City Solicitor Czizek reported ver-
bally on the petition of Mrs. Sanner,

the City Solicitor be authorized to
purchase, as the City's agent, all
property offered for delinquent spe-
cial assessments, where there is no
other purchaser. Seconded by Coun-
cilman Schrempf. Carried by the

Mr. Utzig addressed the Council
and stated that the alley back of his
property on O'Neill street is in very
bad condition, that some filling had
been done there and that there is
now an offset at the end of the alley
making it worse than it was before,
and he asks the Council to put some
more filling there and level it so that
people living there can use the alley.
Council will view the grounds.
Petition of the Pyramid Oil Co.,
making application for lease or pur-
chase of a plot of ground north of
the I. C. R. R. right of way, includ-
ing that portion on which the Shot
Tower stands and east thereof to
Tower street, to be used for whole-
sale oil storage purposes.

Mayor Alderson read the call and
stated that service thereof had been
duly made and accepted and that
this meeting is called for the pur-
pose of hearing objections duly ap-
proved, for the construction of a
combined Storm and Sanitary Sewer
having its general location over Rail-
road avenue, Southern avenue, and
Grandview avenue, to the proposed
contract, or to the cost of the 'm-
pi evement which the City is to bear,
and the issue of bonds to defray
such cost, considering bids for said
sewer and acting on any other bus-
iness that may come before the
meeting.
Notice of publication certified to
by the publisher, that plans and
specifications have been adopted and
are on file in the office of the City
Clerk for the construction of a com-
bined. Storm and Sanitary Sewer
having its general location over Rail-
road avenue, Southern avenue and
Grandview avenue, also form of con-
tract proposed to be executed by the
City of Dubuque to pay for that por-
tion of the construction of said sew-
er as has been assumed by the City
in the sum of approximately $22,000
and it is proposed that when said
sewer is completed, Sewer bonds of
general obligation will be issued to
defray the cost of same.
There being no objections or
remonstrances, Councilman Brede
moved that the notice of publication
be received and filed for record. Sec-

Whereas, proposals have been sub-
mitted by contractors for the con-
strnction of a sanitary sewer in the
Southern Avenue Combined District
Sewer and Uhlrich -Paley Co., .con-
tractors, have submitted the lowest
bid for the furnishing of all labor
and materials and performing the
the work as provided for in the plans
and specifications; now therefore,
Be it resolved by the City Council
of the City of Dubuque that the con-
tracts for the construcion of a sani-
tary sewer in the Southern Avenue
Combined Disriet Sewer be awarded
to Uhlrich -Paley Company for tile
construction with the railway portion
to be constructed of concrete, and
the Mayor and Manager be and they
are hereby directed to execute con-
tracts on behalf of the City of Du-
buque for the complete performance
of said work, and all checks of un-
successful bidders be returned.
Be it further resolved that this
resolution being deemed urgent and
of immediate necessity become effec-
tive from and after its passage and
adoption by the City Council.

Whereas, the City of Dubuque is
the owner of the following described
lots: Lots 1 to 12, both inclusive;
Lot 1 of 15; Lot 1 of 1 of 1.4; Lot 1
of 1 of 15; Lot 1 . 1 of 16; Lot 1
of 1 of 17; all in Block 30 in Du-
buque Harbor Improvement Com-
pany's Addition. And also
Lot 1 of 1 of Block A in Booth's

desirous that said plat be placed on

ords of Dubuque, Dubuque County,
Iowa, therefore
Be it resolved by the City Council
of the City of Dubuque that the plat
of "Industrial Subdivision No. 2" of
the City of Dubuque be and the
same is hereby approved.
Be it further resolved that a legal
certificate of approval and consent
be endorsed upon said plat by the
Mayor and Councilmen on behalf of
the City of Dubuque, as evidence of
such approval and consent, and that
thereafter said plat shall be regular-
ly filed as a public record and con-
stitute a new Subdivision to the City
of Dubuque, bearing the name and
title above stated.
Be it further resolved that the

ing for a reduction in assessment as

levied is right, and the Clerk was
instructed to notify Miss Murphy of
this fact, also explain to her that
she ' was misinformed on the Oak
street matter, as the Council does
not levy assessments for contemplat-
ed improvements, no motion.
Petition of Anna C. Dax referred
to the Council at a previous meeting.
Stating that she is assessed for the
improvement of Cleveland Ave.,
against lot 75 Union Add. in the sum
of $566.08 and against this same lot
$395.07 for the improvement of Bry-
ant street, for reduction in assess-
ment. Council viewed the property.
Petition of Mrs. Sigwarth owner
of lot 74 Union Add., assessed for
$180.84 for improvement of Cleve-
land avenue, and petition of Mrs.
Anna Enright, assessed for lot 48
and 10 feet of lot 47 in the sum of
$255.28 for improvement of Cleve-
land avenue, for reduction in assess-
ment.
The Council on viewing the above
properties of Mrs. Dax, Mrs. Sig -
warth and Mrs. Enright, decided
that these property owners were en-
titled to some consideration.

petitions be referred to the City So-
licitor to devise scme way whereby
the petitioners may lawfully receive

Be it resolved by the City Council
of the City of Dubuque that the May-
or of said city be and he is hereby
authorized and directed to execute a
deed in favor of the Quality 011 Com-
pany for Lot 1 of Industrial Sub. No.
2, same to be conveyed to the Qual-
ity Oil Co., for the sum of $2,791.75.
Be it further resolved that the
Mayor be authorized and directed to
execute a deed in favor of Jaeger
and Kunnert for Lot 8 Industrial
Sub. No. 2, same to be conveyed to
Jaeger and Kunnert for the sum of
$4,100.00.
Be it further resolved that a real
estate contract be entered into with
the Commercial Jobbing Company
for Lot No. 9 of Industrial Sub. No.
2, the amount of consideration being
$3,480, 5% per cent interest on de-
ferred payments.

Gentlemen: My attention has
just been called to the tax sale cer-
tificate against certain lots in Rose-
dale Addition owned by the Voelker
Realty Company.
Tax sale certificates are held
against lots 42 to 48 inclusive, ex
cepting lot 44, Rosedale Addition
which the Voelker Realty Company
stand ready to redeem on condition
that the certificate No. 504 against
Lot 45 Rosedale Addition, be reduced
to the same amount as the figures
will bring on certificate No. 505
against Lot 46 Rosedale Addition.
Neither of these lots are particularly
valuable. The assessment as levied
in July, 1915, against Lot 45 was
$38.28 while the assessment against
Lot 46 was $16.93. Of course the
additional charges now amount to
more than the original assessment.
Tax sale certificates 5019, 5020 and
5021 against Lots 36, 37 and 38 will
be redeemed in full without question.

The tax sale itself is in error in-
asmuch as it states for curbing, gut-
tering and macadamizing Leibnitz
street from North Main street to
Harold street and not for the im-
provement of Cleveland avenue.
Also, the assessment book is in
error inasmuch as the notation in
the book itself would indicate that
the assessment had been entirely

Report of the City Solicitor on the
petition of the Dubuque National
Bank, Dubuque Savings Bank, and
Second National Bank, asking for a
cancellation of additional taxes, hav-
ing been filed with the City Council
and referred to the City Solicitor for
investigation and report. He states
that the facts set forth in the peti-
tion are true. The taxes referred to
in the petition are those which are
due for the year 1919. And after a
careful investigation of the matters
involved, he consulted with Mr.
Smith of the law firm of Hurd, Lene-
han, Smith & O'Connor, who repre-
sent the banks, and have come to an
agreement with reference to these
taxes. They have agreed that the
banks should pay an additional 50%
of the taxes which are claimed to be
due, and if this is agreeable to the
Council, he would suggest that the
County Treasurer be instructed to
correct his tax list by reducing the
valuations there carried by one -half.
If this is done the banks will pay
on this basis. He recommends that
this be done.

Gentlemen: The petition of Mrs.
Irene Speigelhalter asking for the ex-
emption from taxes for the year 1923
upon Lot 2 of the Subdivision of Lot
108 of Cox's Addition to the City of
Dubuque was referred to me for in-
vestigation and report. I beg to ad-
vise that this lady is a widow wom-
an having six small children depend-
ing upon her for support. She has a
small home and no income except
what she can earn through her own
effort. In addition to this she re-
ceives a widow's allowance from the
County as provided by law. The
Board of Supervisors have exempted
her from the payment of these taxes
and I believe the circumstances are
such that the City should do like-
wise. I therefor recommend that
her petition be allowed and that the
County . Treasurer be instructed to
cancel the taxes for the year 1923
upon the property above described.

To the Honorable Mayor and City
Council of the City of Dubuque:
Gentlemen: On the 17th of De-
cember, 1922 the Main sewer in the
alley between Alta Vista street and
Center Place became clogged and
sewage therefrom backed into the
basement of Andrew Shea, the own-
er of abutting property. This con-
dition was discovered on the night
of December 17th which was on a
Sunday and owing to the fact that
it was Sunday and at night it was
practically impossible for him to get
the conditioned checked until the
following day. This resulted in his
damage to the extent of $27.70.
I have investigated the facts sur-
rounding this matter and believe that
the liability of the City rests in the

fact that this sewer had been per-
mitted to become stopped up with
grease, which grease had accumulat-
ed for some time. The Sewer In-
spector tells me that when he
cleaned out the sewer after the stop -
age was disclosed to him he found
great pieces of grease in the sewer
which must have been there for
quite awhile. I believe the claim
should be paid and therefor recom-
mend that a warrant be drawn in
favor of Mr. Shea in the sum of
$27.70.

or, has been completed. I would
therefore recommend the acceptance
of this work.

A Resolution.
Whereas, the contract for the co,
struction of sidewalks abutting lot
2 and Mt 5 Recke's Sub. and lot 12
and lot 18 Stewart's Sub, or by the
construction of sidewalks has been
completed and the City Manager has
examined the work and filed his cer-
tificate stating the same has been
completed according to the terms
and stipulations of the contract and
recommends its acceptance, now
therefore
Be it resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Manag-
er be approved and said improve-
ment be and the same is hereby ac-
cepted and the City Engineer be and
he is hereby instructed to prepare
a plat and schedule showing the
lots or parcels of real estate subject
- to assessment for said improvement
and file the same in the office of the
City. Clerk subject to public inspec-
tion and the City Clerk shall upon
receipt of such plat and schedule
publish the notice of said assess-
ments, as required by law.
Be it further resolved that the
City Treasurer be and he is hereby
directed to pay to the contractor
from the funds realized from the
Special Session, December 29th, 1924 861
sale of improvement bonds issued
upon the above described improve-
ment an amount equal to the amount
of his contract less any retained per-
centage provided for therein.
