertake
such additional duhies, with regard to the Hous*
ing Trust Fund, as are specified in Chapter 26,
Article IH of this Code. (1976 Cede, § 11t/~-77;
Ord. 53-92, § 1, 7-20-1992; Ord. 47-96, § 1,
10-7-1996)
Sec. 15-23. Membership; Vacancies; Quali-
fications:
(a) ~13~e Housing Commission shall be com-
prised of a membership of ten (10) persons.
(b) Current commissioners whose terms ex-
pire August 17, 1993, shall continue to serve
until such time, or until a successor is duly
appointed. Three (3) commissioners shall be
appointed for an initial term of two (2) years,
and three (3) commissioners shall tm appointed
for an initial term of three (3) years. Ail subse-
quent uppointments .shall be for a term of three
(3) years, or until a successor is duly appointed.
Sec. 1/$-24. Meetings:
(a) The Housing Commission shall hold at
least one official meeting per month.
(b) Members of the Commission shah attend
at least two-thirds (=/s) of all regularly sched-
uled and held meetings within a twelve (12)
month period. If any member does net attend
such a prescribed number of meetings, it shall
constitute grounds for the Commission to rec-
ommend to the City Council that said member
be replaced. The attendance of aH members
shall be entered upon the minutes of all meet-
ings.
(c) All meetings shall be held in conformance
with the provisions of the Iowa Open Meetings
Law.
(d) The Housing Commission shall file with
the City Council a copy of the minutes of each
regular and special meeting of the Commission

Sec. 44-218. Membership; Terms; Officers:

The Cable Fr~mchise Administrator and any-

agent of the franchise bolder shall be ineHg/ble
to serve as a member of the Commission. The
membership may include a maximum of two (2)
government officers and employees.
Members of the Commission who represent
subcommuuitiee uti]islng dedicated cb~nels
shall not be deemed to have a conflict of inter-
est in the use of the equipment and facilities
provided for that purpose solely because of their
membership on the Commission.
(b) The term of each member shall be for
three (3) years, with three (3) such terms expir-
ing each June, except those of the initial ap-
pointees onl~, three (3l appointments shall have
one year terms and three (3) appointments shall
have two (2) year terms. If a vacancy occurs
before the expiration of a term, the appoint-
ment shall bo for the unexpired portion of that
term. If tho Council fails to make an appoint-
ment upon tho expiration of a term, the incum-
bent shall continue te serve until an appoint-

among themselves a presiding officer and a
secretary whose offices shall expire the next
June. The City's Cable Franchise Administrator

The Commission shall comprise nine members, four (4) members shall be residents of
census tracts and block groups where at least 51% of the residents are Iow/moderate

Notice to and an opportunity for the
general public to comment, in writing, on
the qualifications of each applicant; and
(3) A formal interview by the City Council to

Sec. 15-49. Duties And Responsibilities;
General:
The Commission shall have the following
duties and responsibilities:

To conduct public hearings in accordance
with the minimum standards established
in the CDBG program's citizen participa-
tion plan to ensure meaningful citizen
input in the planning, implementation
and assessment of the City's CDBG pro-

pation of low and moderate income per-
sons who reside in designated areas of
slum and blight and residents of low and
moderate income neighborhoods, as de-
fined by the City Council, in the plan-
ning, implementation and assessment of
the CDBG program;
(3)
To identify community development
needs, particularly the needs of persons
of low and moderate income;
(4)
To serve in an advisory role upon the
request of the City Council in policy
decisions regarding funding priorities
and program development and implemen-
tation;
(5)
To monitor and evaluate program activi-
ties to advise whether identified commu-
nity development objectives have been
met;
(6) To undertake public information efforts
to educate the citizenry of the availablli-
ty of CDBG funded programs and to
provide for a greater understanding of
the City's community development ef-
forts; and
To assist in .the ~reparati0n of the state-
ment of community development objee-
tires and projected use of funds, amend-
ments thereto and required reports in-
cluding, but not limited to, the annual
grantee performance report (GPR) and
the annual comprehensive housing assis-
tenco strategy (CHAS);

To serve in an advisory role to the City
Manager in the review of complaints and
grievances received in accordance with
the procedures established herein in
Section 15-52;
(9)
To support, upon request, the efforts of
the City Council and other City commis-
sions in the assessment of the general
development needs of the community.

(d) The Housing Commission shall undertake

Sec. 15-23. Membership; Vacancies;
fications:
(a) q3~e Housing Commission shall be com-
prised of a membership of ten (10) persons.
(b) Current commissioners whose terms ex-
pire August 17, 1993, shall continue to serve
until such time, or until a successor is duly
appointed. Three (3) commissioners shall be
appointed for an initial term of two (2) years,
sad throe (3) commissioners shall be appointed
for an initial term of three (3) years. All subee-
quent appointments shall be for a term of three
(3) years, or until a successor is duly appointed.
Sec. '18-24.' Meetings:
(a) The Housing Commission shall hold at
least one official meeting per month.
(b) Members of the Cem~isslon shall attend
at ]east two-thirds (=/a) of all regularly sched-
uled and held meetings within a twelve (12)
month period. If any member does not attend
such a prescribed number of meetings, it shall
constitute grounds for the Commission to rec-
ommend to the City Council that said member
be replaced. The attendance of all members
shall be entered upon the minutes of all meet-
ings.
(c) All meetings shall be held in conformance
with the provisions of the Iowa Open Meetings
Law.
(d) The Housing Commission shall file with
the City Council a copy of the minutes of each
regular and special meeting of the Commission

issue a license to the applicant upon the pay-
ment of five dollars ($5.00). Such license shall
be in effect for the remainder of the calendar
year. A license for every calendar year thereaf-
ter shall be issued upon the payment of five
.dollars !$5.00) unless t~.~.Hcens~, for the preced-
~ng year is in Suspension or has been revoked.
(b) The license shah be worn upon the cloth-
ing of the driver. (1976 Code, § 38-43)
Sec. 46-44. Failure To Comply With City,
State And Federal Laws:
Every driver licensed under this Article shall
comply with all City, State and Federal laws.
Fa/lure to do so will justify the City Manager
suspending or revoking a license. (1976 Code,
§ 38-44)
Sec. 46-45. Suspension And Revocation Of
License:
The City Manager is hereby given the author-
ity to suspend any driver's license issued under
this Article for a driver falling or refusing to
comply with the provisions of this Article, such
suspension to last for a period of not more than
thirty (30) days. The City Manager is a/so given
authority to revoke any dr/vet's license for
failure to comply with the provisions of this
Article. Prior to the suspension or revocation,
the driver shall be given written notice of the
proposed action to be taken and shall have an
opportualty to be heard by the City Coundl,
which shall affirm or reverse the suspension or

DMSION 2. TRANSIT AUTHORITY'
Sec. 46.66. Establiahe&
The City does hereby create and establish a
Transit Authority in and for the City, effective
July t, 1975. (1976 Code, § 38-66) .
Sec. 46-67. Qual/6cations Of Trustees:
The trustees of the Transit Authority shall
qualify by taking their respective oaths of of-

Terms:
(a) The Board of Trnstees of the Transit Au-
thority shall organize for its transaction of
business, elect from its own number a ch.i~per-
son and a secretary who shall serve for such
terms as the Board shall detemine, not exceed-
lng their terms of office as members of the
Board, and abide by all rules and re~ulatioas
that govern the proceedings of the Board.
(b) The Board of Trustees of the Transit Au-
thority shall comprise five (6) trustees appoint-
ed by the City Council. Three (3) of the initial
appointments shall be for terms expir/ng July
30, 1984; one of the in/rial appointments shall
be for a term expiring July 30, 1983; and one of
the initial appointments shall be for 'a term
expiring July 30, 1982. Thereafter, all appoint-
mente shall befor a term of three (8) years or
until a successor has been appointed and qual/-
