Description: To amend the University of Dubuque ID Institutional District to add a new
office /classroom building and additional parking south of the West and
Finley Street intersection. A new parking lot is proposed north of West
and Finley Streets intersection.
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the details of both the new
campus building and parking lots. Mr. Steiner reviewed areas to be landscaped and
access to the parking lots.
Staff reviewed the proposed changes to the University of Dubuque Institutional District,
noting that the developments comply with UDC design standards, except for parking lot
islands.
The Zoning Advisory Commission discussed the request, noting that while off - street
parking is very important, the inclusion of landscaping is as well, and the landscape
islands will only result in the loss of four parking spaces, which is not critical to the
University.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, with the condition that landscape islands be required to be placed
in the parking lot at the corner of Finley and West Streets.

Purpose: To amend the ID Institutional District for the University of Dubuque to allow
the construction of the new Mercer - Birmingham Hall building, the expansion of the
parking lot previously approved for the corner of Finley and West Streets, and the
approval of a new parking lot at the corner of Finley and McCormick Streets.
Property History: The University of Dubuque has assembled the subject property over
the years by purchasing individual parcels from private citizens. The subject parcels
were occupied by single - family residences.
Physical Characteristics: The subject properties have access to the existing street
system and generally slope toward the north.
Conformance with Comprehensive Plan: The project implements the
Comprehensive Plan's Land Use Element Goals: 7.2 and 7.3, and Educational Element
Goals 8.1 and 8.4.

Staff Analysis:
Streets: The proposed amendment to the University of Dubuque institutional
District will primarily impact Finley Street as both the proposed expanded parking
lot and new parking lot will have access onto Finley Street. There may be an
increase in vehicles using Finley Street as people come and go from the proposed
parking lots.
Sidewalks: Existing sidewalks along Finley, McCormick and West Streets will need
to be constructed or replaced per City of Dubuque Ordinances.
Parking: The expansion of the previously approved parking lot at the corner of
Finley and West Streets will increase the number of off - street parking spaces from
89 to 117, a 28 -space increase, over what was approved by the City Council in
March 2010. The proposed new parking lot provides an additional 27 off - street
parking spaces.
Lighting: New outdoor lighting will be required to use cut -off light fixtures to reduce
impact to adjacent properties.
Signage: No signage has been proposed as part of this ID amendment. New
signage shall be subject to Article 15 of the Unified Development Code.
Bulk Regulations: The layout of the proposed Mercer - Birmingham Hall and
associated parking lot improvements will be constructed in substantial compliance
with the submitted campus development plan.
Permeable Area ( %) & Location (Open Space): Permeable area will be in
compliance with the Unified Development Code and will be located as shown on
the submitted campus plans.
Landscaping /Screening: Planning staff recommends that the landscaping and
screening be in . compliance with Article 13 of the Unified Development Code This
will require that for the expanded parking lot at the corner of Finley and West
Streets, four spaces will be lost by the inclusion of parking lot landscaping islands.
Phasing of development: None.
Impact of Request on:
Utilities: Existing utilities are adequate to handle the proposed project.
Traffic Patterns /Counts: No traffic counts are available for Finley, West or
McCormick Streets. Planning staff anticipates that the proposed additional off -
street parking spaces will generate increased traffic on Finley Street.

Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impacts to the environment
provided that adequate erosion control is provided in all phases of construction
and adequate storm water control is provided as part of the development of the
proposed project.
Adjacent Properties: The proposed new parking lot, the expanded parking lot,
and the new campus building will represent a visual change along West Street
and Finley Street, and may increase traffic.
CIP Investments: None proposed.
Staff Analysis: The University of Dubuque is requesting an amendment to their
Institutional District to allow for the construction of the Mercer - Birmingham Hall,
expansion of the parking lot previously approved in March 2010, and a new 27 -space
parking lot near the corner of McCormick and Finley Streets. The amendments to the
ID Institutional District are required when either an institutional district's boundaries are
being expanded or a significant on- campus expansion is taking pace. The proposed
parking lot near the corner of McCormick and Finley Streets is on property currently not
zoned as Institutional District as well as the location of the proposed Mercer -
Birmingham Hall building. The proposed expansion of the previously approved parking
lot will increase the number of spaces by 28, and the new parking lot at the corner of
McCormick and Finley Streets will provide an additional 27 off - street parking spaces.
The proposed Mercer - Birmingham Hall will provide office and classroom space as well
as an outdoor event plaza. The proposed building will have 6,000 square feet on each
of two floors for a total of 12,000 square feet. From McCormick Street side, the building
will be a single -story with two stories exposed on the West Street side.
The new proposed parking lot with access on the McCormick Street and Finley Street
provides an additional 27 off - street parking spaces. The parking lot is being
constructed on land owned by the University of Dubuque, but not currently zoned ID
Institutional District. The proposed parking lot will substantially meet the buffer
requirements contained in Article 13 of the Unified Development Code, except for small
portions of the parking lot as they abut Finley Street and McCormick Street. Planning
staff does not think this is a major departure from the setback requirements contained
in the UDC and have no objection to the proposed layout. The Engineering Department
has reviewed the access points for the parking lot and has no objection.
The University of Dubuque is also proposing enlarging the parking lot approved by the
City council in March 2010 by providing an additional 28 parking stalls. The parking lot
has been principally modified by eliminating the detention basin and replacing this area
with parking. The storm water is proposed to be piped along West Street to a new

proposed underground storm water chamber behind the proposed Mercer - Birmingham
Hall building.
The proposed expansion of the parking lot along Finley and West Streets will comply
with the setback requirements in the Unified Development Code as well as the
landscaping. The one requirement not complied with is the provision of landscape
islands to break -up long rows of parking stalls. The Unified Development Code
requires that where stall length exceeds 20 spaces, that intermediate landscaped
islands be used to break up the parking row. In the proposed parking lot along Finley
and West Streets, it would require a total of 4 spaces be removed and replaced with
landscape islands. The Zoning Advisory Commission can approve through the ID
Institutional District requirements a standard other than that required by the Unified
Development Code.
Planning staff recommends that the Zoning Advisory Commission review Section 5-
22(D) that establishes the criteria for review of Institutional District amendments.

ORDINANCE NO. 28 -10
AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY PROVIDING FOR THE
APPROVAL OF AN AMENDED CAMPUS DEVELOPMENT PLAN TO ALLOW
CONSTRUCTION OF AN EXPANDED PARKING LOT, A NEW PARKING LOT AND A
NEW OFFICE /CLASSROOM BUILDING FOR THE UNIVERSITY OF DUBUQUE ID
INSTITUTIONAL DISTRICT NEAR THE CORNER OF FINLEY AND WEST STREETS.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, be amended by providing for the approval of an amended campus
development plan for the University of Dubuque ID Institutional District, a copy of which
is on file with the City of Dubuque Planning Services Department.
Section 2. Institutional District Regulations.
A. Use Regulations
The following regulations shall apply to all uses made of land in the
above - described ID Institutional District:
1. Principal permitted uses shall be limited to:
a. Offices for administrative personnel or other institutional
employees and affiliates.
b. Churches, libraries, and museums.
c. Classrooms, laboratories, lecture halls, and similar places of
institutional assembly.

d. Off - street parking and loading.
e. Recreational or athletic facilities for the primary use and
benefit of institutional residents or affiliates.
f. Single- family, two - family or multi - family dwellings for the
housing of institutional residents or affiliates.
2. Accessory Uses. The following uses shall be permitted as
accessory uses in the above - described ID Institutional District.
a. Located entirely within a principal building, bookstores, or
bars seating not more than seventy -five (75) persons at one
time and located not closer than two hundred feet (200')
from the nearest Residential or Office Residential District.
b. All uses customarily incidental to the principal permitted
uses in conjunction with which such accessory uses
operated or maintained, but not to include commercial use
outside the principal building.
3. No conditional uses shall be allowed.
B. Lot and Bulk Regulations
Development of land in the ID Institutional District shall be regulated as
follows:
The proposed Mercer Birmingham Hall, the proposed parking lot at the
corner of Finley and West Streets, and the proposed parking lot at
Finley and McCormick Streets shall be constructed in substantial
conformance with the attached amended campus development plan.
C. Performance Standards
The development and maintenance of uses in this ID Institutional
District shall be established in conformance with Section 5 -22 of the
Unified Development Code and the following standards:
1. The storm water control shall be designed and built in accordance
with City Regulations subject to review and approval by the City of
Dubuque Engineering Department.
2. That appropriate erosion and sediment control will be installed
prior to commencement of any land disturbing activity related to
the subject project, including all required state and city permits
related to erosion control.
3. New outdoor lighting shall utilize 72- degree cut -off luminaries.

4. Landscaping shall be provided in compliance with Article 13 of the
Unified Development Code.
5. All utilities, including telephone and cable television, shall be
installed underground.
6. Final site plans shall be submitted in accordance with Articles 12
and 13 of the Unified Development Code.
D. Parking Requirements
The off - street parking requirements for the principal permitted uses for
the herein described ID Institutional District shall be regulated as
follows.
1. The number, size and layout of off - street parking shall be in
substantial compliance with the amended campus plan.
2. Any significant expansion or reduction in the number of off - street
parking spaces must be reviewed by Planning Services staff for
compliance with the adopted Institutional District regulations.
E. Sign Regulations
The sign regulations shall be the same as that which are allowed in the
ID Institutional District as established in Article 15 of the Unified
Development Code.
F. Additional Standards
That all previously approved campus development plans are hereby
amended to allow for the attached campus development plan.
G. Transfer of Ownership
Transfer of ownership of property in this ID Institutional District requires
rezoning of the property to an appropriate zoning district.
H. Modifications
Any modifications of this Ordinance must be approved by the City
Council in accordance with zoning reclassification proceedings of
Article 9 of the Unified Development Code.
I. Recording
A copy of this ordinance shall be recorded at the expense of the
property owner(s) with the Dubuque County Recorder as a permanent
record of the conditions accepted as part of this reclassification
approval within thirty (30) days of the adoption of this ordinance. This
