Minutes_Housing Code Appeals BoardMINUTES OF HOUSING CODE APPEALS BOARD DATE: 20 April 2010 TIME: 4:30 p.m. PLACE: Housing and Community Development Department Chairperson Robert Schaub called the meeting to order at 4:30 p.m. following staff assurance of compliance with Iowa Open Meeting Law. Board Members Present: Staff Present: Public Present: Correspondence /Public Input There was no correspondence or public input. New Business This is a GH Inspection. Tim O'Brien Lynn Lampe Mae Dement Dave Stuart Roger Richard Review and Certification of Minutes of 15 December 2009 Housing Code Appeals Board Meeting Paul Newman motioned to approve the minutes. Bill Kinsella seconded. Motion passed 5 -0. Consent Agenda The consent agenda items are considered to be routine and non - controversial and all consent items will be normally voted upon in a single motion without any separate discussion on a particular item. The following property owners have requested an extension of time to complete repairs. The Housing and Community Development staff concurs with the extension of time requested and respectfully requests Housing Appeals Board approval. James Leslein - 2095 Central Avenue - extension to 5/15/10 Vickie Pyevich - owner of 2070 Pasadena Drive - extension to 6/10 Robert Schaub Tami Ernster Atty. Stuart Hoover ALL DEFICIENCIES AND MOTIONS ARE IN ACCORDANCE WITH THE DUBUQUE HOUSING CODE UNLESS OTHERWISE STATED. EXTENSIONS OF TIME ARE GRANTED IN ACCORDANCE WITH TITLE 6 SECTION 6 -9F(1) AND VARIANCES ARE GRANTED IN ACCORDANCE WITH TITLE 6 SECTION 6- 9F(2). Bill Kinsella motioned to approve the consent agenda. Paul Newman seconded. Motion passed 5 -0. CASE #1 Lynn Lampe, owner of 346 -348 W 5th Street, is requesting an extension on repairs until the building is sold or donated to charity. The owner is trying to solicit interest from a couple of non - profit charities to donate this property to, or to sell the building to someone else. He was before the board last fall requesting an extension, so the most time the board could offer would be until August 10, 2010. Paul Newman motioned to grant the appeal. Bill Kinsella seconded. Motion passed 5 -0. CASE #2 Mae Dement, owner of 686 University Avenue, is requesting an extension of time until March 2011 to make repairs on her property. This is a GH Inspection. David Young motioned to allow 30 days to patch the roof and 6 months to complete repairs on the property. Paul Newman seconded. Motion passed 5 -0. CASE #3 Mary Richards, owner of 1472 Locust Street is requesting the Order of the Housing Officer be reversed because 1) structure is currently in compliance with Sec 6- 6- 10(g), 2) building complies with Sec 6- 6- 9(f)(2)e and Sec 6 -6 -3, 3) order specifies inappropriateTreatment per Sec 6 -6 -10, 4) order requires repair to structure not covered under housing regulations, 5) inspection of property not per Sec 6 -6 -7, and 6) per Sec 6 -6 -1( C) and Sec 6 -6 -3 continued use without changes is authorized. This is a GH Inspection. This case will be postponed to the next agenda. Attorney Hoover and Robert Boge will get together to work out what possible options Mrs. Richards might have. Bill Kinsella motioned to postpone this case for two months or until the next meeting. Paul Newman seconded. Motion passed 5 -0. CASE #4 Roger Richard, owner of 1513 and 1598 Washington Street, is asking for continuance on his extension. This is a GH Inspection. This case is in the court system and the board cannot make any decisions at this time. David Young moved to table Mr. Richard's request. Paul Newman seconded. Motion passed 5 -0. Old Business There is no old business. Information Sharing The election for board chair will be held at the next meeting. ADJOURNMENT David Young moved to adjourn. Paul Newman seconded.
