This is a claim in which claimant alleges that as a City of Dubuque Park Division
employee was cleaning the sidewalk with a sweeper near the United Way Services, Inc.
building located at 215 W. 6th Street, he hit and broke the window of that facility.
According to the report of Gi.I Spence, Leisure Services Manager, he investigated the
claim filed by Ron Spillane of United Way, and a window at the United Way Center was
broken while a park division employee was sweeping the walk in front of it.
It is therefore the recommendation of Gil Spence to approve this claim. The amount to be
reimbursed to United Way is $1,886.85. The Legal Department concurs with this
recommendation.

I have investigated the claim filed by Ron Spillane of United Way and a park division
employee did break this window on May 19, 2003 while sweeping the walk.
The estimate of $1,290 from Zephyr Aluminum to replace the window seems
reasonable and I recommend the claim be paid.

Dear Ron:
I am in receipt of the Zephyr Aluminum invoices that your office fa. xed to me on June 4th
and June 9~ for the amounts of $519.45 and $1,367.40, respectivel~Y~h 1 asked City of
Dubuque Building Services Manager Rich Russell to review the June 4 invoice, and it is
his opinion that 6 ~ hours to board up a broken window seems excessive.
I am wondering if, after the incident occurred, you had another estimate for this work. Or;
can you verify that it did indeed take 6 ½ hours for Zephyr to board up this window?.
Please give. me a cell at your convenience so that we can proceed with your claim.

Tracey,
In reviewing the day the window was boarded up with the staff at United VVay, to the best of everyone's memory
there were 2 employees from Zephyr that work somewhere around 3 to 3 ~ houm that day. They used several
pieces of plywood and cleaned up the mess from the broken glass, etc. As Ron stated, this is the largest window
{unfortunately!) in the building. I hope this helps. Any other questions please feel free to call me Or Ron Spillane.
