On June 16, 2006, the City Council approved the five -year Primary Road Maintenance
Agreement with the Iowa Department of Transportation. This agreement outlines the
responsibilities for maintenance and repair of the primary roads within the corporate
limits of the City during the period of July 1, 2006 through June 30, 2011.
Pursuant to the Primary Road Maintenance Agreement, the Third Street bridge
overpass corridor is maintained by the City, but falls under the jurisdiction of the Iowa
DOT.
City Engineer Gus Psihoyos recommends City Council approval of the Iowa Department
of Transportation Supplemental Agreement for Maintenance of Primary Roads in
Municipalities as it relates to the Third Street Overpass Bridge Approach Repair Project.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution authorizes the Mayor to execute the Iowa Department of
Transportation (Iowa DOT) Supplemental Agreement for Maintenance of Primary Roads
in Municipalities as it relates to the Third Street Overpass Bridge Approach Repair
Project.
BACKGROUND
On June 16, 2006, the City Council approved the five -year Primary Road Maintenance
Agreement with the Iowa Department of Transportation (Iowa DOT). This agreement
outlines the responsibilities for maintenance and repair of the primary roads within the
corporate limits of the City during the period of July 1, 2006 through June 30, 2011.
Per the Primary Road Maintenance Agreement, the Third Street bridge overpass
corridor is maintained by the City, but falls under the jurisdiction of the Iowa DOT.

The City, in partnership with the Iowa Department of Transportation, is working on the
repair improvements for the Third Street Overpass. This repair will include the: section
repair to the east abutment retaining wall; replacement of 300 feet of concrete sidewalk
on both the east and west sides; and the roadway resurfacing on both the east and west
abutment approaches to remove the pavement settlements that have developed. The
work is anticipated to begin on June 23, 2010, with completion by July 23.
The Supplemental Agreement for Maintenance of Primary Roads in Municipalities
outlines the maintenance and the cost - sharing between the City and the Iowa DOT for
this project.
RECOMMENDATION
I recommend that the City Council adopt the enclosed resolution and authorize the
Mayor to execute the Supplemental Agreement for Maintenance of Primary Roads in
Municipalities for the Third Street Bridge Approach Repair Project.

The estimate of probable cost for the Third Street Bridge Approach Repair Project is as
follows:

RESOLUTION APPROVING THE IOWA DEPARTMENT OF TRANSPORTATION
SUPPLEMENTAL AGREEMENT FOR MAINTENANCE OF PRIMARY ROADS IN
MUNICIPALITIES FOR THE THIRD STREET OVERPASS BRIDGE APPROACH
REPAIR PROJECT
Whereas, the City of Dubuque (City) will be the lead agency responsible for the
administration of the Third Street Overpass Bridge Approach Repair Project; and
Whereas, the Third Street Overpass Bridge Approach Repair Project in Dubuque
has been developed to include the: section repair to the east abutment retaining wall;
replacement of 300 feet of concrete sidewalk on both the east and west sides; and the
roadway resurfacing on both the east and west abutment approaches.
Whereas, the City, in partnership with the Iowa Department of Transportation, will
finance the Third Street Overpass Bridge Approach Repair Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That said Iowa Department of Transportation (Iowa DOT)
Supplemental Agreement for Maintenance of Primary Roads in Municipalities between
the City of Dubuque and the Iowa Department of Transportation be approved for the
Third Street Overpass Bridge Approach Repair Project in Dubuque.
Section 2. That the Mayor be authorized and directed to execute two copies of
Supplemental Agreement for Maintenance of Primary Roads in Municipalities for the
Third Street Overpass Bridge Approach Repair Project in Dubuque.

SUPPLEMENTAL AGREEMENT
For Maintenance of Primary Roads in Municipalities
This Supplemental Agreement made and entered into by and between the Municipality of Dubuque
Dubuque County, Iowa, hereinafter referred to as the Municipality, and the Iowa Department of
Transportation, Ames, Iowa, hereinafter referred to as the Department.
AGREEMENT:
I. This Agreement supplements the Agreement for Maintenance and Repair of Primary Roads in Municipalities entered
into by the parties on June 30 , 2006 , and in effect from July 1, 2006 , to June 30, 2011
II. The Municipality agrees to perform and accept all responsibility for those maintenance activities listed in Sections
1.8.1, 1.8.3, 1.8.4 and I.C.1 of the basic Agreement, with respect to the primary roads within the corporate limits of the
Municipality specifically described in this section.
In consideration thereof, the Department agrees to pay the Municipality at the rate of Not Applicable / lane mile
for acceptable work at the end of the fiscal year ending on June 30

Dubuque share estimated to be $18,596. See attached project plans and associated cost estimate. Payment by
state to be based on actual quantities and proper billing by city.
IV. This Supplemental Agreement may be terminated at any time by either party upon 30 days written notice.
V. This Supplemental Agreement shall be in effect from . June 15, 2010 to July 31, 2010 unless re- negotiated or
terminated.
