INTRODUCTION
The purpose of this memorandum is to award the Orchard Drive, Cider Ridge and
Jonathan Lane Water Main Replacement Project 2021 to Temperley Excavating in the
amount of $432,316.50.
BACKGROUND
Since 2004, the area in and around Orchard Drive, Cider Ridge and Jonathan Lane has
been subject to thirteen water main breaks across a 1,250 feet portion of water main,
with four (4) of those events occurring on March 1, 2021, following isolation of the
Roosevelt Street Water Tower as part of a construction punch -list outage. Not only are
the residents inconvenienced with unplanned water outages, but the water also comes
to the surface during the main breaks resulting in significant street damage.
The City's Public Works department has scheduled the area to be "milled -and -filled" and
have requested the water main work be conducted ahead of their paving program.
The water main in the Orchard Hills subdivision area was installed between 1962 and
1965 and is 6-inch ductile iron pipe with standard bury depths of around 5.5 feet.
DISCUSSION
The project scope includes approximately 1,350 lineal feet of water main on Orchard
Drive from the intersection of Orchard Drive south toward the intersection of Jonathan
Lane and Delicia Drive. This is an area is subject to water hammer which leads to water
main breaks, therefore an air release structure will be added as a part of the project
which will provide a location to allow the air to exit the water distribution system.
The project will also include the replacement of approximately 680 feet of curb and
gutter and 360 feet of sidewalk, including the replacement ADA ramp at the northwest
corner of Orchard Drive and Delicia Drive. The proposed HMA pavement replacement
will be completed by the contractor with funding assistance from the City of Dubuque
Public Works Department.

Sealed bids were received and publicly opened on August 9, 2021, for the Orchard
Drive, Cider Ridge and Jonathan Lane Water Main Replacement Project 2021.
Temperley Excavating of East Dubuque, Illinois submitted the apparent low bid in the
amount of $432,316.50. A summary of the bid proposals received is as follows:

RECOMMENDATION
The recommendation is to award the contract for the Jonathan Lane, Cider Ridge, and
Orchard Drive Water Main Replacement Project to Temperley Excavating of East
Dubuque, Illinois in the amount of $432,316.50.
BUDGET IMPACT
Funding for the project will be from Unspent Bond Proceed funds and FY21 Water Main
Improvement CIP No. 7401405, see table below for summary; plus a portion of a Public
Works ADA and Pavement project funding sufficient to cover the proposed project
expenses. The original estimate of probable cost for the Orchard Drive, Cider Ridge and
Jonathan Drive Water Main Project 2021 is:

The lowest bid of $432,316.50 from Temperley Excavating includes ADA curb ramp
replacement and hot mix asphalt (HMA) pavement removal and replacement beyond
the original project scope, This additional work was requested by the Public Works
Department to reduce coordination conflicts and to ensure the project is completed prior
to the asphalt plant season closure. The additional line -item expense for the requested
ADA and HMA pavement totals $89,969.25, which will be paid for from the Public Works
ADA and Pavement CIPs.
Subtracting the additional ADA curb ramp and pavement items, $432,316.50 minus
$89,969.25 equals the bid cost for the water main replacement line items, totaling
$342,347.25, or 1.9% higher than the estimate of probable cost of $305,065 plus 10%
contingency equaling $336,065.
The source of the funds that would be available to cover the project as bid plus
engineering costs, are Unspent Bond Proceeds from Bond Series 2014 B ,CIP Funds in
7401405-Water Main Replacement, CIP 300-1227 PW ADA, and CIP250-5440 PW

AWARDING PUBLIC IMPROVEMENT CONTRACT FOR THE JONATHAN LANE,
CIDER RIDGE AND ORCHARD DRIVE WATER MAIN REPLACMENT PROJECT 2021
Whereas, sealed proposals have been submitted by contractors for the Jonathan
Lane, Cider Ridge, and Orchard Drive Water Main Replacement Project, (the Project)
pursuant to Resolution No. 254-21 and Notice to Bidders published on the City of
Dubuque, Iowa website and plan room service with statewide circulation on the 23rd day
of July 2021; and
Whereas, said sealed proposals were opened and read on the 9th day of August
2021 and it has been determined that Temperley Excavating of East Dubuque, Illinois, in
the base bid amount of $432,316.50, is the lowest responsive, responsible bidder for the
Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That a Public Improvement Contract for the Jonathan Lane, Cider Ridge, and
Orchard Drive Water Main Replacement Project, is hereby awarded to Temperley
Excavating and the City Manager is hereby directed to execute a Public Improvement
Contract on behalf of the City of Dubuque for the Project.
