Mayor Alderson in the Chair. The Mayor stated that this is the regular monthly meeting of the Council for the transaction of such business as may regularly come be- fore the meeting. A petition signed by 688 signers presented. Petition asking for a special elec- tion to authorize the issuance of bonds in the sum of not to exceed $325,000.00 for the purpose of erect- ing, extending, maintaining, operat- ing, building and furnishing the Wa- ter Works of this city of Dubuque, Iowa. • To the Honorable Mayor and Coun- cil of the City of Dubuque: Gentlemen: Whereas it is a mat- ter bf common knowledge that the present City Water Works is wholly inadequate to take care of the needs of the community and provide suf- ficient fire protection for its citizens, due to the fact that machinery and buildings are in need of repair and replacement, and extensions and im- provements are demanded every- where throughout the city, and Whereas, there are not sufficient funds available with which to make such necessary improvements, and Whereas, it has been ascertained that such water works are necessary improvements cannot be erected, ex- tended, maintained, operated, built and furnished within the limit of one and. one - quarter per centum of the actual value of the taxable property of the City of Dubuque, as deter- mined from the last state and coun- ty tax lists previous to the incurring of proposed indebtedness, now there- fore, The undersigned, being resident qualified electors of the City of Du- buque, Iowa, do hereby petition your Honorable Body to call a special election for the purposes of issuing bonds in a sum not to exceed $325,- 000.00 to pay for the maintaining, erection, extending, operating, build- ing and furnishing the Water Works of the City of Dubuque, Iowa, at which time the question to be voted upon which shall be submitted to the electors of said City shall be as provided by Section 1306 -d of the Supplement to the Code of Iowa, 1913, as amended. The petition tieing in regular form and containing the necessary num- ber of names, Councilman Brede moved that it be received and made a matter of record. Seconded by Councilman Schrempf. Carried by the following vote: Yeas — Mayor Alderson, Council- men Brede, Schrempf, Nays —None. Absent — Councilmen Gabriel, Melchior. Resolution providing for a Special Election to vote upon the question of the issuance of bonds for Water Works purposes: Whereas, a petition has been pre- sented to the City Council, signed by a sufficient number of qualified electors of the City of Dubuque, ask- ing the City Council of said City to call an election for the purpose of issuing bonds in the sum of not to exceed $325,000.00, said money to be used for the purpose of erecting, ex- tending, maintaining, operating, building and furnishing the Water Works of the City of Dubuque, and stating that the necessary improve- ments cannot be built, erected, furn- ished, extended, maintained, or oper- ated within the limit of one and one- fourth (1 per centum of the ac- tual value of the taxable property of said City; and Whereas, it has been found by the City Council that said petition com- plies with the law as contained in Section 1306 -c of the Supplement to the Code, 1913, and that pursuant thereto it becomes the duty of the Council to call said election; and Whereas, this meeting is the next regular meeting of the City Council of said City following the filing of said petition; now therefore Be it resolved by the City Coun- cil of the City of Dubuque that a special election be called for Mon- day, January 29, 1923, and that no- tice thereof be published once each week for four (4) consecutive weeks in the' Telegraph - Herald and Times - Journal newspapers of said City, at which election there shall be sub- mitted to the voters of said City the following proposition: For the issuance of bonds ih the sum of $325,000.00 for water works purposes Against the issuance of bonds in the sum of $325,000.00 for water works purposes. Mayor Alderson stated that this is an adjourned meeting of January lst. The following resolution was pre- sented, and adopted: Resolution. Whereas, the whole of City Lot 587 appears to have been assessed to pay for the construction of a sewer in the alley adjacent to said lot, although said lot has been sub- divided and portions thereof owned by different people, and upon tax sale said entire lot was sold to pay for the delinquent assessment, and the City of Dubuque is the owner of the tax certificates; and Whereas, said assessment was er- roneous in that the southerly twenty - four (24) feet of the northerly forty - eight (48) feet of the westerly one - half ( %) of said lot should not have been included within said assess- ment, and was in no manner access- ible for said improvement or liable to pay for the same; and Whereas, in order to remove the cloud upon the title to said portion of said lot as herein described, it 18 necessary that said described por- tion of said lot be relevied from said assessment and the apparent lien therefor be removed; now therefor Be it resolved by the City Coun- cil of the City of Dubuque that the southerly twenty -four (24) feet of the northerly forty -eight (48) feet of the westerly one -half ( of City Lot 587 be and the same is hereby relieved from any lien or cloud caused by the fact that a special assessment appears to have been levied against said real estate to pay for the cost of constructing a sewer in the alley adjacent thereto, and that, in so far as said real estate is concerned that the assessment by and the same is hereby cancelled. Be it further resolved that the City Treasurer indicate upon his records the cancellation of said as- sessment as provided for by this resolution. Passed and adopted this 2nd day of January, 1923. An Ordinance repealing an ordin- ance, entitled "An Ordinance provid- ing for the establishing, opening, altering, and vacating all streets, avenues and alleys; also the manner of fixing and changing grades, and also for the condemnation of private property for such purposes ", the same being Ordinance No. 43 of the Revised Ordinances of the City of Dubuque, 1919. Presented and read. Councilman Gabriel moved that this be considered the first reading of the ordinance. Seconded by Coun- cilman Brede. Gentlemen: The petition of Ed- mund A. Linehan requesting the re- turn to him of a certified check of $350.00, which was declared forfeit- ed by the City, was referred to me for an opinion. This check was put up by the con- tractor as a part of his bid and pur- suant to the notice to contractors which was published prior to the let- ting of this work. The language of the notice stated that the purpose of the check was to be "A guar- antee that a contract will be entered into as awarded" to the bidder. In 'this case no contract was awarded to Mr. Linehan. Some claim was made by him that an error was made in figuring the amount of his bid and he requested that he be permitted to withdraw his bid or that the state- ment be considered in letting this contract. It seems to me that in view of that fact the condition pro- vided for in the notice to contract- ors was not fulfilled, to the extent of letting the contract to him. If the contract had been let to him and he had not signed it, then his check might rightfully have been forfeited, but this was not done and I do not believe that the forfeiture of his check was justified under the cir- cumstances. I therefore recommend that a warrant be drawn upon the general fund in his favor in the sum of $350.00 covering the amount of his certified check. Respectfully submitted. M. H. Gentlemen: I am now erecting a two -story brick store and flat at the corner of 30th and Jackson streets, and desire permission to build four steps from the structure to the in- side edge of the sidewalk. Councilman Brede moved that the prayer of the petition be granted, with the understanding that Mr. Cartigny signs a waiver prepared by the City Solicitor to protect the City. Simplot pre- sented, asking that the City Council instruct the Citizens Tax Investment Corporation to get a refund from the County Treasurer for the amount paid by them at the tax sales for the 1920 and 1921 tax against the undivided one -third of Lot 139, Fin- ley Add., stating that she is a widow of a Civil War veteran and is there- for entitled to tax exemption on the above property. Councilman Brede moved that the petition be referred to the City So- licitor. Seconded by Councilman Ga- briel. Carried by the following vote: Yeas — Mayor Alderson, Council- men Brede, Gabriel, Schrempf. Nays —None. Absent—Councilman Melchior. The City Manager, to whom was referred the matter of the A. W. Kemler Estate, relative to a special assessment (delinquent), reported verbally that he had investigated and finds as follows: That the as- sessment was levied on October 11, 1909, for the construction of a curb and gutter in front of and adjoining Lot 2 of 19 on Julien avenue and does not see any reason why this assessment should not be paid. . Councilman Brede moved that Miss Julia Kemler, agent for the A. W. Kemler Estate, be allowed to pay the original assessment with accum- ulated interest and costs, less the 8 per cent penalty, upon the pay- ment of which the tax sale certif- icate be cancelled. M. on Saturday, January 6th, 1923, at the Council Chamber in the City Hall for the purpose of receiving and considering the bids submitted for the sale of $100,000.00 of 4 per cent of Sewer Bonds of said City, and considering a contract for the sale of said bonds, and for the purpose of introducing a resolution authoriz- ing and approving the contract for the sale of said bonds to the highest bidder, and for any other purpose which might properly come before a regular meeting of the City Council. Their limit, however, was passed before their opportunity came to bid: National City Co., Chi- cago, Ill.; Second Ward Securities Co., Milwaukee, Wis.; White - Philips Co., Davenport, Iowa; - Graham - Schulte Co., Waterloo, Iowa. The last named company offered a prem- ium of $2,700.00 provided these bonds were made payable in New York City. On the present charge of banks for handling payments, the cost to the City for New York pay- ments would be in the neighborhood of $460.00, an additional charge of something like $70.00 for printing to- gether with the delay incident to re- passing the legislation authorizing the issue of bonds would be neces- sary. I would therefore recommend the sale of this issue of bonds to the Federal Securities Corporation, Chi - cago, Ill., at their price as bid, name- ly, par and accrued interest plus a premium of $2,400.00. Resolution authorizing the execu- tion of a contract for the sale of $100,000.00 of 41/2 per cent Sewer Bonds of the City of Dubuque to Federal Securities Corporation of Chicago, Illinois: Whereas, appropriate proceedings were instituted by the City Council of the City of Dubuque, Iowa, for the issuance and sale of 41/2 per cent sewer bonds to the amount of $100,000.00, and notice of the time when bids would be received for the sale of such bonds was duly pub- lished in the Telegraph- Herald, one of the official county newspapers of Dubuque County, Iowa, and also in the Des Moines Leader, a newspaper of general circulation throughout the State of Iowa, for two successive weeks, all as provided by law; and Whereas, pursuant to such notice bids were received by the City Man- ager of said City on January 6, 1923, at his office in the City Hall, at 6 Special Session, January 6th, 1923 which time the same were opened, compared and examined and Whereas, such bids were sub- mitted to the City Council of the City of Dubuque at a meeting called for that purpose on January 6, 1923, and said City Council finds that the Federal Securities Corporation of Chicago, Illinois, submitted the high- est bid for said bonds, said bid offer- ing par plus accrued interest to- gether with a premium of $2,400.00, and it is deemed advisable that a contract be awarded to said Com- pany for said bonds: now therefor Be it resolved by the City Council of the City of Dubuque, in legal ses- sion assembled, that a contract for the sale of $100,000.00 of 41'f per cent sewer bonds of the City of Du- buque be awarded to said Federal Securities Corporation of Chicago, Illinois, and that said contract be executed by the Mayor on behalf of said City of Dubuque upon final pas- sage of this resolution and approval of the contract, a copy of which is bereto attached and made a part hereof. To the Honorable City Manager, Mayor and City Council: Gentlemen: Your petitioners state that some months ago they signed and presented a petition for the im- provements of Langworthy avenue from Booth to College streets Col- lege avenue from Langworthy ave- nue to West Third street, Douglas street (formerly West Second street) and Walsh street. That fne peti- tioners notice by the publication of the resolution of necessity, that Douglas street and Walsh street have been omitted from the resolu- tion, and your petitioners are calling Special Session, January 13th, 1923 7 your attention to the fact that these two streets are included in the peti- tion, that the north side of Douglas street is largely built up and the south side is fronted by the new addition, "Sunny Side ", which is ra- pidly building, and that the improve- ments so far included in the reso- lutions of necessity would leave the abutters on Douglas street and the new lots in "Sunny Side" without an improved street, and provide of no way of getting in and out except to drive in and turn around to get out of the new district, without going over unimproved streets. Wherefor your petitioners ask that Douglas and Walsh streets be included in the improvements to be let soon, and that the work all go on together for the above reason and for the further reason that there will be a saving in the matter of grading by doing the work all at one time. Resolution authorizing the execu- tion of a contract for the sale of $100,000.00 of 4% per cent Sewer Bonds of the City of Dubuque to the Federal Securities Corporation of Chicago, Ill.: Whereas, appropriate proceedings were instituted by the City Council of Dubuque, Iowa, for the issuance and sale of 4 per cent sewer bonds to the amount of $100,000.00, and notice of the time when the bids would be received for the sale of such bonds was duly published in the Telegraph - Herald, one of the of- ficial county newspapers of the City of Dubuque County, -Iowa, and also in the Des Moines Leader, a news- paper of general circulation through- out the State of Iowa, for two con- secutive weeks, all as is provided by law: and Whereas, pursuant to such notice, bids were received by the City Man- ager of said City on January 5th, 1923, at his office in the City Hall, at which time the same were opened, compared and examined, and Whereas, such bids were sub- mitted to the City Council of the City of Dubuque, at a meeting called for that purpose on Jan- uary 6th, 1923, and said City Council finds that the Federal Secur- ities Corporation of Chicago, Ill., submitted the highest bid for said bonds, said bid being par plus ac- crued interest together with a prem- a 8 Special Session, January 13th, 1923 ium of $2,400.00, and it is deemed advisable that a contract be awarded to said Company for said bonds; now therefore Be it resolved by the City Council of the City of Dubuque, in legal ses- sion assembled, that a contract for the sale of $100,000.00 of 4% per cent sewer bonds of the City of Dubuque be awarded said Federal Securities Corporation of Chicago, I11., and that said contract be executed by the Mayor on the behalf of said City of Dubuque upon final passage of this resolution and approval of the con- tract, a copy of which is hereto at- tached and made a part hereof. Petition of Frank and Fred Bell presented, asking the City Council to reconsider their action relative to a stairway in the back of the Bell Building, on 13th and Central ave- nue, stating that If they will be com- pelled to put an iron stairway there it would cost in the neighborhood of $400.00 and a wooden stairway would cost about $60.00, that they are not getting very much rent for the flats in said building, not having raised it as other landlords have done, and if the Council insists on the construction of an iron stairway they would have to raise the rent and it would work a hardship on the tenants. Furthermore the stairway is used only for carrying wood and coal to the occupants in the building and a wooden stairway would do just as well. Gentlemen: You are no doubt aware that there are individuals, some working alone and some as representatives of outside firms, whose business it is to sell drugs and medicines by house to house canvass. This practice is, in the first place, unfair to established lo- cal dealers, who pay taxes and who are required to be registered phar- macists. Secondly, there is a ques- tion as to quality in some cases of the merchandise offered. City Council, Dubuque, Iowa. Gentlemen: The City Solicitor ad- vises that the jury has given a ver- dict in favor of Theresa Jubser against the City of Dubuque on ac- count of personal injury claim on account of falling on the walk on January 31, 1921. The amount of the award is $1,500.00. The evidence as I understand it shows that the walk was clean the day of January 31st, 1921, that during the day water dripped from the overhanging bay window onto the sidewalk and froze in the evening, and it was on this icy place that Theresa Jubser slipped and fell. Also on December 20th, 1920, Mrs. Houston fell on Main street on ac- count of ice forming from water dripping from an overhanging bay i. 10 Special Session, January 13th, 1923 window. This case was settled for $3,000.00. The City at that time not being able to prove that the walk was entirely free from ice the day previous. In view of these constantly re- curring causes of injury and the lia- bility on the part of the City of Du- buque, where a property owner shall have so improved his property as to throw additional responsibility on the part of the City, I would recom- mend that the City require either the removal of all walks, platforms or bay windows which hang over the sidewalk along any street in the City within thirty days or that the owner of any property which has a bay window, sidewalk or platform overhanging the sidewalk be re- quired to file and maintain a surety bond in amount of $5,000.00 as a guarantee that they will assume the responsibility for any bad condition of the walk due to such overhanging structure. The City was indeed lenient in permitting the construction of any of the above structures and was then permitted simply to accommodate the owner and enable him to build on his property to better advantage. It is manifestly unfair for the City to constantly be put to expense on account of personal injury claims arising from these structures which were put in solely for the benefit of the individual improving his prop- erty. It is on this account that I would recommend that the owner of the property be made to assume this responsibility and liability. Respectfully submitted, 0. E. CARR, City Manager. Whereas, the contract heretofore entered into by the City of Dubuque for the construction of a sewer in Parkway street from Langworthy street to the sewer is Douglas street, hereinafter described, has been com- pleted and the City Engineer has computed the cost and expense of said improvement amounts to $1,045.98. Therefore, be it resolved by the City Council of the City of Dubuque, that to provide for the cost of the construction of a sanitary sewer in Parkway street from Langworthy street to the sewer in Douglas street there be issued Sewer Bonds to the amount of $1,045.98. Said bonds shall be issued under the provisions of Chapter 8, Title V, of the Code of Iowa and the amendments there- to, shall bear date as of the 22nd day of February, A. D. 1923, shall be in the denominations of $100.00 each, except that there shall be one bond to the amount of $145.98; they shall be numbered from 8057 to 8066 inclusive, and shall be divided into ten series of which the bonds num- bered 8057 shall constitute the first series, and shall be payable on the first day of April, A. D. 1924; the bonds numbered 8058 shall consti- tute the second sdries and shall be payable on the first day of April, A. D. 1925; the bonds numbered 8059 shall constitute the third series and shall be payable on the first day of April, A. Therefore, be it resolved by the City Council of the City of Dubuque that to provide for the cost of con- struction of a sewer in Park Hill District as follows: In Broadway Extension from Diagonal street to Putnam street, in Putnam street from Broadway Extension to Musca- tine street, in Muscatine street from Putnam street to Charles street, in Fulton street from Broadway Exten- tio,n to approximately 100 feet south of King street in Harlan street, from Fulton street west about 250 feet, in Greeley street from Broadway Ex- tention to King street, and in King street from Broadway Extention to a point about 100 feet east of Fulton street, there be issued Sewer Bonds to the amount of $6,674.41. Said bonds shall be issued under the pro- visions of Chapter 8, Title V, of the Code of Iowa and the amendments thereto, shall bear date as of the 22nd day of February, A. He it further resolved that the City Clerk be and he is hereby in- structed to advertise for proposals for the construction of the im- provement above described, the said improvements to be construct- ed in strict accordance with the plans and specifications thereof, prepared by the City Engineer, and approved by the City Manager, and now on file in the office of the City Clerk, the work to be completed on or before the first day of October, 1923. - The cost and expense of said work as is by law assessable against the property abutting upon or adjacent to said improvement will be assess- ed, and payment will be made to the contractor to the amount of the assessment out of funds to be cre- ated by the sale of improvement bonds, to be issued in anticipation of the collection of said special as- sessment under the provisions of Chapter 8, Title V. of the Code of Iowa, and amendments thereto; and any deficiency between the amount of the contract price and the amount of said bonds will be paid from the proceeds of a special tax to be levied under the provisions of Section 831 of the Code of Iowa, in anticipation of which bonds will be issued under the provisions of Sec- tion 912 of the Code of Iowa and Section 912A of the Code Supple- ment. Be it resolved by the City Coun- cil of the City of Dubuque, that pursuant to a resolution of necess- ity, proposed at a meeting of this Council on the 5th day of Septem- ber, 1922, and duly passed and ap- proved on the 20th day of Sept., 1922, it is hereby ordered that the Special Session, improvement described in said reso- lution of necessity ' providing for the improvement of Delhi street from the west property line of As- bury street to the City Limits, by curbing with new cement curb, re- setting old stone curb where neces- sary, and by paving with either vi- brolithic, brick block on a concrete foundation, or sheet asphalt, or bi- tulithic pavement on the present foundation. In the • event the con- tract is awarded for a bituminous pavement, a concrete gutter is to be constructed, be and the same is hereby ordered constructed.
