Install Improvements, and 11-24 Improvement Guarantees. The submitted Final Plat is
in all other respects in compliance with the Unified Development Code.
As required by the Unified Development Code, a signed pre -annexation agreement for
the subject property has been submitted.

This memorandum transmits the Final Plat of Country View Estates, a resolution, and
related materials for City Council review and approval. The submitted Final Plat of
Country View Estates is a new subdivision located east of Hales Mill Rd., north of Derby
Grange Rd. including parcels 1007200003, 1007200006, 1007300005, 1007400001,
1007400002 and 1007400010 in Dubuque County. The City and County of Dubuque
are jointly reviewing this Final Plat, as it is within two miles of the city's corporate limits.
The City Council approved the preliminary plat for this subdivision on July 19, 2021.
DISCUSSION
The submitted Final Plat of Country View Estates is comprised of approximately 84-
acres and creates ten lots. Lots 1 thru 8 will be for single-family residential
development, Lot 9 will be used for agriculture purposes and Lot 10 is proposed to be
subdivided in the future. The private streets will be built with a County standard 22-foot
paving width. The 22-foot paving width reduces the amount of impermeable surface and
provides adequate travel lane width to serve the 11 building lots proposed.
The proposed Hales Mill Road access complies with SUDAS standards for sight
visibility. The applicant's engineer has provided the necessary documentation to the
City Engineering Department which has confirmed that the new access will meet
SUDAS standards.
The subject subdivision complies with the Unified Development Codes 40 points of
sustainability through a mixture of development tools.
1. Preservation of 21 % of the site as conservancy, including preserving existing
vegetation = 10 points
2. Proposed roadway with 22 feet of pavement reducing storm water runoff = 5
points
3. Compliance with Dubuque County stormwater management ordinance = 10
points
4. Solar orientation for 8 of the 11 proposed lots - 30 points

Planning staff is willing to provide the 10 points for compliance with the County
Ordinance on storm water management in that the Code requires that the first 1.25
inches of rain be infiltrated on the site. This requirement is more stringent than current
City requirements.
The submitted Final Plat does provide sufficient easements to provide for the future
extensions of utilities to the individual building lots. This ensures that the City will not
need to acquire individual easements from future property owners at such time as City
utilities are extended to serve the subdivision.
As required by the Unified Development Code, a signed pre -annexation agreement for
the subject property has been submitted.
RECOMMENDATION
Staff recommends approval of the resolution for the Final Plat of Country View Estates
subject to allowing 22-foot paving width for Hales Mill Road, and waiving Sections 11-20
Water Supply, 11- 21 Sanitary Sewer, 11-23 Obligation to Install Improvements, and 11-
24 Improvement Guarantees. The submitted Final Plat is in all other respects in
compliance with the Unified Development Code.

RESOLUTION NO. 280-21
RESOLUTION APPROVING THE FINAL PLAT OF COUNTRY VIEW ESTATES IN
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Country View
Estates, and
Whereas, said Final Plat provides for a 22-foot pavement width, where 26-foot
paving width for a private street is required by Section 11-15 of Title 16 of the City of
Dubuque Code of Ordinances, Unified Development Code; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and has its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-15 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow two 22-foot wide paved
private streets.
Section 2. That the City Council hereby waives Sections 11-20 Water Supply,
11-21, Sanitary Sewer, 11-23 Obligation to Install Improvements, and 11-24
Improvement Guarantees.
Section 3. That the Final Plat of Country View Estates is hereby approved and
the Mayor and City Clerk are hereby authorized and directed to endorse the approval of
the City of Dubuque, Iowa, upon said final plat, provided the owners of said property
herein named, execute their written acceptance hereto attached agreeing:

a) To construct private street improvements in accordance with improvement
plans approved by Dubuque County and certified upon completion by a
professional engineer licensed by the State of Iowa.
b) To maintain the private street improvements constructed as part of
Country View Estates until such time as a homeowners' association is
formed and is responsible for maintenance of the same.
Section 4. That in the event that Ronald W. and Jessalynn J. Breiner fail to
execute the acceptance within 180 days after the date of this Resolution, the provisions
hereof shall be null and void and the approval of the plat shall not be effective.

approximately 84-acres. The grade slopes from the high point at the west and northwest
corner of the lot along Hales Mill Road to the low point along Derby Grange Road at the

Traffic Patterns: The subject property will be accessed from Hales Mill Road and
vehicular traffic to and from the subdivision will proceed north, south or west along
Hales Mill and Derby Grange Roads. Staff estimates that when fully developed, the
8 residences will generate approximately 80 vehicle trips per day. This represents
a modest increase in vehicular traffic relative to the overall traffic along the adjacent
roadways.
Public Services: Existing public services other than water and sewer are adequate
to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided code compliant septic systems are installed and storm water management
and erosion control measures are provided during all phases of development as
per County standards.
Adjacent Properties: Development of the subdivision will increase traffic, ambient
light levels, noise and activity in this area. However, this is a large -lot subdivision
located in a sparsely developed area and the impacts to adjacent properties should
be minimal.
Staff Analysis: The applicant's request is plat ten lots out of approximately 84-acres.
Lots 1 thru 8 will be for single-family residential development, Lot 9 will be used for
agriculture purposes and Lot 10 is proposed to be subdivided in the future. The property
is currently under cultivation with some wooded hillside to the east. The residential lots
will have a communal well systems, individual septic systems and private streets. As
the property is located in the county within 2 miles of the city limits, joint review with
both County and City Zoning is required.
The subject property has relatively steep topography with approximately 140 feet of
grade change from the high point at the northwest corner of the lot along Hales Mill
Road to the low point along Derby Grange Road at the southeast corner of the lot.
Approximately 3/4 acres on the eastern side of the property lies in a C-1 Conservancy
district and consists of steep wooded hillside. The subject property will be accessed
from Hales Mill Road and vehicular traffic will proceed north, south or west along Hales
Mill and Derby Grange Roads. Seven residential lots will generate little vehicular traffic
relative to the overall traffic along the adjacent roadways. The final plat indicates a
single 66' wide access easement from Hales Mill Road on to the platted Keegan Court.
Keegan Court is a 22' wide paved street and provides frontage to lots 8 and 9.
The subdivision provides a public utility easement on both sides of the interior street as
required by City land subdivision standards. Each lot will exceed the City's minimum lot
area and frontage standards. The subdivision will also leave approximately 18 acres of
wooded hillside undeveloped preserving natural features and vegetation. Eight of the
10 lots are oriented in such a manner as to be ideal for utilization of solar power. The
property will be developed under Dubuque County storm water and erosion control
standards.

Planning Services staff has reviewed the proposed final plat for Country View Estates
for compliance with the City's sustainability requirements. The following are the
proposed sustainable subdivision development tools.
Proposed Sustainable Development Tools:
1) Preservation of 21 % of the site as existing vegetation. — 10 points
2) Proposed roadway with 22 feet of pavement reducing storm water runoff — 5
points
3) Compliance with Dubuque County stormwater management ordinance. — 10 — points
4) Solar orientation for 8 of the 11 proposed lots. — 30 points
Total — 55 points.
Planning staff recommends that the submitted Final Plat of Country View Estates be
approved as it is in substantial compliance with City of Dubuque Subdivision
Regulations and the Fringe Area Development Policy.
