Planning Services Manager Laura Carstens is transmitting information on the
correspondence from the Federal Emergency Management Agency regarding the
proposed flood plain maps for Dubuque. FEMA has published two notices on May 21,
2010 and May 28, 2010 in the Telegraph Herald. The notices advise that FEMA is
soliciting technical information or comments on the proposed base flood elevations
shown in the preliminary Flood Insurance Study (FIS) and on the preliminary Digital
Flood Insurance Rate Map (DFIRM) for the City and County of Dubuque.
The enclosed FEMA letter advises that the community's 90 -day appeal period begins
following the second publication on May 28, 2010. The 90 -day appeal period will end
on August 26, 2010. The proposed base flood elevations, if finalized, will become the
basis for the flood plain management measures for the City of Dubuque.
The FEMA letter describes in detail the process for appealing the proposed base flood
elevations by either the community or private citizens. All appeals must be sent to
FEMA's Region VII Office in Kansas City, Missouri, within the 90 -day appeal period.
FEMA has not changed the DFIRM based on the many requests submitted by the City
of Dubuque to date. FEMA did agree to use the City's two -foot contour data from our
GIS, but indicated the revised DFIRM would likely not be available until after our 90 -day
appeal period has expired.
The City of Dubuque has retained the services of CDM for doing a more detailed
analysis of the City's North End and Bee Branch areas as well as a segment of the
North Fork of the Catfish Creek as a technical appeal of FEMA's preliminary DFIRM for
the City of Dubuque. The consulting firm will begin work at the end of the month.
The City's issue with the preliminary DFIRM prepared by FEMA is not changes to base
flood elevations, but rather the new areas designated as being in a Zone A, which has
no base flood elevation established but still carries the flood insurance requirement for
property owners.
The City continues to work with FEMA officials as well as keeping our elected
representatives at the State and Federal levels informed on our efforts to have the most
accurate DFIRM possible for our community.
This is just a status report. No action from the Mayor and City Council is needed at this
time.

On July 13, 2009, the Department of Homeland Security's Federal Emergency Management
Agency (FEMA) provided your community with Preliminary copies of a Flood Insurance Study
(FIS) report and Flood Insurance Rate Map (FIRM). The FIS report and FIRM for your
community were prepared in our countywide format, which means that flood hazard information
for the entire geographic area of the county, including your community and all incorporated areas,
was presented. This information makes it appropriate to modify the elevations of the flood
having a 1- percent chance of being equaled or exceeded in any given year (base flood) for certain
locations in the City of Dubuque, Dubuque County, Iowa. Public notification by way of a
Standard Newspaper Notice that the proposed modifications in Base Flood Elevations (BFEs) are
posted in the BFE Notice for Studies on the FEMA Website
http:// www .fema.gov /plan/prevent/fhm/bfe will be given in the Telegraph Herald on or about
May 21, 2010 and May 28, 2010. The BFEs for the flooding sources are listed in the table at the
end of the BFE Notice for Studies. Also, the proposed BFE determinations can be obtained by
calling the FEMA Map Information eXchange (FMIX) toll free at 1- 877 -FEMA MAP (1 -877-
336- 2627). A copy of the Standard Newspaper Notice and a copy of the Notice of Proposed
Flood Elevation Determinations published in the Federal Register, on May 4, 2010 at Vol. 75,
Page 23648 are enclosed for your information.
These proposed BFEs, if finalized, will become the basis for the floodplain management
measures that your community must adopt or show evidence of having in effect in order to
qualify or remain qualified for participation in the National Flood Insurance Program (NFIP).
However, before any revised BFEs are effective for floodplain management purposes, you will be
provided an opportunity to appeal the proposed BFEs.
Section 110 of the Flood Disaster Protection Act of 1973 (Public Law 93 -234) is intended to
ensure an equitable balancing of all interests involved in the setting of BFE determinations. The
legislation provides for an explicit process of notification and appeals for your community and for
private persons prior to this office making the BFE determinations final. The appeal procedure is
outlined below for your information. The regulations FEMA developed to implement
Section 110 are listed in Title 44, Chapter I, Part 67, Code of Federal Regulations. A copy of the
NFIP regulations is enclosed.
During the 90 -day appeal period following the second publication in the referenced newspaper,
any owner or lessee of real property in your community who believes his or her property rights
will be adversely affected by the BFE determinations may appeal to you, or to an agency that you

publicly designate. You must send copies of the individual appeals to the FEMA Region as soon
as you receive them. Note that the 90 -day appeal period is statutory and cannot be extended or
shortened for any reason. It is important to know, however, that the sole basis for the appeals is
having knowledge or information indicating that the proposed BFE determinations are
scientifically or technically incorrect. However, inquiries regarding data other than the proposed
BFE determinations (e.g., incorrect street names, typographical errors, omissions) will be
considered as comments and not appeals. Any applicable changes will be made before the
revised FIS report and FIRM become effective.
During the appeal period, private citizens who want to appeal should present to you the scientific
or technical data intended to negate or contradict FEMA's findings in any form, as you specify.
FEMA requests that you review and consolidate all appeals by private persons, and issue a
written opinion stating whether the evidence presented is sufficient to justify an official appeal by
your community on behalf of such persons. Your decision on whether an appeal by the
community in its own name will be made must be sent to this office within the 90 -day appeal
period and at the same time a copy must be sent to the FEMA Region VII, 9221 Ward Parkway,
Suite 300, Kansas City, MO. 64114-3372.
Any documents submitted to you without evidence that they were sent within 90 days of the
second publication in the local newspaper will be considered comments. Your community may
find it appropriate to call further attention to the proposed BFE determinations and to the appeal
procedure by using a press release or other public notice.
If the FEMA Region does not receive an appeal from your community on behalf of individuals
within the 90 days provided, FEMA shall consolidate and review on their own merits the
individual appeals, which you have on file and forwarded to us. FEMA's final decision will be in
writing, and copies will be sent to each individual appellant and the State coordinating agency.
The appeal resolution process will consider any scientific or technical data submitted by your
community intended to negate or contradict the information upon which the proposed BFE
determinations are based. The appeal will be resolved by consultation with officials of the local
government involved, an administrative hearing, or submission of the conflicting data to an
independent scientific body or appropriate Federal agency for a determination. FEMA will
determine the method for resolution.
If your community cannot submit scientific or technical data before the end of the 90 -day appeal
period, you may nevertheless submit data at any time as specified in Part 65 of the NFIP
Regulations. If warranted, FEMA will revise the FIRM again after the effective date.
The reports and other information used for the final determination will be made available for
public inspection. Until the conflict of data is resolved and the FIRM becomes effective, flood
insurance available within your community shall continue to be available in accordance with the
effective FIRM dated September 6, 1989.
If warranted by substantive changes, during the appeal period, FEMA will send to you revised
copies of the FIS report and FIRM. At the end of the 90 -day appeal period and following the
resolution of any appeals, FEMA will send you a letter of final BFE determinations.
The FIRM panels for Dubuque County, Iowa and Incorporated Areas have been
computer - generated. Once the FIS report and FIRM are printed and distributed, the digital files
containing the flood hazard data for the entire county can be provided to your community for use

in a computer mapping system. In the mean time, if you have any questions about the digital files
please contact Amanda Wilson, AECOM, 2405 Grand Boulevard, Suite 1000, Kansas City,
Missouri 64108, the designated mapping partner for preparing digital mapping files. These files
can be used in conjunction with other thematic data for purposes of floodplain management,
insurance determinations, and many other planning applications. In addition, your community
may be eligible for additional credits under the NFIP Community Rating System if you
implement your activities using digital mapping files.

to submit adopted RACT /RACM rules
for several source categories by August
31, 2010. EPA has determined that New
York will be able to meet this
commitment because the State has
already adopted rules for two of the
source categories and recently proposed,
and concluded public comment on,
RACT /RACM provisions for all but one
of the remaining source categories.
Under section 110(k)(4) of the Act,
EPA may conditionally approve a plan
based on a commitment from the State
to adopt specific enforceable measures
by a date certain, but not later than 1
year from the date of approval. If EPA
conditionally approves the commitment
in a final rulemaking action, the State
must meet its commitment to adopt the
identified regulations. If the State fails
to do so, this action will become a
disapproval upon the State's failure to
meet its commitment. EPA will notify
the State by letter that this action has
occurred. If the conditional approval
converts to a disapproval, the
commitment will no longer be a part of
the approved New York SIP. Upon
notification to the State that the
conditional approval has converted to a
disapproval, EPA will publish a notice
in the Federal Register notifying the
public that the conditional approval
automatically converted to a
disapproval. If EPA disapproves the
RACT and RACM SIP submittals, such
action will start a sanctions and FIP
clock (see section V). If the State meets
its commitment, within the applicable
time frame, the conditionally approved
submission will remain a part of the SIP
until EPA takes final action approving
or disapproving the RACT and RACM
submittals. If EPA approves the
submittals, the RACT and RACM
analyses will be fully approved into the
SIP in their entirety.
V. What are the consequences if a final
conditional approval is converted to a
disapproval?
The Act provides for the imposition of
sanctions and the promulgation of a
federal implementation plan (FIP) if
states fail to correct any deficiencies
identified by EPA in a final disapproval
action within certain timeframes.
A. What are the Act's provisions for
sanctions?
If EPA disapproves a required SIP
submittal or component of a SIP
submittal, section 179(a) provides for
the imposition of sanctions unless the
deficiency is corrected within 18
months of the final rulemaking of
disapproval. The first sanction would
apply 18 months after EPA disapproves
the SIP submittal if a state fails to make
the required submittal that EPA
proposes to fully or conditionally
approve within that time. Under EPA's
sanctions regulations, 40 CFR 52.31, the
first sanction would be 2:1 offsets for
sources subject to the new source
review requirements under section 173
of the Act. If the state has still failed to
submit a SIP for which EPA proposes
full or conditional approval 6 months
after the first sanction is imposed, the
second sanction will apply. The second
sanction is a limitation on the receipt of
federal highway funds. EPA also has
authority under section 110(m) to
sanction a broader area.
B. What federal implementation plan
provisions apply if a state fails to submit
an approvable plan?
In addition to sanctions, if EPA finds
that a state failed to submit the required
SIP revision or disapproves the required
SIP revision, or a portion thereof, EPA
must promulgate a FIP no later than 2
years from the date of the finding if the
deficiency has not been corrected.
VI. Statutory and Executive Order
Reviews
Under the Act, the Administrator is
required to approve a SIP submission
that complies with the provisions of the
Act and applicable federal regulations.
42 U.S.C. 7410(k); 40 CFR 52.02(a).
Thus, in reviewing SIP submissions,
EPA's role is to approve state choices,
provided that they meet the criteria of
the Act. Accordingly, this proposed
action merely approves state law as
meeting federal requirements and does
not impose additional requirements
beyond those imposed by state law. For
that reason, this proposed action:
• Is not a "significant regulatory
action" subject to review by the Office
of Management and Budget under
Executive Order 12866 (58 FR 51735,
October 4, 1993);
• Does not impose an information
collection burden under the provisions
of the Paperwork Reduction Act (44
U.S.C. 3501 et seq.);
• Is certified as not having a
significant economic impact on a
substantial number of small entities
under the Regulatory Flexibility Act (5
U.S.C. 601 et seq.);
• Does not contain any unfunded
mandate or significantly or uniquely
affect small governments, as described
in the Unfunded Mandates Reform Act
of 1995 (Pub. L. 104 - 4);
• Does not have Federalism
implications as specified in Executive
Order 13132 (64 FR 43255, August 10,
1999);
• Is not an economically significant
regulatory action based on health or
safety risks subject to Executive Order
13045 (62 FR 19885, April 23, 1997);
• Is not a significant regulatory action
subject to Executive Order 13211 (66 FR
28355, May 22, 2001);
• Is not subject to requirements of
Section 12(d) of the National
Technology Transfer and Advancement
Act of 1995 (15 U.S.C. 272 note) because
application of those requirements would
be inconsistent with the Act; and
• Does not provide EPA with the
discretionary authority to address, as
appropriate, disproportionate human
health or environmental effects, using
practicable and legally permissible
methods, under Executive Order 12898
(59 FR 7629, February 16, 1994).
In addition, this rule does not have
tribal implications as specified by
Executive Order 13175 (65 FR 67249,
November 9, 2000), because the SIP is
not approved to apply in Indian country
located in the state, and EPA notes that
it will not impose substantial direct
costs on tribal governments or preempt
tribal law.

Federal Emergency Management Agency
(FEMA) proposes to make
determinations of BFEs and modified
BFEs for each community listed below,
in accordance with section 110 of the
Flood Disaster Protection Act of 1973,
42 U.S.C. 4104, and 44 CFR 67.4(a).
These proposed BFEs and modified
BFEs, together with the floodplain
management criteria required by 44 CFR
60.3, are the minimum that are required.
They should not be construed to mean
that the community must change any
existing ordinances that are more
stringent in their floodplain
management requirements. The
community may at any time enact
stricter requirements of its own or
pursuant to policies established by other
Federal, State, or regional entities.
These proposed elevations are used to
meet the floodplain management
requirements of the NFIP and also are
used to calculate the appropriate flood
insurance premium rates for new
buildings built after these elevations are
made final, and for the contents in those
buildings.
Comments on any aspect of the Flood
Insurance Study and FIRM, other than
the proposed BFEs, will be considered.
A letter acknowledging receipt of any
comments will not be sent.
National Environmental Policy Act.
This proposed rule is categorically
excluded from the requirements of 44
CFR part 10, Environmental
Consideration. An environmental
impact assessment has not been
prepared.
Regulatory Flexibility Act. As flood
elevation determinations are not within
the scope of the Regulatory Flexibility
Act, 5 U.S.C. 601 -612, a regulatory
flexibility analysis is not required.
Executive Order 12866, Regulatory
Planning and Review. This proposed
rule is not a significant regulatory action
under the criteria of section 3(f) of
Executive Order 12866, as amended.
Executive Order 13132, Federalism.
This proposed rule involves no policies
that have federalism implications under
Executive Order 13132.

AGENCY: Fish and Wildlife Service,

ACTION: Notice of petition finding and
initiation of status review.
SUMMARY: We, the U.S. Fish and
Wildlife Service (Service), announce a
90—day finding on a petition to list
Hermes copper butterfly (Hermelycaena
[Lycaena] bermes) as a threatened or
endangered species under the
Endangered Species Act of 1973, as
amended (Act) and to designate critical
habitat. We find the petition presents
substantial scientific or commercial
information indicating that listing the
Hermes copper butterfly may be
warranted. Therefore, with the
publication of this notice, we are
initiating a status review to determine if
the petitioned action is warranted. To
ensure that the status review is
comprehensive, we are soliciting
scientific and commercial data and
other information regarding this species.
Based on the status review, we will
issue a 12 —month finding on the
petition, which will address whether
the petitioned action is warranted, as
provided in section 4(b)(3)(B) of the Act.

conduct this review, we request that we
receive information on or before July 6,

Request for Information
When we make a finding that a
petition presents substantial
information indicating that listing a
species may be warranted, we are
required to promptly review the status
of the species (status review). For the
status review to be complete and based
on the best available scientific and
commercial information, we request
information on the Hermes copper
butterfly from governmental agencies,
Native American Tribes, the scientific
community, industry, and any other
interested parties. We seek information
on:
(1) The species' biology, range, and
population trends, including:
(a) Habitat requirements for feeding,
breeding, and sheltering;
(b) Genetics and taxonomy;
(c) Historical and current range,
including distribution patterns;
(d) Historical and current population
levels, and current and projected trends;
and
(e) Past and ongoing conservation
measures for the species and its habitat
in the United States and Mexico.
(2) The factors that are the basis for
making a listing determination for a
species under section 4(a) of the
Endangered Species Act of 1973, as
amended (Act) (16 U.S.C. 1531 et seq.),
which are:
(a) The present or threatened
destruction, modification, or
curtailment of its habitat or range;
(b) Overutilization for commercial,
recreational, scientific, or educational
purposes;
(c) Disease or predation;
(d) The inadequacy of existing
